(ii) दकसी मान्यता प्राप्त जििजिद्यालय या संस्ट्थान से अजधमानत: जिजध या प्रबंधन या अथिा ास्त्र या लोक प्रिासन म ें स्नातक जडग्री धारण करता हो; (iii) जिजध के िेत्र म;ें या प्रबंधन या प्रिासन या जित्त, अजधमानत: माध्यस्ट््म ् के िेत्र म ें न्यूनतम बीस िष ा का पश्च- अहता ा अनुभि हो । (2) केन्द्रीय सरकार या राज्य सरकार या संघ राज्यिेत्र प्रिासन या न्यायालयों या अजधकरणों या स्ट्िायत्त जनकायों या मान्यता प्राप्त जििजिद्यालयों के अजधकारी, जिनकी पतैं ालीस िषा से कम की आय ुन हो, और- (क) (i) िो जनयजमत आधार पर सिश्ृ य पि धारण करत े हों; और (ii) जिन्होंने भारत सरकार के संयुि सजचि या समतुल्य पि न्यूनतम िो िषा की अिजध के जलए धारण दकया हो और िो प्रिासन या जिजध के िेत्र म,ें अजधमानत: माध्यस्ट्थम ्के िेत्र में काया करन ेका अनुभि रखत ेहों; और (ख) दकसी मान्यता प्राप्त जििजिद्यालय या संस्ट्थान से अजधमानत: जिजध या प्रबंधन या अथिा ास्त्र या लोक प्रिासन म ें स्नातक जडग्री धारण करता हो, प्रजतजनयुजि पर जनयुजि के जलए पात्र होंग े। 7. जनयजु ि की अिजध.- (1) प्रजतजनयुजि पर जनयुजि के जलए अजधकतम आयु सीमा आिेिन प्राप्त करने की अंजतम तारीख को छप्पन िषा से अजधक नहीं होगी । (2) प्रजतजनयुजि के आधार पर जनयुजि की ििा म,ें मख्ु य कायाकारी अजधकारी की जनयुजि की अिजध साधारणतया तीन िषा से अजधक नहीं होगी । (3) प्रजतजनयुजि पर जनयिु दकए गए मख्ु य कायाकारी अजधकारी की पिािजध कार्माक और प्रजििण जिभाग द्वारा समय- समय पर िारी दकए गए लाग ूआिेिों और अनुिेिों के अनुसार बढाई िा सकेगी । (4) सीधी भती द्वारा जनयुजि की ििा म ें मुख्य कायाकारी अजधकारी की जनयुजि की अिजध अजधकतम तीन िषा की अिजध के जलए या साठ िषा की आयु प्राप्त होने तक, इनमें से िो भी पहले हो, होगी: परंत ु िह पुनर्नायुजि के जलए पात्र होगा । 8. जनयजु ि के जलए प्रदक्रया.- कार्माक और प्रजििण जिभाग द्वारा समय-समय पर िारी दकए गए मागाििाक जसद्धांतों, आिेिों और अनुिेिों का मुख्य कायाकारी अजधकारी के पि पर जनयुजि के जलए अनुसरण दकया िाएगा । 9. आमले न.- इन जिजनयमों म ें दकसी बात के होते हुए भी, मख्ु य कायाकारी अजधकारी के रूप म ें जनयुि दकया गया व्यजि आमेलन के जलए जिचार दकए िाने का पात्र नहीं होगा । 10. अनिु ासजनक कायिा ाजहया.ं - मुख्य कायाकारी अजधकारी के जिरुद्ध अनुिासजनक कायिा ाजहयां केन्द्रीय सरकार के तत्स्ट्थानी िेतनमान म ेंसमूह क से संबंजधत अजधकाररयों पर लागू जनयमों और जिजनयमों के अनसु ार होगी । 11. िास-सजु िधा.- मुख्य कायाकारी अजधकारी, उस समान िर पर मकान दकराया भत्ता प्राप्त करन े का हकिार होगा, िो उन स्ट्थानों पर तत्स्ट्थानी िेतनमान में पि धारण करन े िाले केन्द्रीय सरकार के समूह ‘क’ अजधकाररयों को अनुज्ञेय ह ै। 12. सिे ा ित—ें (1) मुख्य कायाकारी अजधकारी की सेिा ितें, िेतन, भत्त,े छुट्टी, भजिष्य जनजध, अजधिर्षाता, पेंिन और सेिाजनिृजत्त फायि,े जचदकत्सा सुजिधाएं और अन्य सेिा िता के मामले ऐसे जनयमों और जिजनयमों के अनुसार जिजनयजमत होंगे िो केंद्रीय सरकार म ेंतत्स्ट्थानी िेतनमान में समूह ‘क’ से संबंजधत अजधकाररयों को समय-समय पर लाग ूह ैं।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (2) उपजिजनयम (1) म ेंजिजनर्िाष्ट सेिा ित ें सीधी भती द्वारा जनयुि मख्ु य कायाकारी अजधकारी को लाग ूहोंगी । 13. जनरहता ा : िह व्यजि-- (क) जिसन े ऐस े व्यजि स े जिसका पजत या जिसकी पत्नी िीजित ह,ैं जििाह दकया ह,ै या जििाह की संजििा की ह;ै या (ख) जिसन े अपन े पजत या अपनी पत्नी के िीजित रहत े हुए दकसी व्यजि स े जििाह दकया ह ै या जििाह की संजििा की ह,ै उि पिों म ेंस े दकसी पर जनयुजि का पात्र नहीं होगा : परन्त ु यदि केद्रीय सरकार का यह समाधान हो िाता ह ै दक ऐसा जििाह ऐस े व्यजि और जििाह के अन्य पिकार को लाग ू स्ट्िीय जिजध के अधीन अनुज्ञेय ह ैऔर ऐसा करन े के जलए अन्य आधार ह ैंतो िह दकसी व्यजि को इस जनयम के प्रितना स ेछूट ि े सकेगी । 