उपमहािनदशे क (समूह 'क') भत(cid:7278) िनयम, 2002 और महािनदशे ालय, रोजगार एवं (cid:7079)िश(cid:6979)ण (समूह 'क' पद) भत(cid:7278) िनयम, 2011 को उन
बात(cid:7298) के िसवाय अिध(cid:7059)मण करते (cid:7263)ए िज(cid:7008)ह (cid:7286) ऐसे अिध(cid:7059)मण से पहले (cid:7408)कया गया ह ै या करने का लोप (cid:7408)कया गया ह,ै िन(cid:7013) निलिखत िनयम
बनाते ह,(cid:7289) अथा(cid:6981)त :--
1.(cid:32) सिं (cid:6979)(cid:7009)त नाम और (cid:7079)ारंभ :-- (1) इन िनयम(cid:7298) का संि(cid:6979)(cid:7009) त नाम भारतीय कौशल िवकास सेवा िनयम, 2017 है ।
2.(cid:32) ये आिधका(cid:7407)रक राजप(cid:7074) म(cid:7286) (cid:7079)काशन क(cid:7409) तारीख को (cid:7079)वृ(cid:7004) त ह(cid:7298)गे ।
2. प(cid:7407)रभाषाएं.- इन िनयम(cid:7298) म(cid:7286) जब तक (cid:7408)क संदभ(cid:6981) से अ(cid:7008) यथा अपेि(cid:6979)त न हो –-
(क)(cid:32) ‘’आयोग’’ से संघ लोक सेवा आयोग अिभ(cid:7079)ेत ह ै;
(ख)(cid:32) ‘’िनय(cid:7074)ं क (cid:7079)ािधकारी’’ से भारत सरकार का कौशल िवकास एवं उ(cid:7378)मशीलता मं(cid:7074)ालय अिभ(cid:7079)ेत ह ै;
(ग)(cid:32) ‘’िवभागीय अ(cid:7012)य थ(cid:7278)’’ से िन(cid:7013) निलिखत िनयम(cid:7298) के अधीन िनयु(cid:6989) त (cid:7408)कए गए ऐसे सभी िव(cid:7378)मान अिधकारी जो समूह ‘क’
पद धारण (cid:7408)कए (cid:7263)ए ह(cid:7289), अिभ(cid:7079)ेत ह ै–-
(i)(cid:32) उप महािनदशे क (समूह ‘क’ पद), भत(cid:7278) िनयम, 2002; या
(ii)(cid:32) (cid:7079)िश(cid:6979)ण िनदशे ालय (समूह ‘क’ पद), भत(cid:7278) िनयम, 2011,
और इसके अ(cid:7008) तग(cid:6981)त ऐसे अिधकारी भी सि(cid:7013)मिलत ह(cid:7298)गे जो उ(cid:6989) त िनयम(cid:7298) के अधीन पद(cid:7298) पर िनयिमत (cid:7272)प से िनयु(cid:6989)त (cid:7408)कए गए
ह,(cid:7289) (cid:7408)क(cid:7008) तु जो इन िनयम(cid:7298) के (cid:7079)ारंभ क(cid:7409) तारीख को अ(cid:7008) य िवभाग(cid:7298) म(cid:7286) (cid:7079)ितिनयुि(cid:7334) पर ह (cid:7289);

(घ)(cid:32) ‘’िवभागीय (cid:7079)ो(cid:7008)न ित सिमित’’ से इन िनयम(cid:7298) के अधीन (cid:7408)कसी (cid:7061)ेड म(cid:7286) अिधका(cid:7407)रय(cid:7298) क(cid:7409) (cid:7079)ो(cid:7008) नित और पुि(cid:7397) के संबंध म(cid:7286)
िवचार करने के िलए ग(cid:7407)ठत सिमित अिभ(cid:7079)ेत ह ै;
(ङ)(cid:32) ‘’(cid:7357)ूटी पद’’ से अनुसूची I म(cid:7286) सि(cid:7013)मिलत कोई भी पद अिभ(cid:7079)ेत ह ै;
(च)(cid:32) ‘’(cid:7061)ेड’’ से अनुसूची 1 के (cid:7021) तंभ 2 म(cid:7286) िविन(cid:7416)द(cid:7020) ट कोई (cid:7061)ेड अिभ(cid:7079)ेत ह ै;
(छ)(cid:32) (cid:7408)कसी (cid:7061)ेड के संबंध म(cid:7286), ‘’िनयिमत सेवा’’ से उस (cid:7061)ेड म(cid:7286) इन िनयम(cid:7298) के (cid:7079)ारंभ के पूव(cid:6981) या उनके प(cid:7019)च ात क(cid:7409) गई
