L.-33004/99 सससीीी...जजजीीी...---डडडीीी...एएएललल...---अअअ...---000888000888222000222555---222666555222999999 xxxGIDHxxx CCCGGG---DDDLLL---EEE---000888000888222000222555---222666555222999999 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 548] िई दिल्ली, बहृ स्ट्प जतवार, अगस्ट्त 7, 2025/श्रावण 16, 1947 No. 548] NEW DELHI, THURSDAY, AUGUST 7, 2025/SHRAVANA 16, 1947 परे ोजलयम एव ंप्राकृजतक गसै जवजियामक बोडड अजधसचू िा िई दिल्ली, 23 िुलाई 2025 फा. स.ं पीएििीआरबी/टेक/18-िमु ािड ा-टी4पिं ीकरण./(9)/2024/(ई-5488)/3- पेरोजलयम और प्राकृजतक गैस जवजियामक बोडड अजधजियम, 2006 (2006 का 19) की धारा 61 द्वारा प्रित्त िजियों का उपयोग करते हुए, पेरोजलयम और प्राकृजतक गैस जवजियामक बोडड एतद्द्वारा पेरोजलयम और प्राकृजतक गैस जवजियामक बोडड (प्राकृजतक गैस पाइपलाइिों के जलए एकीकृत प्रबधं ि प्रणाली) जवजियम, 2012 को और संिोजधत करिे के जलए जिम्नजलजखत जवजियम बिाता है, अर्ातड ्: - 1. लघ ुिीर्कड और प्रारंभण (1) इि जवजियमों को पेरोजलयम और प्राकृजतक गैस जवजियामक बोडड (प्राकृजतक गैस पाइपलाइिों के जलए एकीकृत प्रबंधि प्रणाली) संिोधि जवजियम, 2025 कहा िाएगा। (2) य ेसरकारी रािपत्र में प्रकािि की तारीख से लागू होंगे। 1. पेरोजलयम और प्राकृजतक गैस जवजियामक बोडड (प्राकृजतक गैस पाइपलाइिों के जलए एकीकृत प्रबंधि प्रणाली) जवजियम, 2012 म,ें - (a) जवद्यमाि जवजियमि 7 के स्ट्र्ाि पर जिम्नािुसार को प्रजतस्ट्र्ाजपत दकया िाएगा: (1) इि जवजियमों के प्रावधािों का अिुपालि सुजिजित करिे के जलए एक स्ट्र्ाजपत व्यापक प्रणाली होगी, जिसम ें रूपरेखा, पूव-ड जिमाडण, जिमाणड , िरुु आत और संचालि के चरणों के िौराि तकिीकी और सरु क्षा ऑजडट का संचालि िाजमल होगा सार् ही सार् समय-समय पर जिर्िडष्ट सतत आधार पर भी होगा। 5288 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (2) ‘बोडड’ सुरक्षा मािक सजहत तकिीकी मािकों और जवजििेिों के अिुपालि की जिगरािी प्रत्यक्ष या दकसी मान्यता प्राप्त तीसरे पक्ष के माध्यम से तीसरे पक्ष के अिरूु पता मूल्यांकि पर अलग जवजियमों के माध्यम स े करेगा। (3) इि जवजियमों के अंतगतड दकसी चूक या जवचलि या कमी की जस्ट्र्जत में, अजधकृत इकाई पेरोजलयम और प्राकृजतक गैस जवजियामक बोडड (प्राकृजतक गैस पाइपलाइि जबछािे, जिमाडण, संचालि या जवस्ट्तार करि े के जलए इकाइयों को अजधकृत करिा) जवजियम, 2008 के जवजियम 16 के अंतगडत अजधकृत इकाई चूककताड ईकाई के रूप में अहतड ा प्राप्त करेगी। (4) इि जवजियमों के प्रयोिि के जलए, िब तक बोड ड द्वारा प्राजधकरण प्रिाि िहीं दकया िाता ह ै या समर्पडत पाइपलाइिों के जलए, दकसी भी चूक या जवचलि या कमी की जस्ट्र्जत में, इकाई पीएििीआरबी अजधजियम, 2006 की धारा 28 के अिुसार िागररक िंड लगाि े और/या जिम्नजलजखत प्रदिया के अिसु ार संचालि के जिलंबि/समाजप्त का सामिा करिे के जलए उत्तरिायी होगी: (क) बोडड इकाई को एक अजधसचू िा िारी करेगा, जिसमें उसे जवजियमों के तहत अपिे िाजयत्वों को पूरा करिे के जलए एक उजचत समय अवजध िी िाएगी; (ख) यदि बोडड द्वारा जिर्िष्टड समयावजध के भीतर बोडड की संतुजष्ट के जलए इकाई द्वारा सुधारात्मक कारडवाई की िाती ह ैतो कोई िंडात्मक कारडवाई िहीं की िाएगी; (ग) यदि इकाई ऐसी समयावजध के भीतर सुधारात्मक कारडवाई करिे म ें जवफल रहती है, तो बोडड ऐसी इकाई को सुिवाई का अवसर िेि े के बाि जलजखत आििे द्वारा जिििे िे सकता ह ै दक इकाई पर लगिे वाल े दकसी अन्य िंड पर प्रजतकूल प्रभाव डाल े जबिा, ऐसी इकाई को जसजवल िंड के रूप में ऐसी राजि का भगु ताि करिा होगा िो प्रत्येक उल्लघं ि के जलए एक करोड़ रुपये स े अजधक िहीं होगी तर्ा लगातार जवफलता की जस्ट्र्जत म,ें अजतररि िडं िो प्रजतदिि िस लाख रुपय े तक हो सकता ह।