## Report on the National Institute of Technology, Durgapur Amendment Statute, 2025
**1. Executive Summary:**
This report analyzes the Statutes of the National Institute of Technology (NIT), Durgapur Amendment Statute, 2025, as published in the Gazette of India. This is an amendment to the original NIT Durgapur Statutes, 2017. The core purpose of this amendment is to address potential vacancies in the office of the Chairperson of the Board of Governors. Key findings indicate that the amendment allows for the temporary appointment of the Chairperson of another Institute of National Importance to discharge the functions of the Chairperson of NIT Durgapur under specific circumstances, and removes substatute 15 from Statute 17.
**2. Introduction:**
This report aims to provide a detailed overview and analysis of the National Institute of Technology, Durgapur Amendment Statute, 2025, based solely on the information provided in the official Gazette notification. The report will outline the key changes introduced by this amendment, its potential impact, and relevant implementation aspects.
**3. Policy Overview:**
* **Original Policy Being Amended:** National Institute of Technology, Durgapur Statutes, 2017.
* **Core Objective(s):** The original Statutes likely outline the rules and governance structure of NIT Durgapur. Based on the text, the amendment focuses on ensuring continuity of leadership and effective governance within the Institute, specifically addressing scenarios involving Chairperson vacancies or inability to fulfill duties.
**4. Background and Rationale:**
This amendment appears to be designed to address potential disruptions in the leadership of the NIT Durgapur's Board of Governors. The amendment specifically addresses the situation where the Chairperson's office becomes vacant due to expiry of tenure, death, resignation, or other reasons, as well as situations where the Chairperson is unable to discharge their duties due to absence, illness, or any other cause. This suggests a potential vulnerability or gap in the original statutes regarding leadership succession or temporary replacement. The amendment to statute 17 suggests this substatute is no longer relevant.
**5. Key Provisions / Changes:**
This section focuses specifically on the changes introduced by the amendment text:
* **Change to Statute 14:**
* **Specific Part Changed:** After substatute iv.
* **New Rule/Provision:** A new substatute v is inserted. This substatute states that in the event of a vacancy in the Chairperson's office (due to various reasons) or the Chairperson's inability to perform duties, the Chairperson of another Institute of National Importance may be appointed to discharge the functions of the Chairperson of NIT Durgapur under Section 16 of the Act. This appointment is valid for a maximum of six months or until a regular Chairperson is nominated, whichever is earlier. The appointment also requires the approval of the Visitor. In case of expiry of tenure, the Visitor may extend the term of the incumbent Chairperson for a period of six months or till the nomination of a regular Chairperson, whichever is earlier.
* **Effect of Change:** This change provides a mechanism for temporary leadership at NIT Durgapur in situations where the Chairperson is unavailable, ensuring continuity of operations and decision-making. It establishes a clear process for appointing a temporary replacement and defines the duration of that appointment.
* **Change to Statute 17:**
* **Specific Part Changed:** substatute 15 is omitted.
* **New Rule/Provision:** The removal of substatute 15.
* **Effect of Change:** This change suggest substatute 15 is no longer required under Statute 17.
**6. Target Audience and Stakeholders:**
Based on the text, the primary stakeholders directly affected by these changes are:
* The Board of Governors of NIT Durgapur.
* The Chairperson of NIT Durgapur.
* Chairpersons of other Institutes of National Importance.
* The Visitor of the National Institute of Technology, Durgapur.
* The National Institute of Technology, Durgapur as an institution.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Board of Governors of NIT Durgapur, with the approval of the Visitor. The Director of NIT Durgapur is also mentioned.
* **Timelines/Procedures:** The temporary appointment of a replacement Chairperson is limited to six months or until a regular Chairperson is nominated, whichever is earlier. The amendment stipulates the Visitor's approval for both the appointment of a replacement and the extension of an incumbent's tenure.
* **Specific to the Changes:** The implementation of the temporary Chairperson provision hinges on the occurrence of a vacancy or inability to perform duties. The Visitor's approval is a critical step in the process.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of these specific changes introduced by the amendment are:
* Ensuring the smooth functioning and governance of NIT Durgapur, even in the absence or incapacitation of the regular Chairperson.
* Providing a clear and defined process for temporary leadership transitions, reducing uncertainty and potential disruptions.
* Maintaining compliance with the National Institutes of Technology, Science Education and Research Act, 2007.
**9. Conclusion:**
The National Institute of Technology, Durgapur Amendment Statute, 2025, represents a refinement of the institution's governance framework. By establishing a mechanism for temporary leadership in the event of Chairperson vacancies or incapacitation, the amendment seeks to ensure continuity and stability within NIT Durgapur. The changes are significant for the Board of Governors, the Chairperson, and the overall operations of the Institute.
