(ii) सा.का.िन. 576 (अ), तारीख 29 िसत(cid:17)बर, 1982; (iii) सा.का.िन. 279 (अ), तारीख 2 अ*ैल, 2012; और (iv) सा.का.िन.373 (अ), तारीख 18 मई, 2012। MINISTRY OF AYURVEDA, YOGA AND NATUROPATHY, UNANI, SIDDHA AND HOMOEOPATHY (AYUSH) NOTIFICATION New Delhi, the, 27th July, 2018 G.S.R. 713(E).—In exercise of the powers conferred by sub-section(1) of section 4 and sub-section (1) of section 32 of the Homoeopathy Central Council Act, 1973 (59 of 1973), the Central Government hereby makes the following rules further to amend the Homoeopathy Central Council (Election) Rules, 1975, namely:- 1. (1) These rules may be called the Homoeopathy Central Council (Election) Amendment Rules, 2018. (2) These rules shall come into force on the date of their publication in the Official Gazette. 2.In the Homoeopathy Central Council (Election) Rules, 1975,- (a) for rule 7, the following rule shall be substituted, namely:- “7. Fixation of dates of various stages of elections.- The Returning Officer shall appoint and notify in the Official Gazette and in such other manner as he thinks fit, the time, date and place for- (a) the receipt of the nomination papers and their scrutiny; (b) the mode of election and the venue of polling booth; (c) the poll; and (d) the scrutiny and counting of votes.”; (b)for rules 13, 14, 15, 16 and 17the following rules shall be substituted, namely:- “13. Poll.— (1) Where the number of candidates duly nominated is equal to or less than the number of members to be elected from the State concerned, the Returning Officer shall forthwith declare such candidates to be duly elected. (2) Where the number of such candidates is less than the number of members to be so elected the Returning Officer shall commence fresh proceedings for the election of the remaining members to be elected under clause (a) of sub-section (1) of section 3 of the Act. (3) Where the number of such candidates exceeds the number of members to be elected to represent the Homoeopathy System of Medicine as the case may be, from the State concerned, the Returning Officer shall publish their names and addresses in the Official Gazette for the purpose of the election. (4) If a poll is found necessary, the Returning Officer shall conduct the election where mode of election is casting of votes in person by ballot in Form-II or Electronic Voting Machine (EVM). (5)The Returning Officer shall publish an advertisement in one issue of the daily newspaper in the English language having circulation in the major part of the State and one issue of such daily newspaper in the regional language as the Returning Officer may consider suitable, about the date and time of the election and venue of the polling booth. (6)Casting of vote in person means, all persons eligible to exercise vote shall physically come to the polling booth on the date and time as notified by the Returning Officer along with the certificate of registration in the concerned State Board/ Council of Homoeopathy and any photo identity card issued by the Central/ State / Union Territory Government to prove his identity before casting vote. (7) Each elector shall have as many votes as there are members to be elected from that State, but shall give only one vote to any one candidate. 14.Casting of vote. -(1) Every elector desirous of recording his vote shall, reach the nearest polling booth to cast his vote on the date and time fixed for the poll.