L.-33004/99 सी.जी.-डी.एल.-अ.-01102020-222189 xxxGIDHxxx CG-DL-E-01102020-222189 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 403] नई ददल्ली, बुधिार, जसतम्ब र 30, 2020/ आज‍ि न 8, 1942 No. 403] NEW DELHI, WEDNESDAY, SEPTEMBER 30, 2020/ ASVINA 8, 1942 परे ोजलयम और प्राकृजतक गसै जिजनयामक बोडड अजधसचू ना नई ददल्ली, 30 जसतम्ब र, 2020 फा.स.ं पीएनजीआरबी/प्राजधकरण/1-सीजीडी(07)/2020(पी-884).—प्राकृजतक गैस जिजनयामक बोडड अजधजनयम, 2006 (2006 का 19) की धारा 61 द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड एतद्द्वारा पेरोजलयम और प्राकृजतक गैस जिजनयामक बोड ड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड जबछाने, जनमाडण, प्रचालन या जिस्ट्तार के जलए सस्ट्ं थाओं को प्राजधकार प्रदान करना) जिजनयम, 2008 में संिोधन करने के जलए जनम्नजलजखत जिजनयम बनाता ह,ै अथाडत:् - 1. लघ ुिीर्कड और प्रारंभ (1) इन जिजनयमों को पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड जबछाने, जनमाडण, प्रचालन या जिस्ट्तार के जलए संस्ट् थाओं को प्राजधकार प्रदान करना) संिोधन जिजनयम, 2020 कहा जाएगा। (2) य े सरकारी राजपत्र में उनके प्रकािन की तारीख स ेलागू होंगे। (3) िे बोली या प्राजधकार िर् ड के बािजूद सभी अजधकृत संस्ट्थाओं पर लाग ूहोंगे। 4650 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 2. पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड जबछाने, जनमाडण, प्रचालन या जिस्ट्तार के जलए संस्ट् थाओं को प्राजधकार प्रदान करना) जिजनयम, 2008 के जिजनयम 14 म,ें उप जिजनयम (1) को जनम्नजलजखत के साथ प्रजतस्ट्थाजपत दकया जाएगा:- "(1) “संस्ट् था घरेलू पीएनजी ग्राहक से नीचे उजल्लजखत उपकरणों और सुजिधाओं की सुरक्षा के जलए ब्याज मुि प्रजतदेय सुरक्षा जमा राजि ले सकती ह,ै जजसमें अंजतम मील कनेजटटजिटी, अथाडत् मीटररग यूजनट से पहले राइजर आइसोलेिन िाल्ि और ग्राहक के पररसर म ें बनरड को जोड़न े िाली सुरक्षा होज पाइप के बीच स्ट्थापना की श्रम लागत भी िाजमल ह,ै जजसकी राजि एक कनेटिन के जलए "छह हजार रुपए" से अजधक नहीं होगी, अथातड ्:- (क) मीटररग यूजनट से पहले राइजर आइसोलिे न िाल्ि; (ख) मीटररग यूजनट तक दस मीटर पाइप; (ग) मीटररग यूजनट; (घ) मीटररग यूजनट से अजतररि प्रिाह चेक िाल्ि-सह-आइसोलेिन िाल्ि तक पांच मीटर पाइप या ट्यूब; (ड.) अजतररि प्रिाह जााँच िाल्ि-सह-आइसोलिे न िाल्ि; और (च) घरेलू पीएनजी बनडर को जोड़न ेिाले मानक आकार के सुरक्षा होज पाइप बिते दक संस्ट्थ ा द्वारा नेटिकड टैररफ बोली म ें अंजतम मील कनेजटटजिटी का प्रभार िाजमल हो। बिते आगे यह दक इस उप-जिजनयम म ें जनर्ददष्ट "छह हजार रुपए" की राजि को संस्ट्थ ा द्वारा घरेल ू पीएनजी ग्राहक के पररसर में स्ट्माट डमीटर लगाने की जस्ट्थजत म ें"नौ हजार रुपए" की राजि स े प्रजतस्ट्थाजपत माना जाएगा। बिते यह भी दक यह घरेलू पीएनजी ग्राहक का जिकल्प होगा दक िह स्ट्माटड मीटर या सामान्य मीटर को तरजीह देगा और संस्ट्थ ा उसे स्ट्माटड मीटर का जिकल्प चुनने के जलए बाध्य नहीं करेगी या घरेल ू पीएनजी कनेटिन प्रदान करने के जलए इस कारण से रोक नहीं लगाएगी दक ग्राहक न े स्ट्माटड मीटर का जिकल्प नहीं चुना ह।ै बिते यह भी दक दकसी मौजूदा घरेल ू पीएनजी ग्राहक के पास यह जिकल् प होगा दक िह ितमड ान सामान्य मीटर को संस्ट् था को तीन हजार रुपए का भुगतान करके स्ट्माटड मीटर से बदल सकता ह।ै स्ट्पष्टीकरण - 1. घरेलू पीएनजी ग्राहक पाइप के जलए सामग्री और श्रम िल्ु क की िास्ट्तजिक लागत और ऊपर जनर्ददष्ट लंबाई से अजधक ट्यूबबग का खचड िहन करेगा। 2. घरेलू पीएनजी ग्राहक एक ही पररसर म ें एक अन्य घरेल ू पीएनजी बनडर या दकसी अन्य गसै -आधाररत उपकरण को जोड़ने के जलए आम मीटररग यूजनट से श्रम प्रभार सजहत स्ट्थापना की िास्ट्तजिक लागत का भुगतान करेगा। 3. इस जिजनयमन के प्रयोजन के जलए उस मीटर को स्ट्माट ड मीटर माना जाएगा, यदद इसम ें (i) संस्ट् था और ग्राहक के बीच दो-तरफा संचार म ें मीटर रीबडग और नदै ाजनक डेटा को संस्ट् था म ें भेजन े की कोई अंतर्ननजहत सुजिधा ह;ै (ii) ग्राहक को जिजभन्न भुगतान जिकल्पों के माध्यम से मीटर ररचाजड करने के जलए प्री-पेड चार्जजग सुजिधा ह;ै और (iii) यदद संतुलन न्यूनतम या उपयुडट त क्रेजडट सीमा स े नीच े चला जाता ह ै तो इसमें लगा अंतर्ननजहत िट- ऑफ-िाल्ि गैस की आपूर्नत को रोक देता ह।ै िन्दना िमाड, सजचि [जिज्ञापन-III/4/असा./264/2020-21][भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 फुट नोट: मूल जिजनयमों को जी.एस.आर. 196(अ.) ददनांक 19 माच,ड 2008 को सरकारी राजपत्र म ें प्रकाजित दकया गया था और बाद में जी.एस.आर. 800 (अ.) ददनांक 19 निंबर, 2008, जी.एस.आर. 295 (अ.) ददनांक 30 अप्रैल, 2009, जी.एस.आर. 478 (अ.) ददनांक 7 जून, 2010, जी.एस.आर. 605 (अ.) ददनांक 19 जुलाई, 2010, फा.सं. पीएनजीआरबी/सीजीडी/जिजनयम/ पनु रीक्षण-2011/2012-III ददनांक 21 जून, 2013, फा.सं.पीएनजीआरबी/सीजीडी/बोली/4/2013-बोली-पूिड ददनाकं 7 अप्रलै , 2014, फा.