L.-33004/99 xxxGIDHxxx सी.जी.-डी.एल.-अ.-19092020-221842 xxxGIDExxx CG-DL-E-19092020-221842 ऄसाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 370] नइ ददल्ली, िुििार, जसतम्ब र 18, 2020/भाद्र 27, 1942 No. 370] NEW DELHI, FRIDAY, SEPTEMBER 18, 2020/BHADRA 27, 1942 परे ोजलयम और प्राकृजतक गसै जिजनयामक बोडड ऄजधसचू ना नइ ददल्ली, 17 जसतंबर 2020 फा.स.ं पीएनजीअरबी/तकनीकी/19इअरडीएमपी/(1)/2020.—पेरोजलयम और प्राकृजतक गसै जिजनयामक बोड ड ऄजधजनयम, 2006 (2006 का 19) की धारा 61 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड एतद्द्वारा पेरोजलयम और प्राकृजतक गैस जिजनयामक बोड ड (अपात प्रजतदिया और अपदा प्रबंधन योजना (इअरडीएमपी) की अचरण पद्धजत) जिजनयम, 2010 में अग े संिोधन करने के जलए जनम्नजलजखत जिजनयम बनाता है, नामतः :- 1. लघ ुिीर्कड और प्रारंभण (1) आन जिजनयमों को पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (अपात प्रजतदिया और अपदा प्रबंधन योजना (इअरडीएमपी) की अचरण पद्धजत) संिोधन जिजनयम, 2020 कहा जाएगा:- (2) य ेिासकीय राजपत्र में आनके प्रकािन की तारीख से लाग ूहोंगे। 2. पेरोजलयम और प्राकृजतक गैस जिजनयामक बोड ड (अपात प्रजतदिया और अपदा प्रबंधन योजना (इअरडीएमपी) की अचरण पद्धजत) जिजनयम, 2010 में: (1) जिजनयम 2 म,ें i. खडं (च) के जलए, जनम्नजलजखत प्रजतस्ट्थाजपत होगा, नामतः: - “अपदा" का ऄथ ड दकसी भी क्षत्रे म ें होन े िाल े जिनाि, दघु डटना, अपदा या गंभीर घटना ह,ै जो प्राकृजतक या मानि जनर्ममत कारणों से ईत्पन्न होती ह,ै या दघु डटना या लापरिाही से होती ह,ै जजसके पररणामस्ट्िरूप जीिन की पयाडप्त 4345 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] हाजन होती ह ै या मानि पीडा या क्षजत, और संपजत्त का जिनाि, या क्षजत, या पयाडिरण का क्षरण, या ऐसी प्रकृजत या पररमाण की, जो प्रभाजित क्षेत्र के समुदाय की क्षमता से परे हो।”; ii. खंड (ठ) के जलए जनम्नजलजखत प्रजतस्ट्थाजपत होगा, नामतः: - “घटना ररकॉर्डडग प्रणाली" का ऄथ ड एक ऐसी प्रणाली से ह ैजजसम ें बाल बाल बचने िाली घटना सजहत समस्ट्त घटनाओं से संबंजधत संपूण ड जानकारी होती ह।ै "; iii. खंड (ढ) जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत होगा, नामतः: -“ररसाि" का ऄथड ह ै दकसी खतरनाक रसायन (रसायनों) या पदाथों या सामग्री को दकसी भी ऄिस्ट्था में पयाडिरण म ेंछोडना।"; iv. खंड (द) म ें “सघं ” िब्द “समूह” िब्द द्वारा प्रजतस्ट्थाजपत होगा और “संघ” िब्द “ऄनबु ंध” िब्द द्वारा प्रजतस्ट्थाजपत होगा। v. “”खंड (न) म ें“स्ट्थापना म”ें िब्दों के पश्चात “ऄथिा स्ट्थल” िब्द सजम्मजलत होंगे। vi. खंड (फ) में “स्ट्थापना म ें हुइ” िब्दों के पश्चात, “ऄथिा स्ट्थल” िब्द सजम्मजलत होंगे। vii. खंड (ब) म ें “स्ट्थापनाओं के ऄंदर” िब्दों के पश्चात और “स्ट्थापना पररसरो” िब्दों के पश्चात “ऄथिा स्ट्थलों” िब्द सजम्मजलत होंगे। viii. खंड (य) में “मात्रात्मक” िब्द का लोप हो जाएगा। ix. खडं (र) म ें ”अपातकाल के जोजखम” िब्दों के जलए “ऄिांजछत घटना के जोजखम को जनयंत्रण में रखना ऄथिा” िब्दों प्रजतस्ट्थाजपत होंगे। x. खंड (ि) म ें “खतरनाक” िब्द “संकटमय” िब्द द्वारा प्रजतस्ट्थाजपत होगा। xi. खंड (ि) में “दरू भार् संख्या” िब्दों से पूिड “अपातकालीन” िब्द सजम्मजलत होगा। xii. खंड (र्) के पश्चात जनम्नजलजखत खंड सजम्मजलत होगा, नामतः: “(स) “पररयोजना प्रभारी” का ऄथड ह ै एक व्यजि जजसका पररयोजना के मामलों पर ऄंजतम जनयंत्रण होता ह ैऔर कंपनी द्वारा जिजधित ऄजधकृत ह।ै ” (2) जिजनयम 3 म,ें i. खंड (ग) के जलए जनम्नजलजखत प्रजतस्ट्थाजपत होगा, नामतः: - "परे ोजलयम और पेरोजलयम ईत्पाद पाआपलाआन;" ii. खंड (घ) के जलए जनम्नजलजखत प्रजतस्ट्थाजपत होगा, नामतः: - "पीओएल जडपो, प्रजतष्ठानों और टर्ममनलों सजहत पेरोजलयम भंडारण सुजिधाए;ं " iii. खंड (घ) के पश्चात जनम्नजलजखत खंड सजम्मजलत होगा, नामतः – “(घ क) एलएनजी टर्ममनलों सजहत प्राकृजतक गसै भंडारण की सुजिधाएं।” iv. खंड (छ) के जलए जनम्नजलजखत प्रजतस्ट्थाजपत होगा, नामतः :- "पेरोजलयम, ऑटो एलपीजी, एलएनजी, सीएनजी अदद जैसे का जितरण करन े िाले खुदरा जबिी केंद्र और ऄय य खुदरा जबिी केंद्रों " v. खंड (ज) में “पेरोजलयम ईत्पाद” िब्दों के पश्चात “एलएनजी, सीएनजी अदद” िब्द सजम्मजलत होंगे। (3) जिजनयम 4.0 म,ें (1) ईप-जिजनयम 4.1 म,ें i. खंड (i) के जलए, “अपात जस्ट्थजत”, िब्द "संभाजित अपातकालीन पररदश्ृ यों" िब्दों द्वारा प्रजतस्ट्थाजपत होंगे; ii. खंड (ii) के जलए, 'जोजखम या अपदा, िब्द "आसे एएलएअरपी स्ट्तर म ें लाकर लोगों, पररसंपजत्तयों और पयाडिरण पर प्रभाि" िब्दों द्वारा प्रजतस्ट्थाजपत होंगे; iii. खंड (iii) के जलए, 'जिकजसत की जाए'ं िब्द का लोप हो जाएगा और “योजनाए”ं िब्द स े पहल,े "अपातकालीन जस्ट्थजत की" िब्दों द्वारा प्रजतस्ट्थाजपत होंगे; iv. खंड (iv) के जलए, “(प्राथजमक, जद्वतीयक और ततृ ीयक)” िब्दों का लोप हो जाएगा; v. खंड (v) के जलए जनम्नजलजखत प्रजतस्ट्थाजपत होगा, नामतः: - “घटना/दघु डटना/अपदा के पश्चात ऄपनी मलू जस्ट्थजतयों को संभि सीमा तक बहाल करन े के ईद्देश्य स ेघटना या दघु डटना या अपदा का ईद्धार;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3 (2) ईप-जिजनयम 4.2 के जलए, i. “आनका ईद्देश्य जनम्नजलजखत जिजनयम लागू करना है” परै ाग्राफ (1) के रूप म ेंिमांदकत दकया जाएगा। ii. खंड (क) और (ख) जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत होगा, नामतः: - “(क) अपातकालीन जस्ट्थजत को यथािीघ्र कम करने के जलए कंपनी को सक्षम बनाने के जलए एक संजक्षप्त और सूचनापरक इअरडीएमपी जिकजसत करने के जलए; (ख) घटना की िृजद्ध को ऑन-साआट और ऑफ-साआट दोनों पर रोकन े के जलए- ; (ग) लोगों पर प्रभाि को य यूनतम करन े के जलए; (घ) संपजत्त, मिीनरी और पयाडिरण के नुकसान को कम करन े के जलए; (ड) दकसी अपातजस्ट्थजत के जलए त्िररत और िमबद्ध प्रजतदिया के जलए तत्परता की जस्ट्थजत जिकजसत करना और जोजखम के साथ ईच्चस्ट्तरीय तैयाररयों (ईपकरण, कार्ममक) की स्ट्थापना करना; (च) स्ट्पष्ट ईद्देश्यों और प्राजधकारों की लाआनों (घटना कमान प्रणाली, क्षत्रे पयडिेक्षण, एकीकृत कमान) के साथ एक घटना प्रबंधन ऄंग प्रदान करन े के जलए; (छ) एक व्यिजस्ट्थत और समय पर जनणडय लने े और प्रजतदिया प्रदिया (ऄजधसूचना, मानक संचालन प्रदिया) सुजनजश्चत करने के जलए; और (ज) ऄच्छे सािडजजनक संबंध बनाए रखन े के जलए;” iii. "रटप्पजणया”ाँ िीर्डक में परै ाग्राफ को िमांक (2) ददया जाएगा और पैराग्राफ (2) म े "होंग”े (shall) िब्द “होंगे” (will) िब्द द्वारा प्रजतस्ट्थाजपत होगा और “संसाधनो” िब्द के पश्चात “ऄजधमानतः” िब्द सजम्मजलत दकया जाएगा और तत्पश्चात जनम्नजलजखत सजम्मजलत होगा, नामतः: “बित े की िॉस कंरी पाआपलाआन नगर गैस जितरण नेटिकों, खुदरा जबिी केंद्रों और सडक पररिहन के मामले म ें इअरडीएमपी के सूत्रीकरण के संदभड में जनम्नजलजखत कायडप्रणाली को ऄपनाया जा सकता ह,ै नामतः:- क. कंपनी को िॉस कंरी पाआपलाआन का एक एकल इअरडीएमपी ऄजभलेख तैयार करे। तथाजप ऄजभलेख म ें स्ट्थान/स्ट्थापना जिजिष्ट जानकारी संबद्ध जिजनयम के ऄनुसार जिस्ट्तृत होगी। कंपनी िैकजल्पक रूप से इअरडीएमपी ऄजभलेख को स्ट्थापना/स्ट्थानिार भी बना सकती ह।ै ख. नगर गैस जितरण कंपनी ऄपने भौगोजलक क्षेत्र के जलए एक एकल इअरडीएमपी ऄजभलेख तैयार कर सकती ह।