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) The ballot shall be issued only to the eligible members on producing the copy of certificate of registration in the concerned State Board/ Council of Homoeopathy and any photo identity card issued by the Central/ State / Union Territory Government. (3) A member who is unable to provide his / her Membership / Registration number or any such additional details which bonafide his / her right of exercising the vote shall not be allowed to exercise his vote. (4) The entire process of instructions will also be made available on the Central Council of Homoeopathy website under the Column “ELECTION PROCESS”. The member may look into the instructionsand thereafter may cast their vote as per procedure. (5) A member shall not hold the Council or agency involved in the voting by responsible for any misuse thereof. 15. Any voter who desire to vote shall sign in ink in the voter list, before casting his/her vote physically. 16.Any candidate may be present in person or may send a representative duly authorised by him in writing to attend at the time of counting of votes. 17. Rejection of members from casting vote.—A person may not be allowed to exercise his vote, if — (a) the person could not prove his identity; or (b) the person fails to show his valid proof of registration in the Register maintained by State Board/ Council; or (c) the person reaches the polling booth after the time specified by the Returning Officer; or (d) the person misbehaves or argue in the premises of polling; or (e) the person is trying to cause obstacles in performing duties ofthe polling officers.”; (c) in rule 18, for sub-rule (2), the following sub-rule shall be substituted, namely:- “(2) All the ballot papers shall be mixed together and shall be scrutinised, and, valid votes counted.”. (1) इन िनयम. का नाम भारतीय िच(cid:1)कaसा क(cid:7)(cid:8)ीय प(cid:21)रषद ्(िनवा6चन) संशोधन िनयम, 2018 ह।ै (2) ये राजपA म(cid:7) उनके *काशन क$ तारीख को *वृ+ होग(cid:7)। 2. भारतीय िच(cid:1)कaसा क(cid:7)(cid:8)ीय प(cid:21)रषद ्(िनवा6चन) िनयम, 1975 म(cid:7),- (क) िनयम 7 Eथान पर िनFिलिखत िनयम रखा जाएगा, अथा6त्:- “7. िनवा6चन के िविभH चरण. क$ तारीख. का िनयतन (cid:1)कया जाना - (cid:21)रटKनग आ(cid:1)फसर िनFिलिखत के िलए तारीख, समय और Eथान िनयत करेगा और उसके राजपA )ारा और ऐसी अOय रीित से अिधसूिचत करेगा िजसे वह ठीक समझेगा- (क) नामिनदशS न पA. का *ा= होना तथा उनक$ संवी<ा। (ख) िनवा6चन का ढंग और मतदान क(cid:7)(cid:8) का Eथान।¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 (ग) मतदान और (घ) मत. का संवी<ा और गणना।” (ख) िनयम 13,14,15,16 और 17 के Eथान पर िनFिलिखत िनयम रखे जाएंगे, अथा6त्:- “13. मतदान- (1) जहां स(cid:17)यकतः नामिनWदX अ]य^थय. क$ संYया संबZ रा[य के, यथािEथित, आयुवSद, िसZ अथवा यूनानी िच(cid:1)कaसा पZितय. का *ितिनिधaव करने के िलए िनवा6िचत (cid:1)कए जाने वाले सदEय. क$ संYया के बराबर हो अथवा उससे कम हो, वहां (cid:21)रटKनग आ(cid:1)फसर तुरंत ऐसे अ]य^थय. को स(cid:17)यकतः िनवा6िचत घोिषत कर दगे ा। (2) जहां ऐसे अ]य^थय. क$ संYया इस *कार से िनवा6िचत (cid:1)कए जाने वाले सदEय. क$ संYया से कम हो, वहां (cid:21)रटKनग आ(cid:1)फसर धारा 3 क$ उपधारा (1) के खंड (क) के अधीन िनवा6िचत (cid:1)कए जाने वाले शेष सदEय. के िनवा6चन के िलए पुनः काय6वाही *ारंभ करेगा। (3) जहां ऐसे अ]य^थय. क$ संYया संबZ रा[य के यथािEथित आयुवदS िसZ अथवा यूनानी िच(cid:1)कaसा पZितय. का *ितिनिधaव करने के िलए िनवा6िचत (cid:1)कए जाने वाले सदEय. क$ संYया से अिधक हो, वहां (cid:21)रटKनग आ(cid:1)फसर िनवा6चन के *योजन के िलए उनके नाम और पते राजपA म(cid:7) *कािशत करेगा। (4) य(cid:1)द िनवा6चन आवbयक समझा जाए तो (cid:21)रटKनग आ(cid:1)फसर िनवा6चन संचालन करेगा जहां िनवा6चन का cप *ोफामा-6 2 म(cid:7) बैलट )ारा dि-गत मतदान अथवा इलैefािनक वोgटग मशीन (ईवीएम) ह।