14. मख्ु य कायका ारी अजधकारी की िजिया ंऔर कृत्य—मुख्य कायाकारी अजधकारी के जनम्नजलजखत कृत्य और िजियां होंगी, िो केंद्र के परामिा स ेप्रयुि की िाएंगी, अथाात ् :-- (i) केंद्र का िैजनक प्रिासन; (ii) मुख्य कायाकारी अजधकारी का केंद्र के अजधकाररयों और अन्य कमाचाररयों पर प्रिासजनक जनयंत्रण होगा; (iii) मानि संसाधन प्रबंधन िैसे ररजियों का भरा िाना, प्रोन्नजत, िेतन जनयत करना; (iv) केंद्रीय सरकार और सजचिालय के साथ समन्िय करना; (v) साधारण जित्तीय जनयम, 2017 और समय-समय पर िारी केंद्रीय सरकार के अन्य दििाजनिेिों के उपबंधों के अनुसार ही केंद्र के जलए माल और सेिा उपापन करना; (vi) प्रसुजिधा प्रबंधन (भिन, अनरु िण, उपस्ट्कर और यानों को दकराए पर लेना); (vii) िार्षाक लेखा, रािस्ट्ि और व्यय जििरण तैयार करना तथा केंद्र का बिट जनष्पािन, जनयजमत मानीटरी और प्राजप्त और व्यय का पनु रीिण करना; (viii) केंद्र की िार्षाक ररपोटा तैयार करना, जिसमें पूिािष ा के िौरान केंद्र के सभी दक्रयाकलाप आते हों, केंद्र के िार्षाक लेखा तैयार करना और समय-समय पर िारी अनुिेिों और नीजत के अनुसार संसि ्के समि रखा िाना सुजनजश्चत करना; (ix) केंद्र के उद्दश्े यों को बढािा िेने के जलए सभी उपाय करना; (x) सरकारी अनुििे ों, नीजतयों, दििाजनिेिों, जििेष रूप से िो उपापन, जिकायत जनिारण प्रणाली, सूचना का अजधकार, 2005 (2005 का 22) से संबंजधत ह,ैं का अनुपालन सुजनजश्चत करना; (xi) अन्य दक्रयाकलाप िैस े निोन्मखु ता लाना, केंद्र के काय ा म ें समानता और पारिर्िाता लाना, केंद्र की ब्ांडडंग करना, केंद्र के दक्रयाकलापों का प्रचार करना, केंद्र की मुकिमेबािी का प्रबंधन करना, आदि; (xii) ऐसे अन्य कृत्य करना या ऐसी अन्य िजियां प्रयोग करना, िो समय-समय पर केंद्र द्वारा समनुिेजित की िाए ं। 15. जिजथल करन े की िजि : िहां केद्रीय सरकार की यह राय ह ै दक ऐसा करना आिश्यक या समीचीन ह,ै िहा ं िह उसके जलए िो कारण ह ैं उन्ह ें लेखबद्ध करके, इन जनयमों के दकसी उपबंध को दकसी िग ा या प्रिग ा के व्यजियों की बाबत, आिेि द्वारा जिजथल कर सकेगी । 16. अिजिष्ट उपबधं —ऐसे जिषय, जिनके संबंध में इन जिजनयमों के अधीन कोई स्ट्पष्ट उपबंध नहीं बनाए गए हैं, अपन े जिजनश्चयों के जलए केंद्र द्वारा केंद्रीय सरकार को जनर्िष्टा दकया िाएगा । हमे न्त गुप्ता, अध्यि [जिज्ञापन-III/4/असा./461/2023-24]4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] INDIA INTERNATIONAL ARBITRATION CENTRE NOTIFICATION New Delhi, the 5th October, 2023 F. No. A-60011/117/2023-Administration(AR)-IIAC. - In exercise of the powers conferred by sub- clauses (c) and (d) of sub-section (2) of section 31 of the India International Arbitration Centre Act, 2019 (17 of 2019), the India International Arbitration Centre hereby makes the following Regulations, namely: - 1. Short title and commencement. – (1) These regulations may be called the India International Arbitration Centre (Manner of Appointment and Powers and Functions of the Chief Executive Officer) Regulations, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. - (1) In these regulations unless the context otherwise requires, - (a) “Act” means India International Arbitration Centre Act, 2019; (b) “Centre” means the India International Arbitration Centre, established and incorporated under section 3 of the Act; (c) “Chief Executive Officer” means the Chief Executive Officer appointed under section 21 of the Act. (2) The other words and expressions used herein but not defined shall have the same meaning respectively assigned to them in the Act. 3. Appointing authority. – The Centre shall be the appointing authority of the Chief Executive Officer. 