1. इि जिजियमों को भारतीय प्रजतभूजत और जिजिमय बोडड (जिदेिी पोर्डफोजलयो जििेिक) (संिोधि) जिजियम, 2023 कहा िा सकेगा । 2. ये जिजियम रािपत्र म ेंइिके प्रकािि की तारीख को लागू होंग े। 3. भारतीय प्रजतभूजत और जिजिमय बोडड (जिदेिी पोर्डफोजलयो जििेिक) जिजियम, 2019 म,ें- I. जिजियम 3 म,ें – i. उप-जिजियम (2) म,ें 1728 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] क. िब्दों और जचह्ि “अजभजहत जिक्षेपागार सहभागी को सरकार या बोडड द्वारा समय- समय पर जिधाडठरत दकए िािे िाले फॉमड म,ें दकया िाएगा” के स्ट्थाि पर, िब्द और जचह्ि “अजभजहत जिक्षेपागार सहभागी (डीडीपी) के पास उसी फॉमड म ें दकया िाएगा िैसा सरकार या बोडड द्वारा समय-समय पर जिधाडठरत दकया िाए” आ िाएँग े | ख. िब्दों “जिधाडठरत फीस लगाई िाएगी” के स्ट्थाि पर, िब्द और जचह्ि “जिधाडठरत की गई फीस लगाई िाएगी तथा कोई दस्ट्तािेि उसी प्रकार प्रस्ट्त त दकए िाएँग े िैसा बोडड द्वारा समय-समय पर जिधाडठरत दकया िाए” आ िाएँग े | II. जिजियम 22 म,ें i. उप-जिजियम (1) म,ें खंड (ख) म,ें िब्द “त रंत” के स्ट्थाि पर, िब्द और जचह्ि “िल्द स े िल्द ककंत सात कायड-ददिसों के भीतर,” आ िाएँगे | ii. उप-जिजियम (1) म,ें खंड (ग) के स्ट्थाि पर जिम्नजलजखत खंड आ िाएगा, अथाडत,् - “(ग) बोडड और अजभजहत जिक्षेपागार सहभागी (डेज़िग्नेठर्ड जडपॉज़िर्री पार्र्डजसपेंर्) को िल्द स े िल्द ककंत सात कायड-ददिसों के भीतर, जलजखत रूप म ें सूजचत करेगा, यदद उसके द्वारा बोडड या अजभजहत जिक्षेपागार सहभागी को पहल े दी गई िािकारी में कोई महत्त्िपूण ड बदलाि हो िाता हो (जिसम ें उसकी संरचिा या स्ट्िाजमत्ि या जियंत्रण या जििेिक समूह म ें प्रत्यक्ष रूप से या अप्रत्यक्ष रूप स ेहुआ कोई बदलाि िाजमल ह)ै ;” iii. उप-जिजियम (1) म,ें खंड (ङ) म,ें िब्द “त रंत” के स्ट्थाि पर, िब्द और जचह्ि “िल्द से िल्द ककंत सात कायड-ददिसों के भीतर,” आ िाएँगे | iv. उप-जिजियम (1) म,ें खंड (र्) के बाद, जिम्नजलजखत खंड िोडा िाएगा, अथाडत,् - These regulations maybe called the Securities and Exchange Board of India (Foreign Portfolio Investors) (Amendment) Regulations, 2023. 2. They shall come into force on the date of their publication in the Official Gazette. 3. In the Securities and Exchange Board of India (Foreign Portfolio Investors) Regulations, 2019, – I. In regulation 3, – i. in sub-regulation (2),4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] a. afterthewords“Form”andbeforethewords“specified by the Government or the Board from time to time”,thewords“and manner”shall be inserted. b. after the words “Part A of the Second Schedule”, the words “and any documents in the manner specified by the Board from time to time” shall be inserted. II. In regulation 22, i. in sub-regulation (1), in clause (b), the word “forthwith” shall be substituted with the words and symbol “as soon as possible but not later thanseven working days,”. ii. in sub-regulation (1), clause (c) shall be substituted with the following, namely,- “(c) as soon as possible but not later thanseven working days, inform the Board and designated depository participant in writing, if there is any material change in the information including any direct or indirect change in its structure or ownership or control or investor grouppreviously furnished by him to the Board or designated depository participant;” iii. in sub-regulation (1), in clause (e), the word “forthwith”shall be substituted with the words and symbol “as soon as possible but not later thanseven working days,”. iv. in sub-regulation (1), after clause (k), the following clause shall be inserted, namely, - “(l) ensure that accurate details regarding its investor group are maintained with its designated depository participant at all times.” v. sub-regulation (5) shall be substituted with the following namely,- “(5) In case of any direct or indirect change in structure or common ownership or control of the foreign portfolio investor or investor group, it shall,as soon as possible but not later thanseven working days, bring the same to the notice of its designated depository participant.” III. In regulation 31, in sub-regulation (1) i. in clause (b), the word “forthwith” shall be substituted with the words “as soon as possible but not later thantwo working days”. ii. in clause (c), the word “forthwith” shall be substituted with the words and symbol “as soon as possible but not later thantwo working days,”. iii. in clause (g), the word “forthwith” shall be substituted with the words “as soon as possible but not later thantwo working days,”.