अनुमो(cid:7408)दत सेवा क(cid:7409) अविध या अविधयां अिभ(cid:7079)ेत ह (cid:7289)और इसके अंतग(cid:6981)त ऐसी कोई अविध या अविधयां भी ह (cid:7289):-
(i) िजन पर ऐसे अ(cid:7012) य(cid:7414)थय(cid:7298) क(cid:7409) दशा म(cid:7286) िज(cid:7008) ह (cid:7286)(cid:7079)ारंिभक गठन के समय िनयु(cid:6989) त (cid:7408)कया गया था, (cid:6996) ये(cid:7020) ठता के (cid:7079)योजन के िलए
िवचार (cid:7408)कया जाएगा; और
(ii) िजनके दौरान कोई अिधकारी उस (cid:7061)ेड म(cid:7286) (cid:7357)ूटी पद धारण करता ह ै (cid:7412)कतु जो छु(cid:7349)ी पर रहने के कारण या अ(cid:7008)य था उस
पद को धारण करने के िलए उपल(cid:7011) ध नह(cid:7277) था ;
(ज) ‘’अनसु चू ी’’ से इन िनयम(cid:7298) से उपाब(cid:7373) अनुसूची अिभ(cid:7079)ेत ह ै;
(झ) ''सवे ा’’ से िनयम 3 के अधीन ग(cid:7407)ठत भारतीय कौशल िवकास सेवा अिभ(cid:7079)ेत ह ै।
3. भारतीय कौशल िवकास सवे ा का गठन :-- (1) भारतीय कौशल िवकास सेवा के (cid:7272)प म(cid:7286) (cid:6980)ात क(cid:7409) जाने वाली एक सेवा का गठन
(cid:7408)कया जाएगा िजसम(cid:7286) िनयम 5 म(cid:7286) िविन(cid:7416)द(cid:7020) ट सद(cid:7021) य ह(cid:7298)गे ।
(2) सेवा म(cid:7286) सि(cid:7013)मिलत सभी पद समूह (‘क’) पद(cid:7298) के (cid:7272)प म(cid:7286) वग(cid:7278)कृत (cid:7408)कए जाएंगे।
4. (cid:7061)ेड, (cid:7079)ािधकृत स(cid:6990)ं य ा और उसका पनु (cid:7414)वलोकन :-- (1) इन िनयम(cid:7298) के (cid:7079)ारंभ पर सेवा के िविभ(cid:7008) न (cid:7061)ेड(cid:7298) म(cid:7286) lfEefyr (cid:7357)ूटी पद,
उनक(cid:7409) सं(cid:6990) या और वेतनमान वे ह(cid:7298)गे जो अनुसूची I म(cid:7286) िविन(cid:7416)द(cid:7020) ट ह:(cid:7289)
पर(cid:7008) तु अनुसूची I म(cid:7286) व(cid:7414)णत (cid:7408)कसी िविश(cid:7020) ट (cid:7061)ेड म(cid:7286) सि(cid:7013)मिलत (cid:7408)कसी (cid:7357)ूटी पद क(cid:7409) एक दसू रे के साथ अदला-बदली हो सकेगी।
(2) इन िनयम(cid:7298) के (cid:7079)ारंभ के प(cid:7019) चात िविभ(cid:7008) न (cid:7061)ेड(cid:7298) म(cid:7286) (cid:7357)ूटी पद(cid:7298) क(cid:7409) (cid:7079)ािधकृत सं(cid:6990) या वह होगी जो समय-समय पर क(cid:7286)(cid:7076)ीय सरकार
(cid:7367)ारा अवधा(cid:7407)रत क(cid:7409) जाये।
(3) क(cid:7286)(cid:7076)ीय सरकार, समय-समय पर और आयोग से परामश(cid:6981) करके अनुसूची I म(cid:7286) सि(cid:7013)मिलत पद(cid:7298) से िभ(cid:7008) न (cid:7408)कसी पद को सेवा म(cid:7286)
सि(cid:7013)मिलत कर सकेगी या उ(cid:6989) त अनुसूची म(cid:7286) सि(cid:7013)मिलत (cid:7408)कसी पद को सेवा से अपव(cid:7414)जत कर सकेगी।
(4) क(cid:7286)(cid:7076)ीय सरकार, समय-समय पर और आयोग से परामश(cid:6981) करके ऐसे (cid:7408)कसी अिधकारी को िजसका पद उपिनयम (3) के अधीन