4. Pay and allowances. - The Chief Executive Officer shall receive pay in the level-15 (Rs.182200-224100) in the pay matrix and other allowances and benefits, as are admissible to the Central Government officer holding the post carrying the same pay. 5. Method of recruitment. – The Chief Executive Officer shall be appointed by direct recruitment or by deputation (including short-term contract) in accordance with the applicable guidelines, orders and instructions issued from time to time by the Department of Personnel and Training in this regard. 6. Eligibility criteria. – (1) For the direct recruitment, the following criteria shall be required to be fulfilled, namely: - (i) Age-limit: Not less than forty-five years; (ii) Possessing a Bachelor’s degree in Law or Management or Economics or Public Administration or any other subject, from a recognised University or Institute and; (ii) Minimum twenty years of post-qualification experience in the field of law; or management or administration or finance, preferably in the field of arbitration. (2) The Officers of the Central Government or State Government or Union territory administration or Courts or Tribunals or Autonomous bodies or recognised Universities, who are not less than forty-five years of age, and - (a) (i) holding analogous post on regular basis; or (ii) holding a post of Joint Secretary to the Government of India or equivalent for a minimum period of two years and having experience of working in areas of administration or law, preferably in the field of arbitration; and (b) possessing a Bachelor’s degree in Law or a degree in Management or Economics or Public Administration or any other subject, from a recognised University or Institute, shall be eligible for appointment on deputation. 7. Term of appointment. – (1) The maximum age-limit for appointment on deputation shall be not be exceeding fifty-six years as on the closing date of the receipt of applications. (2) In case of appointment on deputation basis, the term of appointment of the Chief Executive Officer shall not ordinarily exceed three years. (3) The term of the Chief Executive Officer appointed on deputation may be extended in accordance with the applicable orders and instructions issued from time to time by the Department of Personnel and Training.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 (4) In case of appointment by direct recruitment, the term of appointment of the Chief Executive Officer shall be for a maximum period of three years or till attaining the age of sixty years, whichever is earlier, provided that he shall be eligible for reappointment. 8. Procedure for appointment. - The guidelines, orders and instructions issued by the Department of Personnel and Training from time to time shall be followed for appointment to the post of Chief Executive Officer. 9. Absorption. - Notwithstanding anything in these regulations, the persons appointed as Chief Executive Officer, shall not be eligible to be considered for absorption. 10. Disciplinary proceedings. - The disciplinary proceedings against the Chief Executive Officer shall be as per rules and regulations applicable to officers belonging to Group A in the corresponding scales of pay of the Central Government. 