सेिा केन्द्र प्राजधकरण ऄजधजनयम, 2019 की धारा 28 की ईपधारा (1) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, जनम्नजलजखत
जिजनयम बनाता ह,ै ऄथाात्:-
ऄध्याय I
प्रारंजभक
1. संजिप्त नाम रर प्रारंभ
(1) आन जिजनयमों का संजिप्त नाम ऄंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण (जिजनयम बनाने की प्रक्रिया)
जिजनयम, 2021 ह ै।
(2) ये जिजनयम, ऄन्द्यथा ईपबंजधत के जसिाय, राजपत्र में ईनके प्रकािन की तारीख को प्रिृत्त होंगे ।
(3) ये जिजनयम, प्राजधकरण द्वारा संगानामकमक जिोयों की बाबत बनाए गए जिजनयमों को लागू नहह होंगे ।
2. पररभाोाए ं
(1) आन जिजनयमों में, जब तक संदभा से ऄन्द्यथा ऄपेजित न हो,-
(क) “ऄजधजनयम” से ऄंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण ऄजधजनयम, 2019 ऄजभप्रेत है; रर

(ख) “प्राजधकरण” से ऄजधजनयम की धारा 4 की ईपधारा (1) के ऄधीन स्ट्थाजपत ऄंतरराष्ट्रीय जित्तीय सेिा केन्द्र
प्राजधकरण ऄजभप्रेत ह;ै
(2) ईन िब्दों रर पदो के, जो आन जिजनयमों में प्रयुि ह ैं रर पररभाजोत नहह ह ैं क्रकन्द्तु ऄजधजनयम में पररभाजोत ह,ैं िही
ऄथा होंगे जो ऄजधजनयम में िमिः ईनके ह ैं।
ऄध्याय 2
जिजनयमों का बनाया जाना
3. जिजनयम बनाना
प्राजधकरण, ऄजधजनयम के ईपबंधों को कायााजन्द्ित करने के जलए जिजनयम 4 रर जिजनयम 5 के ऄनुपालन में
प्राजधकरण के ऄनुमोदन से जिजनयम बना सकेगा ।
4. लोक परामि ा
(1) प्राजधकरण, जिजनयम बनाने के प्रयोजनाथा, जनता से रिप्पजणयों की इप्सा करते हुए ऄपनी िैबसाआि पर
जनम्नजलजखत ऄपलोड करेगा:-
(क) प्रस्ट्ताजित जिजनयमों का प्रारूप;
(ख) ऄजधजनयम का ऐसा जिजनर्ददष्ट ईपबंध जजसके ऄधीन प्राजधकरण का जिजनयम बनाने का प्रस्ट्ताि है;
(ग) ईस मुद्दे के संबंध में कथन, जजसे प्रस्ट्ताजित जिजनयमों द्वारा सुलझाने की इप्सा की गइ है;
(घ) प्रस्ट्ताजित जिजनयम से सुसंगत ऄंतरराष्ट्रीय मानक स्ट्थाजपत करने िाले ऄजभकरणों द्वारा समर्थथत मानदडं ों
रर ऄंतरराष्ट्रीय सिोत्तम पद्धजतयों, यक्रद कोइ ह,ैं के संबंध में कथन; रर
(ङ) जनता से रिप्पजणयां प्राप्त करने की रीजत, प्रक्रिया रर समय-सीमा ।
(2) प्राजधकरण जनता को ऄपनी रिप्पजणयां प्रस्ट्तुत करने के जलए साधारणतया कम से कम 21 क्रदन ऄनुज्ञात
करेगा ।
(3) प्राजधकरण, जनता से प्राप्त की गइ रिप्पजणयों पर जिचार करेगा रर ईन्द्ह ें जिजनयमों की ऄजधसूचना की
तारीख के ऄपश्चात् रिप्पजणयों पर ऄपने प्रमकयुत्तर से संबंजधत साधारण कथन सजहत ऄपनी िैबसाआि पर ऄपलोड करेगा ।
(4) यक्रद प्राजधकरण जिजनयमों को ईसके द्वारा प्राप्त रिप्पजणयों पर जिचार करते हुए क्रकए गए पररितानों से
ऄन्द्यथा, प्रस्ट्ताजित जिजनयमों से सारिान् रूप से जभन्न रूप में ऄनुमोक्रदत करने का जिजनश्चय करता ह ै तो िह आस जिजनयम
के ऄधीन आस प्रक्रिया को दोहराएगा ।
