L.-33004/99 vlk/kj.k EXTRAORDINARY Hkkx II—[k.M 3—mi&[k.M (i) PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la . 421] ubZ fnYyh] 'kqØokj] ebZ 26] 2017@ T;s"B 5] 1939 No. 421] NEW DELHI, FRIDAY, MAY 26, 2017/ JYAISTHA 5, 1939 इलक्े (cid:7069)ॉिनकी और सचू ना (cid:7079)ौ(cid:7378)ोिगकी म(cid:7074)ं ालय अिधसचू ना नई िदल्ली, 3 मई, 2017 सा.का.िन. 520(अ).—रा(cid:7398)पित, संिवधान के अनच्ु छेद 309 के परन्तुक (cid:7367)ारा (cid:7079)द(cid:7275) शि(cid:7334)य(cid:7298) का (cid:7079)योग करत ेहुए और संचार और सूचना (cid:7079)ौ(cid:7378)ोिगकी मं(cid:7074)ालय, सचू ना (cid:7079)ौ(cid:7378)ोिगकी िवभाग (समूह ‘क’ पद) भत(cid:7278) िनयम, 2009, को, जहाँ तक उसका संबंध संय(cid:7334)ु िनदशे क (िहन्दी) और ज्य(cid:7399)े िहन्दी अिधकारी के पद स े ह,ै और संचार और सूचना (cid:7079)ौ(cid:7378)ोिगकी मं(cid:7074)ालय, सचू ना (cid:7079)ौ(cid:7378)ोिगकी िवभाग (समूह ‘ख’ पद) भत(cid:7278) िनयम, 2009 को, जहा ँतक उसका सम्बन्ध िहन्दी अिधकारी, ज्ये(cid:7399) िहन्दी अनुवादक और किनष् ठ िहदं ी अनवु ादक के पद स ेह,ै को उन बात(cid:7298) के िसवाय अिध(cid:7059)ातं करते हुए िजन् ह (cid:7286)ऐसे अिध(cid:7059)मण से पूवर् िकया गया ह ै या करने का लोप िकया गया ह,ै इलक्े (cid:7069)ॉिनकी और सचू ना (cid:7079)ौ(cid:7378)ोिगकी मं(cid:7074)ालय म (cid:7286)समूह ‘क’ और समूह ‘ख’ पद(cid:7298) की भत(cid:7278) की प(cid:7373)ित का िविनयमन करने के िलए िन(cid:7388)िलिखत िनयम बनात (cid:7286)ह,(cid:7289) अथार्त्: 1. संिक्ष(cid:7385) नाम और (cid:7079)ारंभ. - (1) इन िनयम(cid:7298) का संिक्ष(cid:7385) नाम इलक्े (cid:7069)ॉिनकी और सचू ना (cid:7079)ौ(cid:7378)ोिगकी मं(cid:7074)ालय (राजभाषा काडर म(cid:7286) समहू ‘क’ और समूह ‘ख’ पद), भत(cid:7278) िनयम, 2017 है। (2) ये राजप(cid:7074) म(cid:7286) उनके (cid:7079)काशन की तारीख को (cid:7079)वृ(cid:7275) ह(cid:7298)गे । 2. पद-सख्ं या, वग(cid:7278)करण, और वते न मैि(cid:7069)क्स म (cid:7286) स्त र. - पद(cid:7298) की संख्या, उसका वग(cid:7278)करण और वेतन मैि(cid:7069)क् स म(cid:7286) स्त र वह होगा, जो इन िनयम(cid:7298) से उपाब(cid:7373) अनुसचू ी के स्तंभ (2) स े(4) म(cid:7286) िविन(cid:7416)द(cid:7397)र् ह।ै 3. भत(cid:7278) की प(cid:7373)ित, आयु-सीमा और अन्य अहतर् ाएं, आिद. - उ(cid:7334) पद पर भत(cid:7278) की प(cid:7373)ित, आयु-सीमा, अहतर् ाए ं और उसस े संबंिधत अन्य बात (cid:7286)व ेह(cid:7298)गी जो उपरो(cid:7334) अनुसचू ी के स्तंभ (5) से (13) म(cid:7286) िविन(cid:7416)द(cid:7397)र् ह।