ै हालााँदक, सीएनजी स्ट्टेिनों, घरेल,ू िाजणजययक और औद्योजगक अपूर्मत के संदभड में जिजिष्ट सूचना और िमन ईपायों के जििरण संबद्ध जिजनयम के ऄनुसार ऄजभलेख म ेंददए जाएंगे। ग. खुदरा जबिी केंद्रों की स्ट्िामी कंपजनयााँ ऄपने खुदरा जबिी केंद्रों के जलए जिजभन्न प्रारूपों (यथा एलपीजी के साथ खुदरा जबिी केंद्र, एलपीजी के जबना खुदरा जबिी केंद्र, नगरों में खुदरा जबिी केंद्र, राजमागों पर खुदरा जबिी केंद्र या दो या ऄजधक अदद का संयोजन या समान प्रकार के ऄय य यंत्र) की पहचान करेंगी और एक ही प्रारूप के सभी खुदरा जबिी केंद्रों के कायाडय ियन के जलए सुजनजश्चत करने के जलए आन जिजनयमों के ऄनुसार जिजिष्ट इअरडीएमपी तैयार करें। य ेऄजभलेख संबंजधत कंपनी के ऄजधकृत कार्ममक द्वारा प्रमाजणत दकए जाएंगे; और घ. सडक पररिहन के जलए कंपनी मागों की पहचान करेगी, जिजिष्ट इअरडीएमपी तैयार करेगी और सगं त जिजनयमों के ऄनुरूप ईसे जिजभन्न जहतधारकों के साथ साझा करेगी।" (3) कंपनी पररयोजना प्रभाररयों द्वारा ऄनुमोददत ददिाजनदिे ों (ऄनुबंध 2 देख)ें के ऄनुसार जनमाडण या पररयोजनाओं के जलए अपातकालीन योजना तयै ार करेगी। हालांदक, जिद्यमान प्रजतष्ठानों के जनमाडणों या पररयोजनाओं के मामल े म ेंितडमान इअरडीएमपी ऄजभलेख को किर दकया जाए या ऄनुबंध 2 के ऄनुसार संिोजधत दकया जाएगा।” (4) जिजनयम 8 म,ें i. ईप-खंड (1) के जलए “प्रणाली होनी चाजहए।” िब्दों के पश्चात ” स्ट्थापना म ें प्रिेि करने.” िब्दों से अरंभ होन े और “ संयंत्र का कोइ प्रजतजनजध हो” िब्दों स ेसमाप्त होने िाले परै ाग्राफ का लोप हो जाएगा;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] ii. ईप-खंड (4) का लोप हो जाएगा; iii. ईप-खंड (1) के पश्चात जनम्नजलजखत को सजम्मजलत दकया जाएगा, नामतः: - "(1 क) संबंजधत कंपनी का बोडड आन जिजनयमों के प्रभािी होन े के नब्बे ददनों के ऄंदर ऄपन े जनदेिकों में स े एक को जनयिु करेगा जो आन जिजनयमों के ऄनुपालन को सुजनजश्चत करने हते ु ईत्तरदायी होगा। " iv. ईप-खंड (2) म ें"सुरक्षा मानकों सजहत तकनीकी मानकों और जिजिजष्टयों" िब्दों का लोप हो जाएगा; v. ईप-खंड (3) के जलए "सुरक्षा मानकों सजहत तकनीकी मानकों और जिजिजष्टयों के प्रािधानो के ऄंतगडत" िब्दों के जलए "पीएनजीअरबी ऄजधजनयम, 2006 का" िब्द प्रजतस्ट्थाजपत होंग;े (5) जिजनयम 10 म,ें (1) ईप-जिजनयम 10.1 म;ें i. खंड (1)(घ) म,ें "जांच बबदओंु " िब्दों से पहल े "संदभड" िब्द सजम्मजलत होगा; (2) ईप-जिजनयम 10.2 म,ें i. “इअरडीएमपी प्रदिया का” से अरंभ होन े िाल े िब्द और “जोजखम का पता लगाना ह।ै ” से समाप्त होन े िाल े िब्द जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत होंगे, नामतः: -“दसू रा कदम प्रत्येक खतरे से जुडी एक घटना के जोजखम को जनधाडररत करना ह।ै अपात- कालीन प्रजतदिया योजनाओं को प्राथजमकता देने के जलए पररदश्ृ यों के ईच्च जोजखम की पहचान करने के जलए जोजखम जिश्लेर्ण का ईपयोग दकया जा सकता ह।ै जोजखम जिश्लेर्ण खतरनाक घटनाओं को रोकन े और कम करने के जलए और यथोजचत व्यािहाररक रूप से कम जोजखम को कम करने के जलए ितडमान सुरक्षा ईपायों की पहचान में भी सहायता करेगा।" ii. (घ) खडं म,ें "खतरों " िब्द 'जोजखम' िब्द स े प्रजतस्ट्थाजपत होगा और "रूप” िब्द “तरीका” िब्द द्वारा प्रजतस्ट्थाजपत होगा और “…. मानक ” से अरंभ होन े िाल े िब्दों और “स्ट्िीकायड … ” से समाप्त होन े िाले िब्दों का लोप हो जाएगा। iii. खडं (ड) का लोप हो जाएगा। iv. खंड (च) म ें “म ें तीन प्रमखु ईपाय िाजमल होने चाजहएाँ” िब्द “नीचे के रूप में तीन क्षेत्रों में िगीकृत दकया जाना चाजहए” द्वारा प्रजतस्ट्थाजपत होंगे। (3) ईप-जिजनयम 10.3 म,ें i. “प्राकृजतक अपदाए”ाँ िीर्डक िाल ेकॉलम म ें “सुनामी” िब्द के पश्चात “महामारी” िब्द सजम्मजलत होगा। ii. “बाहरी” िीर्डक िाल े कॉलम म ें “बाढ़ जिर्ािता/जल जिर्ािता” के पश्चात जनम्नजलजखत िब्द सजम्मजलत होंगे, नामत:- “ड्रोन अिमण”; “सायबर अिमण” (4) ईप-जिजनयम 10.4 म ें खंड (2) में “यूिीसीइ” िब्दों के स्ट्थान पर “िीसीइ, जिर्ाि ररलीज़, बॉल ओिर अदद” प्रजतस्ट्थाजपत होगा। (6) जिजनयम 11 म,ें (1) ईप-जिजनयम 11.2 म,ें i. "और ईपकरणों" िब्दों के पश्चात, "ऄस्ट्थायी अश्रयों" िब्द सजम्मजलत होंग;े (2) ईप-जिजनयम 11.3 म,ें (क) “घटना जनिारक ईपाय और प्रदियाएं” िीर्डक को "स्ट्िास्ट््य, सुरक्षा और पयाडिरण प्रबधं न" द्वारा प्रजतस्ट्थाजपत होगा; (ख) "स्ट्थापना या ऄय य स्ट्थलों पर ... ..." से अरंभ होने िाले िब्द और “.............जनम्नजलजखत िाजमल होना चाजहए:-" स े समाप्त होने िाल े िब्द जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत होंग,े नामतः: - “कंपनी के संचालन और अपात जस्ट्थजत के दौरान सुरक्षा सुजनजश्चत करन े के जलए एक प्रभािी स्ट्िास्ट््य, सुरक्षा और पयाडिरण प्रबंधन प्रणाली होगी और आसमें जनम्नजलजखत सजम्मजलत होगा, नामतः -”; (ग) खडं (ii) में कोष्ठकों और ईसके ऄंदर के िब्दों का लोप हो जाएगा;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 5 (घ) खंड (iii) में "संघ के नेताओं और" िब्दों का लोप हो जाएगा; (ड) खंड (v) में कोष्ठकों और ईसके ऄंदर के िब्दों का लोप हो जाएगा; (च) खडं (vi) में “ताप का पता लगाना” िब्द "ताप/धूम्र का पता लगाना” िब्दों द्वारा प्रजतस्ट्थाजपत होंगे”, और “भराइ स्ट्टेिन” िब्दों के पश्चात “और” िब्द सजम्मजलत दकया जाएगा और तत्पश्चात “तथा ईसके असपास” िब्दों का लोप हो जाएगा। (छ) खंड (viii) में "और एचएसइ प्रबंधन प्रणाली" िब्दों का लोप हो जाएगा; (ज) खडं (ix) को जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत दकया जाएगा, नामतः: - "एकजत्रत होने के स्ट्थानों और भागने के मागों सजहत और ऄय य बबदओंु ि मागों के समान अपातकाल के मामले म ें अगतं ुक सुरक्षा ब्रीफफग, क्या करें और क्या न करें" (7) जिजनयम 12.0 म,ें (1) ईप-जिजनयम खंड 12.1 म,ें i. खंड (ख) म,ें (क) "सीजमत पैमाने पर" िब्दों के पश्चात, "कायाडत्मक" िब्द सजम्मजलत होगा; (ख) “आस्ट्तेमाल दकया ह”ैं िब्दों के पश्चात "जाना चाजहए" िब्द "जाए" िब्द द्वारा प्रजतस्ट्थाजपत होगा; (ग) "ऄपन े "िब्द "ईनका" द्वारा प्रजतस्ट्थाजपत होगा; ii. खंड (घ) म ें “दलों” िब्द "सेिाओं" द्वारा प्रजतस्ट्थाजपत होगा और “समूहों” िब्द "सदस्ट्य या समूहों" द्वारा प्रजतस्ट्थाजपत होगा; iii. खंड (ड) जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत होगा, नामतः: - ’“ऑन-साआट (स्ट्तर- I / II) और ऑफ-साआट (स्ट्तर-III) ऄनुबंध-III में ददए गए कृजत्रम जड्रल फॉमेट अपातकालीन के जलए कृजत्रम जड्रल के ऄनुसार िमिः तीन महीने और बारह महीने में एक बार दकया जाएगा। एक िर्ड के दौरान आकाइ जद्वतीय स्ट्तर के कम से कम एक ऑन-साआट अपातकालीन ऄभ्यास का अयोजन करेगी।’"; iv. खंड (च) जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत होगा, नामतः: - “यह संबंजधत जज़ला प्राजधकारी का ईत्तरदाजयत्ि ह ै दक िह ख़तरनाक रसायन जनमाडण, भंडारण एिं अयात जनयम, 1989 और अपदा प्रबंधन ऄजधजनयम, 2005 के प्रचजलत प्रािधानों के ऄनुसार ईस स्ट्थल पर संभाजित बडी दघु डटना स े संबंजधत अपातजस्ट्थजतयों से जनपटन े और तैयारी करने के जलए एक पयाप्तड ऑफ साआट अपातकालीन योजना तैयार करे। तदनुसार कंपनी संबंजधत जजला प्राजधकरी को ऑफ साआट-कृजत्रम जड्रल अयोजजत करने के जलए जििरण प्रस्ट्ततु करेगी। एक से ऄजधक ईद्योग के सदस्ट्यों िाले स्ट्थानों के जलए ऑफ-साआट अपातकालीन (स्ट्तर III) ऄभ्यास जजला प्राजधकरण के समय िय म ें बारी-बारी से एक ईद्योग के सदस्ट्य द्वारा दकया जा सकता ह।ै आस प्रकार स्ट्थान पर प्रत्येक िर्ड में य यूनतम एक बार ऑफ-साआट अपात- कालीन (स्ट्तर III) का ऄभ्यास दकया जाना सुजनजश्चत करता ह"ै v. खंड (ज) म ें ऄतं म ें जनम्नजलजखत सजम्मजलत दकए जाएगं े, नामतः : "तदनुसार सुधारों के जलए समयबद्ध कायड योजना बनाइ जाए।" vi. खंड (झ) में ऄंत में जनम्नजलजखत सजम्मजलत होगा, नामतः: - “जिजिष्ट कृजत्रम जड्रल ररपोर्टटग प्रपत्र ऄनुबंध- 3 में ददया गया ह।ै ” (2) ईप जिजनयम 12.2 म,ें i. खंड 2 (i) में "प्रजिक्षण" िब्दों के पश्चात "अपातकालीन तैयारी और प्रजतदिया" सजम्मजलत होगा।; ii. खंड 2 (ii) म,ें "सुरक्षा प्रजिक्षण" िब्द जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत होंगे, नामतः :- “स्ट्थल पर तनै ाती से पूिड िैध सुरक्षा प्रजिक्षण और आसके ऄजतररि समय-समय पर संजिदा कर्ममयों और श्रजमकों को पुनश्चयाड प्रजिक्षण भी प्रदान दकया जाएगा।”