ै (5) (cid:21)रटKनग आ(cid:1)फसर िनवा6चन और मतदान बूथ के Eथान क$ तारीख और समय के बारे म(cid:7) रा[य के *मुख भाग म(cid:7) *सा(cid:21)रत होने वाले अंiेजी भाषा के दिैनक समाचार पA के एक अंक म(cid:7) और <ेAीय भाषा म(cid:7) ऐसे दैिनक समाचार पA के एक अंक म(cid:7) िवjापन *कािशत करवाएगा िजसे (cid:21)रटKनग आ(cid:1)फसर उपयु- समझेगा। (6) dि-गत मतदान से अिभ*ेत ह ै (cid:1)क मतािधकार के योkय सभी पाA dि- रिजEfीकरण *माण पA और मतदान से पूव 6 अपनी पहचान सािबत करने के िलए क(cid:7)(cid:8)ीय/रा[य/संघ रा[य <ेA सरकार )ारा जारी फोटो पहचान पA सिहत भारतीय िच(cid:1)कaसा पZित के संबंिधत रा[य बोड6/प(cid:21)रषद ्म(cid:7) (cid:21)रटKनग आ(cid:1)फसर )ारा यथा अिधसूिचत तारीख और समय पर मतदान बूथ पर आएंगे। (7) *aयेक मतदाता को उतने मत *ा= ह.गे िजतनी संYया म,(cid:7) संबZ रा[य से सदEय िनवा6िचत (cid:1)कए जाने ह,m nकतु वह (cid:1)कसी एक अ]यथo को केवल एक ही मत दगे ा। 14. मतदान – (1) *aयेक मतदाता जो अपना मत अिभलेखाबZ करने का इpछुक ह,ै मतदान के िलए िनयत तारीख व समय पर अपना मतदान करने के िलए िनकटतम मतदान बूथ प2चं ेगा। (2) हो(cid:17)योपैथी के संबंिधत रा[य बोड6/ प(cid:21)रषद ् म(cid:7) रजEfीकरण *माण पA क$ *ित और क(cid:7)(cid:8)ीय/रा[य/संघ रा[य<ेA सरकार )ारा जारी कोई फोटो पहचान पA क$ *ित (cid:1)दखाने पर ही पाA सदEय. को मत पA जारी (cid:1)कया जाएगा। (3) कोई सदEय जो अपनी सदEयता/रजEfीकरण संYया अथवा ऐसी कोई अित(cid:21)र- सूचना नहt द े पाता ह ै जो उसके मतािधकार को *मािणत करती ह,ै को मतदान नहt करने (cid:1)दया जाएगा। (4) अनुदशे . क$ पूरी *(cid:1)uया भारतीय िच(cid:1)कaसा क(cid:7)(cid:8)ीय प(cid:21)रषद ्क$ वेबसाइट म(cid:7) “िनवा6चन *(cid:1)uया” Eतंभ म(cid:7) भी उपलrध कराई जाएगी। सदEय अनुदशे दखे ने के पvात *(cid:1)uया अनुसार अपना मतपA कर सकते ह।m (5) कोई सदEय मतदान म(cid:7) शािमल प(cid:21)रषद ्अथवा अिधकरण म(cid:7) दwु पयोग को (cid:1)कसी के िलए िज(cid:17)मेदार नहt ठहराएगा। 15. कोई मतदाता मतदान का इpछुक अपना मतदान करने से पूव6 मतदाता सूची म(cid:7) Eयाही से हEता<र करेगा। 16. मत. क$ गणना के समय पर कोई भी अ]यथo Eवयं उपिEथत हो सकेगा अथवा िलिखत cप से अपने )ारा स(cid:17)यक *ािधकृत एक *ितिनिध को वहां हािजर होन ेके िलए भेज सकेगा। 17. मतदान करने से सदEय. को नामंजूर करना- (cid:1)कसी dि- को मतदान नहt करने (cid:1)दया जा सकेगा, य(cid:1)द- (क) dि- अपनी पहचान सािबत न कर सके; अथवा (ख) dि- रा[य बोड6/ प(cid:21)रषद ् )ारा अनुरि<त रिजEटर म(cid:7) रजEfीकरण का उसका िविधमाOय साxय नहt (cid:1)दखन े म(cid:7) असफल रहता ह;ै अथवा (ग) dि- (cid:21)रटKनग आ(cid:1)फसर )ारा िविनWदX समय के बाद मतदान बूथ प2चं े; (ii) का.आ. 495 (अ),,,, तारीख 4 जुलाई,,,, 1980;;;; (iii) सा.का.िन. 151 (अ),,,, तारीख 15 माच6,,,, 2012;;;; और (iv) सा.का.िन. 372 (अ),,,, तारीख 18 मई,,,, 2012। NOTIFICATION New Delhi, the 27th July, 2018 G.S.R. 714(E).—In exercise of the powers conferred by section 4 and section 35 of the Indian Medicine Central Council Act, 1970 (48 of 1970), Central Government hereby makes the following rules further to amend the Indian Medicine Central Council (Election) Rules, 1975, namely :- 1. (1) These rules may be called the Indian Medicine Central Council (Election) Amendment Rules, 2018. (2) These rules shall come into force on the date of their publication in the Official Gazette. 2. In the Indian Medicine Central Council (Election) Rules, 1975,- (a) for rule 7, the following rule shall be substituted, namely:- “7. Fixation of dates of various stages of elections.— The Returning Officer shall appoint and shall notify in the Official Gazette and in such other manner as he thinks fit, the time, date and place for— (a) the receipt of the nomination papers and their scrutiny; (b) the mode of election and the venue of polling booth; (c) the poll; and (d) the scrutiny and counting of votes.”; (b) for rules 13, 14, 15, 16 and 17, the following rules shall be substituted, namely:- “13. Poll.