The said regulations as approved shall come into force on the date of publication of this notification in the Official Gazette. SCHEDULE In exercise of the powers conferred by section 28 of the Major Port Trust Act, 1963 (38 of 1963), the Board of Trustees of the Mumbai Port hereby makes the following regulations further to amend the Mumbai Port Trust Employees (Recruitment, Seniority and Promotion) Regulations, 2010, namely:- 1. (1) These regulations may be called the Mumbai Port Trust Employees (Recruitment, Seniority and Promotion) Amendment Regulations, 2020. (2) They shall come into force on the date of publication of the approval thereto by the Central Government in the Gazette of India.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. In the Mumbai Port Trust Employees (Recruitment, Seniority and Promotion) Regulations, 2010,- (I) for regulation 4, for the entries, the following regulation shall be substituted, namely:- 4. MANNER OF APPIONTMENT:- (1) All appointments to the posts to which these regulations apply shall be made in accordance with the provisions of these regulations. Appointment may be made either by promotion or by absorption or deputation or direct recruitment. Deputation shall be of employees from the Major Ports, the Central Government, State Government, autonomous bodies or Government Companies fulfilling the criteria of eligibility prescribed for the post: Provided that, an employee of a Board of any Major Port Trust will not be eligible for deputation to the Head of Department level post in Major Port Trusts. (2) The normal period of deputation is three years, which is extendable to four years. In exceptional circumstances, this can be extended to five years by the Central Government in the case of a post, the incumbent of which is regarded as the Head of Department; and by the Chairman in the case of any other post below the level of Head of Department. (II) in the Schedule-I,- (i) against serial number 6, relating to the post of Secretary, in column 12 under the sub-heading “For deputation”, after the words “Autonomous Bodies”, the words “other than Major Port Trust” shall be inserted; (ii) against serial number 47, relating to the post of Financial Adviser & Chief Accounts Officer, in column 12, under the sub-heading “For deputation” after the word “Autonomous Bodies”, the words “other than Major Port Trust” shall be inserted. (iii) against serial number 52, relating to the post of Chief Mechanical Engineer, in column 12, under the sub-heading “For deputation” after the word “Autonomous Bodies”, the word “other than Major Port Trust” shall be inserted. (iv) against serial number 64, relating to the post of Traffic Manager, in column 12 under the sub- heading “For deputation” after the word “Autonomous Bodies”, the word “other than Major Port Trust” shall be inserted. (v) against serial number 73, relating to the post of Chief Engineer, in column 12, under the sub-heading “For deputation” after the word “Autonomous Bodies”, the word “other than Major Port Trust” shall be inserted. (vi) against serial number 82, relating to the post of Chief Medical Officer, in column 12, under the sub- heading “For deputation” after the word “Autonomous Bodies”, the word “other than Major Port Trust” shall be inserted.
