(ii) इस घटना म0 अगर 2थान कम हो, तो उस उLेMय के िलए डीडीए Nारा आवं(cid:19)टत या पहले से ही आवं(cid:19)टत #े+
पर वृ#ारोपण (cid:1)कया जाएगा ।
(iii) प(cid:19)रयोजना ?2तावक पेड़P को काटन ेसे पहल,े उनको ?Qयारोिपत करन ेके सभी सभं व ?यास करेगा ।
(iv) इस घटना म 0 आदशे का अनुपालन नहR (cid:1)कया गया है तो प(cid:19)रयोजना ?2तावक पया(cid:27)वरण मआु वजे का भुगतान

F. No.98/COT/WFD/16-17/5610-21- In exercise of the powers conferred by section 29 of the Delhi
Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of
Delhi, hereby, in public interest exempts an area of total 10.10 ha. (approx.) as detailed below from the
provision of sub-section (3) of section 9 of the said Act for construction of redevelopment of Nauroji Nagar
(commercial complex), New Delhi.

The said exemption is subject to fulfilment of the following conditions:-.
a) The applicant viz NBCC Delhi shall make an advance deposit of an amount of Rs. 8,35,05,000 /- (Rupees

compensatory plantation for a period of Seven years as follows,

(i) 14650 numbers by Forest Department on behalf of NBCC as per riverine ecosystem function of the
floodplains and after approval of the planting scheme from Landscape Department of DDA and
recommendation of Hon’ble NGT in the above indicated site as per letter dated. 28.07.2017.
c) The Hon’ble NGT while disposing off the MA No. 1154/2017 vide order dated 22.09.2017 has given following
directions and clarifications:-
(i) The NBCC shall plant the tall trees at the venue site in question at the first instance.
(ii) In the event, the said space fall short, then the plantation shall be done with tall plants at the site allocated
or already allocated by DDA for that purpose.
(iii) The Project proponent shall make all possible efforts to transplant the trees at the first instance rather than
cutting the trees.
(iv) In the event the order is not complied with, the Project Proponent shall be liable to pay environmental
compensation and even we will direct the stoppage of the project going on.
d) In the light of (c) above, the NBCC shall be planting 250 tall trees (around 3 mt. height) of Pilkhan and
Maulsari on the rear side of the plot in the month of Oct-Nov, 2017. They shall also transplant around 150
existing trees including shrub varieties having girth upto 30 cm in the front side of the plot during Feb-March,
2018 and in case some small transplanted trees do not survive the harsh conditions of Delhi then new trees
shall be planted in their place as per their letter dated 29.09.2017 and as per the drawing showing the proposed
location of plantation as well as transplantation of trees in accordance with map submitted by NBCC with the
proposal.
e) The timber obtained from felling/ transplant of 1465 trees shall be auctioned by the land owning agency and
the proceeds shall be deposited as revenue to the Government.
f) The lops and tops obtained on removal of trees shall be handed over by the National Buildings Construction
Corporation (NBCC) to the officials concerned of Municipal Corporation of Delhi for its use on public
crematoria in Delhi free of cost and receipt obtained may be deposited with DCF (West).
g) Before shifting of timber if any, from site of removal of trees, transportation permission for transportation of
the said wood shall be obtained from Tree Officer (West).
h) The other 48 trees in the area will not be harmed in any manner.