(cid:7289) 4. िनरहतर् ा. - वह (cid:7390)ि(cid:7334) - (क) िजसन ेऐसे (cid:7390)ि(cid:7334) से िजसका पित या िजसकी प(cid:7360)ी जीिवत ह,(cid:7289) िववाह िकया ह,ै या िववाह की सिंवदा की ह;ै या (ख) िजसन ेअपने पित या अपनी प(cid:7360)ी के जीिवत रहते हुए िकसी (cid:7390)ि(cid:7334) से िववाह िकया ह ैया िववाह की संिवदा की है, उ(cid:7334) पद(cid:7298) म(cid:7286) से िकसी पर िनयुि(cid:7334) का पा(cid:7074) नह(cid:7277) होगा: 3376 GI/2017 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] परन्त ुयिद के(cid:7076)ीय सरकार का यह समाधान हो जाता ह ैिक ऐसा िववाह ऐस े(cid:7390)ि(cid:7334) और िववाह के अन्य पक्षकार को लागू स्वीय िविध के अधीन अनुज्ञेय ह ैऔर ऐसा करन ेके िलए अन्य आधार ह (cid:7289)तो वह िकसी (cid:7390)ि(cid:7334) को इस िनयम के (cid:7079)वतर्न से छूट द ेसकेगी। 5. िशिथल करन ेकी शि(cid:7334). - जहां क(cid:7286)(cid:7076)ीय सरकार की यह राय ह (cid:7289)िक ऐसा करना आवश्यक या समीचीन ह,ै वहां वह उसके िलए जो कारण ह (cid:7289)उन्ह (cid:7286)लेखब(cid:7373) करके, इन िनयम(cid:7298) के िकसी उपबधं को िकसी वगर् या (cid:7079)वग र्के (cid:7390)ि(cid:7334)य(cid:7298) की बाबत, आदशे (cid:7367)ारा िशिथल कर सकेगी। 6. या िहन्दी और अं(cid:7061)ेजी म(cid:7286) अध्यापन या िहन्दी या अ(cid:7061)ं ेजी म,(cid:7286) अनुसधं ान का क(cid:7286)(cid:7076)ीय सरकार के अधीन या राज्य सरकार(cid:7298) या िव(cid:7393)िव(cid:7378)ालय(cid:7298) या मान्यता(cid:7079)ा(cid:7385) अनसु ंधान या शैक्षिणक संस्थान(cid:7298) या पिब्लक सेक्टर उप(cid:7059)म(cid:7298) या काननू ी या स्वशासी संगठन(cid:7298) म(cid:7286) दस वष र्का अनुभव। िटप्पण 1: अहतर् ाएं, अन्यथा सअु िहतर् अभ्यिथर्य(cid:7298) की दशा म(cid:7286) सक्षम (cid:7079)ािधकारी के िववेकानसु ार िशिथल की जा सकती ह।ै िटप्पण 2: अनभु व संबंधी अहतर् ा (अहतर् ाएं) सक्षम (cid:7079)ािधकारी के िववके ानुसार अनुसूिचत जाितय(cid:7298) और अनुसूिचत जनजाितय(cid:7298) के अभ्यिथर्य(cid:7298) की दशा म(cid:7286) तब िशिथल की जा सकती ह (cid:7289) जब चयन के िकसी (cid:7079)(cid:7059)म पर मं(cid:7074)ालय की यह राय ह ै िक उनके िलए आरिक्षत िरि(cid:7334)य(cid:7298) को भरने के िलए अपेिक्षत अनभु व रखन े वाल े उन समुदाय(cid:7298) के अभ्यिथर्य(cid:7298) के पयार्(cid:7385) सख्ं या म(cid:7286) उपलब्ध होने की सम्भावना नह(cid:7277) ह।