—(1) Where the number of candidate duly nominated is equal to or less than the number of members to be elected to represent the Ayurveda, Siddha or Unani System of medicine, as the case may be, from the State concerned, the Returning Officer shall forthwith declare such candidates to be duly elected. (2) Where the number of such candidates is less than the number of members to be so elected the Retuning Officer shall commence fresh proceedings for the election of the remaining members to be elected under clause(a) of sub-section (1) of section 3. (3) Where the number of such candidates exceeds the number of members to be elected to represent the Ayurveda, Siddha or Unani Systems of Medicines as the case may be, from the State concerned, the Returning Officer shall publish their names and addresses in the Official Gazette for the purpose of the election. (4) If a poll is found necessary, the Returning Officer shall conduct the election, where mode of election is casting of votes in person by ballot in Form-II or Electronic Voting Machine (EVM). (5) The Returning Officer shall publish an advertisement, in one issue of the daily newspaper in the English language having circulation in the major part of the State and one issue of such daily newspaper in the regional language as the Returning Officer may consider suitable, about the date and time of the election and venue of the polling booth. (6) Casting of vote in person means, all persons eligible to exercise vote shall physically come to the polling booth on the date and time as notified by the Returning Officer along with the certificate of registration in the concerned State Board/ Council of Indian System of medicine and any photo identity card issued by the Central/ State / Union Territory Government to prove his identity before casting vote.¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 7 (7) Each elector shall have as many votes as there are members to be elected from that State, but shall give only one vote to any one candidate. 14. Casting of vote. - (1) Every elector desirous of recording his vote shall, reach the nearest polling booth to cast his vote on the date and time fixed for the poll. (2) The ballot shall be issued only to the eligible members on producing the copy of certificate of registration in the concerned State Board/ Council of Homoeopathy and any photo identity card issued by the Central/ State / Union Territory Government. (3) A member who is unable to provide his / her Membership / Registration number or any such additional details which bonafide his / her right of exercising the vote shall not be allowed to exercise his vote. (4) The entire process of instructions will also be made available on the Central Council of Indian Medicine website under the Column “ELECTION PROCESS”. The member may look into the instructions and thereafter may cast their vote as per procedure. (5) A member shall not hold the Council or agency involved in the voting by responsible for any misuse thereof. 15. Any voter who desire to vote shall sign in ink in the voter list, before casting his/her vote physically. 16. Any candidate may be present in person or may send a representative duly authorised by him in writing to attend at the time of counting of votes. 17. Rejection of members from casting vote.— A person may not be allowed to exercise his vote, if ,— (a) the person could not prove his identity; or (b) the person fails to show his valid proof of registration in the Register maintained by State Board/ Council; or (c) the person reaches the polling booth after the time specified by the Returning Officer; or (d) the person misbehaves or argue in the premises of polling; or (e) the person is trying to cause obstacles in performing duties of the polling officers.”; (c) in rule 18, for sub-rule (2), the following sub-rule shall be substituted, namely:- “(2) All the ballot papers shall be mixed together and shall be scrutinised, and , valid votes counted.”.