ै इसके अजतररि, यदि बोडड उजचत समझे, तो उि इकाई के संचालि को जिलंजबत या समाप्त करि े का जििेि िे सकता ह।ै (घ) यदि इकाई खंड (ग) म ें दिए गए अिुसार बोड ड द्वारा पाररत जिििे ों का पालि करि े म ें जवफल रहती है, तो बोडड अजधजियम के अध्याय IX के तहत अपराधों और िंड के जलए जिधाडररत उजचत कारडवाई कर सकता ह।ै (5) उप-जवजियम (3) या उप-जवजियम (4) म ेंजिजहत प्रदिया के बाविूि, ऐसे मामलों में: (i) जिसम े इकाई की ओर से उल्लंघि सावडिजिक सुरक्षा के जलए आसन्न िोजखम उत्पन्न करता ह ैया (ii) जिसम े बोडड सावडिजिक जहत में या राज्य सुरक्षा के जहत में यह जिधाडररत करता ह ै दक ऐसा करिा आवश्यक ह,ै ‘बोडड’ इकाई को तत्काल उपचारात्मक कारडवाई करिे की आवश्यकता के अलावा, उि इकाई के पररचालि को तत्काल जिलंजबत करिे का जिििे भी िे सकता ह ै तर्ा ऐसे मामलों म,ें बोड ड द्वारा इकाई की सुिवाई का अवसर स्ट्र्जगत दकया िा सकता ह ैऔर बाि में प्रिाि दकया िा सकता ह।ै ध्याि ि ें 1: जियोजित पररयोििाओं म ें सभी ग्रीिफील्ड पररयोििाएं िाजमल होंगी और ब्राउिफील्ड पररयोििाओं के मामल े म,ें भडं ारण, हडैं ललगं या प्रसंस्ट्करण क्षमता म ें कोई वृजि, िििजि में वृजि या दकसी भी स्ट्र्ापिा/सुजवधा के िोजखम स्ट्तर म ेंवृजि िाजमल होगी। अंिि कुमार जमश्रा, सजचव [जवज्ञापि-III/4/असा./281/2025-26] पाि रटप्पणी: 1. मुख्य जवजियम, पेरोजलयम और प्राकृजतक गैस जवजियामक बोडड (प्राकृजतक गैस पाइपलाइिों के जलए अखंडता प्रबंधि प्रणाली), जवजियम, 2012, भारत के रािपत्र, भाग III, खंड 4 म ें दििांक 6 िवंबर 2012 को फा. स.ं इंफ्रा/आईएम/एििीपीएल/1/2010 के तहत प्रकाजित दकए गए र्े। 2. पेरोजलयम और प्राकृजतक गैस जवजियामक बोडड (प्राकृजतक गसै पाइपलाइिों के जलए अखडं ता प्रबंधि प्रणाली), संिोधि जवजियम, 2020, भारत के रािपत्र, भाग III, खंड 4 म ें दििांक 24 िवंबर 2020 को फा. सं. पीएििीआरबी/तकिीकी /14-आईएमएसएििीपीएल/(1)/2019 (पी-216) के तहत प्रकाजित दकए गए र्े।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 PETROLEUM AND NATURAL GAS REGULATORY BOARD NOTIFICATION New Delhi, the 23rd July, 2025 F. No. PNGRB/Tech/18-penalty-T4SReg./(9)/2024/(E-5488)/3.—In exercise of the powers conferred by section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following Regulations further to amend the Petroleum and Natural Gas Regulatory Board (Integrity Management System for Natural Gas Pipelines) Regulations, 2012, namely: - 1. Short title and commencement: (1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Integrity Management System for Natural gas pipelines) Amendment Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Petroleum and Natural Gas Regulatory Board (Integrity Management System for Natural gas pipelines) Regulations, 2012, - (a) existing Regulation 7, shall be substituted as under: “ (1) There shall be an established comprehensive system to ensure compliance with the provisions of these regulations, encompassing the conduct of technical and safety audits