या (iii) जजन्होंने मूल काडर या जिभाग में िेतन मैट्ररक्स के स्ट्तर -13 (1,23,100-2,15,900 रु.) या समतुल्य में जनयजमत आधार पर जनयुजि के पश्चात् उस श्रेणी में तीन िषा सेिा की हो; और (ख) जजनके पास जनम्नजलजखत िैजिक अहता ाएं हों :- आिश्यक :– (अ) (i) दकसी मान्यताप्राप्त जिश्वजिद्यालय या संस्ट्था से जिजध में मास्ट्टर जडग्री (एल.एल.एम); और (ii) जजनके पास जनम्नजलजखत अनुभि हो : (I) राज्य न्याजयक सेिा का तेरह िषा की अिजध तक सदस्ट्य रहा हो; या (II) केंद्रीय या राज्य या संघ राज्यिेत्र के ऐसे सेिक अथिा पजललक सेक्टर उपक्म या कानूनी जनकाय या स्ट्ििासी जनकाय के ऐसे कायापालक या अजधकारी जजनके पास जिजधक काया का तेरह िषा का अनुभि हो; या (III) ऐसे अर्हहत जिजध व्यिसायी जजन्होंने तेरह िषा तक उस रुप में व्यिसाय दकया हो; या (IV) दकसी मान्यताप्राप्त संस्ट्था में तेरह िषा तक जिजध का अध्यापक रहा हो; या (V) केंद्रीय सरकार या राज्य सरकार या संघ राज्यिेत्र में कानूनों, कानूनी जनयमों और आदिे ों का हहदी में अनुिाद का तेरह िषा का अनुभि हो; या (VI) केंद्रीय सरकार या राज्य सरकार या संघ राज्यिेत्र में कानूनों के प्रारुपण का तेरह िषा का अनुभि हो; और (iii) दकसी मान्यताप्राप्त बोडा या जिश्वजिद्यालय या संस्ट्था से माध्यजमक जिद्यालय परीिा या कोई उच्चतर परीिा हहदी माध्यम से उत्तीणा की हो अथिा दकसी मान्यताप्राप्त बोडा या जिश्वजिद्यालय या दकसी संस्ट्थ ा से या केंद्रीय सरकार द्वारा अनुमोददत जिदिे ी जिश्वजिद्यालय से माध्यजमक जिद्यालय परीिा या दकसी उच्चतर परीिा में हहदी एक जिषय के रुप में रहा हो; या (आ) (i) दकसी मान्यताप्राप्त जिश्वजिद्यालय या संस्ट्था से जिजध में बैचलर जडग्री (एल.एल.बी.) ; और (ii) जजनके पास जनम्नजलजखत अनुभि हो :- (I) राज्य न्याजयक सेिा का पंद्रह िषा की अिजध तक सदस्ट्य रहा हो; या (II) केंद्रीय या राज्य या संघ राज्यिेत्र के ऐसे सरकारी सेिक अथिा पजललक सेक्टर उपक्म या कानूनी जनकाय या स्ट्ििासी जनकाय के ऐसे कायापालक या अजधकारी जजनके पास जिजधक काया का पंद्रह िषा का अनुभि हो; या (III) ऐसे अर्हहत जिजध व्यिसायी जजन्होंने पंद्रह िषा तक उस रुप में व्यिसाय दकया हो; या (VI) केंद्रीय सरकार या राज्य सरकार या संघ राज्यिेत्र में कानूनों के प्रारुपण का पंद्रह िषा का अनुभि हो; और (iii) दकसी मान्यताप्राप्त बोडा या जिश्वजिद्यालय या संस्ट्था से माध्यजमक जिद्यालय परीिा या कोई उच्चतर परीिा हहदी माध्यम से उत्तीणा की हो अथिा दकसी मान्यताप्राप्त बोडा या जिश्वजिद्यालय या दकसी संस्ट्थ ा से या केंद्रीय सरकार द्वारा अनुमोददत जिदिे ी जिश्वजिद्यालय से माध्यजमक जिद्यालय परीिा या दकसी उच्चतर परीिा में हहदी एक जिषय के रुप में रहा हो । ट्रटप्पण 1: आिश्यक अहता ाओं में प्रयुि अर्हहत जिजध व्यिसायी पद से ऐसा व्यजि अजभप्रेत ह ै जो एक अजधििा या एक अजभििा हो और जिजध में मास्ट्टर जडग्री(एल.एल.एम.) धारक की दिा में तेरह िषा तक या जिजध में बैचलर जडग्री (एल.एल.