सेवा म(cid:7286) सि(cid:7013)मिलत है, (cid:7408)कसी अ(cid:7021) थायी हिै सयत म(cid:7286) या (cid:7408)कसी अिध(cid:7020) ठायी हिै सयत म(cid:7286) जो वह ठीक समझे, सेवा के समुिचत (cid:7061)ेड म(cid:7286)
िनयु(cid:6989) त कर सकेगी और उस सदशृ (cid:7061)ेड म(cid:7286) उसक(cid:7409) िनरंतर सेवा पर िवचार करने के प(cid:7019) चात उस (cid:7061)ेड म(cid:7286) उसक(cid:7409) (cid:6996) ये(cid:7020) ठता िनयत कर
सकेगी।
5. सवे ा के सद(cid:7021)य :-- (1) िन(cid:7013) निलिखत (cid:7018) यि(cid:7334) सेवा के सद(cid:7021) य ह(cid:7298)गे, अथा(cid:6981)त :--
(क) ऐसे (cid:7018) यि(cid:7334) िज(cid:7008) ह (cid:7286)िनयम 6 के अधीन (cid:7357)ूटी पद(cid:7298) पर िनयु(cid:6989) त (cid:7408)कया गया ह ै; और
(ख) ऐसे (cid:7018) यि(cid:7334) िज(cid:7008) ह (cid:7286)िनयम 4 के उपिनयम (4) और (7) के अधीन (cid:7357)ूटी पद(cid:7298) पर िनयु(cid:6989) त (cid:7408)कया गया ह ै।
(2) उपिनयम (1) के ख(cid:7003) ड (क) के अधीन िनयु(cid:6989) त (cid:7408)कसी (cid:7018) यि(cid:7334) को ऐसी िनयुि(cid:7334) पर अनुसूची I म(cid:7286) उस पर लागू त(cid:7004)स मान
(cid:7061)ेड म(cid:7286) सेवा का सद(cid:7021) य माना जाएगा ।
(3) उपिनयम (1) के ख(cid:7003) ड (ख) के अधीन िनयु(cid:6989) त कोई (cid:7018) यि(cid:7334) उ(cid:6989) त िनयुि(cid:7334) क(cid:7409) तारीख से अनुसूची I म(cid:7286) उस पर लागू
त(cid:7004) समान (cid:7061)ेड म(cid:7286) काय(cid:6981) करते (cid:7263)ए सेवा का सद(cid:7021) य होगा ।
6. सवे ा का (cid:7079)ारंिभक गठन :-- इन िनयम(cid:7298) के (cid:7079)ारंभ क(cid:7409) तारीख को िनयिमत आधार पर िविभ(cid:7008) न (cid:7061)ेड(cid:7298) म(cid:7286) समूह ‘‘क’’ पद धारण करने
वाले सभी िव(cid:7378)मान िवभागीय अ(cid:7012) य(cid:7414)थय(cid:7298) को त(cid:7004) समान (cid:7357)ूटी पद(cid:7298) पर और यथाि(cid:7021)थित, (cid:7408)कसी अिध(cid:7020) ठायी या (cid:7021) थानाप(cid:7008)न हिै सयत
म(cid:7286) सेवा के (cid:7061)ेड म(cid:7286) िनयु(cid:6989) त (cid:7408)कया गया माना जाएगा ।¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3
7. सवे ा का भावी अनरु (cid:6979)ण :- इन िनयम(cid:7298) के (cid:7079)ारंभ के प(cid:7019) चात अनुसूची I म(cid:7286) िन(cid:7416)द(cid:7020) ट (cid:7408)कसी भी (cid:7061)ेड म(cid:7286) (cid:7408)कसी (cid:7407)रि(cid:7334) को िन(cid:7013)न िलिखत
रीित म(cid:7286) भरा जाएगा :--
(क) सेवा के िविभ(cid:7008) न (cid:7061)ेड(cid:7298) के िलए िनयुि(cid:7334)यां, भत(cid:7278) क(cid:7409) प(cid:7373)ित, (cid:7079)ो(cid:7008) नित के (cid:6979)े(cid:7074), अगले िन(cid:7013) नतर (cid:7061)ेड म(cid:7286) U;wuतम अहक(cid:6981) सेवा
और अनुसूची 2 म(cid:7286) िविन(cid:7416)द(cid:7020) ट, यथाि(cid:7021)थित, (cid:7079)ो(cid:7008) नित या (cid:7079)ितिनयिु (cid:7334) पर (cid:7021) थाना(cid:7008) तरण (cid:7367)ारा और अ(cid:7008) य पा(cid:7074)ता शत(cid:7300) के