throughout the stages of design, pre-construction, construction, commissioning, and operation, and also on an ongoing basis, as periodically specified. (2) The Board shall monitor the compliance of these regulations, either directly or through an accredited third party via separate regulations on third-party conformity assessment. (3) In event of any default or deviation or shortfall under these Regulations, the authorized entity shall qualify as defaulting entity under the Regulation 16 of Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand Natural Gas Pipelines) Regulations, 2008. (4) For the purpose of these Regulations, until authorization is granted by the Board or for dedicated pipelines, in event of any default or deviation or shortfall, the entity shall be liable to face the imposition of civil penalty as per Section 28 of the PNGRB Act, 2006 and/or suspension/termination of operation, as per following procedure: (a) The Board shall issue a notice to the entity, allowing it a reasonable time period to fulfil its obligations under the regulations; (b) No punitive action shall be taken in case remedial action is taken by the entity, to the satisfaction of the Board, within the time period specified by the Board; (c) In case the entity fails to undertake remedial action within such time period, the Board may, after giving such entity an opportunity of being heard, by order in writing, direct that, without prejudice to any other penalty which the entity may be liable for, such entity shall pay, by way of civil penalty, an amount which shall not exceed one crore rupees for each contravention, and in case of a continuing failure, additional penalty which may extend to ten lakh rupees for every day. In addition, the Board, if it deems appropriate, may direct for suspension or termination of operations of the said entity.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (d) If the entity fails to comply with the directions passed by the Board, as provided in clause (c), the Board may take appropriate action as prescribed for offences and punishment under Chapter IX of the Act. (5) Notwithstanding the procedure contained in sub-regulation (3) or sub-regulation (4), in cases: (i) where the violation on the part of the entity poses an imminent danger to public safety or (ii) where the Board determines, in public interest or in the interest of State security, that it is so required, the Board may, apart from requiring the entity to take immediate remedial action, also direct for immediate suspension of operations of the said entity and in such cases, an opportunity of being heard may be deferred and afforded subsequently to the entity by the Board. Note 1: Planned projects shall include all greenfield projects and, in the case of brownfield projects, shall encompass any addition to storage, handling, or processing capacity, increase in manpower, or increase in risk level of any installation/facility.