(5) जिजनयमों को प्राजधकरण द्वारा ऄनुमोक्रदत क्रकए जाने के पश्चात् तुरंत ऄजधसूजचत क्रकया जाएगा रर ईनके
प्रितान की तारीख ईसमें जिजनर्ददष्ट तारीख से होगी ।
(6) आस जिजनयम में के ईपबंधों पर प्रजतकूल प्रभाि डाले जबना, प्राजधकरण, यक्रद िह अिश्यक समझता ह,ै
जिजनयमों का प्रारूप तैयार करने के संबंध में जसफाररिें करने के जलए ऐसी जििेोज्ञ या सलाहकारी सजमजतयां गरात कर
सकेगा, जो िह समुजचत समझे ।
5. ऄमकयािश्यक जिजनयम
(1) जहां प्राजधकरण की यह राय ह ै क्रक कजतपय जिजनयम ऄमकयािश्यक रूप से बनाए जाने ऄपेजित ह ैं या जिद्यमान
जिजनयमों में ऄमकयािश्यक रूप से संिोधन क्रकया जाना ऄपेजित ह ै तो िह आस ऄध्याय के ऄधीन ईपबंधों का ऄनुसरण क्रकए
जबना, यथाजस्ट्थजत, ऐसे जिजनयम बना सकेगा या जिद्यमान जिजनयमों में संिोधन कर सकेगा यक्रद िह यह समझता ह ै क्रक
ईन ईपबंधों के ऄनुपालन के जलए ऄपेजित समय के कारण िे ईद्देश्य जिफल हो जाएंगे जजन्द्ह ें पूरा करने की इप्सा की गइ ह ै
या समस्ट्या के जनिारण में ऄसम्यक् जिलंब काररत होगा या बाजार में जिफलता अएगी, बितें िह ऐसा करने के जलए
जिस्ट्तृत न्द्यायौजचमकय प्रस्ट्तुत करता ह ै।
(2) ईप-जिजनयम (1) के ऄधीन बनाए गए जिजनयम तब तक ऄजधसूचना की तारीख से छह मास की ऄिजध के
पश्चात् स्ट्ितः समाप्त हो जाएंगे जब तक ईन्द्ह ें आन जिजनयमों के ऄनुसार बनाए गए जिजनयमों द्वारा प्रजतस्ट्थाजपत नहह कर

परन्द्तु आन जिजनयमों की ऄजधसूचना से पूिा बनाए गए सभी जिजनयम, आन जिजनयमों के ऄनुसार बनाए गए समझे
जाएंगे रर िे तब तक जिजधमान्द्य बने रहगें े जब तक ईन्द्ह ेंसंिोजधत, जनरजसत या प्रजतस्ट्थाजपत नहह कर क्रदया जाता ह ै।
ऄध्याय 3
जिजनयमों का सिं ोधन रर पनु र्थिलोकन
6. जिजनयमों का सिं ोधन
क्रकसी भी जिजनयम में संिोधन, ऄध्याय 2 के ईपबंधों के ऄनुपालन में क्रकया जाएगा ।
7. जिजनयमों का पनु र्थिलोकन
प्राजधकरण, प्रमकयेक जिजनयम का तब तक प्रमकयेक तीन िोा में पुनर्थिलोकन करेगा जब तक क्रक आससे पूिा पुनर्थिलोकन ऄपेजित
नहह होता ह ैरर जनम्नजलजखत बातों को ध्यान में रखते हुए क्रकसी जिजनयम का संिोधन या जनरसन करेगा –
(क) ईसके ईद्देश्य;
(ख) ईसके पररणाम;
(ग) ईसके क्रियान्द्ियन का ऄनुभि;
(घ) ईसके प्रितान का ऄनुभि रर संबंजधत मुकदमेबाजी;
(ङ) िैजिक सिोत्तम पदधजतयां, यक्रद कोइ हैं;
(च) पररिर्थतत िातािरण में ईसकी सुसंगजत; रर
(छ) कोइ ऄन्द्य कारक, जो प्राजधकरण द्वारा सुसंगत समझा जाए ।

International Financial Services Centres Authority (Procedure for making Regulations)
Regulations, 2021
IFSCA/2021-22/GN/REG012.—In exercise of the powers conferred by sub-section (1) of
section 28 of International Financial Services Centres Authority Act, 2019, the International Financial
