(एससीटी) में जनर्ददष्ट दकया गया ह।ै (छ) "ददवय ागं जन" का ऄथग िही ह गा ज ददव यांगजनक के ऄजधकार ऄजधजनयम, 2016 (2016 का 49) की धारा 2 के खंड (खंडक) में जनर्ददष्ट दकया गया ह;ै (ज) "ऄनसु चू ी" स े ऄजभप्रेत आन जनयमक से ईपाबि ऄनुसूची से ह;ै (झ) "ऄनसु जू चत जाजत" र "ऄनसु जू चत जनजाजत" का ऄथ ग िही ह गा ज संजिधान के ऄनुच्छेद 366 के क्मिः खंड (24) र (25) म ें ईनके जलए जिजनर्ददष्ट दकया गया ह;ै (ञ) "सिे ा" स े ऄजभप्रेत भारतीय जिदेि सेिा ह;ै 3. जिदिे सिे ा ब ड ग-(1) एक ब डग का गठन दकया जाएगा जजसे जिदेि सेिा ब डग कहा जाएगा। (2) जिदेि सेिा ब डग म ेंजनम्नजलजखत िाजमल हकग:े (i) ऄध्यि के रूप म ेंजिदेि सजचि के साथ जिदेि मंत्रालय म ेंभारत सरकार के सभी सजचि; (ii) िाजणज्य मंत्रालय में भारत सरकार के सजचि; तथा (iii) जिदेि मत्रं ालय में प्रिासन के प्रभारी संयुक्त सजचि ब डग के सजचि हकगे। (3) ब डग के क इ भी तीन सदस्ट्य क रम पणू ग करेंगे। 4. जिदिे सिे ा ब ड ग के काय ग -– जिदेि सेिा ब डग का कायग जनम्नजलजखत मामलक पर केन्र सरकार क परामिग दने ा ह गा, ऄथागत: - (i) जमिन प्रमुखक क छ डकर सभी पदक पर तनै ाती र स्ट् थानातं रण। (ii) जिदेि जस्ट्थत भारतीय जमिनक र केन् रक में तैनात दकए गए ऄजधकाररयक क राजनजयक दजाग प्रदान करना। 5. सिे ा का सघं टन - (1) सेिा के जलए एक संिगग का सघं टन दकया जाएगा। (2) संिगग म ेंपदक की संख् या र आसकी सरं चना केंर सरकार वारारा समय-समय पर जनधागररत की जाएगी। (3) आस सेिा के ग्रडे र आसमें पदक की प्राजधकृत संख् या आन जनयमक में ईपाबि ऄनुसूची I म ें ददए ऄनुसार रख े जाएंगे; (4) दकसी ग्रेड में जनयुजक्त करन े के जलए सिम प्राजधकारी ईस ग्रेड के जलए ऄस्ट्थायी या स्ट्थायी पररिधगन कर सकता ह,ै यदद समय-समय पर सा करना अिश्यक ह जजसके जलए सामान्य या जििेष अदेि जारी दकए जाएंगे। 6. सिं ग गपदक पर जनयजु तत या:ं- (1) आस सेिा म ें संिगग पदक के जलए सभी जनयुजतत यां केंर सरकार वारारा आन जनयमािली के प्रािधानक के ऄनुसार की जाएगी। (2) से देिक म ें जहां जमिन प्रमुख मौजूद नहीं ह,ं िहां जमिन र केंर के प्रमुख के पदक क केंर सरकार वारारा ऄपन े जििेकाजधकार से आस सेिा के सदस्ट्यक या ऄन्य व्यजक्तयक की जनयुजक्त वारारा भरा जाएगा। 7. पदक क समाप्त करन े या स्ट्थजगत रखन े की िजक्त:- (1) केंर सरकार दकन् हीं भी स्ट्थायी या ऄस्ट्थायी संिगग पदक क समाप्त कर सकती ह ैया स्ट्थजगत रख सकती ह।ै (2) दकसी ग्रेड म ें दकसी संिगग पद क जनयंत्रक प्राजधकारी वारारा, यदद आस तरह के पद की अिश्यकता ह , त दकसी समय के जलए, संिगग बाह्य पद घ जषत दकया जा सकता ह,ै जनयंत्रक प्राजधकारी वारारा जनधागररत जििेष य ग्यता या ऄनुभि रखने िाले व्यजक्तयक से प्रजतजनयुजक्त अधार पर जनयुजक्त वारारा भरे जाने पर र तथा सी घ षणा दकए जान े पर यह पद ईक्त घ षणा लागू रहने तक संिगग से बाहर रहगे ा। 8. सिे ा म ेंजनयजु क्त:- आस सेिा में सभी प्रारंजभक जनयुजक्तयां जनम्नजलजखत रीजत स ेकी जाएगी:- (1) केंर सरकार वारारा अय ग के परामि ग से समय-समय पर बनाए गए से जिजनयमनक के ऄनुसार अय ग वारारा अय जजत की गइ खलु ी प्रजतय जगता परीिा के पररणाम के अधार पर कजनष्ठ स्ट्तर पर सिं गग पद पर सीधी भती वारारा।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 (2) भारतीय जिदेि सेिा, िाखा ख के ग्रेड I के से ऄजधकाररयक, जजन्हकने ईस ग्रडे म ें न्यूनतम तीन िष ग की सेिा पूरी कर ली ह र अय ग वारारा जिजनर्ददष् टानुसार आस सेिा के जलए सीधी भती हते ु जनधागररत न्यूनतम ििै जणक ऄहतग ाए ं पूरी करते ह , में से िररष्ठ स्ट् तर पर संिग गपद के जलए चयन के अधार पर पद न्नजत वारारा। बितें दक आस सेिा में भारतीय जिदेि सेिा, िाखा ख के ग्रेड-1 से पद न्नजत वारारा जनयुक्त दकए गए ऄजधकाररयक की कुल संख्या दकसी भी समय आस संिगग म ें िररष्ठ स्ट्तर र ईससे ईच् च स्ट् तर के पदक से 22.5 प्रजतित स े ऄजधक न ह लेदकन आसम ेंजमिन र केंर प्रमुखक के अध े पद िाजमल नहीं हकगे। (3) जनयम 8 के ईपजनयम (2) के ऄनुसार सेिा के िररष्ठ स्ट्तर पर जनयुजक्तयां करन े के जलए जिभागीय पद न्नजत सजमजत की संरचना आन जनयमािली की ऄनुसूची II के ऄनुसार जनधागररत की जाएगी। 