6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (3) ईप-जिजनयम 12.3 के जलए, i. “चूंदक बडी अपात जस्ट्थजत” िब्दों से अरंभ होन े िाले और “जिचार दकया जाना चाजहए” से समाप्त होने िाल े िब्द जनम्नजलजखत से प्रजतस्ट्थाजपत होंगे, नामतः :-“प्रमुख अपातजस्ट्थजतयों का मुक़ाबला करने के जलए एकल आकाइ/सुजिधा/कंपनी/स्ट्थल की क्षमता स े परे हो सकता ह ै आसजलए यह अिश्यक ह ै दक पडोसी ईद्योगों के साथ परस्ट्पररक सहायता समझौता हो। परस्ट्पररक सहायता समझौते तैयार करत े समय जनम्नजलजखत पर ध्यान ददया जाएगा:-”; ii. खंड (क) में "स्ट्तर-II" िब्दों के पश्चात "और स्ट्तर-III" िब्द सजम्मजलत दकए जाएगं े। (8) जिजनयम 13.0 में खडं (क) (iii) का लोप हो जाएगा; (9) जिजनयम 14.0 म,ें i. खंड (1) के जलए "सगं ठन" िब्द "कार्ममक या समूह" िब्दों द्वारा प्रजतस्ट्थाजपत होगा; ii. खंड (2)(क) के जलए जनम्नजलजखत प्रजतस्ट्थाजपत होगा, नामतः: "घटना स े पूिड, पश्चात और के दौरान तत्परतापूिडक कारडिाइ करने के जलए।" iii. खंड (2)(ड) के जलए "समारोह" िब्द "भूजमका" िब्द द्वारा प्रजतस्ट्थाजपत होगा; (10) ईप-जिजनयम 14.2 म,ें (1) िीर्डक “भूजमका और ईत्तरदाजयत्ि” को “जिजिष्ट भूजमकाएं और ईत्तरदाजयत्ि” िब्दों द्वारा प्रजतस्ट्थाजपत होगा; (2) ईप-जिजनयम 14.2.1 म,ें i. "परंतु तक सीजमत नहीं ह"ै िब्द "िाजमल होंग”े िब्दों के पश्चात सजम्मजलत होंग;े ii. खंड (ड) म,ें “ऄस्ट्पताल” िब्द के पश्चात "एसअइसी " िब्द सजम्मजलत होगा; (3) ईप-जिजनयम 14.2.2 म,ें i. "मुख्य" िब्द "स्ट्थल" िब्द द्वारा प्रजतस्ट्थाजपत होगा और “िाजमल होंगे”, के पश्चात “परंत ु तक सीजमत नहीं” िब्द सजम्मजलत होंग;े ii. खंड (ख) म ें "लेन”े , िब्द को "समथड का ऄजधकार” िब्दो द्वारा प्रजतस्ट्थाजपत दकया जाएगा और "संभालने” िब्दों को "ल ेसकने" िब्दों द्वारा प्रजतस्ट्थाजपत दकया जाएगा; iii. खंड (घ) म,ें “एसअइसी", िब्दों से पूिड "सीअइसी या" िब्द सजम्मजलत होंगे और “ऄजधसूजचत ह”ैं िब्द “ऄजधसूचना के जलए” िब्दों द्वारा प्रजतस्ट्थाजपत होगा; और “सीअइसी से” िब्दों के पश्चात “यदद लाग ूहो” िब्द सजम्मजलत होंग;े iv. खंड (ड) में “िह” िब्द “एसअइसी” िब्दों द्वारा प्रजतस्ट्थाजपत होगा, v. खंड (छ) के पश्चात जनम्नजलजखत खंड सजम्मजलत होगा, नामतः "(ज) एसअइसी यह सुजनजश्चत करेगा दक अपातकालीन प्रजतदिया टीम के सभी कमी अपातकाल के दौरान सौंपी गइ भूजमकाओं के जलए प्रजिजक्षत हों।" (4) जिजनयम 14.2.3 म,ें i. "जनयंत्रक" िब्द "समय ियक" िब्द द्वारा प्रजतस्ट्थाजपत होगा; ii. खंड (ख) के जलए, जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत होगा, नामतः: - "बाह्य एजेंजसयों के एसअइसी में अने पर जनदेजित करने के जलए।"; (5) ईप जिजनयम 14.2.4 के जलए; i. खंड (ड) म ें"जनदेि देना" िब्द "बाह्य मागडदिनड " िब्दों द्वारा प्रजतस्ट्थाजपत होंग;े ii. खंड (च) का लोप हो जाएगा। iii. खंड (छ) म ें"बाहरी" िब्द "बाह्य" िब्द द्वारा प्रजतस्ट्थाजपत होगा; iv. खंड (झ) का लोप हो जाएगा;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 7 v. खंड (ञ) में "रकों" िब्द "िाहनों" िब्द द्वारा प्रजतस्ट्थाजपत होगा; vi. खंड (ठ) में "हाआड्रेंट", िब्द "ऄजि जल" िब्दों द्वारा प्रजतस्ट्थाजपत होंगे। vii. खंड (ठ) के पश्चात जनम्नजलजखत खंड सजम्मजलत होगा, नामतः:- “(ड) पारस्ट्पररक सहायता जुटाने पर सीअइसी को सलाह देन े और पारस्ट्पररक सहायता के सदस्ट्यों से सहायता सजहत ऄजतररि ऄजििमन संसाधनों की अिश्यकता की व्यिस्ट्था करने के जलए।”; (6) ईप-जिजनयम 14.2.5.6 (क) म,ें i. िीर्डक में "इअरडीएमपी" िब्द के जलए "घटना" िब्द प्रजतस्ट्थाजपत होगा; ii. “दकसी भी प्रकार की अपातजस्ट्थजत” िब्दों स े अरंभ होने िाल े और “ररकाड ड रख े जाएंगे।” स े समाप्त होन े िाल े िब्द जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत होंगे, नामतः: - “बाल बाल बचने िाली घटना सजहत समस्ट्त प्रकार की घटनाओं या अपातजस्ट्थजतयों का ऄजभलेख रखने के जलए एक प्रणाली होगी। iii. “ऄजभलेख रजजस्ट्टर” िब्द “ऄजभलेखन प्रणाली” िब्दों द्वारा प्रजतस्ट्थाजपत होंगे। iv. रटप्पणी में “योजना म…े ” िब्द के पश्चात “ऑफ-साआट” िब्दों सजम्मजलत होंगे। (7) ईप जिजनयम 14.2.5.8 म ेंखंड 2 (ग) के जलए "जनयंत्रण कक्ष" िब्दों का लोप हो जाएगा; (8) ईप जिजनयम 14.2.5.9 के जलए, (1) खंड 2 (क) और (ख) जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत होंगे, नामतः: - “(क) अपातकालीन स्ट्तर I – स्ट्तर I के जलए सायरन कोड का जनणडय प्रजतष्ठान के अकार और जरटलता को ध्यान म ें रखत े हुए कंपनी के अधार पर होगा; (ख) अपातकालीन स्ट्तर II - दो जमनट के जलए एक सााँय सााँय सायरन”; और ”(ग) अपातजस्ट्थजत स्ट्तर-III – स्ट्तर-II के मामल े म ें समान प्रकार का सायरन परंत ु एक जमनट के ऄंतराल पर तीन बार बजाया जाएगा ऄथातड (प्रतीक्षा सायरन 2 जमनट+ ऄंतराल 1 जमनट + सायरन 2 जमनट +ऄंतराल 1 जमनट + सायरन 2) को प्रतीक्षा सायरन बजान े की कुल ऄिजध अठ जमनट होगी।”; (11) जिजनयम 15.0 म;ें (1) ईप-जिजनयम 15.1 के जलए,; i. खंड 2 (छ) म ें "अपात लाआटें" िब्द "अपात पािर बैकऄप और डीसी स्रोत के साथ अपात लाआट" िब्दों द्वारा प्रजतस्ट्थाजपत होंग;े (2) ईप-जिजनयम 15.2 के जलए; i. खंड (1) में "मात्रात्मक जोजखम अकलन" िब्दों को “प्रमुख पररदश्ृ यों के पररणाम जिश्लेर्ण" िब्दों द्वारा प्रजतस्ट्थाजपत दकया जाएगा; (12) जिजनयम 16.0 म:ें i. खंड (2) में "सुरक्षा" िब्द के जलए "जब कोइ संचालन कमी ईपजस्ट्थत नहीं होता है तो सुरक्षा या ऄय य प्रजिजक्षत" िब्दों द्वारा प्रजतस्ट्थाजपत होगा और "जनयंत्रकों" िब्द के पश्चात "या समय ियक" िब्द सजम्मजलत होंगे। खंड (3) म,ें "अपात जस्ट्थजत" िब्द "जस्ट्थजत" िब्द द्वारा प्रजतस्ट्थाजपत होगा और “संयंत्र पररसर” िब्द “एक स्ट्थापना या साआट” िब्दों द्वारा प्रजतस्ट्थाजपत होंगे। (13) जिजनयम 17.0 म:ें i. खंड (2) (ख) में "ऄजि सुरक्षा" िब्दों के पश्चात" और ऄजििमन" िब्द सजम्मजलत होंगे; ii. खंड (2) (ग) का लोप हो जाएगा;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] iii. खंड (2) (च) म ें "चौबीस घंटे" से अरंभ होन े िाल े और “ईपलब्ध होना चाजहए” से समाप्त होने िाले िब्द जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत होंग,े नामतः: - “प्राथजमक जचदकत्सा सुजिधाएं, अंतररक जचदकत्सा सुजिधाएं, या पास के ऄस्ट्पताल या स्ट्िास्ट््य केंद्र के साथ टाइ-ऄप” (14) जिजनयम 18.0 के जलए; i. बबद ु (क) में ईजल्लजखत "5 दकमी के दायरे में" िब्द "2 दकमी के व्यास या पररणामों के जिश्लेर्ण के ऄनुसार, जो भी ऄजधक हो" िब्दों द्वारा प्रजतस्ट्थाजपत होंग:े ii. बबद ु(ग) के पश्चात जनम्नजलजखत सजम्मजलत होगा, नामतः "(ग1) पडोसी ईद्योग, प्रजतष्ठान, पाआपलाआन ें अदद" (15) जिजनयम 20.0 म ें खंड (3) जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत होगा, नामतः:- “अपातजस्ट्थजत के मामले में स्ट्थापना की अिश्यकतओं के ऄनरूु प सािडजजनक ईद्घोर्णा प्रणाली या पोटेबल ईद्घोर्णा प्रणाली या मगे ा फोन मोबाआल िाहन िाले िाहन ईद्घोर्णा के जलए ईपलब्ध रहने चाजहएं।