प्रजतदिया और आपिा प्रबंधि योििा हते ु आचरण पद्धजत) जवजियम, 2010 को और संिोजधत करिे के जलए जिम्नजलजखत
जवजियम बिाता ह,ै िामत: -
1. लघ ुिीर्कड और प्रारंभण
(1) इि जवजियमों को पेरोजलयम और प्राकृजतक गैस जवजियामक बोड ड (आपातकालीि प्रजतदिया और आपिा प्रबंधि
योििा हते ु आचरण पद्धजत) सिं ोधि जवजियम, 2025 कहा िाएगा।
(2) ये सरकारी रािपत्र में इिके प्रकािि की तारीख स ेलागू होंगे।
2. पेरोजलयम एवं प्राकृजतक गैस जवजियामक बोडड (आपातकालीि प्रजतदिया और आपिा प्रबंधि योििा हते ु आचरण
पद्धजत) जवजियम, 2010 म,ें -
(a) जवजियमि 7 म,ें-
(i) मौिूिा खंड को "(ए)" के रूप में पुिः िमांदकत दकया िाएगा।

(ii) अंत में जिम्नजलजखत को िाजमल दकया िाएगा, अर्ाडत:्
“(बी) संबंजधत इकाई का बोड ड इि जवजियमों के लागू होि े के िब्ब े दििों के भीतर अपि े एक जििेिक की
जियुजि करेगा, िो इि जवजियमों के अिपु ालि को सुजिजित करिे के जलए उत्तरिायी होगा।”
(b) जवजियम 8 के स्ट्र्ाि पर जिम्नजलजखत प्रजतस्ट्र्ाजपत दकया िाएगा: -
“
8. चूक और पररणाम
(1) इि जवजियमों के प्रावधािों का अिुपालि सुजिजित करिे के जलए एक स्ट्र्ाजपत व्यापक प्रणाली होगी, जिसम ें
रूपरेखा, पूव-ड जिमाडण, जिमाणड , िरुु आत और संचालि के चरणों के िौराि तकिीकी और सरु क्षा ऑजडट का
संचालि िाजमल होगा सार् ही सार् समय-समय पर जिर्िडष्ट सतत आधार पर भी होगा।
(2) ‘बोडड’ सुरक्षा मािक सजहत तकिीकी मािकों और जवजििेिों के अिुपालि की जिगरािी प्रत्यक्ष या दकसी
मान्यता प्राप्त तीसरे पक्ष के माध्यम से तीसरे पक्ष के अिरूु पता मूल्यांकि पर अलग जवजियमों के माध्यम स े
करेगा।
(3) इि जवजियमों के प्रयोिि के जलए दकसी भी िोर् या जवचलि या कमी की जस्ट्र्जत में, इकाई पीएििीआरबी
अजधजियम, 2006 की धारा 28 के अिुसार जसजवल िडं लगाि े और/या जिम्नजलजखत प्रदिया के अिुसार
संचालि के जिलंबि/समाजप्त का सामिा करि े के जलए उत्तरिायी होगी:
(क) बोडड इकाई को एक अजधसचू िा िारी करेगा, जिसमें उस े जवजियमों के तहत अपि े िाजयत्वों को पूरा करि े
के जलए एक उजचत समय अवजध िी िाएगी;
(ख) यदि बोडड द्वारा जिर्िष्टड समयावजध के भीतर बोड ड की संतुजष्ट के जलए इकाई द्वारा सुधारात्मक कारडवाई की
िाती ह ैतो कोई िंडात्मक कारडवाई िहीं की िाएगी;
(ग) यदि इकाई ऐसी समयावजध के भीतर सुधारात्मक कारडवाई करिे म ें जवफल रहती है, तो बोडड ऐसी इकाई
को सुिवाई का अवसर िेि े के बाि जलजखत आिेि द्वारा जिििे िे सकता ह ै दक इकाई पर लगिे वाल े
दकसी अन्य िंड पर प्रजतकूल प्रभाव डाले जबिा, ऐसी इकाई को जसजवल िंड के रूप में ऐसी राजि का
भुगताि करिा होगा, िो प्रत्यके उल्लंघि के जलए एक करोड़ रुपय े स े अजधक िहीं होगी तर्ा लगातार
जवफलता की जस्ट्र्जत में, अजतररि िडं िो प्रजतदिि िस लाख रुपये तक हो सकता ह।ै इसके अजतररि,
यदि बोडड उजचत समझे, तो उि इकाई के संचालि को जिलंजबत या समाप्त करि े का जिििे ि ेसकता ह।ै
(घ) यदि इकाई खंड (ग) में दिए गए अिुसार बोडड द्वारा पाररत जििेिों का पालि करिे में जवफल रहती है,
तो बोड ड अजधजियम के अध्याय IX के अंतगडत अपराधों और िडं के जलए जिधाडररत उजचत कारडवाई कर
सकता ह।ै
बिते दक उप-जवजियम (3) के खंड (क) स े(घ) म ेंजिजहत दकसी भी बात के बाविूि, ऐस ेमामलों म ें
(i) जिसम े इकाई की ओर से उल्लंघि सावडिजिक सुरक्षा के जलए आसन्न िोजखम उत्पन्न करता ह ैया
(ii) जिसम े बोडड सावडिजिक जहत में या राज्य सुरक्षा के जहत में यह जिधाडररत करता ह ै दक ऐसा करिा आवश्यक
ह,ै
‘बोडड’ इकाई को तत्काल उपचारात्मक कारडवाई करिे की आवश्यकता के अलावा, उि इकाई के पररचालि को
तत्काल जिलंजबत करिे का जिििे भी िे सकता ह ै तर्ा ऐसे मामलों म,ें बोड ड द्वारा इकाई की सुिवाई का अवसर
स्ट्र्जगत दकया िा सकता ह ैऔर बाि में प्रिाि दकया िा सकता ह।ै
ध्याि ि ें 1: जियोजित पररयोििाओं म ें सभी ग्रीिफील्ड पररयोििाएं िाजमल होंगी और ब्राउिफील्ड
पररयोििाओं के मामल े म,ें भडं ारण, हडैं ललगं या प्रसंस्ट्करण क्षमता म ें कोई वृजद्ध, िििजि में वृजद्ध या दकसी भी
स्ट्र्ापिा/सुजवधा के िोजखम स्ट्तर म ेंवृजद्ध िाजमल होगी।

by section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum
and Natural Gas Regulatory Board hereby makes the following Regulations further to amend the Petroleum
and Natural Gas Regulatory Board (Petroleum and Natural Gas Regulatory Board (Codes of Practices for
