Executive Summary & Key Takeaways

Okay, I'm ready to analyze the provided policy text and generate the report. **Report: Analysis of the Supreme Court Judges Amendment Rules, 2021** **1. Executive Summary:** This report analyzes the Supreme Court Judges Amendment Rules, 2021, which amends the Supreme Court Judges Rules, 1959. The core purpose of the amendment, as gleaned from the text, is to increase the allowance amounts provided to Supreme Court Judges under specific subrules. The key finding is that the amendment significantly raises the monetary allowances, likely to address cost-of-living adjustments or other factors impacting judicial expenses. **2. Introduction:** This report aims to provide an informative overview and analysis of the Supreme Court Judges Amendment Rules, 2021, based solely on the text provided in the official notification. It examines the changes introduced by the amendment and their potential impact. **3. Policy Overview:** * **Amendment:** This is an amendment to the existing Supreme Court Judges Rules, 1959. * **Core Objective:** The primary objective, as inferred from the text, is to revise and increase the allowance amounts payable to Supreme Court Judges. This is achieved through specific monetary changes detailed in the amendment. **4. Background and Rationale:** * **Amendment:** The amendment likely addresses the need to adjust existing allowance amounts due to factors such as inflation, increased costs of living, or a re-evaluation of the expenses incurred by Supreme Court Judges in fulfilling their duties. The substantial increase in allowances suggests a significant gap had developed between the existing allowances and the actual costs borne by the judges. **5. Key Provisions / Changes:** The amendment introduces the following changes to the Supreme Court Judges Rules, 1959: * **Specific Part of Original Policy Changed:** Rule 3B. * **New Rule/Provision:** * In subrule 1 of rule 3B, the words "twenty five thousand rupees" are substituted with "seventy thousand rupees." * In subrule 2 of rule 3B, the words "fourteen thousand rupees" are substituted with "thirty nine thousand rupees." * **Difference/Effect of Changes:** * Subrule 1 allowance is increased from ₹25,000 to ₹70,000. This is an increase of ₹45,000. * Subrule 2 allowance is increased from ₹14,000 to ₹39,000. This is an increase of ₹25,000. These changes represent substantial increases in the allowances provided under these subrules. **6. Target Audience and Stakeholders:** The direct target audience and stakeholders are primarily the Supreme Court Judges, who will be the recipients of the increased allowances. Indirectly, the stakeholders include the Ministry of Law and Justice (Department of Justice), responsible for implementing and administering the rules, and potentially the general public as it relates to the efficient functioning and compensation of the judiciary. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Ministry of Law and Justice (Department of Justice) is responsible for implementing the amendment. * **Timelines/Procedures:** The rules come into force on the date of their publication in the Official Gazette (March 18, 2021, as indicated in the document). The procedure for disbursement of the revised allowances would likely follow existing protocols within the Supreme Court and relevant administrative bodies. **8. Expected Outcomes / Impact of Changes:** The intended outcome of these changes is likely to provide Supreme Court Judges with more adequate financial support to cover expenses related to their official duties. The increased allowances are intended to improve the judges' financial well-being and potentially enhance their ability to perform their judicial functions effectively. This might indirectly improve the perception of the judiciary's independence by ensuring adequate compensation and resources. **9. Conclusion:** The Supreme Court Judges Amendment Rules, 2021, represent a significant upward revision of specific allowances provided to Supreme Court Judges. This amendment is likely intended to address the increasing cost of living and ensure that judges receive adequate financial support. The changes, implemented by the Ministry of Law and Justice, are expected to improve the financial well-being of the judges and contribute to the efficient functioning of the Supreme Court.
