करते "ए एत$ारा भारतीय (cid:12)ितभिू त और िविनमय बोड (cid:4) (पार%प(cid:24)रक िनिध) िविनयम, 1996 का और संशोधन करने के िलए
िन&िलिखत िविनयम बनाता ह,ै अथा(cid:4)त ्————
1. इस िविनयम(cid:31) को भारतीय (cid:12)ितभिू त और िविनमय बोड (cid:4) (पार%प(cid:24)रक िनिध) (दसू रा संशोधन) िविनयम, 2018 कहा
जा सकेगा ।
2. वे राजप. म/ उनके (cid:12)काशन क(cid:22) तारीख को (cid:12)वृ(cid:28) ह(cid:31)गे ।
3. भारतीय (cid:12)ितभूित और िविनमय बोड (cid:4)(पार%प(cid:24)रक िनिध) िविनयम, 1996 म,/ ————
क. िविनयम 48 म,/ उप-िविनयम (2) म/, श9द “संपणू (cid:4) भारत म/ प(cid:24)रचालन वाले कम स े कम दो दिैनक
समाचारप.(cid:31) म / (cid:12)कािशत =कया जाएगा” श9द(cid:31) तथा िच>न “उसी (cid:12)कार (cid:12)कट =कया जाएगा, जैसा बोड (cid:4) (cid:26)ारा
िनधा(cid:4)(cid:24)रत =कया जाए” स े(cid:12)ित%थािपत हो जाएंगे ।

ख. िविनयम 49 म/, ————
i. उप-िविनयम (1) िन&िलिखत से (cid:12)ित%थािपत हो जाएगा, अथा(cid:4)त,् –
“(1) िजस क(cid:22)मत पर यूिनट(cid:31) का अिभदान या िवCय =कया जा सकेगा और िजस क(cid:22)मत पर ऐसी
यूिनट(cid:31) का पार%प(cid:24)रक िनिध (Eयूचुअल फंड) (cid:26)ारा =कसी भी समय पनु :Cय =कया जा सकेगा, वह
क(cid:22)मत िनवेशक(cid:31) (िविनधानकता(cid:4)G) को उसी (cid:12)कार उपल9ध कराई जाएगी, जैसा बोड (cid:4)(cid:26)ारा िनधा(cid:24)(cid:4) रत
=कया जाए ।”;
ii. मौजूदा उप-िविनयम (2) िन&िलिखत से (cid:12)ित%थािपत हो जाएगा, अथात(cid:4) ्, ————
“(2) पार%प(cid:24)रक िनिध (Eयूचुअल फंड) यूिनट(cid:31) क(cid:22) िवCय एवं पुन:Cय क(cid:22)मत क(cid:22) गणना करने क(cid:22)
पIित उसी (cid:12)कार सिू चत करेगी, जैसा बोड (cid:4)(cid:26)ारा िनधा(cid:24)(cid:4) रत =कया जाए ।” ।
ग. िविनयम 52 म/, उप-िविनयम (6क) म/, खंड (ग) म,/ ————
i. अंक “0.20” अंक “0.05” से (cid:12)ित%थािपत हो जाएगा;
ii. श9द तथा िच>न “(cid:12)ितशत से अनिधक ।” श9द(cid:31) तथा िच>न(cid:31) “(cid:12)ितशत स ेअनिधक, या जैसा बोड (cid:4)(cid:26)ारा
िनधा(cid:4)(cid:24)रत =कया जाए:” से (cid:12)ित%थािपत हो जाएगं ;े
iii. िन&िलिखत नया परंतकु अंत:%थािपत =कया जाएगा, अथा(cid:4)त,् ————
“परंतु यह =क ऐस े अित(cid:24)र(cid:30) Lय उन %क(cid:22)म(cid:31) के (cid:12)ित (cid:12)भा(cid:24)रत नहM =कए जाएंगे (उन %क(cid:22)म(cid:31) के
खचN म/ नहM =दखाए जाएंगे), िजन पर िनकास (cid:12)भार (िनकास भार / एिPज़ट लोड) न लगाया जाता