“ (16) जिजनयम 21.0 म,ें खंड (2) “आस ईद्देश्य के जलए” िब्दों स े अरंभ होने िाले और “समूह को ददए जान े चाजहए” िब्दों से समाप्त होन े िाले भाग का लोप हो जाएगा और "प्रदि"ड िब्द “युि" िब्द द्वारा प्रजतस्ट्थाजपत होगा। (17) जिजनयम 23.0 म,ें i. खंड (1) के जलए जनम्नजलजखत प्रजतस्ट्थाजपत होगा, नामतः;- "छोटी और बाल बाल बचन े िाली समस्ट्त घटनाओं को कंपनी द्वारा ऄनुसूची-VI में जनर्ददष्ट प्रारूप म ें जनरीक्षण के जलए रखा जाए। “प्रमुख” हादसे को बोडड को ऄनुसूची-VI पर रखे हुए जिजनर्ददष्ट प्रारूप में सूजचत दकया जाएगा और आस प्रकार की घटनाओं की ररपोटड ईनके घरटत होन े के 48 घंटे के ऄदं र प्रस्ट्ततु की जानी चाजहए। यद्यजप ’प्रमुख’ हादसे पर प्रथम सूचना ररपोट ड (एफअइअर) को दरू भार्, इ-मेल या एसएमएस के माध्यम से बोडड को तत्काल ऄथिा घटना घरटत होने के चार 4 घंटे के ऄंदर सूजचत दकया जाएगा।" ii. (ख) खडं (2) म,ें (क) "सभी प्रमुख घटनाओं" से अरंभ होने िाल े और "प्रस्ट्तुत की जाएगी" िब्दों के साथ समाप्त होने िाल े िब्दों का लोप हो जाएगा; (ख) बबद ु(घ) म ें"10.0 लाख रुपये" िब्द को "रुपये 20.0 लाख” िब्दों द्वारा प्रजतस्ट्थाजपत होंग;े (ग) बबद ु(छ) का लोप हो जाएगा; iii. खंड (2) के पश्चात जनम्नजलजखत खंड सजम्मजलत दकए जाएंगे, नामतः: "(3) सभी ‘प्रमुख’ घटनाओं की जिस्ट्तृत जााँच ररपोट ड जााँच के दौरान की गइ संस्ट्तुजतयों के समयबद्ध िमन योजना के साथ होने के 30 ददनों के ऄंदर बोडड को प्रस्ट्तुत की जाएगी। दकसी घटना में तत्पश्चात घातक हाजन होने के मामले में ऄनुमाजनत हाजन रुपये 20 लाख से ऄजधक और संचयी मानि घंटे 500 स े ऄजधक घंटे की हाजन होन े पर आस प्रकार की घटनाओं को ऄनुसूची-VI में ददए गए जनधाडररत प्रारूप म ेंतरु ंत प्रमुख घटनाओं के रूप में भी सूजचत दकया जाएगा। (4) प्रमुख (जिस्ट्तृत जांच ररपोटड सजहत) और छोटी घटनाओं का सारांि और बाल बाल बचने िाली घटनाओं (केिल संख्या) की त्रैमाजसक ररपोटड प्रत्येक जतमाही की समाजप्त के तीस ददन के ऄंदर बोड डको भेजी जाएगी। (18) जिजनयम 24.0 म,ें (क) “बोड ड को घटना की” से अरम्भ होने िाले िब्दों और “स्ट्तर पर समय िय करेगा” िब्दों के साथ समाप्त होने िाले को ईसके खडं (1) के रूप म ें िमांदकत दकया जाएगा; (ख) खंड 1, जैसा दक िमांदकत दकया गया ह,ै के पश्चात जनम्नजलजखत खंड सजम्मजलत दकए जाएंग,े नामतः :- “(2) चूको, कजमयों का पता लगान,े जिफलताओं के कारणों का पता लगाने और आस प्रकार की घटनाओं अदद की पनु रािृजत्त से बचने के जलए सभी प्रमुख घटनाओं की जााँच कंपनी द्वारा एक जााँच सजमजत के माध्यम से करिाइ जाएगी जजसमें ऐसे जििेर्ज्ञ सजम्मजलत होंगे जो आस घटना से[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 9 प्रत्यक्ष रूप से सम्बद्ध न हों तथा घटना के 30 ददन के ऄंदर सजमजत की ररपोट ड बोडड को प्रस्ट्तुत करेगी। (3) जनम्नजलजखत घटनाओं की आस प्रकार की जाचं बोडड द्वारा गरठत एक जांच सजमजत द्वारा भी की जाएगी:- क .धमाका या जिस्ट्फोट; ख .घातक या प्रमुख ऄजि दघु डटनाए;ं ग .बोड ड द्वारा जनधाडररत दकए गए पेरोजलयम, पेरोजलयम ईत्पाद या ` स पाआपलाआनों म ेंपाआपलाआन ररसाि; तथा घ .बोड ड द्वारा जनजश्चत की गइ कोइ ऄय य घटना। (4) जााँच सजमजत के जलए संदभ डकी ितों में जनम्नजलजखत सजम्मजलत होंगी, नामतः कचूकों ., कजमयों की पहचान करें; ख ऄसफलता का मूल कारण .स्ट्थाजपत करें; ग सीऐ . घटनाओं की पुनरािृजत्त को रोकने के जलए सुधार/ ईपचारात्मक ईपाय सुझाएं. (5) जांच सजमजत एक सप्ताह के ऄदं र प्रारंजभक ररपोटड और गठन के ददन के ऄंदर बोडड को ऄंजतम ररपोटड 30 प्रस्ट्तुत करेगी (6) कंपनी ऐसी घटनाओं की पुनरािृजत्त को रोकने के जलए अिश्यक ईपाय करेगी और अग े की कारडिाइ आस तरह की जांच सजमजत की ररपोटड का भाग होन े के जलए की गइ ररपोटड को बोडड की कंपनी के जनदेिक मंडल द्वारा जिजधित रूप से जाचं की गइ। (19) जिजनयम म ें28.0; ज) व्यजिगत सुरक्षा ईपकरण; और झ) सुरक्षा जागरूकता और प्रजिक्षण अदद। 4. अपातकालीन तयै ारी के ईपाय: क) पहचान दकए गए पररदश्ृ य और ईसके मल्ू यांकन पर अपातकालीन जड्रल और कारडिाइ; ख) अपातकालीन प्रजतदिया पर प्रजिक्षण का अयोजन; और ग) पारस्ट्पररक सहायता 5. अपातकालीन प्रजतदिया प्रदिया: कंपनी त्िररत प्रजतदिया सुजनजश्चत करने के जलए सुजनयोजजत और प्रलेजखत प्रदियाएाँ तैयार करेगी। कायड योजना को सभी अपातकालीन पररदश्ृ यों, जजय ह ें ऑन-साआट और ऑफ-साआट के रूप में पहचाना जाता है, के जलए ऄजभलेजखत दकया जा सकता ह।ै 6. अपातकालीन सगं ठन और ईत्तरदाजयत्ि: कंपनी संगठन चाटड (अपातकालीन एक्िन फ्लो चाटड) बनाएगी और पररयोजना स्ट्थल पर अपातकालीन जस्ट्थजत को प्रभािी ढंग से संभालने के जलए प्रमुख कर्ममयों की भूजमका और ईत्तरदाजयत्िों को पररभाजर्त करेगी। अपातकालीन संगठन और ईत्तरदाजयत्िों को जिकजसत करन े के जलए पीएनजीअरबी (इअरडीएमपी) जिजनयम के जिजनयम 14.0 को संदर्मभत दकया जा सकता ह।ै 7. अपातकालीन जनयत्रं ण के जलए ससं ाधन:[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 15 1) पररयोजना या जनमाणड स्ट्थल के ऄंदर ईपलब्ध अपातकालीन जनयंत्रण प्रणाली और सुजिधाएाँ जनम्नानुसार होंगी, नामतः – (क) ऄजि और गैस संसूचन प्रणाली; Short title and commencement (1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Codes of Practices for Emergency Response and Disaster Management Plan (ERDMP)) Amendment Regulations, 2020, namely: - (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Petroleum and Natural Gas Regulatory Board (Codes of Practices for Emergency Response and Disaster Management Plan (ERDMP)), Regulations 2010: (1) In regulation 2, (i) in clause (f), the following shall be substituted, namely: -―disaster‖ means a catastrophe, mishap, calamity or grave occurrence in any area, arising from natural or man-made causes, or by accident or negligence which results in substantial loss of life or human suffering or damage to, and destruction of, property, or damage to, or degradation of, environment, and is of such a nature or magnitude as to be beyond the coping capacity of the community of the affected area.‖; (ii) in clause (l), the following shall be substituted, namely: -―incident recording system‖ means a system containing complete information pertaining to all incidents including near misses.‖; (iii) in clause (n), the following shall be substituted, namely: -―leak‖ means release or discharge of a hazardous chemical(s) or substances or material in any state into the environment.‖; (iv) in clause (r), the word, ―association‖ shall be substituted by the word, ―group‖, and the word, ―associations‖, shall be substituted by the word, ―agreement‖; (v) in clause (t), after the words, ―in an installation‖, the words, ―or site‖, shall be inserted; (vi) in clause (v), after the words, ―place in an installation‖, the words, ―or site‖ shall be inserted; (vii) in clause (w), after the words, ―within the installation‖, and also after the words, ―installation premises‖, the words, ―or sites‖ shall be inserted; (viii) in clause (z), the word, ―quantitative‖, shall be omitted; (ix) in clause (aa), for the words, ―the risk of emergencies‖, the words, ―or mange the risk of undesired event‖, shall be substituted; (x) in clause (ac), the word, ―dangerous‖, shall be substituted by the word, ―hazardous‖. (xi) in clause (ad), before the words, ―telephone numbers‖, the word, ―emergency‖, shall be inserted;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (xii) after clause (ae), the following clause shall be inserted, namely: ―(af) ―Project In-Charge‖ means an individual that has ultimate control over the affairs of the project and is duly authorized by the entity.‖ (2) In regulation 3, (i) in clause (c), the following shall be substituted, namely: - ―petroleum and petroleum product pipeline;‖ (ii) in clause (d), the following shall be substituted, namely: - ―petroleum storage facilities including POL depot, installations and terminals;‖ (iii) after clause (d), the following clause shall be inserted, namely - ―(da) Natural gas storage facilities including LNG terminals.