अनुसार क(cid:7409) जाएंगी ;
(ख) (cid:7079)ो(cid:7008) नित के िलए अिधका(cid:7407)रय(cid:7298) का चयन अनुसूची 3 के अनुसार ग(cid:7407)ठत िवभागीय (cid:7079)ो(cid:7008) नती सिमित क(cid:7409) िसफा(cid:7407)रश पर
(cid:7408)कया जाएगा ;
(ग) सेवा के किन(cid:7020) ठ वेतनमान (सहायक िनदशे क) म(cid:7286) सीधी भत(cid:7278) (cid:7367)ारा िनयुि(cid:7334) के िलए शैि(cid:6979)क और अ(cid:7008) य अहत(cid:6981) ाएं, अनुभव
और आयु-सीमा वह होगी जो अनुसूची 4 म(cid:7286) िविन(cid:7416)द(cid:7020) ट ह ै।
8. प(cid:7407)रवी(cid:6979)ा : (1) सीधी भत(cid:7278) (cid:7367)ारा या (cid:7079)ो(cid:7008) नित (cid:7367)ारा सेवा म(cid:7286) िनयु(cid:6989) त (cid:7079)(cid:7004) येक अिधकारी दो वष(cid:6981) क(cid:7409) कालाविध के िलए प(cid:7407)रवी(cid:6979)ा पर
होगा :
पर(cid:7008) तु िनयं(cid:7074)क (cid:7079)िधकारी क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा इस िनिम(cid:7275) समय-समय पर जारी (cid:7408)कए गए अनुदशे (cid:7298) के अनुसार प(cid:7407)रवी(cid:6979)ा क(cid:7409)
अविध को बढ़ा सकेगा :
पर(cid:7008) तु यह और (cid:7408)क प(cid:7407)रवी(cid:6979)ा क(cid:7409) अविध बढ़ाने का िविन(cid:7019) चय साधारणतया प(cid:7407)रवी(cid:6979)ा क(cid:7409) अविध क(cid:7409) समाि(cid:7385) के प(cid:7019)च ात आठ
स(cid:7009) ताह के भीतर (cid:7408)कया जाएगा और उ(cid:6989) त अविध के भीतर ऐसा करने के कारण(cid:7298) सिहत संबंिधत अिधकारी को िलिखत (cid:7272)प म(cid:7286)
संसूिचत कर (cid:7408)दया जाएगा ।
(2) प(cid:7407)रवी(cid:6979)ा या उसक(cid:7409) बढ़ाई गई कोई अविध पूरा करने पर (cid:7408)कसी अिधकारी को, य(cid:7408)द उसे (cid:7021) थायी िनयुि(cid:7334) के िलए
उपयु(cid:6989) त पाया जाता है, िनयिमत आधार पर उसक(cid:7409) िनयुि(cid:7334) म(cid:7286) (cid:7079)ितधा(cid:7407)रत (cid:7408)कया जाएगा और स(cid:7013) यक् अनु(cid:7059)म म(cid:7286)
उपल(cid:7011) ध अिध(cid:7020) ठायी (cid:7407)रि(cid:7334) पर उसक(cid:7409) पुि(cid:7397) कर दी जाएगी ।
(3) य(cid:7408)द, यथाि(cid:7021)थित, प(cid:7407)रवी(cid:6979)ा या उसक(cid:7409) बढ़ाई गई (cid:7408)कसी अविध के दौरान क(cid:7286)(cid:7076)ीय सरकार क(cid:7409) यह राय ह ै (cid:7408)क कोई
अिधकारी (cid:7021) थायी िनयुि(cid:7334) के िलए उपयु(cid:6989) त नह(cid:7277) है, तो क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा उसके कोई कारण बताए िबना - (क) य(cid:7408)द
वह सीधी भत(cid:7278) (cid:7367)ारा िनयु(cid:6989) त (cid:7408)कय गया था, तो उसे उस पद पर सेवा से उ(cid:7008) मु(cid:6989) त (cid:7408)कया जाये ; और (ख) य(cid:7408)द वह