सं. एल एमआईएससी/ VI/I/2007 ददनांक 1 जनिरी, 2015, फा.सं. पीएनजीआरबी/सीजीडी/जिजनयम/संिोधन/ 2015 ददनांक 13 फरिरी 2015,पीएनजीआरबी/सीजीडी/संिोधन/2015/2 ददनांक 11 ददसंबर 2015, फा.सं. पीएनजीआरबी/ सीजीडी/संिोधन/ 2015/2/एससी ददनांक 26 अप्रलै 2016, फा.सं. पीएनजीआरबी/ प्राजधकार/ सीजीडी/ एएमडी/2018 ददनांक 6 अप्रलै 2018, फा.सं. पीएनजीआरबी/ प्राजधकार/ सीजीडी/संिोधन/2018/2 ददनांक 27 अप्रलै 2018, फा.सं. पीएनजीआरबी/ प्राजधकार/ सीजीडी/संिोधन/ 2018/3 ददनांक 6 निंबर 2018, और फा.सं. पीएनजीआरबी/ प्राजधकार/ सीजीडी/संिोधन/2018/4 ददनांक 21 निंबर 2018। द्वारा संिोजधत दकया गया था। PETROLEUM AND NATURAL GAS REGULATORY BOARD NOTIFICATION New Delhi, the 30th September, 2020 F. No. PNGRB/Auth/1-CGD(07)/2020 (P-884) .— In exercise of the powers conferred by Section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations to amend the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand City or Local Natural Gas Distribution Networks) Regulations, 2008, namely: - 1. Short title and commencement. (1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand City or Local Natural Gas Distribution Networks) Amendment Regulations, 2020. (2) They shall come into force on the date of their publication in the official Gazette. (3) They shall be applicable to all authorized entities irrespective of the year of bidding or authorization. 2. In the Petroleum and Natural Gas Regulatory Board (Authorising Entities to Lay, Build, Operate or Expand City or Local Natural Gas Distribution Networks) Regulations, 2008 in regulation 14, for sub regulation (1), and the Explanation thereto, the following shall be substituted, namely: - “(1) The entity may take an interest-free refundable security deposit from domestic PNG Customer towards security of the equipments and facilities mentioned below, including the labour cost of installation towards last mile connectivity, that is, between the riser isolation valve before the metering unit and the suraksha hose pipe connecting the burner in the customer's premises for an amount not exceeding “rupees six thousand” for a single connection, namely:- (a) riser isolation valve before the metering unit; (b) ten meters of pipe up to the metering unit; (c) metering unit; (d) five meters of pipe or tube from the metering unit up to the excess flow check valve-cum-isolation valve; (e) excess flow check valve-cum-isolation valve; and (f) suraksha hose pipe of standard size connecting the domestic PNG burner Provided that the network tariff bid by the entity shall include the charges towards the last mile connectivity: Provided further that the amount of “rupees six thousand” referred to in this sub-regulation shall be4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] deemed to have been substituted by the amount of “rupees nine thousand” in case the entity installs a smart meter at the premises of the domestic PNG Customer: Provided also that it shall be the option of the domestic PNG customer to choose either the smart meter or the normal meter and the entity shall not force him to opt for the smart meter or to withhold providing the domestic PNG connection for the reason that the customer has not opted for the smart meter: Provided also that an existing domestic PNG customer shall have the option to seek replacement of existing normal meter by a smart meter on payment of rupees three thousand to the entity. Explanation.- 1. The domestic PNG customer shall bear the actual cost of the material and labour charges for pipe and the tubing in excess of the length specified above. 2. The domestic PNG customer shall pay the actual cost of installation including labour charges from the common metering unit onwards for connecting another domestic PNG burner or any other gas-based appliance in the same premises. 3. A meter shall be considered to be a smart meter for the purpose of this regulation if it has - (i) an in-built feature of sending the meter reading and diagnostic data to the entity in a two- way communication between the entity and the customer; (ii) a pre-paid charging facility enabling the customer to recharge the meter through various payment options; and (iii) an inbuild shut-off valve which stops gas supply once the balance goes below the set minimum or above the maximum credit limit.