ै वाछं नीय: िकसी मान्यता(cid:7079)ा(cid:7385) बोडर् से दसव(cid:7277) स्तर पर संिवधान की अनुसूची 8 म(cid:7286) सिम्मिलत भाषा(cid:7312) म(cid:7286) से िकसी एक भाषा का, िहन्दी से िभ(cid:7382), अध्ययन िकया हो। सीधे भत(cid:7278) िकए जान े वाले (cid:7390)ि(cid:7334)य(cid:7298) के िलए पिरवीक्षा की भत(cid:7278) की प(cid:7373)ित : भत(cid:7278) सीध े होगी या (cid:7079)ो(cid:7382)ित (cid:7367)ारा या िविहत आयु और शैिक्षक अहतार्एं (cid:7079)ो(cid:7382)त अविध, यिद कोई (cid:7079)ितिनयुि(cid:7334) या आमेलन (cid:7367)ारा तथा िविभ(cid:7382) प(cid:7373)ितय(cid:7298) (cid:7367)ारा भरी (cid:7390)ि(cid:7334)य(cid:7298) की दशा म(cid:7286) लाग ूह(cid:7298)गी जान ेवाली िरि(cid:7334)य(cid:7298) की (cid:7079)ितशतता हो (8) (9) (10) नह(cid:7277) सीधी भत(cid:7278) के िलए (cid:7079)ो(cid:7382)ित (cid:7367)ारा, िजसके न हो सकने पर (cid:7079)ितिनयुि(cid:7334) (cid:7367)ारा, दोन(cid:7298) के एक वषर्। न हो सकन ेपर सीधी भत(cid:7278) (cid:7367)ारा। (cid:7079)ो(cid:7382)ित या (cid:7079)ितिनयुि(cid:7334) या आमेलन (cid:7367)ारा या भत(cid:7278) की दशा म(cid:7286) वे (cid:7088)ेिणयांिजनस े(cid:7079)ो(cid:7382)ित या (cid:7079)ितिनयुि(cid:7334) या आमले न िकया जाएगा। (11) (cid:7079)ितिनयिु(cid:7334): क(cid:7286)(cid:7076)ीय सरकार या राज्य सरकार(cid:7298) या संघ राज्य क्षे(cid:7074)(cid:7298) या पिब्लक सक्े टर के अधीन ऐसे अिधकारी— (क) (i) िजन्ह(cid:7298)न ेमूल काडर या िवभाग म(cid:7286) िनयिमत आधार पर सदशृ पद धारण िकया हुआ ह;ै या (ii) िजन्ह(cid:7298)ने वेतन मैि(cid:7069)क्स के स्तर-11 म(cid:7286) (67700-208700) म(cid:7286) अनुमोिदत या िनयिमत आधार पर उस (cid:7088)ेणी म(cid:7286) पाचं वष र्सेवा की हो; और (ख) स्तंभ (7) के अधीन सीधी भत(cid:7278) के िलए िविहत िकए गए अनुभव और शैिक्षक अहतर् ाएं रखता हो। िटप्पण 1: पदावास अविध के रूप म(cid:7286) भत(cid:7278) वष र् के पहले िदन को उस (cid:7088)ेणी म(cid:7286) की गई अनुमोिदत सेवा (cid:7079)ो(cid:7382)ित के िलए िगनी जाएगी। सीधी भत(cid:7278) के िलए “अनुमोिदत सवे ा” की पिरभाषा और भत(cid:7278) की ज्य(cid:7399)े ता (cid:7079)ो(cid:7382)ित की प(cid:7373)ितया ंिन(cid:7388)ानसु ार ह(cid:7298)गी:- (i) उस (cid:7088)णे ी म(cid:7286) सीध ेभत(cid:7278) िकए गए अिधकारी की बाबत, उस (cid:7088)ेणी म (cid:7286)की गई िनयिमत सवे ा की अविध या अविधयां, िजनके अन्तगर्त4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अनपु िस्थित की वह अविध या अविधयां भी ह (cid:7289) िजसके या िजनके दौरान उसने िनयिमत आधार पर पद धारण िकया हुआ होता, यिद वह उस वष,र् िजसम(cid:7286) सीधी भत(cid:7278) के िलए परीक्षा आयोिजत की गई थी, के बाद वाले भत(cid:7278) वषर् के पहले िदन स ेऐसा पद धारण करन ेके िलए छु(cid:7349)ी पर नह(cid:7277) रहा होता या अन्यथा उपलब्ध नह(cid:7277) रहा होता। (ii) िन(cid:7388)तर (cid:7088)णे ी