(cid:7079)ो(cid:7008) नित (cid:7367)ारा िनयु(cid:6989) त (cid:7408)कया गया था, तो उसे (cid:7079)ो(cid:7008) नित (cid:7408)क ठीक पूव(cid:6981) उसके (cid:7367)ारा धा(cid:7407)रत पद पर (cid:7079)ितव(cid:7414)तत (cid:7408)कया जाये ।
(4) प(cid:7407)रवी(cid:6979)ा या उसक(cid:7409) बढ़ाई गई (cid:7408)कसी अविध के दौरान अिधकारी से ऐसे (cid:7079)िश(cid:6979)ण पाठय(cid:7059)म और अनुदेश (cid:7079)ा(cid:7009)त करने
तथा ऐसी परी(cid:6979)ाएं और परी(cid:6979)ण उ(cid:7275)ीण करने क(cid:7409) अपे(cid:6979)ा क(cid:7409) जा सकेगी जो क(cid:7286)(cid:7076)ीय सरकार प(cid:7407)रवी(cid:6979)ा के समाधान-(cid:7079)द
(cid:7272)प म(cid:7286) पूरा करने क(cid:7409) शत(cid:6981) के (cid:7272)प म(cid:7286) आव(cid:7019) यक समझे।
(5) उपिनयम (1) से (4) के अधीन सेवा के सद(cid:7021) य(cid:7298) क(cid:7409) प(cid:7407)रवी(cid:6979)ा से संबंिधत अ(cid:7008) य मामले इस संबंध म(cid:7286) क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा
समय-समय पर जारी अनुदशे (cid:7298) से शािसत ह(cid:7298)गे ।
9. (cid:6996)य (cid:7020)े ठता : (1) िनयम 6 के अधीन सेवा के (cid:7079)ारंिभक गठन पर अनुसूची I म(cid:7286) व(cid:7414)णत िविभ(cid:7008) न (cid:7061)ेड(cid:7298) म(cid:7286) िनयु(cid:6989) त अिधका(cid:7407)रय(cid:7298) क(cid:7409)
पर(cid:7021) पर (cid:6996) ये(cid:7020) ठता का अवधारण, िनयम 2 के ख(cid:7003) ड (ग) के व(cid:7414)णत िनयम(cid:7298) के अधीन भत(cid:7278) (cid:7408)कए गए अिधका(cid:7407)रय(cid:7298) क(cid:7409) पर(cid:7021)प र
(cid:6996) ये(cid:7020) ठता के संबंिधत (cid:7061)ेड(cid:7298) म(cid:7286) अनुर(cid:6979)ण के अधीन रहते (cid:7263)ए उस (cid:7061)ेड म(cid:7286) िनयिमत िनरंतर सेवा क(cid:7409) समयाविध के अनुसार (cid:7408)कया
जाएगा;
(2) (cid:7079)ारंिभक गठन के समय िनयु(cid:6989) त अिधकारी बाद म(cid:7286) िनयु(cid:6989) त सभी अिधका(cid:7407)रय(cid:7298) से (cid:6996) ये(cid:7020) ठ ह(cid:7298)गे;
(3) (cid:7079)ारंिभक गठन के प(cid:7019) चात सेवा म(cid:7286) िनयु(cid:6989) त अिधका(cid:7407)रय(cid:7298) क(cid:7409) (cid:6996) ये(cid:7020) ठता समय-समय पर यथा संशोिधत का(cid:7414)मक और
(cid:7079)िश(cid:6979)ण िवभाग के काया(cid:6981)लय (cid:6980)ापन सं. 22011/7/86-(cid:7021) था. तारीख 3 जुलाई, 1986 म(cid:7286) अंत(cid:7414)व(cid:7020) ट उपबंध(cid:7298) के अनुसार
अवधा(cid:7407)रत क(cid:7409) जाएगी;
(4) िनयम 4 के उप-िनयम (4) के अधीन िनयु(cid:6989) त अिधका(cid:7407)रय(cid:7298) क(cid:7409) (cid:6996) य(cid:7020)े ठता इन िनयम(cid:7298) म(cid:7286) उपबंिधत रीित म(cid:7286) िनयत क(cid:7409)
जाएगी;
(5) ऐसे अिधका(cid:7407)रय(cid:7298) क(cid:7409) (cid:6996) ये(cid:7020) ठता जो इस िनयम के अंतग(cid:6981)त नह(cid:7277) आते ह(cid:7289), क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा आयोग के परामश(cid:6981) से