9. पद न्नजतया:ं- (1) सेिा के जिजभन्न ग्रेडक में ऄजधकाररयक की पद न्नजत आन जनयमािली की ऄनुसूची II के ऄनुसार गरठत की गइ जिभागीय पद न्नजत सजमजत की ऄनुिंसाओं के अधार पर सेिा में स्ट्थायी सदस्ट्यक र ऄगले न्यूनतर ग्रेड म ें पद धारण करन े िाल े र आन जनयमािली की ऄनुसूची III में जनधागररत की गइ सी रीजत र आसकी पात्रता ित,ें ऄजतररक्त मापदंड र बचं माकग क पूरा करने िाल ेसदस्ट्यक में से की जाएगी। (2) ऄजधकाररयक क सेिा के ग्रडे I, ग्रेड II र ग्रडे III के जलए पद न्नजत के जलए बैच के िररष्ठ ऄजधकाररयक के साथ सभी स्ट्तर पर बैच-िार माना जाएगा। पद न्नजत के जलए सूचीबि ऄजधकाररयक क ररजक्तयक की ईपलब्धता के ऄध् यधीन संबंजधत िषग के दौरान दकसी भी समय पद न्नत दकया जा सकता ह।ै (3) जहां सिम प्राजधकाररयक का मत ह ैदक सा करना ऄजनिायग या ऄपररहायग ह ैत या जलजखत में ररकाड गदकए जान े िाले कारणक से सेिा के ग्रडे I, ग्रेड II र ग्रडे III में पद न्नजत के जलए भारत र जिदेि म ें ऄजतररक्त मापदडं र आन जनयमक की ऄनुसूची III में यथा जनधागररत पद न्नजत के जलए ऄजनिायग प्रजििण तथा समय-समय पर यथा संि जधत सूचीबि ददिा-जनदेिक में छूट द ेसकता ह।ै 10. प्रजतजनयजु क्त वारारा जनयजु क्त:- (1) सरकार दकसी भी समय सेिा के दकसी सदस्ट्य क सेिा में र ऄन्य दकसी ऄजखल भारतीय सेिा, केंरीय सेिा समूह क, या दकसी ऄंतरराष्ट्रीय संगठन या जिदेिी जनय क्ता की सेिा में ईसके वारारा धाररत समकि या ईच्चतर पद पर प्रजतजनयक्तु कर सकती ह।ै सी रीजत स े जनयुक्त सेिा का सदस्ट्य प्रजतजनयुजक्त अरिी पद पर धाररत ह गा। बिते दक प्रजतजनयुजक्त की ऄिजध प्रथमत: तीन िषग स े ऄजधक नहीं ह गी यद्यजप केंर सरकार ईक्त क र ऄजधक बढा सकती ह ै बिते दक प्रजतजनयुजक्त की कुल ऄिजध सी प्रजतजनयुजक्त के जलए सरकार वारारा जनधागररत ददिा-जनदेिक स े ऄजधक नहीं ह गी। (2) सरकार, यदद संतुष्ट ह ैदक सेिा का क इ भी ईपयुक्त सदस्ट्य दकसी संिगग जििेष का पद भरने के जलए ईपलब्ध नहीं ह ै त यह केंर सरकार की सेिा या ऄजखल भारतीय सेिा में समकि पद धारण करन े िाले तथा जनयंत्रक प्राजधकारी वारारा जनधागररत िाछं नीय ऄहतग ा या ऄनुभि रखने िाले ऄजधकारी क तीन िष ग तक के जलए ईस पर जनयक्तु कर सकती ह।ै आस प्रकार से जनयुक्त व्यजक्त संिगग पद के स्ट्थगन में रखे गए पद के जिरुि तैनात ह गा जैसा दक जनयमन 7 म ें प्रदत्त ह:ै बिते दक यदद केंर सरकार तब भी संतुष्ट ह दक सेिा का क इ ईपयुक्त सदस्ट्य ईक्त ऄिजध की समाजप्त पर भी ईपलब्ध नहीं ह ै त केंर सरकार जनयुजक्त की कुल ऄिजध क 7 िषग तक रखते ए ए ईसकी जनयुजक्त ऄिजध क एक िषग तक बढा सकती ह।ै 11. िररष्ठता:- (1) आन जनयमक के लागू ह न े पर दकसी भी ग्रडे में जनयुक्त सेिा के सदस्ट्यक की परस्ट्पर िररष्ठता ईनके संबंजधत ग्रडे क में परस्ट्पर िररष्ठता ह गी जैसा दक आन जनयमक के लाग ूह ने से पूिग जनधागररत की गइ है: बिते दक यदद सेिा के दकसी सदस्ट्य की िररष्ठता आन जनयमक के लागू ह न े से पूिग जनधागररत नहीं की गइ ह ै त ईक्त का जनधागरण जनयंत्रक प्राजधकारी वारारा सामान्य अदेिक के ऄनुसार या जनयंत्रक प्राजधकारी वारारा िररष्ठता पर समय-समय पर जारी ऄनदु ेिक के ऄनुसार ह गा। (2) अय ग वारारा अय जजत खलु ी प्रजतय जगता परीिा के पररणाम पर सेिा में भती दकसी ऄजधकारी का अबंटन िषग, ईक्त परीिा अय जजत ह ने का ऄनुिती िष गह गा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) जनयम 8 के ईप जनयम (1) के ऄनरूु प सेिा म ें भती दकए गए ऄजधकाररयक की परस्ट्पर िररष्ठता अय ग वारारा अय जजत परीिा र फाईण्ड ेिन पाठ्यक्म में काय-ग जनष्पादन के अधार पर र सरकार वारारा समय-समय पर यथा जनधागररत ऄन्य ऄजनिायग पररिीिाधीन प्रजििण के अधार पर मंत्रालय वारारा संकजलत मेररट सचू ी के ऄनुसार ह गी। (4) जनयम 8 के ईप-जनयम (2) के ऄनुसार सेिा में पद न्नत दकए गए ऄजधकाररयक क आस प्रकार िषग अिंरटत दकया जाएगा:- (i) ईस िषग से पहले तीन िषों के ऄनुरूप जजसमें क इ ऄजधकारी भारतीय जिदेि सेिा के िररष्ठ पद पर एक मलू पद के जिरुि जनयुक्त ए अ ह ; (ii) भारतीय जिदेि सेिा के ग्रडे