Products (Quality Control) Order, 2012, the Steel and Steel Products (Quality Control) Second Order, 2012, the Steel and Steel Products (Quality Control) Order, 2015 and the Steel and Steel Products (Quality Control) Order, 2017, except as respects things done or omitted to be done before such supersession, the Central Government, being of the opinion that it is necessary or expedient so to do in the public interest, after consulting the Bureau of Indian Standards, hereby makes the following Order, namely:— 1. Short title and commencement. – (1) This Order may be called the Steel and Steel Products (Quality Control) Order, 2018. (2) This order shall come into force on the date of its publication in the Official Gazette. 2. Definitions .- In this Order, unless the context otherwise requires, - (a) “Act” means the Bureau of Indian Standards Act, 2016 (11 of 2016); (b) “appropriate authority” means, - (i) an officer not below the rank of an Under Secretary in the Ministry of Steel; or (ii) the General Manager of a District Industries Center in a state; or (iii) the Director of Industries or Commissioner of Industries in a State or Union territory; and (iv) an officer nominated by the Director General, Bureau of Indian Standards; (c) “ITC(HS) Codes” means the Indian Trades Classification (Harmonised System) Codes specified in column (4) of the Schedule; (d) “Schedule” means the Schedule appended to this Order;¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 9 (e) “steel and steel products” means the products having title of Indian Standard as specified in column (3) of the Schedule which are covered under the Indian Standard specified in column (2) thereof; (f) words and expressions used herein and not defined, but defined in the Act shall have the same meaning as assigned to them in the Act. 3. Application.- (1) This Order shall apply to steel and steel products, but nothing herein shall apply to such products meant for export. 4. Conformity to Standards.- Every steel and steel products shall conform to the corresponding Indian Standard specified in column (2) of the Schedule with effect from the corresponding date specified in column (5) thereof. 5. Compulsory use of Standard Mark.- Every steel and steel product shall bear the Standard Mark under a licence issued by the Bureau of Indian Standards. 6. Certification and Enforcement Authority.- The Bureau of Indian Standards shall be the certifying and enforcing authority in respect of the steel and steel products. 7. Penalty for Contravention. - Any person who contravenes any of the provisions of this Order shall be punishable in accordance with the provisions of Section 29 of the Act. 8. Date of effect of amendment or revision in Indian Standards. - Where any amendment or revision is made by the Bureau in the title, scope, grade, testing requirements or any other parameters with respect to any Indian Standard specified in the Schedule, such amendment or revision shall apply to the provisions of this Order with effect from the date notified by the Bureau in this behalf, as if such amendment or revision are made under this Order with effect from such date. 9. Appeal: - (1) Any person who is aggrieved by any decision of the appropriate authority may prefer an appeal to the Central Government. (2) The Central Government may constitute an Empowered Committee consisting of the Secretary to the Government of India in the Ministry of Steel as Chairperson and one person each to represent the Bureau of Indian Standards, the Directorate General of Foreign Trade and the Ministry of Steel as members, to advise it on any matter, including disposal of appeal. (3) The Central Government may, after giving the appellant an opportunity of hearing and after considering the advice given by the Empowered Committee, pass such order as it may deem fit.
