और प्राकृजतक गैस जवजियामक बोडड एतद्द्वारा पेरोजलयम और प्राकृजतक गैस जवजियामक बोडड (पेरोजलयम और पेरोजलयम
उत्पाि पाइपलाइिों के जलए सुरक्षा मािक सजित तकिीकी मािक और जवजिजियां) जवजियम, 2016 को और संिोजधत
करिे के जलए जिम्नजलजखत जवजियम बिाता ि,ै अर्ाडत:् —
1. लघ ुिीर्कड और प्रारंभण:
(1) इि जवजियमों को पेरोजलयम और प्राकृजतक गैस जवजियामक बोडड (पेरोजलयम और पेरोजलयम उत्पाि पाइपलाइिों
के जलए सरु क्षा मािक सजित तकिीकी मािक और जवजिजियां) संिोधि जवजियम, 2025 किा िाएगा।
(2) ये सरकारी रािपत्र में इिके प्रकािि की तारीख स ेलागू िोंगे।
1. पेरोजलयम और प्राकृजतक गैस जवजियामक बोडड (पेरोजलयम और पेरोजलयम उत्पाि पाइपलाइिों के जलए सरु क्षा मािक
सजित तकिीकी मािक और जवजिजियां) जवजियम, 2016 म,ें -
(a) मौिूिा जवजियम 8 को जिम्नािसु ार प्रजतस्ट्र्ाजपत दकया िाएगा:
“

(1) इि जवजियमों के प्रावधािों का अिुपालि सुजिजित करिे के जलए एक स्ट्र्ाजपत व्यापक प्रणाली िोगी,
जिसमें रूपरेखा, पूवड-जिमाडण, जिमाडण, िुरुआत और संचालि के चरणों के िौराि तकिीकी और सुरक्षा
ऑजडट का संचालि िाजमल िोगा सार् िी सार् समय-समय पर जिर्िडि सतत आधार पर भी िोगा। दकसी
भी जियोजित पररयोििा का जववरण जवस्ट्तृत व्यविायडता ररपोटड (डीएफआर), लआे उट, पीईएसओ
अिुमोिि और पयाडवरणीय मिं ूरी आदि सजित, िो भी लागू िो, जिमाणड िुरू करि े से कम से कम एक
मिीिे पूवड बोड ड के समक्ष प्रस्ट्ततु दकया िाएगा।
(2) ‘बोडड’ सुरक्षा मािक सजित तकिीकी मािकों और जवजििेिों के अिुपालि की जिगरािी प्रत्यक्ष या दकसी
मान्यता प्राप्त तीसरे पक्ष के माध्यम स े तीसरे पक्ष के अिुरूपता मूल्यांकि पर अलग जवजियमों के माध्यम स े
करेगा।
(3) इि जवजियमों के अंतगडत दकसी चूक या जवचलि या कमी की जस्ट्र्जत में, प्राजधकृत इकाई परे ोजलयम और
प्राकृजतक गैस जवजियामक बोडड (पेरोजलयम और पेरोजलयम उत्पाि पाइपलाइिों को जबछािे, जिमाडण,
संचालि या जवस्ट्तार करिे के जलए इकाइयों को प्राजधकृत करिा), जवजियम, 2010 के जवजियम 16 के
अंतगतड अजधकृत इकाई चूककताड ईकाई के रूप म ेंअितड ा प्राप्त करेगी।
(4) इि जवजियमों के प्रयोिि के जलए, िब तक बोडड द्वारा प्राजधकरण प्रिाि ििीं दकया िाता ि ै या समर्पतड
पाइपलाइि के जलए, दकसी भी चूक या जवचलि या कमी की जस्ट्र्जत में, इकाई पीएििीआरबी अजधजियम,
2006 की धारा 28 के अिुसार िागररक िडं लगािे और/या जिम्नजलजखत प्रदिया के अिुसार संचालि के
जिलंबि/समाजप्त का सामिा करिे के जलए उत्तरिायी िोगी:
(क) बोडड इकाई को एक अजधसूचिा िारी करेगा, जिसमें उसे जवजियमों के तित अपिे िाजयत्वों को पूरा
करिे के जलए एक उजचत समय अवजध िी िाएगी;
(ख) यदि बोड ड द्वारा जिर्िडि समयावजध के भीतर बोड ड की संतजु ि के जलए इकाई द्वारा सधु ारात्मक कारडवाई
की िाती ि ैतो कोई िंडात्मक कारडवाई ििीं की िाएगी;
(ग) यदि इकाई ऐसी समयावजध के भीतर सुधारात्मक कारडवाई करि े म ें जवफल रिती िै, तो बोड ड ऐसी
इकाई को सुिवाई का अवसर िेिे के बाि जलजखत आििे द्वारा जििेि ि े सकता ि ै दक इकाई पर लगि े
वाले दकसी अन्य िडं पर प्रजतकूल प्रभाव डाले जबिा, ऐसी इकाई को जसजवल िंड के रूप म ें ऐसी राजि
का भुगताि करिा िोगा, िो प्रत्येक उल्लंघि के जलए एक करोड़ रुपय े से अजधक ििीं िोगी तर्ा
लगातार जवफलता की जस्ट्र्जत में, अजतररि िडं िो प्रजतदिि िस लाख रुपये तक िो सकता ि।ै इसके
अजतररि, यदि बोड ड उजचत समझे, तो उि इकाई के संचालि को जिलंजबत या समाप्त करिे का जििेि
िे सकता ि।ै
(घ) यदि इकाई खंड (ग) म ें दिए गए अिुसार बोडड द्वारा पाररत जििेिों का पालि करि े में जवफल रिती िै,
तो बोडड अजधजियम के अध्याय IX के अंतगडत अपराधों और िडं के जलए जिधाडररत उजचत कारडवाई कर
सकता ि।ै
(5) उप-जवजियम (3) या उप-जवजियम (4) में जिजित प्रदिया के बाविूि, ऐसे मामलों में:
(i) जिसम े इकाई की ओर से उल्लंघि सावडिजिक सुरक्षा के जलए आसन्न िोजखम उत्पन्न करता ि ैया
(ii) जिसमे बोडड सावडिजिक जित में या राज्य सुरक्षा के जित में यि जिधाडररत करता ि ैदक ऐसा करिा आवश्यक िै,
‘बोडड’ इकाई को तत्काल उपचारात्मक कारडवाई करि े की आवश्यकता के अलावा, उि इकाई के पररचालि को तत्काल
जिलंजबत करि े का जििेि भी ि े सकता ि ै तर्ा ऐसे मामलों म,ें बोडड द्वारा इकाई की सुिवाई का अवसर स्ट्र्जगत दकया िा
सकता ि ैऔर बाि म ेंप्रिाि दकया िा सकता ि।ै
ध्याि ि ें 1: जियोजित पररयोििाओं म ें सभी ग्रीिफील्ड पररयोििाएं िाजमल िोंगी और ब्राउिफील्ड पररयोििाओं के
मामले म,ें भंडारण, िडैं ललगं या प्रसंस्ट्करण क्षमता म ें कोई वृजि, िििजि म ें वृजि या दकसी भी स्ट्र्ापिा/सुजवधा के िोजखम
स्ट्तर में वृजि िाजमल िोगी।

NOTIFICATION
New Delhi, the 23rd July, 2025
F. No. PNGRB/Tech/18-penalty-T4SReg./(9)/2024/(E-5488)/10.—In exercise of the powers conferred by
section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas
Regulatory Board hereby makes the following Regulations further to amend the Petroleum and Natural Gas
