L.-33004/99 ससीी..जजीी..--डडीी..एएलल..--अअ..--1133005522002255--226633005511 xxxGIDHxxx CCGG--DDLL--EE--1133005522002255--226633005511 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 360] िई दिल्ली, िुक्रिार, मई 9, 2025/ििै ाख 19, 1947 No. 360] NEW DELHI, FRIDAY, MAY 9, 2025/VAISAKHA 19, 1947 परे ोजलयम और प्राकृजतक गसै जिजियामक बोडड अजधसचू िा िई दिल्ली, 8 मई 2025 फा. स.ं पीएििीआरबी/प्राजधकरण/5-एलएििी(01)/2023 (E-4853).–– पेरोजलयम एिं प्राकृजतक गैस जिजियामक बोडड अजधजियम, 2006 (2006 का 19) के खंड 61 में िर्णडत िजियों का प्रयोग करते हुए, पेरोजलयम एिं प्राकृजतक गैस जिजियामक बोडड एतद्द्वारा जिम्नजलजखत जियम बिाता है, अर्ाडत्:- 1. सजं िप्त िीर्कड और प्रारंभ, - (1) इि जिजियमों को पेरोजलयम एिं प्राकृजतक गैस जिजियामक बोडड [तरलीकृत प्राकृजतक गैस (एलएििी) टर्मडिलों की स्ट्र्ापिा एिं सचं ालि के जलए पंिीकरण] जिजियम, 2025 कहा िाएगा। (2) ये जियम सरकारी रािपत्र में इिके प्रकािि की जतजर् से प्रभािी होंगे। 2. पररभार्ाए ँ- (1) इि जिजियमों में, िब तक दक संिभड से अन्यर्ा अपेजित ि हो, तब तक - (क) "अजधजियम" का अर्ड ह ै पेरोजलयम एिं प्राकृजतक गैस जिजियामक बोडड अजधजियम, 2006 (2006 का 19); (ख) "जियत दिि" का अर्ड 1 अक् तूबर, 2007 की तारीख से है, िब केंद्र सरकार िे पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड की स्ट्र्ापिा को अजधसजू चत दकया र्ा; (ग) "बोडड" का अर्ड ह ै इस अजधजियम के खंड 3 के उप-खंड (1) के अधीि स्ट्र्ाजपत पेरोजलयम एिं प्राकृजतक गैस जिजियामक बोडड; 3113 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (घ) "तरलीकृत प्राकृजतक गैस टर्मडिल (एलएििी टर्मडिल)" का अर्ड उस अिसंरचिा से है, िो जिम् िजलखत के जलए आिश् यक ह ै - (i) तरलीकृत प्राकृजतक गैस प्राप्त करि े के जलए; (ii) तरलीकृत प्राकृजतक गैस का भंडारण करि े के जलए; (iii) तरलीकृत प्राकृजतक गैस के पुिगैसीकरण को सिम करिे के जलए; और (iv) पुिगैसीकृत तरलीकृत प्राकृजतक गैस को सुजिधा की बाहरी सीमा तक पहुचँ ािे के जलए। स्ट्पष्टीकरण - फ्लोटटंग भंडारण पुिगैसीकरण यूजिट (एफएसआरयू), गुरुत्िाकर्डण आधाररत भंडारण एिं पुिगैसीकरण यूजिट (िीबीएसआरयू) और खंड (i) से (iv) तक उजल्लजखत अिसंरचिा को किर करि े िाली कोई अन्य समाि सुजिधाएं, चाह े उन्ह ें दकसी भी िाम से बुलाया िाए, तरलीकृत प्राकृजतक गैस टर्मडिल मािा िाएगा; (ड.) "अिुसूची" का अर्ड इि जिजियमों की अिुसचू ी स े ह।ै (2) इि जिजियमों में िो िब्ि या िाक्यांि इस्ट्तेमाल दकए गए ह ैं लेदकि पररभाजर्त िहीं हैं, यदि िे िब्ि अजधजियम या उसके अंतगडत बिे जियमों या जिजियमों, िैसा भी मामला हो, म ें पररभाजर्त ह,ैं तो उिका िही मतलब होगा िो िहां दिया गया ह।ै 3. प्रयोज्यता, - ये जिजियम उस कंपिी पर लागू होंगे - (क) िो जियत दिि के बाि तरलीकृत प्राकृजतक गैस टर्मिड ल (जिस े आगे "एलएििी टर्मडिल" कहा िाएगा) स्ट्र्ाजपत करि े या सचं ाजलत करिे की इच्छुक है; (ख) जिसिे जियत दिि से ठीक पहले एलएििी टर्मडिल स्ट्र्ाजपत कर जलया ह ै या संचाजलत कर रहा ह।ै 4. पिं ीकरण के जलए आििे ि, - (1) जियत दिि के बाि एलएििी टर्मडिल स्ट्र्ाजपत करिे या सचं ाजलत करि े की इच्छुक कोई भी कंपिी अिुसूची-I के अिुसार अपि े अंजतम जििेि जिणडय (एफआईडी) से पहले बोडड को इस उद्देश्य के जलए जििरण के सार् एक सूचिा प्रस्ट्तुत करेगी: बिते दक यदि कोई कंपिी जियत दिि के बाि और इि जियमों के लागू होि े स े ठीक पहल े एलएििी टर्मडिल चला रही है, तो उसे इस उप-जियम के तहत िािकारी िेि े की ज़रूरत िहीं होगी, लेदकि उस े उप-जियम (3) के अिुसार पंिीकरण के जलए िल्ि से िल्ि आिेिि िेिा होगा, और यह आिेिि इि जियमों के लागू होिे के 45 दििों के भीतर ििे ा िरूरी होगा। (2) बोडड