L.-33004/99 xxxGIDHxxx सी.जी.-डी.एलxx.x-GअI.D-E2x4x1x 12020-223291 CG-DL-E-24112020-223291 असाधारण EXTRAORDINARY भाग III—खण्ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 524] नई ददल्ली, मगं लिार, निम्बर 24, 2020/अग्रिायण 3, 1942 No. 524] NEW DELHI, TUESDAY, NOVEMBER 24, 2020/AGRAHAYANA 3, 1942 परे ोजलयम और प्राकृजतक गसै जिजनयामक बोड ड अजधसचू ना नई ददल्ली, 23 निम् बर, 2020 फा.स.ं पीएनजीआरबी/टेक/27-पीडीटी4एस/(1)/2020 (पी-1922).---पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड अजधजनयम, 2006 (2006 का 19) की धारा 61 द्वारा प्रदत्त िजियों का प्रयोग करते हुए पेरोजलयम और प्राकृजतक गैस जिजनयामक बोड ड एतदद्वृ ारा परे ोजलयम और प्राकृजतक गैस जिजनयामक बोड ड (सुरक्षा मानक सजित तकनीकी मानकऔर जिजिजियों के जिकास की प्रदिया) जिजनयम, 2009 म ेंआग े संिोधन करन े के जलए जनम्नजलजखत जिजनयम बनाता ि ैअथाडत:्- 1. लघ ुिीर्कड और प्रारंभ (1) इन जिजनयमों को पेरोजलयम और प्राकृजतक गसै जिजनयामक बोड ड (सुरक्षा मानक सजित तकनीकी मानक और जिजिजियों के जिकास करन े की प्रदिया) सिं ोधन जिजनयम, 2020 किा जाएगा। (2) ये सरकारी राजपत्र म ेंअपन ेप्रकािन की तारीख से लाग ूिोंगे। 2. पेरोजलयम और प्राकृजतक गैस जिजनयामक बोड ड (सुरक्षा मानक सजित तकनीकी मानक और जिजिजियों के जिकास करन े की प्रदिया) जिजनयम, 2009 के जिजनयम 6 के जलए जनम्नजलजखत जिजनयमन प्रजतस्ट्थाजपत दकया जाएगा, अथाडत:् - "6. मानक बनान ेकी प्रदिया (1) कोई भी इच्छुक पाटी मानक तैयार करन े या पेरोजलयम, परे ोजलयम उत्पादों और प्राकृजतक गैसों स े संबंजधत गजतजिजधयों म ें मौजूदा मानक को बनाने या अद्यतन या संिोजधत या रद्द करन े के जलए जजसम ें डाउनस्ट् रीम पेरोजलयम और प्राकृजतक गैस क्षत्रे स े संबंजधत पाइपलाइन और बुजनयादी ढांचा पररयोजनाओं 5716 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] का जनमाडण और संचालन िाजमल ि ै जजस े पेरोजलयम और प्राकृजतक गैस जिजनयामक बोड ड (िल्ु क एि ं अन्य प्रभारउगािी) जिजनयम, 2007 के तित जनर्ददि एक आिदे न िुल्क के साथ अनुबंध-II के रूप म ें बोड ड को एक प्रस्ट्ताि प्रस्ट्ततु कर सकते ि ैं। (2) उप-जिजनयम (1) में दकसी बात के िोत े हुए भी, बोडड स्ट् ित: दकसी स्ट्थाजपत मानक को बनाने, अद्यतन, संिोधन या रद्द करन े का जनणयड ल े सकता ि,ै तादक दकसी भी जिजिि जिर्य पर नए मानकों को बनान े और उसम ें आिोधन तथा मौजदू ा मानकों के संिोधन का काय ड बोड ड द्वारा या तकनीकी सजमजत द्वारा िी दकया जाएगा। (3) यदद बोड ड दकसी भी मौजूदा मानकों की जांच करने पर इस बात से संतुष्ट िो दक ऐसमे ानकों को अंतरराष्ट्रीय सिोत्तम प्रथाओं का पालन करते हुए दकसी एसडीओ द्वारा जिकजसत दकया गया ि ै और ऐस े एसडीओ को पयाडप्त संख्या म ें मानकों का जिकास करन े का श्रेय ददया गया ि,ै तो बोड ड ऐसे मानकों का संदभड द ेसकता ि ैया उन् ि ेंअपना सकता ि।ै (4) जिचार-जिमिड के बाद, तकनीकी सजमजत एक मसौदा मानक या संिोधन तैयार करेगी और उसे बोड ड को प्रस्ट्ततु करेगी तथा बोड ड मसौदा मानक या संिोधन पर संिोधन सजित या जबना संिोधन के जिचार और अनुमोदन करेगा और उस े सािडजजनक परामि ड के जलए अपनी िेबसाइट पर कम से कम इक्कीस ददनों के जलए अपलोड करेगा। (5) बोडड सािडजजनक परामि ड के दौरान प्राप्त रटप्पजणयों को तकनीकी उप-सजमजत को बोड ड को प्राप्त रटप्पजणयों पर उनके जिचार प्रस्ट्ततु करन ेके जलए अग्रेजर्त कर सकता ि।ै (6) मसौदा मानक और सािडजजनक परामि ड के दौरान प्राप्त रटप्पजणयों और तकनीकी सजमजत के जिचारों, यदद उस पर लाग ूिों, को बोड डकी िबे साइट पर सािडजजनक परामि ड के दौरान प्राप्त रटप्प जणयों पर चचाड करन े के जलए ओपन िाउस आयोजजत करने स े पिल े बोड ड द्वारा जनधाडररत अिजध के जलए प्रकाजित दकया जाएगा। (7) बोडड ओपन िाउस की रटप्पजणयों या जिचारों को मानन े के बाद मानक को अपना सकता ि।ै िैकजल्पक रूप स,े बोडड इसे अपनान े से पिल े प्राप्त रटप्पजणयों पर तकनीकी सजमजत का मत प्राप्त कर सकता ि।ै (8) यदद अंजतम रूप ददए गए मानक के जलए सिायता की आिश्यकता िो या दकसी अन्य मानक पर पाठ को पुन: प्रस्ट्ततु करता ि,ै जजसका बौजिक सपं दा अजधकार दकसी अन्य व्यजि के पास ि,ै तो मानक तैयार करन े के जलए ऐस े व्यजि की सिमजत लेन े की जजम्मेदारी तकनीकी सजमजत या एसडीओ, यदद कोई िो, की िोगी। (9) तकनीकी सजमजत, सिडसम्मजत से मसौद े को अंजतम रूप देगी और यदद आम सिमजत निीं बनती िै, तो मानक को मतदान द्वारा दो-जतिाई सदस्ट्यों के बहुमत स े अंजतम रूप ददया जाएगा और मानक को अपनात े समय आम सिमजत न बनन े के जिस्ट्ततृ कारण, यदद कोई िों, को बोड डको सूजचत दकया जाएगा। (10) बोडड द्वारा आिश्यक समझे गए सभी मानकों की कम स े कम पांच िर्ों म ें एक बार समय-समय पर समीक्षा की जाएगी और उस े संिोजधत, पुन: पुजि या िापस जलया जाएगा। (11) प्रकाजित मानकों को संिोजधत या आिोजधत करन े के प्रस्ट्तािों पर संबंजधत तकनीकी सजमजत द्वारा नए मानकों के जिकास के प्रस्ट् तािों की िी तरि जिचार दकया जाएगा, जजसका अंजतम जनणडय बोड ड के पास िोगा।" िन्दना िमा,ड सजचि [जिज्ञापन-III/4/असा./383/2020] पाद रटप्प णी : मूल जनयमों को ददनांक 14/05/2009 के जीएसआर 323(अ.) द्वारा अजधसूजचत दकया गया था और तत्पश्चात ् ददनांक 01/01/2015 की फा.