‖ (iv) for clause (g), the following shall be substituted, namely: - ―retail outlets dispensing like Petroleum, Auto LPG, LNG, CNG and like other retail outlets‖ (v) in clause (h), after the words, ―petroleum products‖, the words, ―LNG, CNG etc.‖, shall be inserted. (3) In regulation 4.0, (1) In sub-regulation 4.1, (i) for clause (i), the word, ‗emergencies‘, shall be substituted by the words ―probable emergency scenarios‖; (ii) for clause (ii), the words, ‗the risk or disaster‘, shall be substituted by the words ―impact on people, assets and environment by bringing it in ALARP level‖; (iii) for clause (iii), the words, ‗that to develop‘, shall be substituted by the words ―of emergency‖; (iv) for clause (iv), the words, ‗(primary, secondary and tertiary)‘, shall be omitted; (v) for clause (v), the following shall be substituted, namely: - ―the post incident or accident or disaster recovery with aim to restore the affected area to its original conditions to the extent possible.‖ (2) For sub-regulation 4.2., (i) the paragraph ―It is intended to apply these regulations‖ shall be numbered as (1). (ii) clauses (a) and (b) shall be substituted by the following, namely: ―(a) to develop a concise and informative ERDMP to enable the entity to mitigate the emergency as quickly as possible; (b) to prevent escalation of event both on-site and off-site; (c) to minimize impact on people; (d) to reduce damage to property, machinery and environment; (e) to develop a state of readiness for a prompt and orderly response to an emergency and to establish a high order of preparedness (equipment, personnel) commensurate with the risk; (f) to provide an incident management organogram with clear missions and lines of authority (incident command system, field supervision, unified command); (g) to ensure an orderly and timely decision-making and response process[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 19 (notification, standard operating procedures); (h) to maintain good public relations;‖ (iii) ‗The paragraph in the heading, ―Note‖, shall be numbered as (2) and in the Paragraph (2) as so numbered for the word, ―shall‖, the word, ―will‖, shall be substituted and after the word, ―resources‖, the word, ―preferably‖, shall be inserted and after the paragraph so numbered the following shall be inserted, namely:- ―Provided that, in respect of Cross-Country Pipelines, City Gas Distribution Networks, Retails Outlets, Road Transportation, the following methodologies may be adopted with respect to formulation of ERDMP, namely: - a. The entity may prepare a single ERDMP document of a Cross Country Pipeline. However, location/installation specific information shall be detailed in the document in accordance with the relevant regulations. Alternatively, entity can make ERDMP document installation/location wise also; b. The CGD entity can prepare a single ERDMP document for its Geographical Area. However, specific information and mitigation measures w.r.t CNG Stations, Domestic, Commercial and Industrial supplies shall be detailed in the document in accordance with relevant regulations; c. Entities owning Retail outlets (ROs) shall identify various format for its RO like (Like RO with LPG, RO without LPG, RO in Cities, ROs on Highways or combination of two or more or other like devices) and prepare typical ERDMP in accordance with these regulations for implementation across all ROs of same format and ensure compliance. These documents shall be certified by the authorized personnel of the concerned entity; and d. For road transportation, entity shall identify the routes, prepare typical ERDMP and share the same with various stakeholders in accordance with the relevant regulations.‖ (3) The entity shall formulate Emergency Plan for Constructions or Projects in accordance with the guidelines (Refer Annexure 2), duly approved by Project In-Charge. However, in case of Constructions or Projects in existing installations, the existing ERDMP document should either cover or be modified as per Annexure 2.‖ (4) In regulation 8, i. for sub-clause (1), after the words, ―on-going basis‖, the words beginning with, ―there shall also be a system of ―and ending with the words, ―and return gate‖, shall be omitted; ii. sub-clause (4) shall be omitted; iii. after sub-clause (1), the following shall be inserted, namely: - ―(1a) The Board of the concerned entity, within ninety days of the commencement of these regulations shall appoint one of its directors, who shall be responsible for ensuring compliance to these regulations.‖; iv. for sub-clause (2), the words ―Technical Standards and Specifications including Safety Standards‖, shall be omitted; v. for sub-clause (3), for the words ―the provisions of the technical standards, specifications including safety standards‖, the words ―PNGRB Act, 2006‖ shall be substituted.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (5) In regulation 10, (1) In sub-regulation 10.1; i. in clause (1)(d), before the words ―check points‖, the word ―refer‖, shall be inserted; (2) In sub-regulation 10.2, i. the words beginning with, ―The second step‖, and ending with the words, ―associated with each hazard‖, the following shall be substituted, namely: - ―The second step is to determine the risk of an incident associated with each hazard. The risk analysis may be used to identify the high risk of scenarios to prioritize the emergency response plans. The risk analysis would also aid in identifying the existing safeguards in place to prevent and mitigate the hazardous event and in reducing the risk as low as reasonably practicable.‖ ii. in clause (d), the word ―hazards‖, shall be substituted by the word, ―risks‖ and the word, ―fashion‖, shall be substituted by the word, ―manner‖ and the words beginning with ―criteria should then‖ and ending with ―all parties concerned‖ shall be omitted; iii. clause (e) shall be omitted; iv. in clause (f), the words ―involves three major steps: -‖, shall be substituted by the words ―should be categorized in three regions as below:‖ (3) In sub-regulation 10.3, i. in the Column heading, ―Natural Calamities‖, after the word, ―Tsunami‖, the word, ―Pandemic‖, shall be inserted; ii. in the Column heading, ―Extraneous‖, after the word, ―Food Poisoning/ Water Poisoning‖, the following words shall be inserted, namely: ―Drone Attack; Cyber Attack.‖ (4) In sub-regulation 10.4, (6) In clause (2), for the letters ―UVCE‖, the letter, ―VCE, toxic release, Boil Over etc. shall be substituted.