को उप-जिजियम (1) के तहत सूचिा जमलिे के तीस दििों के भीतर यह तय करिा होगा दक िह उप-जिजियम (3) के अिुसार कंपिी द्वारा दकए गए पंिीकरण के आिेिि को आगे बढाएगा या िहीं, और इसका जिणडय िेिा होगा: बिते दक ऐसा जिणडय लेत े समय बोडड को िीचे दिए गए एक या एक से अजधक उद्देश्यों को ध्याि में रखिा होगा, अर्ाडत्: (i) कंपजियों के बीच प्रजतस्ट्पधाड को बढािा िेिा; (ii) जिष्फल जििेि से बचिा; (iii) आपूर्तड को बिाए रखिा या बढािा या समतापूणड जितरण सुजिजित करिा या पूरे िेि में प्राकृजतक गैस की पयाडप्त उपलब्धता सुजिजित करिा; (iv) प्राकृजतक गैस की उपलब्धता के संिभड में ग्राहकों के जहतों की सुरिा करिा; और (v) प्रस्ट्ताजित एलएििी टर्मडिल से पुिः गैसीकृत तरलीकृत प्राकृजतक गैस की जिकासी के जलए प्राकृजतक गैस पाइपलाइि अिसंरचिा की उपलब्ध करािा। (3) कंपिी अिुसूची-II के अिुसार पंिीकरण के जलए बोडड को आिेिि करेगी, सार् ही पेरोजलयम एिं प्राकृजतक गैस जिजियामक बोडड (िुल्क एिं अन्य प्रभार उगाही) जियामक, 2007 के तहत जिर्िडष्ट आिेिि िुल्क भी िेगी: बिते दक एक स े अजधक एलएििी टर्मडिल स्ट्र्ाजपत करि े या संचाजलत करि े की इच्छुक कंपिी ऐस े प्रत्येक एलएििी टर्मडिल के जलए आिेिि िुल्क के सार् अलग-अलग आिेिि करेगी:[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 इसके अलािा, यह भी प्रािधाि ह ै दक इस उप-जिजियम के तहत प्राप्त आिेिि के मूल्यांकि के जलए, बोडड उप-जिजियम (2) के प्रािधाि के अिसु ार उद्देश्यों द्वारा जििेजित होगा। (4) कंपिी के पास एलएििी टर्मडिल की िमता का उपयोग करिे की एक ठोस व्यापार योििा होिी चाजहए, और िह अपिी व्यापार योििा, एलएििी या पुिगैसीकृत प्राकृजतक गैस को जिकालिे की जिस्ट्तृत योििा और स्ट्िीकृत जिस्ट्तृत व्यिहायतड ा ररपोटड (डीएफआर) की प्रजत बोडड को िेगी। (5) कंपिी बोडड को अपिी जिस्ट्तृत व्यिहायतड ा ररपोटड (डीएफआर) में एलएििी टर्मडिल की अिुमाजित पररयोििा लागत के एक प्रजतित या 25 करोड़ रुपए, िो भी कम हो, के बराबर राजि की बैंक गारंटी प्रस्ट्तुत करेगी। 5. पिं ीकरण प्रमाणपत्र, - (1) बोडड, कंपिी के द्वारा िमा दकए गए िस्ट्तािेज़, जिष्पािि बैंक गारंटी और आिेिि िुल्क की िांच करिे के बाि, जियमों के अिुसार पंिीकरण के जलए आिेिि पर जिचार करेगा। यदि सब कुछ सही पाया गया, तो बोडड कंपिी को अिुसचू ी-V के अिुसार एलएििी टर्मडिल स्ट्र्ाजपत करिे या चलािे (या िोिों) के जलए पंिीकरण प्रमाणपत्र िे सकता ह।ै यह प्रमाणपत्र पंिीकरण की तारीख या टर्मडिल िुरू करिे की तारीख (िो भी पहले हो) स े 30 साल के जलए िैध होगा। (2) कंपिी पेरोजलयम और प्राकृजतक गैस जिजियामक बोड ड (तरलीकृत प्राकृजतक गैस सुजिधाओं के जलए सरु िा मािकों सजहत तकिीकी मािक और जिजििेि) जिजियम, 2018 और बोडड द्वारा अजधसूजचत अन्य ऐसे जिजियमों का पालि करेगी। (3) यदि कंपिी, कंपिी अजधजियम, 2013 (2013 का 18) के तहत पंिीकृत िहीं है, तो िह इि जिजियमों के तहत पंिीकरण की तारीख से छह महीि े के भीतर खुि को कंपिी अजधजियम, 2013 (2013 का 18) के तहत एक कंपिी के रूप में पिं ीकृत कराएगी। (4) कंपिी एलएििी टर्मडिल की समापि अिसु ूची बोडड के अिुमोिि के जलए प्रस्ट्तुत करेगी। (5) बोडड समय-समय पर एलएििी टर्मडिल की प्रगजत की जिगरािी करेगा। समापि अिुसूची का पालि करि े में जिफलता या अजधसूजचत जिजियमों के अिुपालि म ें जिफलता के मामले में, बोडड सुििाई का उजचत अिसर ििे े के बाि, प्रत्येक चूक के जलए जिष्प ािि बैंक गारंटी मूल्य के 5% तक का िुमाडिा लगा सकता ह।