स.ं एल-जिजिध/VI/I/ 2007 द्वारा संिोजधत दकया गया था।[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 PETROLEUM AND NATURAL GAS REGULATORY BOARD NOTIFICATION New Delhi, the 23rd November, 2020 F. No. PNGRB/Tech/27-PDT4S/(1)/2020 (P-1922). −In exercise of the powers conferred by section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations further to amend the Petroleum and Natural Gas Regulatory Board (Procedure for development of Technical Standards and Specifications including Safety Standards) Regulations, 2009, namely: - 1. Short title and commencement. (1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Procedure for development of Technical Standards and Specifications including Safety Standards) Amendment Regulations, 2020. (2) They shall come into force on the date of their publication in the Official Gazette. 2. For the regulation 6 of the Petroleum and Natural Gas Regulatory Board (Procedure for development of Technical Standards and Specifications including Safety Standards) Regulations, 2009, the following regulation shall be substituted, namely: - ―6. Procedure for formulation of standards. (1) Any interested party may submit a proposal to the Board for formulation of a standard or updating or amending or cancelling an existing standard in activities relating to petroleum, petroleum products and natural gas including the construction and operation of pipeline and infrastructure projects related to downstream petroleum and natural gas sector in the form of Annexure – II alongwith an application fee as specified under the Petroleum and Natural Gas Regulatory Board (Levy of Fees and Other Charges) Regulations, 2007. (2) Notwithstanding anything in sub-regulation (1), the Board on its own may also decide to develop, update, amend or cancel an established standard so that the work of formulation of new standards and modification and revision of existing standards on any specific subject shall be undertaken by the Board itself or through technical committee. (3) If the Board on examining any existing standards is satisfied that such standards have been developed by an SDO following the international best practices and such SDO has been credited for development of substantial number of standards, the Board may refer or adopt such standards. (4) After deliberations, technical committee shall prepare a draft standard or amendment and shall submit the same to the Board and the Board shall consider and approve the draft standard or amendment with or without modification and put it on its website for public consultation for a minimum period of twenty one days. (5) The Board may forward the comments received during public consultation to the technical subcommittee to submit its views on the comments received to the Board. (6) The draft standard and the comments received during public consultation and views of the technical committee, if applicable on same shall be published on the website of the Board for a period as decided by Board before conducting Open House for discussions on the comments received during public consultation. (7) The Board may adopt the standard after considering the comments or views of the Open House. Alternatively, the Board may seek views of technical committee on the comments received, before its adoption. (8) In case the finalized standard draws assistance or reproduces text form any other standard where some other person has intellectual property right, the responsibility for seeking concurrence of such person shall lie with the technical committee or SDO, if any, preparing the draft standard.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (9) Technical committee shall finalize the draft by consensus in the committee and if consensus is not reached, the standard shall be finalized by voting and acceptance by two- third majority of members and the detailed reasons for lack of consensus, if any, shall be conveyed to the Board for its consideration while adopting the standard. (10) All standards so developed shall be reviewed periodically at least once in five years, and revised, reaffirmed or withdrawn, as considered necessary by the Board. (11) Proposals for revising or amending published standards shall be considered by the technical committee concerned in a manner similar to proposals for development of new standards with the final decision resting with the Board.‖.