i. मौजूदा शीषक(cid:4) िन&िलिखत स े(cid:12)ित%थािपत हो जाएगा, अथात(cid:4) ्, ————
“वाTषक (cid:24)रपोट(cid:4) और उसके सार क(cid:22) (cid:12)ितया ँ(cid:12)दान करना”;
ii. उप-िविनयम (1) और उसका परंतकु िन&िलिखत स े(cid:12)ित%थािपत हो जाएगा, अथात(cid:4) ्, ————
“(1) पार%प(cid:24)रक िनिध (Eयूचुअल फंड) क(cid:22) %क(cid:22)मवार वाTषक (cid:24)रपोट(cid:4) या उसका सिं WX सार सभी
यूिनटधारक(cid:31) को यथाशीY Zकतु संबंिधत (सुसंगत) लेखा वष(cid:4) के समाX होन े क(cid:22) तारीख से चार
महीन(cid:31) के भीतर उसी (cid:12)कार (cid:12)दान =कया जाएगा, जैसा बोड (cid:4)(cid:26)ारा िनधा(cid:4)(cid:24)रत =कया जाए ।”;
iii. उप-िविनयम (2) म,/ उसके परंतुक म/, श9द “(cid:12)ेिषत सिं WX %क(cid:22)मवार वाTषक (cid:24)रपोट(cid:4) इस संबधं म /बोड (cid:4)
(cid:26)ारा िविहत फॉम]ट म/ ह”ै श9द(cid:31) “(cid:12)दान क(cid:22) गई सिं WX %क(cid:22)मवार वाTषक (cid:24)रपोट(cid:4) बोड(cid:4) (cid:26)ारा इस संबंध

SECURITIES AND EXCHANGE BOARD OF INDIA (MUTUAL FUNDS)
(SECOND AMENDMENT) REGULATIONS, 2018
No. SEBI/LAD-NRO/GN/2018/14.—In exercise of the powers conferred by section 30 read with clause (c) of
sub-section (2) of section 11 of the Securities and Exchange Board of India Act, 1992 (15 of 1992), the Board hereby
makes the following regulations to further amend the Securities and Exchange Board of India (Mutual Funds)
Regulations, 1996, namely –
1. These Regulations may be called the Securities and Exchange Board of India (Mutual Funds) (Second
Amendment) Regulations, 2018.
2. They shall come into force on the date of their publication in the Official Gazette.
3. In the Securities and Exchange Board of India (Mutual Funds) Regulations, 1996, -
a. in regulation 48, in sub-regulation (2), the words “published in at least two daily newspapers having
circulation all over India” shall be substituted with the words “disclosed in the manner specified by the
Board”.
b. in regulation 49, —
i. in sub-regulation (1), the words “in the manner specified by the Board” shall be inserted after
the word “investors” and before the symbol “.”.
ii. the existing sub-regulation (2) shall be substituted with the following, namely, —
“The mutual fund shall provide the methodology of calculating the sale and repurchase price
of units in the manner specified by the Board.”
c. in regulation 52, in sub-regulation (6A), in clause (c), —¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 7
i. the figure “0.20” shall be substituted with the figure “0.05”;
ii. after the words “net assets of the scheme”, the words and symbol “or as specified by the
Board:” shall be inserted;
iii. the following new proviso shall be inserted, namely,—
“Provided that such additional expenses shall not be charged to the schemes where the exit
load is not levied or applicable.”
d. in regulation 56,—
i. the existing title shall be substituted with the following, namely, -
“Providing copies of Annual Report and summary thereof”
ii. in sub-regulation (1),—
1. the word “mailed” shall be substituted with the word “provided”.
2. after the words “relevant accounts year”, the words “in the manner specified by the
Board” shall be inserted.
3. the proviso shall be omitted.
iii. in sub-regulation (2), in the proviso thereto, the word “mailed” shall be substituted with the
word “provided”.
iv. after sub-regulation (2), the following new sub-regulation shall be inserted as regulation (3),
namely –
“(3) Notwithstanding anything contained in sub-regulation (1), the mutual fund shall provide
physical copy of the abridged summary of the Annual Report without any cost, if a request
through any mode is received from a unitholder.”
v. in the existing sub-regulation (3), which shall now be re-numbered as sub-regulation (3A), the
word “mailed” appearing therein shall be substituted with the word “provided”.
e. in regulation 59A, —
i. the words “one month” shall be substituted with the words “ten days”.
ii. after the words and symbol “scheme portfolio”, the symbols and words “, in the manner
specified by the Board” shall be inserted.
iii. the existing proviso shall be omitted.