‖ In Regulation 11, (1) in sub-regulation 11.2, (i) after the words, ―and appliances,‖, the words ―temporary shelters‖, shall be inserted; (2) in sub-regulation 11.3, (a) the heading, ―Incident preventing measures and procedures‖, shall be substituted by the heading, ―Health, Safety and Environment Management‘; (b) the words starting with ―The incident preventions‖ and ending with the words, ―shall include the following‖, shall be substituted by the following, namely: - ―The entity shall have an effective Health, Safety and Environment Management System in place to ensure safety during operation and emergencies and this shall include the following, namely: -‖; (c) in clause (ii), the brackets and the words therein, shall be omitted; (d) in clause (iii), the words ―Union leaders and‖, shall be omitted; (e) in clause (v), the brackets and the words therein, shall be omitted; (f) in clause (vi), the words, ―heat detection‖, shall be substituted by the words ―heat/smoke detection‖ and after the words, ―filing stations‖, the word, ―and‖, shall be inserted and the words, ―and along with periphery‖, shall be omitted;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 21 (g) in clause (viii), the words ―and HSE Management system;‖, shall be omitted; (h) in clause (ix), shall be substituted by the following, namely: -―Visitor safety briefing including, do‘s and don‘ts in case of emergency including assembly points and escape routes and like other points and routes‖ (7) In regulation 12.0, (1) In sub-regulation 12.1, i. in clause (b), (a) after the words, ―Limited scale‖, the word ―functional‖ shall be inserted; (b) the word, ―should‖, placed after the words, ―are useful and‖, shall be substituted by the word, ―may‘; and (c) the word, ―his‖, shall be substituted by the word, ―their‖; ii. in clause (d), the words ‗companies‘, shall be substituted by ―services‖ and the words ‗groups‘, shall be substituted by ―member or groups‖; iii. clause (e), shall be substituted by the following, namely: - ―Mock drill for On site (Level –I or II) and Off site (Level-III) emergency shall be carried once in three months and twelve months respectively in accordance with Typical Mock Drill Reporting format provided in Annexure -3. Entity shall conduct at least one On site emergency exercise of Level-II during a year.‖; iv. clause (f), shall be substituted by the following, namely: - ―it is the responsibility of the concerned District Authority to prepare and keep up-to-date an adequate off-site emergency plan detailing as to how emergencies relating to a possible major accident on the site will be dealt with, as per prevailing provisions of Manufacture, Storage and Import of Hazardous Chemical (MSIHC) Rules,1989 and Disaster Management (DM) Act, 2005, accordingly, entity shall submit the details to the concerned District Authority to conduct the off-site mock drill. For locations having more than one industry member, the Off-site emergency exercise may be carried out by one industry member by turn in coordination with the concerned District Authority, thus ensuring at least one off-site emergency (Level-III) exercise is conducted at the location every year ‖; v. in clause (h), at the end the following shall be inserted, namely: - ―Accordingly, time bound action plan to be prepared for rectifications.‖ vi. in clause (i), the following shall be inserted at the end, namely:- ―Typical Mock Drill Reporting Format is given at Annexure-3‖ (2) In sub-regulation 12.2, i. in clause 2 (i), after the word ―Training‖, the words ―on Emergency Preparedness and Response‖ shall be inserted; ii. in clause 2 (ii), for the words ―and passing safety training‖, the following shall be substituted namely:- ―valid safety training prior to the deployment at site and refresher trainings shall also be imparted to contract personnel and labourer periodically‖. (3) In sub-regulation 12.3, i. The words beginning with ―Since combating major‖ and ending with the words, ―mutual aid arrangements‖, the following shall be substituted, namely: - ―Since combating major emergencies might be beyond the capability of22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] individual unit/ facility/ entity /site, it is essential to have mutual aid agreement with neighboring industries. Consideration shall be given to the following while preparing mutual aid agreements:-‖; ii. in clause (a), after the word ―Level-II‖ the words ―and Level-III‖ shall be inserted. (8) In regulation 13.0, the clause (a) (iii), shall be omitted; (9) In regulation 14.0, i. for clause (1), the word, ―organization‖, shall be substituted by the words, ―personnel or group‖, and for the words, ―with succession planning and‖, the word, ―for‖ shall be substituted; ii. for clause (2)(a), the following shall be substituted, namely: ―to promptly act before, after and during the incident.‖ iii. for clause (2)(e), for the word ―function‖, the word ―role‖, shall be substituted; (10) In sub-regulation 14.2, (1) The heading, ―Roles and Responsibilities‖, shall be substituted by the heading, ―Typical Roles and Responsibilities‖; (2) in sub-regulation 14.2.1, i. after the words, ―shall include‖, the words, ―but not limited to‖, shall be inserted; ii. in clause (e), at the end, the words ―in consultation with SIC.‖, shall be inserted; (3) in sub-regulation 14.2.2, i. for the word, ―Chief‖, the word, ―Site‖, shall be substituted and after the words ―shall include‖, the words, ―but not limited to‖, shall be inserted.; ii. in clause (b), the words ―capable of making‖, shall be substituted by the words ―empowered of taking‖ and the word ―taking‖ shall be substituted by the word ―take‖; iii. in clause (d), before the word, ―SIC‖, the words, ―CIC or‖, shall be inserted, for the words ―are notified‖, he words ―for notification‖, shall be substituted and after the words, ―from the CIC‖, the words, ―if applicable‖, shall be inserted; iv. in clause (e), the word ―He‖, shall be substituted by the word ―SIC‖, v. after clause (g), the following clause shall be inserted, namely: ―(h) The SIC shall ensure that all personnel of emergency response team are trained for assigned roles during emergency.‖ (4) in sub-regulation 14.2.3, i. the word ―controller‖ shall be substituted by the word ―coordinator‖; ii. for clause (b), the following shall be substituted, namely: - ―to direct on arrival of external agencies to SIC.‖; (5) In sub-regulation 14.2.4; i. in clause (e), the words ―direct the‖, shall be substituted by the words ―guide the external‖; ii. clause (f) shall be omitted; iii. in clause (g), the word ―outside‖, shall be substituted by the word ‖external‖; iv. clause (i) shall be omitted ; v. in clause (j), the word ―trucks‖, shall be substituted by the word ―vehicles‖; vi. in clause (l), the word ―hydrant‖, shall be substituted by the words ―fire water‖.