Emergency Response and Disaster Management Plan) Regulations, 2010, namely: -
1. Short title and commencement:
(1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Petroleum and
Natural Gas Regulatory Board (Codes of Practices for Emergency Response and Disaster
Management Plan) Amendment Regulations, 2025.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Petroleum and Natural Gas Regulatory Board (Codes of Practices for Emergency Response
and Disaster Management Plan) Regulations, 2010, -
(a) In Regulation 7,-
(i) the existing clause shall be renumbered as “(a)”.
(ii) at the end, the following shall be inserted, namely:
“(b) The Board of the concerned entity, within ninety days of the commencement of these
regulations shall appoint one of its directors, who shall be responsible for ensuring compliance
to these regulations.”
(b) Regulation 8, shall be substituted namely: -
"
8. Default and consequences.
(3) There shall be an established comprehensive system to ensure compliance with the provisions of
these regulations, encompassing the conduct of technical and safety audits throughout the stages
of design, pre-construction, construction, commissioning, and operation, and also on an ongoing
basis, as periodically specified.
(4) The Board shall monitor the compliance of these regulations, either directly or through an
accredited third party via separate regulations on third-party conformity assessment.
(5) For the purpose of these Regulations, in event of any default or deviation or shortfall, the entity
shall be liable to face the imposition of civil penalty as per Section 28 of the PNGRB Act, 2006
and/or suspension/termination of operation, as per following procedure:
(a) The Board shall issue a notice to the entity, allowing it a reasonable time period to fulfil its4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
obligations under the regulations;
(b) No punitive action shall be taken in case remedial action is taken by the entity, to the
satisfaction of the Board, within the time period specified by the Board;
(c) In case the entity fails to undertake remedial action within such time period, the Board may,
after giving such entity an opportunity of being heard, by order in writing, direct that,
without prejudice to any other penalty which the entity may be liable for, such entity shall
pay, by way of civil penalty, an amount which shall not exceed one crore rupees for each
contravention, and in case of a continuing failure, additional penalty which may extend to
ten lakh rupees for every day. In addition, the Board, if it deems appropriate, may direct for
suspension or termination of operations of the said entity.
(d) If the entity fails to comply with the directions passed by the Board, as provided in clause
(c), the Board may take appropriate action as prescribed for offences and punishment under
Chapter IX of the Act.
Provided that, notwithstanding anything contained in clauses (a) to (d) of sub-regulation (3), in
cases
(i) where the violation on the part of the entity poses an imminent danger to public safety or
(ii) where the Board determines, in public interest or in the interest of State security, that it is so
required, the Board may, apart from requiring the entity to take immediate remedial action, also
direct for immediate suspension of operations of the said entity and in such cases, an opportunity
of being heard may be deferred and afforded subsequently to the entity by the Board.
Note 1: Planned projects shall include all greenfield projects and, in the case of brownfield
projects, shall encompass any addition to storage, handling, or processing capacity, increase in
manpower, or increase in risk level of any installation/facility.