(6) य(cid:7408)द इस िनयम के अधीन (cid:6996) ये(cid:7020) ठता िनयत (cid:7408)कए जाने क(cid:7409) दशा म(cid:7286) कोई क(cid:7407)ठनाई या िवसंगित पैदा हो जाती हो तो उसका
अवधारण क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा आयोग के परामश(cid:6981) से (cid:7408)कया जाएगा ।
10. सवे ा म (cid:7286) िनयिु(cid:7334):-- सेवा के िविभ(cid:7008)न (cid:7061)ेड(cid:7298) म(cid:7286) सभी पद(cid:7298) के िलए सेवा क(cid:7409) सभी िनयिु (cid:7334)यां िनयं(cid:7074)क (cid:7079)िधकारी (cid:7367)ारा क(cid:7409) जाएंगी।
'(cid:7079)ितिनयिु (cid:7334) (आईएसटीसी)' के मामल(cid:7298) म(cid:7286) आयोग का परामश(cid:6981) आव(cid:7019)यक होगा।
11. भारत के (cid:7408)कसी भी भाग म (cid:7286)सेवा के िलए दािय(cid:7004)व और अ(cid:7008)य शत (cid:7288) :-- (1) सेवा म(cid:7286) िनयु(cid:6989) त अिधकारी भारत म(cid:7286) या भारत के बाहर
(cid:7408)कसी भी (cid:7021) थान पर सेवा करने के दािय(cid:7004) वाधीन होगा ।

(ख) िजसने अपने पित या अपनी प(cid:7004) नी के जीिवत होते (cid:7263)ए (cid:7408)कसी (cid:7018) यि(cid:7334) से िववाह (cid:7408)कया है,
सेवा म(cid:7286) िनयुि(cid:7334) का पा(cid:7074) नह(cid:7277) होगा :
पर(cid:7008) तु य(cid:7408)द क(cid:7286)(cid:7076)ीय सरकार को यह समाधान हो जाता ह ै(cid:7408)क ऐसा िववाह ऐसे (cid:7018) यि(cid:7334) और िववाह के अ(cid:7008) य प(cid:6979)कार को लागू (cid:7021)व ीय

कारण ह(cid:7289) उ(cid:7008) ह(cid:7286) लेखब(cid:7373) करके तथा आयोग से परामश(cid:6981) करके, इन िनयम(cid:7298) के (cid:7408)कसी उपबंध को (cid:7408)कसी वग(cid:6981) या (cid:7079)वग(cid:6981) के (cid:7018)य ि(cid:7334)य(cid:7298) के
बाबत, आदशे (cid:7367)ारा िश िथल कर सकेगी ।
14. (cid:7018) याविृ (cid:7275) :--
इन िनयम(cid:7298) क(cid:7409) कोई बात ऐसे आर(cid:6979)ण(cid:7298), आयु-सीमा म(cid:7286) छूट और अन् य (cid:7407)रयायत(cid:7298) पर (cid:7079)भाव नह(cid:7277) डालेगी, िजनका सरकार (cid:7367)ारा
इस संबंध म(cid:7286) समय-समय पर जारी (cid:7408)कए गए आदशे (cid:7298) के अनुसार अनुसिचत जाितय(cid:7298), अनुसूिचत जनजाितय(cid:7298), अ(cid:7008)य िपछड़ा वग(cid:6981),

NOTIFICATION
New Delhi, the 4th January, 2017
G.S.R. 5(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in
Supersession of the Deputy Director General (Group ‘A’) Recruitment Rules, 2002 and the Directorate General of
Training (Group ‘A’ Posts) Recruitment Rules, 2011, except as respects things done or omitted to be done before such
supersession, the President hereby makes the following rules, namely:-
1.(cid:32) Short title and commencement:– (1) These rules may be called the Indian Skill Development Service Rules,
2017.