Regulatory Board (Technical Standards and Specifications including Safety Standards for Petroleum and Petroleum
Products Pipelines) Regulations, 2016, namely:—
1. Short title and commencement:
(1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Technical Standards and
Specifications including Safety Standards for Petroleum and Petroleum Products Pipelines) Amendment
Regulations, 2025.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Petroleum and Natural Gas Regulatory Board (Technical Standards and Specifications including Safety
Standards for Petroleum and Petroleum Products Pipelines) Regulations, 2016, -
(a) existing Regulation 8, shall be substituted as under:
“
(1) There shall be an established comprehensive system to ensure compliance with the provisions of these
regulations, encompassing the conduct of technical and safety audits throughout the stages of design,
pre-construction, construction, commissioning, and operation, and also on an ongoing basis, as
periodically specified. Details of any planned project along with Detailed Feasibility Report (DFR),
layout, PESO approval and Environmental Clearance etc. as may be applicable, shall be submitted to
Board at least one month prior to commencing the construction.
(2) The Board shall monitor the compliance with Technical Standards and Specifications, including Safety
Standards, either directly or through an accredited third party via separate regulations on third-party
conformity assessment.
(3) In the event of any default or deviation or shortfall under these Regulations, the authorized entity shall
qualify as defaulting entity under the regulation 16 of Petroleum and Natural Gas Regulatory Board
(Authorizing Entities to Lay, Build, Operate or Expand Petroleum and Petroleum Products Pipelines),
Regulations, 2010.
(4) For the purpose of these Regulations, until authorization is granted by the Board or for dedicated
pipeline, in event of any default or deviation or shortfall, the entity shall be liable to face the imposition
of civil penalty as per Section 28 of the PNGRB Act, 2006 and/or suspension/termination of operation,
as per following procedure:
(a) The Board shall issue a notice to the entity, allowing it a reasonable time period to fulfil its
obligations under the regulations;
(b) No punitive action shall be taken in case remedial action is taken by the entity, to the satisfaction of
the Board, within the time period specified by the Board;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
(c) In case the entity fails to undertake remedial action within such time period, the Board may, after
giving such entity an opportunity of being heard, by order in writing, direct that, without prejudice to
any other penalty which the entity may be liable for, such entity shall pay, by way of civil penalty, an
amount which shall not exceed one crore rupees for each contravention, and in case of a continuing
failure, additional penalty which may extend to ten lakh rupees for every day. In addition, the Board,
if it deems appropriate, may direct for suspension or termination of operations of the said entity.
(d) If the entity fails to comply with the directions passed by the Board, as provided in clause (c), the
Board may take appropriate action as prescribed for offences and punishment under Chapter IX of
the Act.
(5) Notwithstanding the procedure contained in sub-regulation (3) or sub-regulation (4), in cases:
(i) where the violation on the part of the entity poses an imminent danger to public safety or
(ii) where the Board determines, in public interest or in the interest of State security, that it is so required,
the Board may, apart from requiring the entity to take immediate remedial action, also direct for immediate
suspension of operations of the said entity and in such cases, an opportunity of being heard may be deferred
and afforded subsequently to the entity by the Board.
Note 1: Planned projects shall include all greenfield projects and, in the case of brownfield projects, shall
encompass any addition to storage, handling, or processing capacity, increase in manpower, or increase in
risk level of any installation/facility.