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 23 vii. after clause (l), the following clause shall be inserted, namely: ―(m) to advise CIC on mobilization of mutual aid and to arrange requirement of additional firefighting resources including help from mutual aid members.‖; (6) In sub-regulation 14.2.5.7 (a), i. in the heading, for the word ―ERDMP‖ shall be substituted by the word ―Incident‖; ii. the words starting with ‗There shall be‖ and ending with, ―Level-III.‖, shall be substituted by the following, namely: ―There shall be a system to maintain the records for of all kind of incidents or emergencies including near miss.‖; iii. for the words, ―Record Register‘, the words, ―Recording System‖, shall be substituted; iv. in the Note, after the words, ―during an‖, the word, ―off-site‖, shall be inserted. (7) In sub-regulation 14.2.5.8, for clause 2 (c) the words ―Control room‖ shall be omitted; (8) In sub-regulation 14.2.5.9, (a) clause 2 (a) and (b), shall be substituted by the following, namely: ―(a) Emergency Level I – The siren code for Level I shall be decided by entity depending upon the size and complexity of installation; (b) Emergency Level II - A wailing siren for two minutes; and (c) Emergency Level III- Same type of siren as incase of Level-II but the same will be sounded for three times at the interval of one minutes i.e. (waiting siren 2min + gap 1min + siren 2min +gap 1min +waiting siren 2min) total duration of disaster siren to be eight minutes.‖; (11) In regulation 15.0, (1) In sub-regulation 15.1; i. In clause 2 (g), the words ―emergency lights‘, shall be substituted by the words ―emergency power back up and emergency light with DC source‖; (2) In sub-regulation 15.2; i. In clause (1), the words ―quantitative risk assessment‖, shall be substituted by the words ―consequence analysis of the major scenarios‖; (12) In regulation 16.0, i. in clause (2), for the words ―the security‖, the words, ―when no operating personnel are present, the security or other trained‖, shall be substituted and after the word ―controllers‖, the words, ― or coordinators‖, shall be inserted; ii. in clause (3), the word ―emergency‖, shall be substituted by the word ―situation‖ and for the word, ―plant premises‖, the words, ―an installation or site‖, shall be substituted. (13) In regulation 17.0, i. in clause (2) (b), after the words ―fire protection‖, the words ―and fire-fighting‖ shall be inserted; ii. clause (2)(c), shall be omitted; iii. in Clause (2)(f), the words beginning with, ―first aid and medical‖, and ending with, ―first aid room‖, the following shall be substituted, namely: ―first aid facilities, in house medical facilities, or a tie-up with nearby hospital or health center.‖; (14) In regulation 18.0,24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] i. In point (a), the words ―5 km radius‖, shall be substituted by the words, ―2 km radius or as per consequences analysis, whichever is higher‖; ii. after point (c), the following shall be inserted, namely: ―(c1) neighboring industries, installations, pipelines etc.‖ (15) In regulation 20.0, clause (3), shall be substituted by the following, namely: - ―Vehicle with Public Address System or Portable PA system or Mega Phone as per requirement of the installation should be available for announcement in case of emergency‖. (16) In regulation 21.0, clause (2), the word beginning with, ―For the purpose‖ and ending with, ―Crisis management group‖, shall be omitted and the word ―carrying‖ shall be substituted by the words ―containing‖. (17) In regulation 23.0, i. For clause (1), the following shall be substituted, namely; - ―1) All incidents covered under Minor Incident and Near Misses should be maintained by the entity for inspection in the format as specified in Schedule-VI. ‗Major‘ Incident shall be reported to the PNGRB in the format specified and placed at Schedule-VI. The above report should be submitted within 48 hours after occurrence of the incidents. However, First Information Report (FIR) on ‗Major‘ Incident shall be intimated to PNGRB through telephone, email or SMS immediately or but not later than 4 hours of occurrence.‖ ii. In clause 2), (a) the words beginning with, ―investigation report‖, and ending with the words, ―the Board‖, shall be omitted; (b) in point (d), the words ―Rs. 10.0 Lac‖, shall be substituted by ―Rs. 20.0 Lac‖; (c) point (g), shall be omitted; iii. After clause 2), the following clauses shall be inserted, namely: ―3) Detailed investigation report of all ‗Major‘ incidents shall be submitted to the Board within 30 days of occurrence along with time bound mitigation plan of recommendations, made during the investigation. In case, any incident subsequently leads to fatality, assessed loss of above Rs. 20 Lac and cumulative man hours lost more than 500 hours. Such incidents shall also be reported as major incidents immediately in prescribed format as placed in schedule-VI. (4) Quarterly report consisting Summary of Major (including detailed Investigation Report) and Minor incidents and Near Misses (only numbers.) shall be sent to the Board within 30 days of the end of every quarter.‖ (18) In regulation 24.0, (a) The words beginning with, ―After reporting of incident‖, and ending with, ―normalization of the situation‖, shall be numbered as Clause (1) thereof; (b) After clause (1) as numbered, the following clauses shall be inserted, namely: - ―(2) All Major Incidents shall be investigated by the entity through an enquiry committee comprising experts not directly associated with the incident to identify the lapses, shortcomings, establish the causes which establishes the failure and suggest remedial measures to prevent the recurrence of such incident etc. and submit its report to the Board within 30 days of the incident.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 25 (3) Following incidents shall also be investigated by such an enquiry committee constituted by the Board, namely: -. a. Explosion or blast; b. Fires involving fatality or major fires; c. Pipeline leakages in petroleum, petroleum product or natural gas pipelines as decided by the Board; and d. Any other incident as decided by the Board. (4) Terms of reference for the enquiry committee shall include the following, namely: a. identify the lapses, shortcomings; b. establish the root cause of failure; c. suggest improvements or remedial measures to prevent the recurrence of such incidents. (5) Such enquiry committee shall submit the preliminary report within a week and thereafter, the final report to the Board within 30 days of constitution. (6) The entity shall take necessary measures to prevent the recurrence of such incidents, and forward the action taken report to be the part of the report of such enquiry committee duly vetted by the board of Directors of the entity of the Board.