Services Centres Authority hereby makes the following regulations, namely: -
CHAPTER I
PRELIMINARY
1. Short title and commencement.
(1) These regulations may be called the International Financial Services Centres Authority
(Procedure for making Regulations) Regulations, 2021.
(2) Save as otherwise provided, these regulations shall come into force on the date of their
publication in the Official Gazette.
(3) These regulations shall not apply to regulations made by the Authority in respect of
organizational matters.
2. Definitions.
(1) In these regulations, unless the context otherwise requires, -4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
(a) “Act” means the International Financial Services Centres Authority Act, 2019 and
(b) "Authority" means the International Financial Services Centres Authority established under
sub-section (1) of section 4;
(2) Words and expressions used and not defined in these regulations but defined in the Act shall have
the meanings respectively assigned to them in the Act.
CHAPTER II
MAKING OF REGULATIONS
3. Making regulations.
The Authority may make regulations to carry out the provisions of the Act with the approval of the
authority, in compliance with regulations 4 and 5.
4. Public Consultation.
(1) For the purpose of making regulations, the authority shall upload the following on its website
seeking comments from the public: -
(a) draft of proposed regulations;
(b) the specific provision of the Act under which the authority proposes regulations;
(c) a statement of the issue that the proposed regulation seeks to address;
(d) a statement carrying norms advocated by international standard setting agencies and the
international best practices, if any, relevant to the proposed regulation; and
(e) the manner, process and timelines for receiving comments from the public.
(2) The Authority shall ordinarily allow at least 21 days for public to submit their comments.
(3) The Authority shall consider the public comments received and upload the same on its website
along with a general statement of its response on the comments, not later than the date of
notification of regulations.
(4) If the Authority decides to approve regulations in a form substantially different from the
proposed regulations other than changes made in consideration of comments received by it, it shall
repeat the process under this regulation.
(5) The regulations shall be notified promptly after it is approved by the Authority and the date of
their enforcement shall be from the date specified therein.
(6) Without prejudice to provisions in this regulation, the Authority may if it considers necessary
constitute expert or advisory committees, as it may consider appropriate for making
recommendations on drafting regulations.
5. Urgent regulations.
(1) Where the Authority is of the opinion that certain regulations are required to be made or
existing regulations are required to be amended urgently, it may make such regulations or amend the
existing regulations, as the case may be, with the approval of Authority, without following the
provisions under this Chapter, if it considers that time required for compliance with those provisions
would defeat the objectives sought to be achieved or cause undue delay in redressing the problem or
market failure, provided it submits detailed justification for doing so.
(2) The regulations made under sub-regulation (1) shall automatically lapse after a period of six
months from the date of notification unless replaced by regulations made in accordance with these
regulations.
Provided that all regulations made prior to the notification of these regulations shall be deemed to
have been made in accordance with these regulations and shall remain valid unless amended,

CHAPTER III
AMENDMENT AND REVIEW OF REGULATIONS
6. Amendment of Regulations.
An amendment to any regulations shall be made in compliance with the provisions of Chapter II.
7. Review of Regulations.
The Authority shall review each regulation every three years unless a review is warranted earlier and
amend or repeal any regulation, keeping in view-
(a) its objectives;
(b) its outcome;
(c) experience of its implementation;
(d) experience of its enforcement and the related litigation;
(e) global best practices, if any;
(f) its relevance in the changed environment; and
(g) any other factor considered relevant by the Authority.
