(1) इन जिजनयमों का संजिप् त नाम भारतीय प्रजतस्ट् पधा ाआयोग (साधारण) संिोधन जिजनयम, 2024 ह।ै (2) य े उनके रािपत्र म ेंप्रकािन की तारीख को प्रिृत् त होंगे। 2. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 म,ें उपजिजनयम (2) में, ‘‘कोई पिकार उसके द्वारा प्रस्ट् ततु सूचना या िस्ट् ताििे ों पर गोपनीयता की मांग करता ह ैतो िह ऐसे व् यिहार के जलए अकाट्य कारण 2990 GI/2024 (1)2 THE पिकार उसके द्वारा प्रस्ट् तुत सूचना या िस्ट् तािेिों पर गोपनीयता की मांग करता ह ै तो िह ऐसे व् यिहार के जलए अकाट्य कारण अजधकजर्त करेगा और स्ट् ियं प्रमाजणत करेगा दक दकसी सूचना या िस्ट् तािेि (िस्ट् तािेिों) या उसके दकसी भाग(भागों)’’ िब् ि रखे िाएंगे। 3. भारतीय प्रजतस्ट्प धा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 म,ें उपजिजनयम (2) म,ें खण् ड (घ) के पश् चात, ‘‘एक िचनबंध उपलब्ध कराएगा” िब् िों के पश् चात, ‘‘एक िपर्पत्र के स्ट् िरूप में’’ िब् ि अतं :स्ट् र्ाजपत दकए िाएंगे, ‘‘प्राजधकृत’’ िब् ि से पहले ‘‘सम् यक रूप स”े िब् ि अतं :स्ट्र् ाजपत दकया िाएगा, और ‘‘मंडल या कोई अन् य समकि जनकाय’’ के स्ट् र्ान पर ‘‘पिकार’’ िब् ि रखा िाएगा। 4. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 म,ें उपजिजनयम (3), (4) और (5) म,ें ‘‘िस्ट् तािेि(िस्ट् तािेिों)’’ िब् ि स ेपहल,े ‘‘सूचना या’’ िब् ि अतं :स्ट्र् ाजपत दकए िाएगं े। 5. भारतीय प्रजतस्ट्प धा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 म,ें उपजिजनयम (3) में, ‘‘सूचना(सूचनाओं)’’ िब् ि के स्ट् र्ान पर, ‘‘सूचना’’ िब् ि रखा िाएगा। 6. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 म,ें उपजिजनयम (6) के िसू रे परंतुक में, ‘‘िस्ट् तािेिों’’ िब् ि के स्ट्र् ान पर, ‘‘िस्ट् तािेि(िस्ट् तािेिों)’’ िब् ि रखा िाएगा। 7. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 म,ें उपजिजनयम (6) के पश् चात, जनम्न जलजखत जिजनयम अंत:स्ट् र्ाजपत दकया िाएगा: ‘‘(6क) (क) गोपनीय सूचना तक पहुचं की मागं करन ेिाल ेपिकार, एक आिेिन की रीजत से, यर्ासंभििीघ्र, गोपनीयता िलय स्ट्र् ाजपत करने का अनुरोध करेगा। (ख) उस ििा म,ें िहां पिकार ने अन् िेषण ररपोर्ा की अगोपनीय पाठ की प्राजि के पश् चात, ऐसा अनुरोध दकया ह ैिहा ं उसे, उसकी प्राजि के 10 (िस) दििसों के भीतर कर दिया िाएगा:: परंत ुयह दक यदि आयोग का यह समाधान हो िाता ह ैदक पिकार को 10 (िस) दििसों की कजर्त कालािजध के भीतर अनुरोध करन ेसे पयािा कारण स ेरोका गया र्ा, तो िह 7 (सात) दििसों की आगे की कालािजध के भीतर दकए गए अनरुोध पर जिचार कर सकेगा।” 8. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 म,ें उपजिजनयम (7) में, ‘‘िचनबंध िाजखल करना’’ िब् िों के पश् चात, ‘‘एक िपर्पत्र के स्ट् िरूप म’ें’ िब् ि अतं :स्ट्र् ाजपत दकए िाएंग े और ‘‘िस्ट् तािेि’’ िब् ि के स्ट् र्ान पर ‘‘िस्ट् तािेि(िस्ट् तािेिों)’’ िब्ि रखा िाएगा। 9. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 में, उपजिजनयम (7) के पहले परंतुक में, ‘‘उपयुाक् त जनबंधनों पर अलग िचनबंध(िचनबंधों)’’ िब् िों के पश् चात, ‘‘एक िपर्पत्र के स्ट् िरूप म’ें’ िब् ि अंत:स्ट्र् ाजपत दकए िाएंगे। 10. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 म,ें उपजिजनयम (7) के िसू रे परंतुक में, ‘‘परंतु यह और दक गोपनीयता िलय का भाग बनने िाल े संबंजधत पिकारों के प्रजतजनजध’’ िब्ि ों के स्ट् र्ान पर ‘‘परंत ु यह और दक गोपनीयता िलय का भाग बनन ेिाले संबंजधत पिकार और उनके सिस्ट् य’’ िब् ि रखे िाएंगे। 11. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 म,ें उपजिजनयम (7) के पश् चात, जनम्न जलजखत जिजनयम अंत:स्ट् र्ाजपत दकया िाएगा:[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 ‘‘(7क) पिकार गोपनीय िलय स्ट्र् ाजपत करन ेके आिेि की प्राजि की तारीख 10 (िस) दििसों की कालािजध के भीतर, उपयुाक् त उपजिजनयम (7) के जनबधं नों के अनुसार िचनबंध िाजखल करेंग:े परंत ुयह दक यदि आयोग का यह समाधान हो िाता ह ैदक पिकार को 10 (िस) दििसों की कजर्त कालािजध के भीतर, िचनबंध िाजखल करने से पयााि कारण से रोका गया र्ा, तो िह 5 (पांच) दििसों की आगे की कालािजध के भीतर, उसका प्रजतग्रहण कर सकेगा।” 12. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 म,ें उपजिजनयम (8) के पश् चात, जनम्न जलजखत उपजिजनयम अंत:स्ट् र्ाजपत दकए िाएगं े और तिनुसार, ितामान उपजिजनयम (9) और (10) क्रमि: उपजिजनयम (11) और (12) के रूप म ें पनु : संख् याककंत हो िाएगं े: “(9) (1) गोपनीयता िलय म ेंसजम्मजलत पिकार, इन जिजनयमों के जिजनयम 50 के सार् परठत, जिजनयम 37 के अधीन, िचनबंध(िचनबंधों) को प्रस्ट् ततु करन ेकी तारीख से 7 (सात) दििसों की कलािजध के भीतर, जनरीिण की मांग करने के आिेिन(आििनों) को कर सकेंगे। (2) पिकारों को ऐसा जनरीिण, अनुज्ञा दिय ेिाने के 21 (इक्क ीस) दििसों की कालािजध के भीतर पणू ा करना होगा। (3) पिकार, इसके पश् चात 7 (सात) दििसों की कालािजध के भीतर, इन जिजनयमों के जिजनयम 50 के सार् परठत जिजनयम 37 के अधीन, प्रमाजणत प्रजतयां प्रिान करन ेकी मांग के आिेिन(आिेिनों) को कर सकेंगे। (4) प्रमाजणत प्रजतयों की मागं करन ेके आिेिन की प्राजि पर, उसकी 14 (चौिह) दििसों की कालािजध के भीतर प्रिायगी कर िी िाएगी: परंतु यह दक सजचि, उपयुाक् त उपखंड (2) के अधीन जिजहत समयािजध(समयािजधयों) को आगे 7 (सात) दििसों की कालािजध ककंतु अपश् चात, बढा सकेगा।” “(10) (1) आयोग, आपिादिक मामलों में, जिजिष्र् जिषय के तथ्य ों और पररजस्ट्र्जतयों पर जिचार करत ेहुए, कारणों को जलजखत में लेखबद्ध करके, इस जिजनयम के अधीन जिजहत समयािजध बढा सकेगा। (2) उस ििा म,ें िहां पिकार(पिकारगण), प्रित् त समयािजध का पालन करने म ेंजिफल रहता ह/ैरहते ह,ैं िहा ं आयोग, कानून के अनुसार कायिााही िारी रखेगा।” 13. भारतीय प्रजतस्ट्प धा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 म,ें उपजिजनयम (10) (संिोजधत उपजिजनयम 12) में, ‘‘िस्ट् ताििे (िस्ट् तािेिों) या उसके भाग(भागों)’’’ िब् िों से पहले ‘‘सूचना या’’ िब् ि अंत:स्ट्र् ाजपत दकए िाएंगे। 14. भारतीय प्रजतस्ट्प धा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 35 म,ें उपजिजनयम (10) (संिोजधत उपजिजनयम 12) के पहल े परंतकु में, ‘’कायाालय डीिी’’ िब् िों से पहल े‘‘कायाालय महाजनिेिक’ िब् ि रखे िाएंगे। 15. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 37 म,ें उपजिजनयम (1) म,ें ‘‘खण् ड 57 के उपबधों’’ िब् िों के पश् चात, ‘‘अजधजनयम का’’ िब् ि अतं :स्ट्र् ाजपत दकए िाएंग े और ‘‘और जिजनयम 35’’ िब् िों के पश् चात, ‘‘इन जिजनयमों का’’ िब् ि अतं :स्ट् र्ाजपत दकए िाएंगे। 16. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 37 म,ें उपजिजनयम (1) म,ें पणू ाजिराम ‘‘।‘’ के बिाय जिसगा ‘’:’’ के सार् समाप् त होगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 17. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 37 म,ें उपजिजनयम (2) म,ें ‘‘ऐसे व् यजि को जनरीिण करने की अनज्ञु ा’’ िब् िों के पश् चात, ‘‘और/या प्रमाजणत प्रजतयां प्रिान करना’’ िब् ि अंत:स्ट् र्ाजपत दकए िाएंगे। 18. भारतीय प्रजतस्ट्प धा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 37 म,ें उपजिजनयम (3) के परंतुक में, ‘‘िस्ट् तािेिों का जनरीिण या उसकी प्रजतयां प्राप् त करना’’ िब् िों के स्ट् र्ान पर ‘‘िस्ट् तािेिों का जनरीिण या उसकी प्रमाजणत प्रजतयां प्रिान करना’’ िब् ि रखे िाएंगे। 19. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 37 म,ें उपजिजनयम (3) के परंतुक के पश् चात, जनम्न जलजखत िसू रा परंतुक अंत:स्ट् र्ाजपत दकया िाएगा: "परंत ुयह और दक गोपनीय िस्ट् तािेिों का जनरीिण और उसकी प्रमाजणत प्रजतयां अजभप्राप् त करने के प्रयोिनों के जलए, इन जिजनयमों के जिजनयम 35 के अधीन यर्ाअनुबद्ध समय सीमाएं लाग ूहोंगी।" 20. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 37 म,ें उपजिजनयम (1) में, उपजिजनयम (3) का पहला परंतुक पूणाजिराम ‘‘।‘’ के बिाय जिसगा ‘’:’’ के सार् समाप् त होगा। 21. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 50 का िीषाक, "जनरीिण और प्रजतजलजप प्रभार" म ें"जनरीिण और प्रजतजलजप फीस" िीषाक रखा िाएगा। 22. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 50 म,ें उपजिजनयम (1) म,ें "एक हिार रुपय े प्रजत दििस" िब् िों के स्ट् र्ान पर "िो हिार पांच सौ रुपय ेप्रजत दििस" िब् ि रखे िाएगं े। 23. भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जिजनयम, 2009 म,ें जिजनयम 50 म,ें उपजिजनयम (2) में, "कायाािाजहयों के पिकारों के जलए प्रजतयां प्राप् त करने संबंधी प्रभार" िब् िों के स्ट् र्ान पर "प्रमाजणत प्रजतयां प्रिाय करने के जलए फीस" िब् असाधारण 5 THE COMPETITION COMMISSION OF INDIA [The Competition Commission of India (General) Amendment Regulations, 2024)] NOTIFICATION New Delhi, the 10th May, 2024 (No. 06 of 2024) No. L-3(2)/ Regl.-Gen. (Amdt.)/ 2024/ CCI.