I, िाखा ख म ें जनरंतर तीन िषग की न्यनू तम सेिा के बाद प्र‍ यके तीन िषग की सेिा पूरी करन े के जलए एक िषग का िेटेज ददया जाएगा। आस ईप-जनयम के तहत िेटेज की गणना के जलए, ऄपूणाांक यदद क इ ह त ईसे नजरऄदं ाज दकया जाएगा: बिते दक अिंरटत दकया गया िषग सेिा के िररष्ठ पद पर िास्ट्तजिक पद न्नजत के पूिगिती िषग से अठ िषग की ऄिजध स े पहले का नहीं ह गा: आसके ऄजतररतत बित े दक भारतीय जिदेि सेिा के ग्रडे I, िाखा ख स े पद न्नत ऄजधकारी क ईस चयन सूची म ें ईसके िररष्ठ ऄजधकारी क अिंरटत दकए गए िष ग या जपछली चयन सूची के अधार पर सेिा म ें जनयुजक्त िष ग स े पहले का िषग अिंरटत नहीं दकया जाएगा। (5) जनयम 8 के ईप-जनयम (1) के ऄनुसार अय ग वारारा अय जजत प्रजतय गी परीिाओं के अधार पर सेिा में जनयुक्त सीधी भती दकए गए ईम् मीदिारक र ईप-जनयम (2) र जनयम 8 के ऄनुसार िररष्ठ पदक में पद न्नत ऄजधकाररयक की िररष्ठता के बीच, आस प्रय जन के, ईनकी िररष्ठ ता ईन्ह ें अिंरटत दकए गए िषग पर जनभगर करेगी र जहा ं अिंटन का िष ग समान ह गा, िहां सीधी भती िाले ईम् मीदिार िररष्ठ हकगे। 12. पररिीिा र स्ट्थायीकरण- (1) जनयम 8 के ईप-जनयम (1) के तहत कजनष्ठ स्ट् तर में सीधी भती वारारा या जनयम 8 के ईप-जनयम (2) के तहत िररष्ठ स्ट्त र में पद न्नजत वारारा, सेिा में जनयुजक्त पर प्र‍यके ऄजधकारी द िषग की ऄिजध के जलए पररिीिा पर रहगे ा: बिते दक जनयंत्रक प्राजधकारी सरकार वारारा समय-समय पर जारी जनदेिक के ऄनुसरण म ें पररिीिा ऄिजध बढा सकता ह।ै (2) पररिीिा की ऄिजध या ईसमें दकए गए दकसी भी प्रकार के जिस्ट् तार के पूरा ह ने पर, ऄजधकाररयक क , यदद स्ट्थायी जनयुजक्त के जलए ईपयुक्त पाया जाता ह,ै त ईन् ह ें जनयजमत अधार पर ईनकी जनयुजक्तयक म ें बरकरार रखा जा सकता ह ै र ईपलब्ध मलू ररजक्तयक के जिरूि जनयत समय में स्ट् थायी दकया जा सकती ह,ै जैसा भी मामला ह । (3) यदद, पररिीिा की ऄिजध या ईसके जिस्ट्तार के दौरान, जैसा भी मामला ह , सरकार की यह राय ह ै दक ऄजधकारी स्ट्थायी जनयुजक्त के जलए ईपयुत त नहीं ह,ै त सरकार ईस ऄजधकारी क सेिा से हटा सकती ह ै या सेिा म ें ईनकी जनयुजक्त से पहल े ईसके वारारा धारण दकए गए पद पर प्र‍यािर्थतत कर सकती ह,ै जैसा भी मामला ह । (4) पररिीिा ऄिजध के दौरान या ईसके दकसी भी प्रकार के जिस्ट्तार के दौरान, ईम्मीदिारक क पररिीिा क संत षजनक रूप से परू ा करने की ितग के रूप में, सरकार वारारा ऄपेजित प्रजििण के से पाठ्यक्म क पूरा करना ह गा र सरकार वारारा ईजचत समझी जाने िाली सी परीिाए ं र परीिण ईत्तीणग करने हकगे। सेिा में जनयुक्त क इ भी ऄजधकारी तब तक सेिा में स्ट्थायीकरण के जलए पात्र नहीं ह गा जब तक दक िह केंर सरकार की तुजष्ट तक, अिंरटत की गइ ऄजनिायग जिदिे ी भाषा में जनधागररत परीिा या परीिण ईत्तीणग न कर ल:े बिते दक जहां तक पररिीिा से संबंजधत ऄन्य मामलक का संबधं ह,ै सेिा म ें कायगरत सदस्ट्य आस संबंध म ें सरकार वारारा समय-समय पर जारी ऄनुदेिक वारारा िाजसत हकगे। 13. ऄय ग्यता– (1) क इ भी व्यजक्त तब तक सेिा में जनयक्तु नहीं दकया जाएगा जब तक दक िह भारत का नागररक न ह । (2) क इ भी व्यजक्त, - (क) जजसने से व यजक्त से जजसका पजत या जजसकी प‍ नी जीजित ह,ै जििाह दकया ह ै या जििाह का ऄनुबंध दकया ह ैया[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 (ख) जजसने ऄपने पजत या ऄपनी प‍ नी के जीजित रहते ए ए दकसी व यजक्त से जििाह दकया ह ै या जििाह का ऄनुबंध दकया ह,ै ईतत पद पर जनयुजक्त का पात्र नहीं ह गा; या बिते दक यदद केंरीय सरकार आस तथ्य से संतुष्ट ह दक सा जििाह ईस व यजक्त र जििाह के ऄन्य पिकार के मामले में लाग ूस्ट् िीय जिजध के ऄधीन ऄनुम‍य ह ै र सा करने के ऄन्य अधार ह ंत िह दकसी व यजक्त क आस जनयम के प्रितगन से छूट द ेसकती ह।ै 14. जनयम जिजथल करन ेकी िजक्त: जहां केंरीय सरकार की यह राय ह ैदक सा करना अिश्यक या समीचीन है, िहां िह कारणक क लेखबि करके र अय ग से परामिग करके आन जनयमक के दकसी भी ईपबंध क दकसी िगग या प्रिगग के व यजक्तयक के बाबत, अदेि वारारा जिजथल कर सकती ह।ै 15. व्याख्या:- यदद आन जनयमक की व्याख्या स े संबंजधत क इ मामला ईठता ह,ै त यह सरकार वारारा तय दकया जाएगा। 