ै (6) उप-जिजियम (1) के तहत िारी पंिीकरण प्रमाणपत्र की िैधता बढािे के जलए, कंपिी को उस पंिीकरण प्रमाणपत्र की समाजप्त से छह महीिे पहले जिस्ट्तार के जलए आिेिि करिा होगा। बिते दक बोड ड उस अिजध के समाप्त होि े के बाि आिेिि पर जिचार कर सकता है, यदि िह इस बात स े संतुष्ट ह ै दक उस अिजध के भीतर आिेिि ि िेिे का पयाडप्त कारण र्ा। (7) बोडड, उप-जिजियम (6) के तहत आिेिि की िाचं करिे के बाि, उजचत जिबंधि एिं ितों पर एक बार म ें 10 साल के ब्लॉक के जलए पंिीकरण के जिस्ट्तार पर जिचार कर सकता है, िसै ा दक िह उजचत समझे। 6. जियत दिि स े पहल े एलएििी टर्मिड ल स्ट्र्ाजपत करि े या सचं ाजलत करि े िाली कंपजियां, (1) कंपिी अिसु ूची IV के अिुसार प्रपत्र में सहायक िस्ट्तािेिों के सार् प्रासंजगक िािकारी प्रस्ट्तुत करेगी। बोडड कंपिी को स्ट्िीकृजत पत्र िारी करेगा। (2) कंपिी पेरोजलयम एिं प्राकृजतक गैस जिजियामक बोड ड (तरलीकृत प्राकृजतक गैस सुजिधाओं के जलए सरु िा मािकों सजहत तकिीकी मािक और जिजििेि) जिजियम, 2018 का पालि करेगी। (3) कंपिी की गजतजिजधया ँ ऐसे अन्य जिजियमों के अधीि होंगी िो अजधजियम के प्रािधािों के अिसु ार लाग ू हो सकती ह।ैं 7. मौििू ा एलएििी टर्मिड लों का िमता जिस्ट्तार, (1) िहा ँ कोई कंपिी मौिूिा एलएििी टर्मडिल की िमता का जिस्ट्तार करि े का प्रस्ट्ताि करती है, तो िह जिजियम (5) के उप-जिजियम (1) के तहत िारी पंिीकरण के मौिूिा प्रमाणपत्र/ जिजियम (6) के उप- जिजियम (1) के तहत िारी स्ट्िीकृजत-पत्र में संिोधि के जलए बोडड को अिुरोध प्रस्ट्ततु करेगी। बिते दक संिोधि के जलए ऐसा आिेिि जिस्ट्तार गजतजिजधयों के प्रारंभ होिे स े कम स े कम 90 दिि पहल े दकया िाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (2) बोडड उप-जिजियम (1) के तहत दकए गए अिुरोध पर उजचत जिचार करिे के बाि, मौिूिा पंिीकरण प्रमाणपत्र/ स्ट्िीकृजत-पत्र में संिोधि कर सकता ह।ै (3) बोडड ऐस े पंिीकरण प्रमाणपत्र/ स्ट्िीकृजत-पत्र में संिोधि के जलए अिुमोिि प्रिाि करते समय, जिजियम (4) के उप-जिजियम (2) के प्रािधाि में जिर्िडष्ट एक या अजधक उद्देश्यों को ध्याि में रखेगा। 8. स्ट्िाजमत्ि म ें पररितिड , - (1) जिजियम (5) के उप-जिजियम (1) के तहत िारी पंिीकरण प्रमाणपत्र/ जिजियम (6) के उप-जिजियम (1) के तहत िारी स्ट्िीकृजत-पत्र या िामांकि के बाि एलएििी टर्मडिल के संबंध में स्ट्िाजमत्ि, प्रबंधि जियंत्रण या दकसी अन्य ऐसे पररितडि के मामले में, पंिीकरण प्रमाणपत्र/ स्ट्िीकृजत-पत्र या िामांकि में संिोधि का अिुरोध करते हुए ऐस े पररितडि के 60 दििों के भीतर सहायक िस्ट्तािेिों की प्रजतयों के सार् बोडड को सूजचत दकया िाएगा। (2) ऐसी सचू िा प्राप्त होि े तर्ा अिरु ोध की उजचत िाचं के पिात, बोडड िए स्ट्िामी के िाम पर पंिीकरण प्रमाणपत्र/ स्ट्िीकृजत या िामाकं ि पत्र में संिोधि कर सकता ह।ै 9. सचू िा प्रस्ट्ततु करिा, - सभी कंपजियां, जिि पर जिजियम (3) के अंतगडत ये जिजियम लागू होते हैं, प्रत्येक िर्ड 1 अप्रैल तर्ा 1 अक् तूबर को अिुसूची-III में जिर्िडष्ट प्रारूप में बोडड को सूचिा प्रस्ट्तुत करेंगी तर्ा उसे अपिी िेबसाइट पर प्रिर्िडत करेंगी। 10. पिं ीकरण प्रमाणपत्र का जिलबं ि या समाजप्त, - (1) यदि कोई पंिीकृत कंपिी प्रजतबंधात्मक व्यापार व्यिहार में िाजमल ह ै या पेरोजलयम एिं प्राकृजतक गैस जिजियामक बोडड (तरलीकृत प्राकृजतक गैस सुजिधाओं के जलए सुरिा मािकों सजहत तकिीकी मािक और जिजििेि) जिजियम, 2018 के तहत दकसी िाजयत्ि की पूर्तड में चूक करती ह ै या जिजियम (5) के उप- जिजियम (1) के तहत िारी पंिीकरण प्रमाणपत्र के तहत जिर्िडष्ट ितों का पालि करिे में जिफल रहती ह,ै तो बोडड, कंपिी को सुििे के बाि, पंिीकरण प्रमाणपत्र को तीि महीिे की अिजध के जलए तरु ंत जिलंजबत कर सकता ह:ै बिते दक कंपिी को बोडड द्वारा जिलंबि अिजध के भीतर चकू को सुधारि े का अिसर दिया िाएगा। इसके अलािा, उप-जिजियम (1) में जिजहत दकसी भी बात के बाििूि, ऐसे मामलों में: - (i) िहां कंपिी की ओर स े उल्लंघि सािडिजिक सुरिा के जलए आसन्न खतरा पैिा करता है; या (ii) िहां बोडड सािडिजिक