(cid:1)द(cid:3)ली प"रवहन िनगम .ारा 74 पेड़( के अलावा (cid:1)कसी भी पेड़ क* कटाई / 4Rयारोपण एक अपराध होगा।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 14. (cid:1)द(cid:3)ली वृ’ प"रर’ण अिधिनयम, 1994 क* धारा 12 के अनुपालन म(cid:24) उपभोगी सं(cid:31)था .ारा िव(cid:31)तृत वृ’ारोपण अनुसूची 4(cid:31)ततु क* जाएगी । 20. उपभोगी सं(cid:31)था .ारा साइट क* तैयारी और वृ’ारोपण के िलए एक िव(cid:31)तृत योजना 4(cid:31)तुत (cid:1)कया जाएगा । jk’Vªh; jkt/kkuh {ks= fnYyh सरकार d s vkn”s k l s rFkk mud s uke ij] मनीषा स(cid:28)सेना, सिचव (पया(cid:26)वरण एवं वन) DEPARTMENT OF ENVIRONMENT, FORESTS AND WILDLIFE NOTIFICATION Delhi, the 23rd December, 2019 F. No. 155/WFD/ COT/ 18-19/10788-96.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby, in public interest exempts an area of total 2.926 ha. approx as detailed below for construction of DTC Bus depot-I at Ghumenhera, Delhi from the provision of sub-section (3) of section 9 of the said Act. Location. Total No of trees at No of trees to be Compensatory plantation the project site required. (Number of trees) Felled Total DTC Bus DEPOT-I at 91 74 74 740 by User Agency. Ghumenhera, Delhi. Total 91 74 74 740 The said exemption is subject to fulfillment of the following conditions:- 1. The applicant i.e Delhi Transport Corporation shall make an advance deposit of an amount of Rs. 42,18,000 /- (Rupees Forty Two Lakh and Eighteen Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows, Sl.N. (a) 100% Compensatory Plantation of native species shall be carried out by User Agency at the following locations:-4 DELHI GAZETTE : EXTRAORDINARY PART IV] 1. DTC Terminal -I Narela 87 (264 Mtr. approx.) 2. DTC Terminal –II Narela 86 42,18,000 /- Deputy Conservator (258 Mtr. approx.) of Forests 3. Jhuljhuli Fitness Centre (West)/ (1164 Mtr. approx.) 388 Tree Officer Total 562 Nos.* * Remaining 178 saplings would be planted at Jhuljhuli depot of Transport Department. 2. 100% Compensatory Plantation of 740 saplings of native species will be raised and maintained by Delhi Transport Corporation for Seven years and monitored till its successful establishment as indicated at 1 (a) above. 3. 1:10 plants of native species 6-8 feet height will be planted as compensatory plantation on non-forest land in lieu of removal of 74 no. of trees. The plantation will be done following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance would be carried out thereafter by West Forest Division utilizing the deposits made by User Agency. 4. User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer concerned (as deposits) 5. The User agency may implement the improved soil moisture conservation activities on identified land division utilizing the deposits made by User Agency. 6. The User Agency shall ensure that the plan of this proposal shall not be changed. 7. Site will have to be secured from encroachment and undesired biotic interference. 8. Extensive interventions if any required to be undertaken for soil preparation, would be carried out and additional budget if needed, shall be provided by User Agency. 9. The land over which compensatory plantation is raised shall not be utilized for any other purpose without the approval of Tree Officer concerned. 10. Transplantation of trees must be initiated immediately after permission is issued and should be completed not later than 3 (three) months, after which a completion report has to be submitted to the Tree Officer. The spacing of the transplantation of trees should not be less than 4 metres (point to point). 11. Permission for felling/ transplantation of tress would be granted at their own risk and without prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees. 12. Before the felling of trees from the site is commenced all requisite statutory clearances shall necessarily be obtained by the User Agency. 13. Felling/ Transplantation of any trees apart from 74 trees by DTC would constitute an offence. 14. Completion of documentation regarding compensatory plantation as per provisions in DPTA, 1994 would be done by User Agency. 15. Progress report of transplantation shall be submitted through inspection officer concerned along with complete details of trees. 16. The timber obtained from removal of trees shall be auctioned by the user agency. The proceeds will be deposited as revenue to the Government account. The lops and tops of trees will be sent/ supplied to nearest crematorium free of cost and the same should be reported to DCF (West)/ Tree Officer.[PART IV DELHI GAZETTE : EXTRAORDINARY 5 17. Before shifting of timber if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the DCF (West). 18. It should be ensured by the user agency that all the conditions mentioned in environmental clearance if any obtained, must be followed scrupulously. 19. Detailed plantation schedule will have to be submitted by user agency in compliance with Section 12 of Delhi Preservation of Trees Act, 1994. 20.
