FOOD CORPORATION OF INDIA NOTIFICATION New Delhi, the 28th December, 2021 No. 135 No. EP. 39 (1)/2020.—In exercise of the powers conferred by Section 45 of Food Corporation Act, 1964 (37 of 1964) and with the previous sanction of the Government of India, the Food Corporation of India hereby makes the following Regulations to further amend the Food Corporation of India (Staff) Regulations, 1971 namely:- 1. (i) These Regulations shall be called the Food Corporation of India (Staff) (Seventh Amendment) Regulations, 2021. (ii) These shall come into force from the date of Notification in the Official Gazette. 2. A new Regulation 60-B below Regulation 60-A under Chapter 5- Discipline and Appeal Regulations shall be inserted In the Food Corporation of India (Staff) Regulations, 1971 as under: ―60-B – Procedure for withholding of employer contribution of the pension corpus for recovery of pecuniary loss: (i) During initiation of the Disciplinary Proceeding by issue of charge sheet, the Disciplinary Authority may withhold pension corpus accumulated by the contributions made by the employer for ordering recovery from pension if, the employee is found to have caused pecuniary loss to the Corporation in the disciplinary or judicial proceedings while in service including service rendered on deputation or on re-employment after retirement. If, the disciplinary or judicial proceedings culminate in imposition of a penalty of compulsory retirement or removal from service or dismissal under Regulation 54 (vii), (viii) or (ix) the employer’s contribution to the pension corpus shall be forfeited. Provided the relevant provisions of DCPS/PFRDA Act, Regulations and Rules notified thereunder as the case may be, shall be kept in view. M. K. GOGOI, Secy.