जहत में या राज्य सरु िा के जहत में यह जिधाडररत करता ह ै दक ऐसा करिा आिश्यक ह,ै बोडड कंपिी को तत्काल सुधारात् मक कारडिाई करिे की आिश्यकता के अलािा, आिेि द्वारा उि कंपिी का संचालि अस्ट्र्ायी रूप से तरु ंत रोकिे का जििेि भी िे सकता ह ै और ऐस े मामलों में, इस संबंध में अंजतम आिेि पाररत करि े के जलए बोडड द्वारा कंपिी को सिु िाई का अिसर प्रिाि दकया िाएगा। (2) उप-जिजियम (1) में जिजहत दकसी भी बात के बाििूि, बोडड चूक को सुधारिे के जलए समय बढािे की अिुमजत िे सकता है, यदि िह जिलंबि अिजध के तीि महीिे के िौराि कंपिी द्वारा प्राप्त प्रगजत से संतुष्ट ह ै और यदि िह उजचत समझता ह ै दक चूक को सुधारिे के जलए ऐसी समयािजध बढािा आिश्यक ह।ै बिते दक जिजियम (5) के उप-जिजियम (1) के तहत िारी पंिीकरण प्रमाणपत्र भी, कंपिी को सुधार करिे का समय िेत े हुए, जिलजं बत रहगे ा। (3) यदि कंपिी चूक को सुधारिे म ें जिफल रहती है, तो बोडड ऐसी कंपिी को सुििाई का अिसर िेि े के बाि पंिीकरण प्रमाणपत्र को समाप्त कर सकता ह।ै (4) जिजियम (5) के उप-जिजियम (1) के तहत दकसी कंपिी को िारी पंिीकरण प्रमाणपत्र की समाजप्त के मामले म,ें ऐसी कंपिी द्वारा प्रस्ट्तुत बैंक गारंटी िब्त कर ली िाएगी। 11. जिजिध, - No. PNGRB/Auth/5-RegLNG(01)/2023 (E-4853).––In exercise of the powers conferred by Section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations, namely: - 1. Short title and commencement, - (1) These regulations may be called the Petroleum and Natural Gas Regulatory Board [Registration for Establishing and Operating Liquefied Natural Gas (LNG) Terminals] Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions, - (1) In these regulations, unless the context otherwise requires, - (a) “Act” means the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006); (b) “Appointed day” means the date of October 1, 2007, when the Central Government notified the establishment of the Petroleum and Natural Gas Regulatory Board; (c) “Board” means the Petroleum and Natural Gas Regulatory Board established under sub- section (1) of the Section 3 of the Act; (d) "Liquefied Natural Gas terminal (LNG terminal)” means an infrastructure required to, - (i) receive Liquefied natural gas; (ii) store Liquefied natural gas; (iii) enable regasification of Liquefied natural gas; and (iv) transport re-gasified Liquefied natural gas to the outside boundaries of the facility. Explanation, - Floating Storage Regassification unit (FSRU), Gravity Based Storage and Regasification Unit (GBSRU) and any other like facilities covering the infrastructure mentioned from clauses (i) to (iv) by whatsoever name called shall be a Liquefied Natural Gas terminal; (e) “Schedule” means a Schedule to these regulations. (2) Words or expressions used and not defined in these regulations, but defined in the Act or in the rules or regulations made thereunder, shall have the meanings respectively assigned to them in the Act or in the rules or regulations, as the case may be. 3. Applicability, - These regulations shall apply to an entity - (a) Which is desirous of establishing or operating a Liquefied Natural Gas terminal (hereinafter referred to as “LNG terminal”) after the appointed day; (b) Which has already established or is operating a LNG terminal immediately before the appointed day. 4. Application for Registration. -[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 