(2) They shall come into force on the date of their publication in the Official Gazette.
2.(cid:32) Definition.-In these rules, unless the context otherwise requires,
(a)(cid:32)“Commission” means the Union Public Service Commission;
(b)(cid:32)“Controlling Authority” means the Government of India in the Ministry of Skill Development and
Entrepreneurship;
(c)(cid:32)“departmental candidates” means all the existing officers holding Group ‘A’ posts appointed under–
(i)(cid:32) The Deputy Director General (Group ‘A’ Post), Recruitment Rules, 2002; or
(ii)(cid:32) The Directorate of Training (Group ‘A’ Posts) Recruitment Rules, 2011;
and include officers appointed on regular basis to the posts under the said rules but are on deputation to
other Departments on the date of commencement of these rules;
(d)(cid:32)“Department Promotion Committee” means a Committee constituted to consider promotion and
confirmation of officers in any grade under these rules;
(e)(cid:32)“duty post” means any post included in the First Schedule;
(f)(cid:32)“Grade” means a Grade specified in column 2 of the First Schedule;
(g)(cid:32)“regular service” in relation to any Grade means the period or periods of service in that Grade rendered after
the commencement of these rules and includes any period or periods -
(i) taken into account for the purpose of seniority in case of those appointed at the initial constitution;
and
(ii) during which an officer would have held a duty post in that Grade but for being on leave or
otherwise not available to hold such post;
(h)(cid:32)“Schedule” means a Schedule appended to these rules;
(i)(cid:32)“Service” means the Indian Skill Development Service constituted under rule 3.
3.(cid:32) Constitution of Indian Skill Development Service. – (1) There shall be constituted a Service to be known as
the Indian Skill Development Service consisting of members specified in rule 5.
(2) All the posts included in the Service shall be classified as Group ‘A’ posts.
4.(cid:32) Grades, authorised strength and its review. – (1) The duty posts included in the various Grades of the
Service, their number and the scales of pay on the commencement of these rules, shall be as specified in the
First Schedule:
Provided that a duty post included in a particular Grade as mentioned in the First Schedule shall be
interchangeable with one another.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(2) After the commencement of these rules, the authorised strength of the duty posts in various grades shall be
such as may, from time to time, be determined by the Central Government.
(3) Central Government may, in consultation with the Commission, include in the Service such posts as can be
deemed to be equivalent in status, pay band and Grade pay or pay scale to the posts included in First
Schedule or exclude from the service a duty post included in the said Schedule.
(4) The Central Government may, from time to time and in consultation with the Commission, appoint an
officer to a duty post whose post is included in the Service under sub-rule (3), to the appropriate Grade of
the Service in a temporary capacity or in a substantive capacity as it thinks fit and fix his seniority in that
Grade after taking into account his continuous regular service in the analogous Grade.
5.(cid:32) Member of Service. – (1) The following persons shall be the members of the Service, namely:-
(a) persons appointed to duty posts under rule 6; and
(b) persons appointed to duty posts under sub-rule (4) of rule 4 and rule 7.
(2) A person appointed under clause (a) of sub-rule (1) shall on such appointment be deemed to be the member
of the Service in the corresponding Grade, applicable to as specified him in the First Schedule.
(3) A person appointed under clause (b) of sub-rule (1) shall be a member of the Service in the corresponding
Grade applicable to him as specified in the First Schedule from the date of such appointment.
6.(cid:32) Initial constitution of Service. – All the existing departmental candidates holding Group ‘A’ posts in various
Grades on regular basis on the date of commencement of these rules shall be deemed to be appointed to the
corresponding duty posts and the Grade of the Service in a substantive or officiating capacity, as the case may
be.
7.(cid:32) Future maintenance of Service.- Any vacancy in any of the Grades referred to in the First Schedule after the
commencement of these rules shall be filled in following manner namely:–
(a)(cid:32) appointments to various Grades of the Service shall be made in accordance with the method of
recruitment, the field of promotion, the minimum qualifying service in the next lower Grade and other
eligibility conditions for appointment by promotion or transfer on deputation, as the case may be, as
specified in the Second Schedule.
(b)(cid:32) The selection of officers for promotion shall be made on the recommendation of the Departmental
Promotion Committee constituted in accordance with the Third Schedule;
(c)(cid:32) The educational and other qualifications, experience and age limits for appointment by direct recruitment
to Junior Time Scale (Assistant Director) of the Service shall as specified in the Fourth Schedule.