16. वय ािजृ त्त-आन जनयमक में ईजल्लजखत क इ बात, अरिण, अय ु सीमा म ें छूट र सी ऄन्य ररयायतक पर प्रभाि नहीं डालगे ी, जजनका केंरीय सरकार वारारा आस संबंध म ें समय-समय पर जारी दकए गए अदेिक के ऄनुसार ऄनुसूजचत जाजतयक, ऄनुसूजचत जनजाजतयक, ऄन्य जपछडे िगों, अर्थथक रूप से जपछडे िगों, ददव यांगजनक, भूतपूिग सैजनकक र ऄन्य जििेष श्रणे ी के व यजक्तयक के जलए ईपबंध करना ऄपेजित ह।ै ऄनसु चू ी I [जनयम 5 का ईप-जनयम (3)] (िते न मरै रतस म ेंग्रडे , लिे ल तथा सिे ा म ेंसजम्मजलत पदक की सख्ं या) क्म (प्रिासन) MINISTRY OF EXTERNAL AFFAIRS NOTIFICATION New Delhi, the 27th April, 2020 G.S.R. 265(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Indian Foreign Service (Recruitment, Cadre, Seniority and Promotion) Rules, 1961 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, namely:- 1. Short title and commencement.––(1) These rules may be called the Indian Foreign Service (Recruitment, Cadre, Seniority and Promotion) Rules, 2020. (2) They shall come into force from the date of publication in the Official Gazette. 2. Definitions.–– In these rules, unless the context otherwise requires, - (a) ―Cadre Post‖ means a post included in the cadre of the Service and includes a temporary post which forms a temporary addition to the cadre; (b) ―Commission‖ means the Union Public Service Commission; (c) ―Controlling Authority‖ means the Government of India in the Ministry of External Affairs; (d) ―economically weaker section‖ shall have the same meaning assigned to it in clause (6) of article 15 of the Constitution; (e) ―Government‖ means the Government of India; (f) ―Other Backward Classes‖ shall have the same meaning as provided in Department of Personnel and Training OM No.36012/22/93-Estt.(SCT) dated 8th September, 1993 as amended from time to time; (g) ―person with disability‖ shall have the same meaning as assigned to it in clause (s) of Section 2 of the Rights of Persons with Disabilities Act, 2016 (No.49 of 2016); (h) ―Schedule‖ means schedule appended to these rules; (i) ―Scheduled Castes‖ and ―Scheduled Tribes‖ shall have the same meaning as assigned to them respectively in clauses (24) and (25) of article 366 of the Constitution; (j) ―Service‖ means the Indian Foreign Service;10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. Foreign Service Board.––(1) There shall be constituted a Board to be called as the Foreign Service Board. (2) The Foreign Service Board shall consist of: (i) All Secretaries to the Government of India in the Ministry of External Affairs with Foreign Secretary as Chairman; (ii) The Secretary to the Government of India in the Ministry of Commerce; and (iii) The Joint Secretary in charge of Administration in the Ministry of External Affairs shall be Secretary to the Board. (3) Any three members of the Board shall constitute the quorum. 4. Functions of the Foreign Service Board.––The functions of the Foreign Service Board shall be to advise the Central Government on the following matters, namely:- (i) Postings and transfers, other than those of Heads of Missions. (ii) Grant of Diplomatic status to officers posted in Indian Missions and Posts abroad. 5. Constitution of the Service.––(1) There shall be constituted a cadre for the service. (2) The strength and composition of the cadre shall be determined by the Central Government from time to time. (3) The grades and authorised strength of the Service shall be as laid down in Schedule I to these rules; (4) The authority competent to make an appointment to a grade may make temporary or permanent additions to that grade, as it may deem necessary from time to time subject to any general or special order that may be issued. 