13 (1) Any entity desirous of establishing or operating a LNG terminal after the appointed day shall submit an intimation along with details for such purpose to the Board before its Final Investment Decision (FID) as per Schedule – I: Provided that any entity operating a LNG terminal after the appointed day and immediately before the commencement of these regulations, shall not be required to submit intimation under this sub-regulation but shall submit an application as per sub-regulation (3) for registration as soon as possible, but not later than 45 days after the commencement of these regulations. (2) The Board within thirty days from receipt of intimation under sub-regulation (1), shall provide its decision to proceed with application of registration made by an entity as per sub- regulation (3): Provided that the Board in deciding so, shall be guided by one or more of the following objectives, namely: - (i) promoting competition among entities; (ii) avoiding infructuous investment; (iii) maintaining or increasing supplies or for securing equitable distribution or ensuring adequate availability of natural gas throughout the country; (iv) protection of customers’ interest in terms of availability of natural gas; and (v) availability of natural gas pipeline infrastructure for evacuation of re-gasified Liquefied Natural Gas from the proposed LNG terminal. (3) The entity shall make an application for registration to the Board as per Schedule –II, along with an application fee specified under the Petroleum and Natural Gas Regulatory Board (Levy of Fee and other Charges) Regulations, 2007: Provided that an entity desirous of establishing or operating more than one LNG terminal shall make separate applications for each of such LNG terminals with application fee: Provided further that for assessment of an application received under this sub-regulation, the Board shall be guided by the objectives as per proviso to sub-regulation (2). (4) The entity shall have a credible business plan for utilization of capacity in the LNG terminal and shall submit the business plan and detailed evacuation plan of LNG or re-gasified natural gas from its LNG terminal, along with copy of its approved Detailed Feasibility Report (DFR) to the Board. (5) The entity shall furnish a bank guarantee to the Board for an amount equivalent to one per cent of the estimated project cost of the LNG terminal in its Detailed Feasibility Report (DFR) or Rs 25 crore, whichever is less. 5. Certificate of Registration, - (1) The Board after examining the application for registration referred to in sub-regulation (3) of regulation (4), along with the documents provided, performance bank guarantee, and application fee submitted by the entity, may issue a certificate of registration allowing the entity to establish or operate or for both a LNG terminal for 30 years, commencing from the date of commissioning or from the date of registration whichever is earlier, as per Schedule- V. (2) The entity shall abide by the Petroleum and Natural Gas Regulatory Board (Technical Standards and Specifications including Safety Standards for Liquefied Natural Gas Facilities) Regulations, 2018 and other such regulations as may be notified by the Board.