‖ (19) In regulation 28.0; (1) In sub-regulation 28.1, i. in clause (a), the words ―all along the routes‖, shall be omitted; (2) in sub-regulation 28.3, i. clause (g) and (h) of sub-regulation 28.3.1, shall be substituted by the following, namely; ―(g) arrange water through municipal water tanker or any other source.‖. (20) Regulation 29.0, ―Security Threat Plan‖ and Regulation 30.0, ―Miscellaneous‖, shall be re-numbered as 30.0 and 31.0 respectively. (21) Regulation 30.0 as re-numbered, shall be substituted by the following, namely: ―A detailed action plan on security breach or threat including bomb threat shall be prepared by entity and mock drill shall be carried out against various scenarios, at least once in a year‖. (22) In clause (1) of regulation 31.0 as renumbered, the words beginning with ―seek approval‖ and ending with, ―these regulations.‖, shall be substituted by the following, namely: ―thereafter take approval from Board of the entity for non-conformities and mitigation measures. The said approval along with the compliance report, mitigation measures and implementation schedule shall be submitted to the Board within six months.‖ (23) in Schedule-I, at the end of the Note, the words beginning with, ―A Copy of ERDMP‖, and ending with, ―submitted to the PNGRB‖, shall be numbered as (1) and after point (1) as so numbered, following point shall be inserted, namely: ―(2) The periodical review of ERDMP document shall be approved by the authority which has approved the ERDMP document i.e. entity's Board of Directors.‖ (24) In paragraph 8 of Schedule-III, for the words ―Technical Support Services‖, the words ―Professional Emergency Responders,‖, shall be substituted. It should be understood that the size and complexity of projects possess the various hazards and risks associated with construction activities. In majority, slow response, lack of resources, or the absence of trained personnel at construction site will lead to chaos in an emergency. To minimize human suffering and financial losses, it is therefore strongly recommended to develop the emergency response plan before commencement of project. The Emergency Response Plan shall include the following considerations: 1. Statutory Requirements: The entity shall ensure compliance of applicable Central and State Rules and Regulations and enactments such as The Building and Other Construction Workers‘ Act 1996, the Environment (Protection) Act, 1986, the Factories Act, 1948, the Inflammable Substances Act, 1952, the Motor Vehicles Act, 1988, the Public Liability Insurance Act, 1991, the Petroleum Act, 1934, the National Environment Tribunal Act, 1995, the Explosives Act, 1884 etc. Applicability and status of compliance should be made part of Emergency Response Plan. 2. Pre-Emergency Planning: a) The process of hazard identification and risk assessment involves a thorough review of construction activities such as Excavation, Scaffolding, Platforms and Ladders, Structural Work, Laying of Reinforcement and Concreting, Road Work, Cutting or Welding, Working in Confined Space, Proof or Pressure Testing, Working at Heights, Handling and Lifting Equipment, Vehicle Movement, Electrical, Demolition, Radiography, Shot blasting, transportation of pipes or equipment etc. to identify potential On-Site and Off-Site emergencies. b) Listing out On-Site (Level I and II) and Off-Site (Level-III) Emergency Scenarios based on the consequences and resources. 3. Emergency Mitigation Measures: The entity shall have an effective Health, Safety and Environment Management System in place to ensure safety during the following construction activities, namely: - a) Health, Safety and Environment (HSE) Policy; b) Duties & Responsibilities of Contractor/Executing Agency; c) Site planning and layout; d) Deployment of Safety Officer/Supervision; e) Safety committees with fair participation of workers; f) Safety audits and inspections shall be carried out with the help of prescribed checklists;30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] g) Work permit system; h) Personal protective equipment; and i) Safety awareness and training etc. 4. Emergency Preparedness Measures: a) Emergency Drill and Exercise on identified scenarios and its evaluations; b) Organizing trainings on Emergency Response; and c) Mutual Aid. 5. Emergency Response Procedures: The entity shall prepare well planned and documented procedures to ensure prompt response. The action plan may be documented for all emergency scenarios, identified as On-site and Off-site. 6. Emergency Organization and Responsibilities: The entity shall formulate organization chart (emergency action flow chart) and define the roles and responsibilities of key personnel for handling the emergency situation effectively at project site. Regulation 14.0 of PNGRB (ERDMP) Regulations, may be referred to develop the emergency organization and responsibilities. 7. Resources for Controlling Emergency: 1) The available emergency control systems and facilities within the project or construction site shall be as under, namely: - (a) Fire and gas detection system; (b) Fire protection and firefighting system (Active and Passive); (c) Ambulance facility in house, if not available then should be available on urgent call basis; (d) Rescue facilities and personal protective equipment (PPEs); (e) First aid facilities; (f) Medical facility in house or tie up with nearby hospital/health center; (g) Internal and External Communication facilities along with alerting system; (h) Assembly points; and (i) Escape route and evacuation zones. 2) Internal and External Emergency contact numbers and addresses of police, fire, station, hospitals, mutual aid industry, factory inspectors, Board, State Pollution, Control Board, Petroleum and Explosive Safety Organization (PESO), etc. 3) Addresses and Telephone Directory of Professional Emergency Responders, Technical Support Services. 8. Emergency Recovery Procedure: After the emergency, the following activities need to be carried out in detail, namely: a) Information to statutory authorities (Refer Clause 23.0 for Reporting of Incident to PNGRB); b) Incident investigation; c) Damage assessment; d) Salvage of products, de-contamination, clean-up and restoration; and e) A detailed report shall be prepared based on the entire experience of the incident, including restorations, limitations and lessons learnt.
