प्रसंस्ट्कृत खाद्य उत्पाद जिर्ाात जिकास प्राजधकरण में समूह क, ख और ग पदों पर भती के तरीके को जिजिर्जमत करि े के जलए जिम्नजलजखत जिजिर्म निाता ह,, अथाात 1. संजिप्त िाम एि ंप्रारंभ (i) इि जिर्मों का संजिप्त िाम कृजि और प्रसंस्ट्कृत खाद्य उत्पाद जिर्ाात जिकास प्राजधकरण (भती) जिजिर्म, 2022 ह , । (ii) र्े रािपत्र में प्रकािि की तारीख से प्रिृत्त होंग े । 2. प्रारंजभक सगं िि सभी ितामाि जिर्जमत अजधकारी एिं कमाचारी जििको इि जिजिर्मों के तहत जिर्जमत आधार पर जिर्ुि दकर्ा गर्ा ह,, इि जिजिर्मों के अधीि जिर्ुि दकए गए समझे िाएँगे और जिर्जमत आधार पर उिकी सेिा की पठरिीिा, पुजि और प्रोन्नजत के से कृजि और प्रसंस्ट्कृत खाद्य उत्पाद जिर्ाात जिकास प्राजधकरण अजधजिर्म,1985 (1986 का 2) अजभप्रेत ह;, (ii) “एपीडा” से कृजि और प्रसंस्ट्कृत खाद्य उत्पाद जिर्ाात जिकास प्राजधकरण अजभप्रेत ह;, (iii) “जिर्ुजि” के अंतगात सीधी भती, प्रोन्नजत द्वारा और दकसी अन्र् जिजहत माध्र्म से जिर्ुि अजभप्रेत ह;, (iv) “प्राजधकरण” से अजधजिर्म की धारा 4 के अधीि स्ट्थाजपत कृजि और प्रसंस्ट्कृत खाद्य उत्पाद जिर्ाात जिकास प्राजधकरण(एपीडा)अजभप्रते ह;, (v) “अध्र्ि” से अजभप्रेत ह ,केंद्र सरकार द्वारा जिर्िु एपीडा के अध्र्ि (vi) “जिर्ुजि प्राजधकारी” a. महाप्रनंधक के स्ट्तर तक सभी पद जििके िेति स्ट्तर 12 (78800 – 209200 रुपए) से अजधक ि हो – अध्र्ि; और b. सजचि और जिदेिक पद के जलए - केंद्रीर् सरकार के अिुमोदि के साथ अध्र्ि । (vii) “जिभागीर् अभ्र्थी” प्राजधकरण के सभी ऐसे कमाचारी िो प्रोन्नजत के जलए जिचाराधीि अभ्र्थी ह;, “जिभागीर् प्रोन्नजत सजमजत” अथिा डीपीसी से अजभप्रेत उस सजमजत से ह , िो अपेजित ििा की सेिा पूरा करिे िाले और प्रोन्नजत के जलए अन्र्था पात्र कमाचाठरर्ों की प्रोन्नजत के जिचार हते ु गठित ह , | डी.पी.सी का गिि अिुसूची में प्रत्र्ेक पद के संदभा म ेंजिधााठरत रूप म ेंहोगा; (viii) “प्रजतजिर्ुजि” से अजभप्रेत केंद्रीर् सरकार द्वारा इस संनंध म ें जिधााठरत जिर्मों के अिुसार केंद्रीर्/राज्र् सरकार/सरकारी िेत्र के उपक्रमों/स्ट्िार्त जिकार्ों से सेिाएं लिे ा । (ix) “सीधी भती” से अजभप्रेत रोिगार केंद्र से अभ्र्र्थार्ों की मांग करके, जिज्ञापि के िठरए आिेदि आमंजत्रत करके/ प्राजधकरण के पात्र कमाचाठरर्ों से आिेदि स्ट्िीकार कर भती करिा ह, । (x) परन्त ु सीधी भती की प्रदक्रर्ा में िहाँ कहीं भी आिश्र्कतािसु ार अध्र्ि द्वारा जलजखत परीिा और/र्ा सािात्कार जिधााठरत दकर्ा िा सकता ह , और इस कार्ा के जलए अध्र्ि, सरकार के जिर्मािुसार/आदिे ािुसार उपर्ुि एिेंसी/सगं िि/संस्ट्था/फम ा की सेिाओं को संलग्न/दकराए पर जलर्ा िा सकता ह , । प्राजधकरण के कमाचाठरर्ों को, र्दद भती दकए िाते ह , तो भती के प्रर्ोििों के जलए सीधे भती दकए गए कमाचारी समझा िाएगा और ि े जपछली सेिा की गणिा करि े के सम्नन्ध म ें केन्द्रीर् सरकार के जिर्मों द्वारा िाजसत होंगे । (xi) “कमाचारी” से ऐसा व्यजि अजभप्रेत ह , िो जिर्जमत पद धारण कर रहा ह , और संलग्न अिुसूची के कॉलम 2 में जिजिर्दिा कोई भी पद धारण कर रहा ह;, (xii) “सरकार” से केंद्रीर् सरकार अजभप्रेत ह;, (xiii) “िेति” से मूल जिर्म और पूरक जिर्म म ेंर्थापठरभाजित िेति अजभप्रेत ह;, (xiv) “अिुसूची” से इि जिजिर्मों की अिुसूची अजभप्रेत ह;, (xv) “सिे ा” से प्राजधकरण में सेिा अजभप्रेत ह;, (xvi) “जिजिर्मों” अजधजिर्म के अधीि निाए गए जिजिर्म अजभप्रेत ह;, (xvii) “जिर्मों” से कृजि एिं प्रसंस्ट्कृत खाद्य उत्पाद जिर्ाात जिकास प्राजधकरण जिर्म 1986 और दकसी प्रकार के अन्र् जिर्म िो इस अजधजिर्म के अधीि निाए गए से अजभप्रेत ह;,[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 4. लाग ूहोिा र्े जिजिर्म कृजि और प्रसंस्ट्कृत खाद्य उत्पाद जिर्ाात जिकास प्राजधकरण के अिुसूची में कॉलम 2 में उल्लेजखत प्राजधकरण के सभी पदों को लागू होंगे । 5. िते िमाि, र्ोग्र्ता और भती की पद्धजत सेिा में जिजभन्न पदों के िेतिमाि, उि पदों पर भती के जलए अपेजित न्र्ूितम अहता ाएं और भती का तरीका िह होगा िो अिुसचू ी में जिजिर्दिा दकर्ा गर्ा ह , । 6. कजतपर् प्रिगों के व्यजिर्ों की नानत आरिण, जिजथलता आदद इि जिजिर्मों की कोई नात अिुसूजचत िाजत, अिुसूजचत िि िाजत, और जििेि प्रिगों के व्यजिर्ों के जलए केन्द्रीर् सरकार द्वारा समर् समर् पर िारी दकए गए आदिे ों के अिुसार उपनंजधत दकए िािे के जलए अपेजित आरिणों, आर् ुसीमा में जिजथलताओं और अन्र् ठरर्ार्तों को प्रभाजित िहीं करेगी । 