(ii) यदि मामले की समीिा पर अथवा कमाचारी जिगम स े समय पूवा या अन्यथा सेवाजिवृत्त होिे का प्रजतवेिि दकया िाता ह,ै तो सेवा म ें जिगम के कमाचारी को बहाल करिे का जिणाय जलया िाता ह,ै बहाली का आिेि िेिे वाल े प्राजधकारी असाधारण अवकाि सजहत अथवा मामले के तथ्यों और पररजस्ट्थजतयों के आधार पर अकाय ा दिवस के रूप म ें मािकर, िये और स्ट्वीकाय ा छतट्टी के प्रिाि करत े हुए बहाली की जतजथ और समय पूवा सेवाजिवृजत्त की तारीख के बीच के हस्ट्तिेप की अवजध को जवजियजमत कर सकते हाःै बिते दक हस्ट्तिेप की अवजध को वेति और भत्त े सजहत सभी प्रयोििाथा ड्यूटी पर जबताई गई अवजध के रूप म ें मािा िाएगा, यदि यह जविेर् रूप स े प्राजधकारी द्वारा बहाली आिेि करत े हुए दकया िाता ह ै दक समय पूवा सेवाजिवृजत्त मामले की पररजस्ट्थजतयों म ें उजचत िहीं थी, अथवा, यदि न्यायालय द्वारा समय स े पहल े सेवाजिवृजत्त का आिेि अलग रखा गया ह।ै (iii) िहााँ समयपूवा सेवाजिवृजत्त के आिेि को, समय की सेवाजिवृजत्त के बाि की अवजध और बहाली की तारीख के बीच की अवजध के जियमि के संबंध म ें जवजिष्ट जिििे ों के साथ एक जवजध न्यायालय द्वारा अलग रखा गया ह ैऔर आग े कोई अपील िायर करि े का प्रस्ट्ताव िहीं ह,ै उपरोि अवजध न्यायालय के जििेिों के अितसार जवजियजमत होगी। (2)(ख) (i) कोई भी जिगम कमाचारी पचास वर्ा की आय त प्राप्त करिे के बाि (और जिगम की सेवा म ें 35 वर् ा की आय त प्राप्त करिे स े पहले आया ह)ै , और अन्य सभी मामलों म ें उसिे 55 वर्ा की आय त प्राप्त करिे के बाि सेवा स े उपयति प्राजधकारी को जलजखत में तीि महीि े स े कम समय का िोरटस िेकर, यदि वह श्रेणी 'I' या 'II' सेवा या पि म ेंह,ैं सेवाजिवृत्त हो सकते हाःै (क) यह जिलंबि के तहत जिगम के कमाचारी को अितमजत ििे े के जलए उपयित प्राजधकारी के जलए खतला होगा िो इस खडं के तहत सेवाजिवृत्त होिा चाहत े ह।ैं (ख) उप-खंड (2) (ख) (i) म ें संिर्भात जिगम का कमाचारी जियतजि प्राजधकारी को जलजखत रूप म ें अिरत ोध कर सकते ह ैंदक वह तीि महीि े स े कम समय के िोरटस को स्ट्वीकार कर सके; Short Title and Commencement: (i) These Regulations shall be called the Food Corporation of India (Staff) (First Amendment) Regulations, 2021. (ii) These shall come into force from the date of Notification in the Official Gazette. 2. Definitions: The definition and meaning of the words and designation of posts in this Regulations shall have the same meaning as contained in the Food Corporations Act, 1964 and the Food Corporation of India (Staff) Regulations, 1971. 3. In the FCI (Staff) Regulations, 1971, Regulation 22(2) may be amended as under: (2) (A) (i) Notwithstanding anything contained in this Regulation, the Appropriate Authority shall, if it is of the opinion that it is in the public interest so to do, have the absolute right to retire any Corporation employee by giving him notice of not less than three months in writing or three months' pay and allowances in lieu of such notice: (a) If he is, in Category I & II service or post in a substantive, quasi-permanent or temporary capacity and had entered Corporation service before attaining the age of 35 years, after he has attained the age of 50 years; (b) In any other case after he has attained the age of fifty-five year; (ii) If on a review of the case either on a representation from the Corporation employee retired prematurely or otherwise, it is decided to, reinstate the Corporation employee in service, the authority ordering reinstatement may regulate the intervening period between the date of pre-mature retirement and the date of reinstatement by the grant of leave of the kind due and admissible, including extraordinary leave or by treating it as dies non depending upon the facts and circumstances of the case: Provided that the intervening period shall be treated as a period spent on duty for all purposes including pay and allowances, if it is specifically held by the authority ordering reinstatement that the premature retirement was itself not justified in the circumstances of the case, or, if the order of premature retirement is set aside by a Court of Law. (iii) Where the order of premature retirement is set aside by a Court of Law with specific directions in regard to regulation of the period between the date of premature retirement and the date of reinstatement and no further appeal is proposed to be filed, the aforesaid period shall be regulated in accordance with the directions of the Court. (2)(B) (i) Any Corporation employee may, by giving notice of not less than three months in writing to the appropriate authority retire from service after he has attained the age of fifty years, if he is in Category ‘I’ or ‘II’ service or post, (and had entered the Corporation service before attaining the age of 35 years), and in all other cases after he has attained the age of 55 years: (a) It shall be open to the Appropriate Authority to withhold permission to a Corporation employee under suspension who seeks to retire under this clause.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (b) A Corporation employee referred to in sub-clause (2)(B)(i) may make request in writing to the Appointing authority to accept notice of less than three months giving reasons therefor; (c) On receipt of a request under sub-clause (b), the Appointing Authority may consider such request for the curtailment of the period of notice of three months on merits and if it is satisfied that the curtailment of the period of notice will not cause any administrative inconvenience, the Appointing Authority may relax the requirement of notice of three months on the condition that the Corporation employee shall not apply for commutation of a part of his pension before the expiry of the period of notice of three months. (2)(B) (ii) A Corporation employee, who has elected to retire under this rule and has given the necessary intimation to that effect to the Appointing Authority, shall be precluded from withdrawing his election subsequently except with the specific approval of such authority: Provided that the request for withdrawal shall be within the intended date of his retirement. (2)(C) Notwithstanding anything contained in Clause (2)(A)(i), the Appropriate Authority shall, if it is of the opinion that it is in the public interest to do so, have the absolute right to retire a Corporation employee in Category III & IV service or posts, after he has completed thirty years’ service by giving him notice of not less than three months in writing or three months’ pay and allowances in lieu of such notice. (2)(D) A Corporation employee in Category III or IV service or posts, may, by giving notice of not less than three months in writing to the Appropriate Authority, retire from service after he has completed thirty years’ service.