—In exercise of the powers conferred by sections 36 and 64 of the Competition Act, 2002 (12 of 2003), the Competition Commission of India hereby makes the following regulations to further amend the Competition Commission of India (General) Regulations, 2009, namely: – 1. Short title and commencement. (1) These regulations may be called the Competition Commission of India (General) Amendment Regulations, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, in sub-regulation (2), the words “A party seeking confidentiality over the information or the documents furnished by it shall set out cogent reasons for such treatment and shall self-certify that making the document or documents or information or a part or parts thereof public” shall be substituted with the words “A party seeking confidentiality over the information or the document(s) furnished by it shall set out cogent reasons for such treatment and shall self-certify that making the information or document(s) or part(s) thereof public”. 3. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, in sub-regulation (2), after clause (d), after the words “shall provide an undertaking”, the words “in the form of an affidavit” shall be inserted, before the word “authorised”, the word “duly” shall be inserted, and the words “Board or any other equivalent body” shall be substituted with the word “party”. 4. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, in sub-regulations (3), (4) and (5), before the word “document(s)” the words “information or” shall be inserted. 5. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, in sub-regulation (3), the word “information(s)” shall be substituted with the word “information”. 6. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, in the second proviso to sub-regulation (6), the word “documents” shall be substituted with the word “document(s)”. 7. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, after sub-regulation (6), the following sub-regulation shall be inserted: “(6A) (a) The party seeking access to confidential information shall make a request for setting up a Confidentiality Ring, by way of an application, at the earliest. (b) In case such request is made by a party post receipt of the non-confidential version of the investigation report, the same shall be made within a period of 10 (ten) days from the receipt thereof: Provided that if the Commission is satisfied that the party was prevented by sufficient cause from making the request within the said period of 10 (ten) days, it may entertain the request made within a further period of 7 (seven) days.” 8. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, in sub-regulation (7), after the words “filing of undertakings”, the words “in the form of an affidavit” shall be inserted and the word “documents” shall be substituted with the word “document(s)”. 9. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, in the first proviso to sub-regulation (7), after the words “separate undertaking(s) on aforesaid terms”, the words “in the form of an affidavit” shall be inserted. 10. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, in the second proviso to sub-regulation (7), the words “Provided further that the representatives of the parties concerned forming part of Confidentiality Ring” shall be substituted by the words “Provided further that the parties concerned and their members forming part of Confidentiality Ring”. 11. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, after sub-regulation (7), the following sub-regulation shall be inserted:6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] “(7A) The parties shall file undertakings in terms of sub-regulation (7) above within a period of 10 (ten) days from the date of receipt of the order setting up Confidentiality Ring: Provided that if the Commission is satisfied that the party was prevented by sufficient cause from filing the undertaking within the said period of 10 (ten) days, it may accept the same filed within a further period of 5 (five) days.” 12. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, after sub-regulation (8), the following sub-regulations shall be inserted and accordingly, existing sub-regulations (9) and (10) shall be renumbered as sub-regulations (11) and (12), respectively: “(9) (1) The parties included in the Confidentiality Ring may make application(s) seeking inspection under regulation 37 read with regulation 50 of these regulations, within a period of 7 (seven) days from the date of submission of undertaking(s). (2) Such inspection shall be completed by the parties within a period of 21 (twenty-one) days of being allowed. (3) The parties may make application(s) seeking grant of certified copies under regulation 37 read with regulation 50 of these regulations within a period of 7 (seven) days thereafter. (4) On receipt of an application seeking certified copies, the same shall be supplied within a period of 14 (fourteen) days: Provided that the Secretary may extend the time period(s) prescribed under sub-clause (2) above for a further period of 7 (seven) days but not thereafter.” “(10) (1) The Commission may, considering the facts and circumstances of a particular matter, in exceptional cases, extend the timelines prescribed under this regulation for reasons to be recorded in writing. (2) In case the party(s) fail to adhere to the given timelines, the Commission shall continue with the proceedings in accordance with law.” 13. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, sub-regulation (10) (revised sub-regulation 12), before the words “document(s) or part(s) thereof”, the words “information or” shall be inserted. 14. In the Competition Commission of India (General) Regulations, 2009, in regulation 35, in the first proviso to sub-regulation (10) (revised sub-regulation 12), the words “Office of the DG” shall be substituted with the words “Office of the Director General”. 15. In the Competition Commission of India (General) Regulations, 2009, in regulation 37, in sub-regulation (1), after the words “provisions of Section 57”, the words “of the Act” shall be inserted and after the words “and regulation 35”, the words “of these regulations” shall be inserted. 16. In the Competition Commission of India (General) Regulations, 2009, regulation 37, sub-regulation (1), shall end with a colon “:” instead of a full-stop “.” 17. In the Competition Commission of India (General) Regulations, 2009, in regulation 37, in sub-regulation (2), after the words “allow such person inspection”, the words “and/ or grant of certified copies” shall be inserted. 18. In the Competition Commission of India (General) Regulations, 2009, in regulation 37, in the proviso to sub- regulation (3), the words “inspection of documents or copying thereof” shall be substituted by the words “inspection of documents or grant of certified copies thereof”. 19. In the Competition Commission of India (General) Regulations, 2009, in regulation 37, after the proviso to sub- regulation (3), the following second proviso shall be inserted: “Provided further that for the purposes of inspection and grant of certified copies of confidential documents, the time limits as stipulated under regulation 35 of these regulations, shall apply.” 20. In the Competition Commission of India (General) Regulations, 2009, regulation 37, the first proviso to sub- regulation (3), shall end with a colon “:” instead of a full-stop “.” 21. In the Competition Commission of India (General) Regulations, 2009, the heading of regulation 50 “Inspection and copying charges” shall be substituted with the heading “Inspection and copying fees”. 22. In the Competition Commission of India (General) Regulations, 2009, in regulation 50, in sub-regulation (1), the words “rupees one thousand per day” shall be substituted by the words “rupees two thousand five hundred per day”.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 23. In the Competition Commission of India (General) Regulations, 2009, in regulation 50, in sub-regulation (2), the words “Copying Charges for the parties to the proceedings” shall be substituted by the words “Fees for supplying certified copies”.