11. Accommodation. - The Chief Executive Officer shall be entitled to a house rent allowance at the same rate, as are admissible to officers of Group ‘A’ of the Central Government holding the post in corresponding scale of pay, stationed at those places. 12. Conditions of service. – (1) The conditions of service of the Chief Executive Officer in the matters of pay, allowances, leave, provident fund, age of superannuation, pension and retirement benefits, medical facilities and other conditions of service, shall be regulated in accordance with such rules and regulations as are for the time being applicable to officers belonging to Group ‘A’ in corresponding scales of pay in the Central Government. (2) The conditions of service referred to in sub-regulation (1) shall also apply to the Chief Executive Officer appointed by direct recruitment. 13. Disqualification. —No person, - (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts: Provided that the Central Government may, if satisfied that such marriage is permissible under personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 14. Powers and functions of Chief Executive Officer. - The Chief Executive Officer shall have the following functions and powers, which would be exercised in consultation with the Centre, namely: - (i) the day-to-day administration of the Centre; (ii) the Chief Executive Officer shall have administrative control over the officers and other employees of the Centre; (iii) human resource management like filling up of vacancies, promotion, pay fixation; (iv) coordinating with the Central Government and the Secretariat; (v) procurement of goods and services for the Centre strictly as per the provisions of General Financial Rules, 2017 and other guidelines of the Central Government issued from time to time; (vi) facility management (Maintenance of building, hiring of equipment and vehicles) (vii) the preparation of the annual accounts, statement of revenue and expenditure and the execution of the budget of the Centre, regular monitoring and reviewing of expenditure and receipts; (viii) preparation of annual report of the Centre covering all activities of the Centre during the previous year, preparation of annual accounts of the Centre and ensuring laying in the Parliament as per the policy and instructions issued from time to time; (ix) all steps to promote the objectives of the Centre; (x) ensuring compliance of Government instructions, policies, guidelines particularly those relating to procurement, grievance redressal mechanism, Right to Information Act, 2005 (22 of 2005); (xi) other activities like bringing innovation, equity and transparency in the working of the Centre, branding of the Centre, publicity of the activities of the Centre, management of litigation of the Centre etc; (xii) performing such other functions, or exercising such other powers, as may be assigned by the Centre from time to time.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 15. Power to relax. -Where the Centre is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these regulations with respect to any class or category of persons with the prior approval of the Central Government. 16. Residuary provisions. - Matters with respect to which no express provision has been made under these regulations shall be referred by the Centre to the Central Government for its decision.