6. Appointments to Cadre posts.––(1) All appointments to cadre posts in the Service shall be made by the Central Government in accordance with the provisions of these rules. (2) Posts of Heads of Mission, and of Heads of Post in countries where there are no Heads of Mission may be filled by the Central Government at its discretion by appointment of members of the Service or other persons. 7. Power to abolish posts or hold posts in abeyance.––(1) The Central Government may abolish or hold in abeyance any permanent or temporary Cadre Posts. (2) Any cadre post in a Grade may be declared by the Controlling Authority to be excluded from the cadre, if such a post is required, for the time being, to be filled by the appointment on deputation basis of persons possessing such special qualifications or experience as may be prescribed by the Controlling Authority, and on such a declaration being made, the post shall remain excluded from the cadre so long as the said declaration remains in force. 8. Appointment to Service.––All initial appointments to the Service shall be done in the following manner:- (1) by direct recruitment to a cadre post in Junior Scale on the basis of results of an open competitive examination held by the Commission in accordance with such regulations as the Central Government may from time to time make in consultation with the Commission. (2) by promotion based on selection to a cadre post in Senior Scale from amongst officers of Grade I of the Indian Foreign Service, Branch B who have completed not less than three years of continuous service in that grade and fulfill minimum educational qualifications prescribed for direct recruitment to the Service as prescribed by the Commission: Provided that the total number of officers appointed to the Service by promotion from Grade I of Indian Foreign Service, Branch B may not, at any time, exceed 22.5 per cent. of posts in the cadre at Senior Scale and above but excluding one-half of the posts of Heads of Missions and Posts. (3) The composition of the Departmental Promotion Committee for making appointments to Senior Scale of the Service in accordance with sub-rule (2) of rule 8 will be as laid down in Schedule II to these rules.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 11 9. Promotions.––(1) Promotion of officers to various grades of the Service shall be made on the basis of the recommendations of the Departmental Promotion Committee constituted in accordance with Schedule II to these rules from amongst members confirmed in the Service and holding posts in the next lower grade in such manner and fulfilling such eligibility conditions, additional criteria and benchmark as laid down in Schedule III to these rules. (2) Officers shall be considered batch-wise with all overlooked officers senior to the batch for promotion to Grade I, Grade II and Grade III of the Service. Officers empanelled for promotion could be promoted at any time during the relevant year, subject to availability of vacancies. (3) Where the Controlling Authority is of the opinion that it is necessary or expedient to do so, it may by order for reasons to be recorded in writing, relax the additional criteria on service in India and abroad for promotion to Grades I, Grade II and Grade III of the Service and completion of mandatory training for promotion as laid down in Schedule III to these rules and in the empanelment guidelines as amended from time to time. 10. Appointment by Deputation.