7. जिर्जु ि करि ेकी िजि (1) अध्र्ि, जिदिे क और सजचि के अजतठरि सभी जिर्ुजिर्ां अध्र्ि द्वारा की िाएगं ी। (2) अध्र्ि को अजतआिश्र्क मामलों में और कार्ा की अत्र्ािश्र्कताओं को पूरा करिे के जलए, दकसी ठरजि में, चर्ि सजमजत द्वारा चर्ि दकए जनिा, तदथ ा जिर्ुजिर्ा ं करि े के जलए सिि होगा र्दद ऐसी ठरजि, ऐसे पद में ह , जिसका िेतिमाि ऐसा ह , जिसका िेति स्ट्तर 12 (78800-209200) और ऐसी जिर्ुजिर्ा ं एक समर् म ें िब्न े ददि स े अजधक अिजध के जलए र्ा कुल जमलाकर एक िि ा के जलए अथिा उस समर् तक के जलए होगी िन ऐसे पद पर जिर्ुजि र्ा प्रोन्नजत इि जिर्मों के अिुसार कर दी िाती ह,, िो भी पूिात्तर हो । 8. जिजथलीकरण िहां अध्र्ि की र्ह रार् हो दक ऐसा करिा आिश्र्क ह,, तो िह ऐसे कारणों के आधार पर िो लेखनद्ध दकए िाएँगे, समूह ख और ग प्रिगा के पदों पर व्यजिर्ों की नानत इि जिर्मों के उपनंधों में से दकसी में छूट दी िा सकती ह , । तथाजप समूह ‘क’ के पदों के जलए इि जिर्मों के उपनंधो म ें कोई भी छूट सरकार के पूि ा अिुमोदि स े ही िाएगी । 9. अर्ोग्र्ता कोई भी व्यजि- (1) िो एक पजत र्ा पत्नी के िीजित होिे के साथ, अजतठरि जििाह के अिुनंध में प्रििे दकर्ा ह , । (2) िो एक पजत र्ा पत्नी के िीजित होिे पर दकसी अन्र् व्यजि से जििाह अिुनंध में प्रिेि करिे पर दकसी भी पद पर जिर्ुजि के पात्र हते ु र्ोग्र् होंग े र्दद केन्द्रीर् सरकार संतुि ह , दक इस तरह का जििाह, ऐस े व्यजि/अन्र् पाटी के जलए लागू व्यजिगत कािूि के तहत अिुमत ह ,और इस जिर्म के प्रिताि से दकसी भी व्यजि को मुि करि े के जलए अन्र् कारण उपलब्ध हो । (3) िो दकसी भी आपराजधक कृत्र् के जलए देि के कािूि के दकसी न्र्ार्ालर् द्वारा दजण्डत हो िो अन्र्था जिर्मों के तहत दकसी भी सरकारी सेिा के दकसी पद पर जिर्ुजि के जलए रोक जलर्ा गर्ा हो । 10. व्याख्र्ा र्दद इि जिजिर्मों की व्याख्र्ा के संनंध में कोई प्रश्न उत्पन्न होता ह , तो उसे केंद्रीर् सरकार को भेिा िाएगा िो इस संनंध में जिणार् करेगी। 11. जिरसि कृजि और प्रसंस्ट्कृत खाद्य उत्पाद जिर्ाात जिकास प्राजधकरण (भती) जिजिर्म, 28 अप्रल, , 2011 को एतद्द्वारा समर्-समर् पर र्था-संिोजधत िीएसपी संख्र्ा 87 के अंतगात अजधसूजचत जिरस्ट्त दकर्ा िाता ह।,4 THE GAZETTE OF में से एक के रूप में जिधााठरत दकर्ा गर्ा ह,, िहां ऐसे ग्रेडों पर जिम्नजलजखत ितें लागू होंगी, जििसे प्रजतजिर्ुजि/प्रोन्नजत की िािी ह , (1) फीडर श्रेणी में जिभागीर् अजधकारी, िो प्रोन्नजत की सीधी लाइि में ह,, प्रजतजिर्ुजि पर जिर्ुजि के जिचाराथा र्ोग्र् िहीं होंगे | इसी प्रकार, प्रजतजिर्ुि व्यजि प्रोन्नजत द्वारा जिर्ुजि के जिचाराथा र्ोग्र् िहीं होंगे। (2) फीडर श्रेणी में जिभागीर् अजधकाठरर्ों की जिर्ुजि के मामले में, पद/ठरजि को प्रोन्नजत द्वारा भरा गर्ा मािा िाएगा। (3) प्रजतजिर्ुजि की आरंजभक अिजध तीि ििा की होगी जिस े ििा प्रजतििा आधार पर नढार्ा िा सकता ह।, प्रजतजिर्ुजि की अजधकतम लगातार अिजध पांच ििा होगी। केंद्रीर् सरकार/राज्र् सरकार/सांजिजधक/ स्ट्िार्त जिकार् (जिकार्ों) के उसी र्ा दकसी अन्र् संगिि /जिभाग में इस जिर्ुजि से तत्काल पूिा धाठरत दकसी अन्र् संिगा नाह्य पद में प्रजतजिर्जु ि की III/4/असा./114/2022-23] AGRICULTURAL AND PROCESSED FOOD PRODUCTS EXPORT DEVELOPMENT AUTHORITY (APEDA) NOTIFICATION New Delhi, the 13 June, 2022 F.No. APEDA/PAD/2017-18/000044. —In exercise of the powers conferred by section 33 read with sub section 3 of section 7 of the Agricultural and Processed Food Products Export Development Authority Act, 1985 (2 of 1986), the Agricultural and Processed Food Products Export Development Authority (APEDA), with the previous sanction of the Central Government, hereby makes the following regulations, regulating the method of recruitment to the Group A, B and C posts in the Agricultural and Processed Food Products Export Development Authority, namely:- 1. Short Title and Commencement (i) These regulations may be called Agricultural and Processed Food Products Export Development Authority (Recruitment) Regulations, 2022.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ii) These regulations shall come into force on the date of its publication in the Official Gazette. 