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (3) The entity, on being registered and not being a company under the Companies Act, 2013 (18 of 2013), shall get itself registered as a company under the Companies Act, 2013 (18 of 2013), within six months from the date of registration under these regulations. (4) The entity shall submit the completion schedule of the LNG terminal for approval of the Board. (5) The Board shall monitor the progress of the LNG terminal from time to time. In case of failure in adherence to completion schedule or compliances to notified regulations, the Board may, after giving it a reasonable opportunity of being heard, impose penalty up to 5 % of Performance Bank Guarantee value for each default. (6) For extending the validity of certificate of registration issued under sub-regulation (1), the entity shall be required to make application for extension prior to six months from the date of expiry of such certificate of registration. Provided that the Board may entertain an application after expiry of the said period, if it is satisfied that there was sufficient cause for not filing the application within that period. (7) The Board, upon scrutiny of the application under sub-regulation (6), may consider extension of registration for a block of 10 years at a time on such terms and conditions, as it may deem fit. 6. Entities establishing or operating a LNG Terminal before the appointed day. - (1) The entity shall submit relevant information along with supporting documents in the form as per Schedule IV. The Board shall issue a letter of acceptance to the entity. (2) The entity shall abide by the Petroleum and Natural Gas Regulatory Board (Technical Standards and Specifications including Safety Standards for Liquefied Natural Gas Facilities) Regulations, 2018. (3) The activities of the entity shall be subject to such other regulations as may be applicable as per the provisions of the Act. 7. Capacity Expansion of Existing LNG Terminals. - (1) Where an entity proposes to expand the capacity of an existing LNG terminal, it shall submit a request for amendment in existing certificate of registration issued under sub-regulation (1) of regulation (5) /Letter of acceptance issued under sub-regulation (1) of Regulation (6) to the Board. Provided that such an application for amendment shall be made at least 90 days before the commencement of expansion activities. (2) The Board after due consideration of request made under sub-regulation (1), may amend the existing certificate of registration/ Letter of acceptance. (3) The Board while granting approval for amendment in such certificate of registration/ letter of acceptance, shall be guided by one or more of the objectives, referred to in proviso to sub- regulation (2) of regulation (4). 8. Change of Ownership, - (1) In case of change in the ownership, management control or any other such change in respect of the LNG terminal after issue of the certificate of registration issued under sub-regulation (1) of regulation (5)/ Letter of acceptance issued under sub-regulation (1) of Regulation (6) to the Board or enlistment, the same shall be informed to the Board along with copies of the supporting documents within 60 days of such a change with a request for amending the certificate of registration / Letter of acceptance or enlistment.