––(1) The Government may at any time depute a member of the Service to a post equivalent to or higher than that held by him in the Service, in any other All India Services, Central Services Group A, or an International Organisation or a foreign employer. A member of the Service so deputed shall be held against a post in the deputation reserve: Provided that the period of deputation shall not exceed three years in the first instance although the Central Government may extend the same by further periods subject to the total period of deputation not being more than extant Government guidelines prescribed for such deputation. (2) The Government may, if it is satisfied that no suitable member of the Service is available to fill a particular cadre post, appoint thereto for a period not exceeding three years, an officer holding analogous post in Central Government Service or All India Service and possessing desirable qualification or experience as may be prescribed by the Controlling Authority. A person so appointed shall be held against a cadre post held in abeyance as provided in rule 7: Provided that if the Central Government is still satisfied that no suitable member of the Service is available at the end of the above period they may extend the appointment by one year at a time for total period of up to seven years. 11. Seniority.––(1) The relative seniority of members of the Service, appointed to any Grade, on commencement of these rules, shall be the relative seniority in their respective grades as determined before the date of commencement of these rules: Provided that if the seniority of any member of the Service has not been determined before the date of commencement of these rules, the same shall be determined by the controlling authority in accordance with the general orders or instructions on seniority issued by the controlling authority from time to time. (2) The year of allotment of an officer recruited to the Service on the results of an open competitive examination held by the Commission, shall be the year, following the year in which the said examination was held. (3) The inter-se seniority of officers recruited to the Service in accordance with sub-rule (1) of rule 8 shall be in accordance with the merit list compiled by the Ministry, based on the examination conducted by the Commission, and performance in foundation course and other mandatory training during probation as prescribed by the Government from time to time. (4) The year of allotment of officers promoted to the Service in accordance with sub-rule (2) of rule 8, shall be assigned as follows:- (i) One corresponding to three years prior to the year in which the officer is appointed against a substantive post in the Senior Scale of the Indian Foreign Service; (ii) A weightage of one year for every completed three years of service beyond the minimum three years of continuous service in Grade I of Indian Foreign Service, Branch B shall be given. For the purpose of calculation of weightage under this sub-rule, fractions if any shall be ignored: Provided that the year of allotment so assigned shall not be earlier than eight years preceding the year of actual promotion to Senior Scale of the