म(cid:7286) सेवा की अविध के आधार पर उस (cid:7088)णे ी म(cid:7286) भत(cid:7278) िकए गए अिधकारी के बाबत, उस (cid:7088)ेणी म(cid:7286) की गई िनयिमत सेवा की अविध या अविधयां, िजनके अन्तगतर् अनपु िस्थित की वह अविध या अविधयां भी ह (cid:7289) िजसके या िजनके दौरान उस भत(cid:7278) वषर्, िजसके िलए भत(cid:7278) की गई थी, के पहल े िदन स े उस (cid:7088)ेणी म (cid:7286) उसन े िनयिमत आधार पर पद धारण िकया हुआ होता, यिद वह ऐसा पद धारण करन ेके िलए छु(cid:7349)ी पर नह(cid:7277) रहा होता या अन्यथा उपलब्ध नह(cid:7277) रहा होता। परंत ु जहा ं उपरो(cid:7334) उपखंड (i) और उपखडं (ii) म(cid:7286) उिल्लिखत मामल(cid:7298) म (cid:7286) स े िकसी मामल े म (cid:7286) िनयुि(cid:7334) पर पद(cid:7061)हण करने म (cid:7286) 90 िदन स े अिधक का िवलबं हुआ ह ैवहां ऐसा िवलंब अिधकारी की ओर स ेिकसी चकू के कारण नह(cid:7277) होना चािहए। िटप्पण 2: पोषक (cid:7079)वग र्के ऐस ेिवभागीय अिधकारी, जो (cid:7079)ो(cid:7382)ित की सीधी पंि(cid:7334) म(cid:7286) ह,ै (cid:7079)ितिनयुि(cid:7334) पर िनयुि(cid:7334) के िलए िवचार िकए जाने के पा(cid:7074) नह(cid:7277) ह(cid:7298)ग े। इसी (cid:7079)कार, (cid:7079)ितिनयु(cid:7334) (cid:7390)ि(cid:7334) (cid:7079)ो(cid:7382)ित (cid:7367)ारा िनयुि(cid:7334) के िलए िवचार िकए जान ेके पा(cid:7074) नह(cid:7277) ह(cid:7298)गे। िटप्पण 3: (cid:7079)ितिनयुि(cid:7334) की अविध, िजसके अन्तगर्त के(cid:7076)ीय सरकार के उसी या िकसी अन्य संगठन या िवभाग म(cid:7286) इस िनयुि(cid:7334) से ठीक पहल ेधािरत िकसी अन्य काडर बा(cid:7405) पद पर (cid:7079)ितिनयुि(cid:7334) की अविध ह,ै साधारणतया चार वष र्स ेअिधक नह(cid:7277) होगी। िटप्पण 4: (cid:7079)ितिनयुि(cid:7334) पर िनयुि(cid:7334) के िलए अिधकतम आयु-सीमा आवेदन (cid:7079)ा(cid:7385) करने की अंितम तारीख को ‘56 वष र् स े अिधक नह(cid:7277) होगी।’ यिद िवभागीय (cid:7079)ो(cid:7382)ित सिमित ह ैतो उसकीसंरचना। भत(cid:7278) करने म(cid:7286) िकन पिरिस्थितय(cid:7298) म(cid:7286) संघ लोक सेवा आयोग से परामशर् िकया जाएगा (12) (13) समहू 'क' िवभागीय (cid:7079)ो(cid:7382)ित सिमित, ((cid:7079)ो(cid:7382)ित और पिु(cid:7397) पर िवचार करन े के लागू नह(cid:7277) होता। िलए) िजसम (cid:7286)िनम्न िलिखत ह(cid:7298)ग:े- (1) कािमर्क (cid:7079)मखु , इलेक्(cid:7069)ॉिनकी और सचू ना - अध्यक्ष; Disqualification.—No person, - (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts: Provided that the Central Government may, if satisfied that such marriage is permissible under personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 6.