2. Initial Constitution All the existing regular employees on the roll of APEDA on the date of commencement of these regulations shall be deemed to be appointed under these regulations and their period of service of regular appointment shall be admissible for all service matters. 3. Definitions Unless the context otherwise requires: (i) “Act” means the Agricultural and Processed Food Products Export Development Authority Act, 1985 (2 of 1986); (ii) “APEDA” means the Agricultural and Processed Food Products Export Development Authority; (iii) “Appointment” includes direct recruitment, appointment by promotion and through any other prescribed method; (iv) “Authority” means Agricultural and Processed Food Products Export Development Authority (APEDA) established under section 4 of the Act; (v) “Chairman‟ means the Chairman of APEDA appointed by the Central Govt. (vi) “Appointing Authority” means (i) For all the posts upto the pay level 12 (Rs. 78800 – 209200) upto the level of General Manager – Chairman; and (ii) For the posts of Secretary and Director - Chairman with the approval of the Central Government (vii) “Departmental Candidates” means all the eligible employees in the line of promotion. (viii) “Departmental Promotion Committee” or DPC means the committee constituted to consider cases for promotion of those employees who have completed the required years of service and who are otherwise eligible for promotion. The composition of the DPC will be as indicated in each post in the Schedule. (ix) Deputation means borrowing the services from Central/State Government/ Public Sector Undertakings/Autonomous bodies, as per the rules prescribed in this regard by the Central Government. (x) “Direct Recruitment” means recruitment by calling the candidate from Employment Exchange/ inviting applications through advertisement/entertaining applications from the Authority’s eligible employees. Provided that a written test and or interview, as the case may be, may be prescribed wherever deemed necessary by the Chairman as part of the process of direct recruitment and for this purpose, the Chairman may engage/hire the services of suitable agency//organization/institution/firm as per rules/orders of the Government. The Authority’s employees, if recruited will be treated as direct recruits for the purposes of recruitment and will be governed by the Central Government rules regarding counting of past service. (xii) “Government” means the Central Government; (xiii) “Pay” means the pay as defined under the Fundamental Rules and Supplementary Rules; (xiv) “Schedule” means the Schedule to these regulations; (xv) “Service” – means in the regular service with the Authority (xvi) “Regulations” means regulations made under the Act. (xvii) “Rules” means the Agricultural and Processed Food Products Export Development Authority Rules 1986 and any other rule(s) made under the Act.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 13 4. Application These regulations shall apply to all the posts specified under column 2 of the Schedule attached herewith. 5. Scale of Pay, qualification, method of Recruitment The scales of pay attached to different posts in the service, the minimum qualifications required for recruitment to the posts and the method of recruitment shall be as specified in the Schedule. 