Service:12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Provided further that an officer promoted from Grade I of Indian Foreign Service, Branch B shall not be assigned a year of allotment earlier than the year of allotment assigned to an officer senior to him in that Select List or appointed to the Service on the basis of an earlier Select List. (5) Between direct recruits appointed to the Service on the basis of competitive examinations conducted by the Commission in accordance with sub-rule (1) of rule 8 and officers promoted to the Senior Scale in the manner as laid down in sub-rule (2) and rule 8, inter-se seniority shall depend on the year of allotment assigned to them and where the year of allotment is the same, direct recruits shall be senior. 12. Probation and Confirmation.––(1) Every officer on appointment to the Service, either by direct recruitment to Junior Scale under sub-rule (1) of rule 8 or by promotion to Senior Scale under sub- Rule (2) of rule 8 shall be on probation for a period of two years: Provided that the Controlling Authority may extend the period of probation in accordance with the instructions issued by the Government from time to time. (2) On completion of the period of probation or any extension thereof, officers shall, if considered fit for permanent appointment, be retained in their appointments on regular basis and be confirmed in due course against the available substantive vacancies, as the case may be. (3) If, during the period of probation or any extension thereof, as the case may be, Government is of the opinion that an officer is not fit for permanent appointment, the Government may discharge or revert the officer to the post held by him prior to his appointment in the Service, as the case may be. (4) During the period of probation, or any extension thereof, candidates may be required by Government to undergo such course of training and pass such examinations, and tests as Government may deem fit, as a condition to satisfactory completion of probation. No officer appointed to the Service shall be eligible for confirmation in the Service unless he has to the satisfaction of the Central Government, passed the prescribed examination or test in the Compulsory Foreign Language allotted to him: Provided that as regards other matters relating to probation, the members of the Service will be governed by the instructions issued by the Government in this regard from time to time. 13. Disqualification.––(1) No person shall be appointed to the Service unless he is a citizen of India. (2) No person,–– (a) who has entered into or contracted a marriage with a person having his spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the Service: Provided that the Central Government, may if satisfied that such marriage is permissible under the personal law applicable to the person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this sub-rule. 14. Power to Relax.––Where the Government is of the opinion that it is necessary or expedient to do so, it may, by order, for reasons to be recorded in writing, and in consultation with the Commission, relax any of the provisions of these rules with respect to any class or category of persons. 15. Interpretation.––If any question arises relating to interpretation of these rules, it shall be decided by the Government. 16. Note 2: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or qualifying service, or for two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.