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 15 (2) Upon receipt of such an information and due examination of the request, the Board may amend the certificate of registration/ Letter of acceptance or enlistment, in the name of the new owner. 9. Submission of Information, - All entities to which these regulations apply under regulation (3), shall submit information to the Board on 1st April and 1st October of each year, in the format as specified in Schedule-III and host the same on its website. 10. Suspension or Termination of Certificate of Registration, - (1) In case a registered entity is involved in restrictive trade practice or defaults in fulfilment of any obligation under Petroleum and Natural Gas Regulatory Board (Technical Standards and Specifications including Safety Standards for Liquefied Natural Gas Facilities) Regulations, 2018 or fails to adhere to conditions specified under the certificate of registration issued under sub-regulation (1) of regulation (5), the Board, after hearing the entity, may immediately suspend the certificate of registration for a period of three months: Provided that the entity shall be allowed to rectify the default within such suspension period by the Board. Provided further that, notwithstanding anything contained in sub-regulation (1), in cases: - (i) where the violation on the part of the entity poses an imminent danger to public safety; or (ii)where the Board determines, in public interest or in the interest of State security, that it is so required, the Board may, apart from requiring the entity to take immediate remedial action, also direct, by order, for immediate temporary suspension of operations of the said entity and in such cases, an opportunity of being heard shall be provided subsequently to the entity by the Board for passing final order in this respect. (2) Notwithstanding anything contained in sub-regulation (1), the Board may permit an extension of time, to rectify the default, if it is satisfied with the progress achieved by the entity during the three-months of suspension period and if it deemed fit that such an extension is necessary for rectifying the default. Provided that the certificate of registration issued under sub-regulation (1) of regulation (5) shall also remain suspended simultaneously with the time permitted for rectification to an entity. (3) If, the entity fails to rectify the default, the Board may terminate the certificate of registration after giving an opportunity of being heard to such an entity. (4) In case of termination of the certificate of registration issued to an entity under sub-regulation (1) of regulation (5), the bank guarantee furnished by such an entity shall be forfeited. 11. The entity shall publish its available re-gasification facilities on monthly basis on 1st day of each month. 6. The furnishing of performance bond of Rs. 25 Crore is a guarantee for timely commissioning of the project as per the specified targets and for meeting the performance undertakings during operating phase of the project. 7.