6. Reservations, Relaxations, etc. in respect of certain categories of persons Nothing in these Regulations shall affect reservations, relaxations of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, OBC and other special categories of persons in accordance with the orders issued by the Central Government from time to time. 7. Power of Appointment (1) All appointments except that of Chairman, Director and Secretary shall be made by the Chairman (2) The Chairman shall be empowered in urgent cases and to meet exigencies of work, to make adhoc appointments to a vacancy without the selection being made by the Selection Committee if such vacancy is in a post carrying pay level 12 (Rs. 78800 – 209200) and such appointments shall be for a period not exceeding 90 days at a time or one year in aggregate or till the appointment or promotion to such post is made in accordance with these regulations, whichever is earlier. 8. Relaxation Where the Chairman is of the opinion that it is necessary to do so, he may, by order for reasons to be recorded in writing, relax any of the provisions of these Recruitment regulations with respect to persons of Group C and B category of posts. However, for Group A posts, any relaxation in the provisions of these regulations shall be made only with the prior approval of the Central Government. 9. Disqualification No person - (1) who has entered into or contracted a marriage with a person having a spouse living (2) who having a spouse living has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the posts, Provided that Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other ground for so doing, exempt any person from the operation of this rule. (3) who have been punished by any court of law of the land for any criminal act which otherwise debar any incumbent to hold any post in Government service under the rules, shall be eligible for appointment to any of the posts. 10. Interpretation If any question arises relating to the interpretation of these regulations, it shall be referred to the Central Government who shall decide the same. 11. Repeal The Agricultural and Processed Food Products Export Development Authority (Recruitment) Revised Regulations, 2011 notified under GSP No.87 dated 28.4.2011 and as amended from time to time, are hereby repealed. General Note 1: Where promotion has been prescribed as method of recruitment/one of the methods of recruitment other than the method of ‘By Deputation/Promotion’, the following condition shall apply in respect of grades from which promotion is to be made: Where juniors who have completed their qualifying/eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/ eligibility service or two years, whichever is less, and have successfully completed probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying/ eligibility service. General Note 2: Where promotions to a grade/post are made from more than one grade/post under these regulations, a combined eligibility list of the eligible officers from various feeder grades shall be prepared in accordance with the instructions/orders issued by DOPT, Government of India. General Note 3: Where Deputation/Promotion has been prescribed as method of recruitment/one of the methods of recruitment, the following conditions shall apply to grades from which Deputation/Promotion is to be made: (1) The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly officer on deputation shall not be eligible for consideration for appointment by promotion. (2) In case of appointment of departmental officers in the feeder category, the post/vacancy will be deemed to have been filled by promotion. (3) The initial period of deputation shall be three years extendable on year to year basis. The maximum continuous period of deputation shall be five years. The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization / department of the Central Government/State Government/Statutory/Autonomous Body(s) shall ordinarily not exceed five years.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (4) The maximum age-limit for appointment by deputation shall not exceed 56 years as on the closing date for receipt of applications.
