स.ं ईपी-36(1)2020.—खाद्य जनगम अजधजनयम, 1964 (1964 का 37वां) की धारा 45 द्वारा प्रदत्त िजियों का
प्रयोग करत े हुए तथा केंद्र सरकार की पूवाानुमजत स े भारतीय खाद्य जनगम (कमाचारीवृंद) जवजनयम, 1971 म ें संिोधन करन े
के जलए भारतीय खाद्य जनगम एतदद्वारा जनम्नजलजखत जवजनयम बनाता ह,ै यथा :-
1. संजिप्त िीर्का तथा आरंभ:
(i) ये जवजनयम, भारतीय खाद्य जनगम (कमाचारीवृंद) (पांचवा संिोधन) जवजनयम, 2020 कहलाएंगे।
(ii) ये सरकारी गजट म ें अजधसूचना की तारीख स ेलागू होंगे।
2. पररभार्ा: इन जवजनयमों म ें िब्दों की पररभार्ा और उनका अथ ा तथा पदों के पदनाम का अथ ा वही होगा जैसादक
खाद्य जनगम अजधजनयम, 1964 तथा भारतीय खाद्य जनगम (कमाचारीवृंद) जवजनयम, 1971 में ददया गया ह।ै
3. भारतीय खाद्य जनगम (कमचा ारीवदृं ) जवजनयम 1971, जवजनयम 58 (1) और (7) म ें जनम्नानुसार संिोधन दकए गए
ह:ैं -
(1) जवजनयम 54 के क्लॉज (v) और (ix) म ें जवजनर्ददष्ट दकसी भी पेनल्टी को अजधरोजपत करने का आदेि नहीं ददया जाएगा
जसवाय इसके चाहे व्यजिगत सनु वाई अथवा जवजडयो काफ्रं ेंससग^ के माध्यम स े की गई इंक्व ायरीज के बाद इस जवजनयम
अथवा जवजनयम 59 म ें ददए गए तरीके से यथासंभव हो तथा पजब्लक सवेंट (इंक्व ायरीज), अजधजनयम, 1850 (1850 का
37वां) में ददए गए तरीके से, जहां ऐसी इंक्व ायरीज उस अजधजनयम के तहत हुई हो।

(7) कमाचारी ऐसे ददन और ऐसे समय में जाचं प्राजधकारी के समि व्यजिगत रूप स े या वीजडयो कॉन्फ्फ्रेंससग^ के माध्यम स े
उपजस्ट्थत हो सकता ह ै और इस तरह के चाजा की तारीख से दस ददनों के भीतर उसे आर्टटकल्स ऑफ चाजा और कदाचार
अथवा दव्यु ावहार के आरोपों के बयान के रूप में जांच प्राजधकारी के रूप में इस नोरटस में या इस तरह के आगे के समय के
भीतर जलजखत नोरटस द्वारा दस ददनों से अजधक नहीं हो, जैसा दक पूछताछ प्राजधकारी अनुमजत द ेसकता ह।ै
^ इस संिोधन का, ददनांक 15.09.2017 के का.ज्ञा. 142/40/2015-एवीडी-। के माध्यम स े जारी डीओपीटी के
ददिा-जनदेिों के अनुसार जवजडयो कांफ्रेंससग के माध्यम स े पहल े ही की गई / की जा रही दकसी भी जवभागीय
कायावाजहयों पर कोई प्रजतकूल प्रभाव नहीं पडेगा ।

NOTIFICATION
New Delhi, the 7th December, 2020
No. 128
No. EP.36(1)/2020.—In exercise of the powers conferred by Section 45 of Food Corporations Act,
1964 (37 of 1964) and with the previous sanction of the Central Government, the Food Corporation of India
hereby makes the following Regulations further to amend the Food Corporation of India (Staff)
Regulations, 1971 namely:-
1. Short Title and Commencement:
(i) These Regulations shall be called the Food Corporation of India (Staff) (Fifth Amendment)
Regulations, 2020.
(ii) These shall come into force from the date of Notification in the Official Gazette.
2. Definitions: The definition and meaning of the words and designation of posts in this Regulations
shall have the same meaning as contained in the Food Corporations Act, 1964 and the Food Corporation of
India (Staff) Regulations, 1971.
3. In FCI (Staff) Regulations, 1971, Regulation 58 (1) and (7) may be amended as under:
(1) No order imposing any of the penalties specified in clauses (v) to (ix) of Regulation 54 shall be made
except after an inquiry held whether through personal hearing or through Video Conferencing^ as far
as may be, in the manner provided in this regulation and Regulation 59, or in the matter provided by the
Public Servants (Inquiries) Act, 1850 (37 of 1850), where such inquiry is held under that Act.
(7) The employee shall appear in person or through Video Conferencing^ before the inquiring authority
on such day and at such time within ten working days from the date of receipt by him of the articles of
charge and the statement of the imputations of mis-conduct or misbehavior, as the inquiring authority may,[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3
by a notice in writing, specify in this behalf, or within such further time, not exceeding ten days, as the
inquiring authority may allow.
^The amendment will not have any adverse effect on any departmental Proceedings already
conducted / being conducted through Video Conferencing in terms of DOPT Guidelines issued
vide O.M. 142/40/2015-AVD-I dated 15.09.2017.