8.(cid:32) Probation.– (1) Every officer appointed to the Service either by direct recruitment or by promotion in Junior
Scale shall be on probation for a period of two years:
Provided that the Controlling Authority may extend the period of probation in accordance with the
instructions issued by the Central Government from time to time in this regard:
Provided further that any decision for extension of period of probation shall be taken ordinarily within eight
weeks after the expiry of the period of probation and communicated in writing to the concerned officer together
with the reasons for so doing within the said period.
(2) On completion of the period of probation or any extension thereof, the officer shall, if considered fit for
permanent appointment, be retained in his appointment on regular basis and be confirmed in due course
against the available substantive vacancy.
(3) If, during the period of probation or any extension thereof, as the case may be, the Central Government is of
the opinion that an officer is not fit for permanent appointment, the Central Government without any reason
being assigned, may –
(a) If he was appointed by direct recruitment discharge him from Service in that post;
(b) If he was appointed by promotion revert him to the post held by him immediately before such promotion.
(4) During the period of probation or any extension thereof, the officer may be required to undergo such
courses of training and instructions and pass such examinations and tests as the Central Government may
consider necessary as a condition to the satisfactory completion of probation.
(5) Subject to sub-rules (1) to (4), the other matters relating to probation of the members of the Service shall be
governed by the instructions issued by the Central Government from time to time in this regard.
9.(cid:32) Seniority. – The inter-se seniority of the officers appointed to the various Grades mentioned in the First
Schedule at the initial constitution of the Service under rule 6, shall be determined according to the length of
regular continuous service in the Grade subject to maintenance in the respective Grades of inter-se seniority of
officers recruited under the rules mentioned in clause 1 of rule 2;
(2) Officers appointed at the initial constitution shall be senior to those appointed subsequently.
(3) The seniority of the officers appointed to the Service after the initial constitution shall be determined in
accordance with the provisions contained in the Department of Personnel and Training
O.M. No. 22011/7/86/Estt., Dated the 3rd July, 1986 as amended from time to time.
(4) The seniority of officers appointed under sub-rule (4) of rule 4 shall be fixed in the manner provided in these

(5) The seniority of officers not covered under this rule, shall be determined by Central Government in
consultation with the Commission.
(6) In case the fixation of the seniority under this rule results in difficulties or anomalies, the same shall be
determined by the Central Government in consultation with the Commission.
10.(cid:32) Appointment to Service. – All appointments to the Service shall be made by the Controlling Authority for all
the posts in various Grades of the Service and in case of ‘Deputation (ISTC)’, consultation with the Commission
shall be necessary.
11.(cid:32) Liability for service in any part of India and other conditions of service. – (1) The officers appointed to the
Service shall be liable to serve any where in India or outside.
(2) The conditions of service of the members of the Service, in respect of matters for which no provision is
made in these rules, shall be the same as are applicable, from time to time, to officers of Central Civil
Service in general.
12.(cid:32) Disqualification:– No person, –
(a)(cid:32)who has entered into or contracted a marriage with a person having a spouse living; or
(b)(cid:32)who, having a spouse living has entered into or contracted a marriage with any person,
shall be eligible for appointment to the Service:
Provided that the Central Government may, if satisfied, that such marriage is permissible under the personal
law applicable to such person and the other party to the marriage and that there are other grounds for so doing,
exempt any person from the operation of this rule.
13.(cid:32) Power to relax.– where the Central Government is of the opinion that it is necessary or expedient so to do, it
may by order, for reasons to be recorded in writing and in consultation with the Commission, relax any of the
provisions to these rules with respect to any class or category of persons.
14.(cid:32) Saving.– Nothing in these rules shall effect reservations, relaxation of age limit and other concessions required
to be provided for the persons belonging to the Scheduled Castes, the Scheduled Tribes, Other Backward
Classes, Ex-Servicemen and other special categories of persons in accordance with the orders issued by the
Government from time to time in this regard.
15.(cid:32) Residuary matters:– In regard to matters not specifically covered by these rules, the members of the Service
shall be governed by the rules, regulations and orders applicable to the Central Civil Services or equivalent
posts in general.
16.(cid:32) Interpretation:– If any question relating to interpretation of these rules arises, it shall be referred to the Central
Government who shall decide the same.