बी.) धारक की दिा में पंद्रह िषा तक उसी हजै सयत में व्यिसाय दकया हो । ट्रटप्पण 2: जिजधक काया में अनुभि पद से सरकार या पजललक सेक्टर उपक्म या कानूनी जनकाय या स्ट्ििासी जनकाय के अधीन अजधष्ठायी जिजधक पदधारी अजभप्रेत ह ै जजसके जलए एल.एल.बी. की जडग्री भती के जलए एक पूिा अपेजित या आिश्यक अहता ा हो । िांछनीय : (i) केंद्रीय सरकार या राज्य सरकार या संघ राज्यिेत्र में हहदी में जिधायी प्रारुपण का पांच िषा का अनुभि । (ii) दकसी मान्यताप्राप्त जिश्वजिद्यालय से बैचलर जडग्री जजसमें जडग्री स्ट्तर पर हहदी एक जिषय के रुप में रहा हो या माध्यम रहा हो । ट्रटप्पण 1- प्रजतजनयुजि की अिजध, जजसके अंतगात केन्द्रीय सरकार के उसी या दकसी अन्य संगठन / जिभाग में इस जनयुजि से ठीक पहले धाट्ररत दकसी अन्य काडर बाह्य पद पर प्रजतजनयुजि की अिजध ह ै साधारणतया तीन िषा से अजधक नहीं होगी । ट्रटप्पण 2 - प्रजतजनयुजि द्वारा जनयुजि के जलए अजधकतम आयु सीमा आिेदन प्राप्त करने की अंजतम तारीख को छप्पन िषा से अजधक नहीं होगी । ट्रटप्पण 3 - जहां ऐसे कजनष्ठ व्यजततयों के संबंध में, जजन्होंने अपनी अहका / पात्रता सेिा पूरी कर ली ह,ै प्रोन्नजत के जलए जिचार दकया जा रहा हो, िहां उनसे ज्येष्ठ व्यजक् तयों के संबंध में भी जिचार दकया जाएगा परंतु यह तब जब दक उनके द्वारा की गई ऐसी अहका /पात्रता सेिा, अपेजित अहका / पात्रता सेिा के आधे से अजधक से या दो िषा से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कजनष्ठ व्यजक् तयों सजहत जजन्होंने ऐसी अहका /पात्रता सेिा पहले ही पूरी कर ली है अगली उच्चतर श्रेणी में प्रोन्नजत के जलए अपनी पट्ररिीिा की अिजध सफलतापूिाक पूरी कर ली हो । ट्रटप्पण 4 - पोषक प्रिगा के ऐसे जिभागीय अजधकारी, जो प्रोन्नजत की सीधी पंजि में ह,ै प्रजतजनयुजि पर जनयुजि के जलए जिचार दकए जाने के पात्र नहीं होंगे । इसी प्रकार प्रजतजनयुि व्यजि प्रोन्नजत द्वारा जनयुजि के जलए जिचार दकए जाने के पात्र नहीं होंगे । यदद जिभागीय प्रोन्नजत सजमजत ह,ै तो उसकी संरचना भती करन े म ें दकन पट्ररजस्ट्थजतयों म ेंसंघ लोक सेिा आयोग से परामि ा दकया जाएगा (12) (13) प्रोन्नजत के संबंध में जिचार करने के जलए समूह ‘क’ जिभागीय प्रजतजनयुजि के आधार पर पद को भरते समय संघ लोक सेिा आयोग से परामिा करना आिश्यक ह ै। प्रोन्नजत सजमजत, जजसमें जनम्नजलजखत होंगे :-[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 1. अध्यि या सदस्ट्य, संघ लोक सेिा आयोग -- अध्यि 2. सजचि, जिधायी जिभाग, जिजध और न्याय मंत्रालय -- सदस्ट्य 3. अपर सजचि, जिधायी जिभाग, जिजध और न्याय मंत्रालय -- सदस्ट्य 4. अपर सजचि, जिधायी जिभाग, जिजध और न्याय मंत्रालय -- सदस्ट्य [फा. सं. ए-12018/1/2021-प्रिा.] अनूप कुमार िार्ष्णेय, संयुि सजचि और जिधायी परामिी MINISTRY OF LAW AND JUSTICE (Legislative Department) NOTIFICATION New Delhi, the 24th August, 2021 G.S.R. 586(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Law and Justice, Legislative Department, Official Languages Wing (Group ‘A’ Posts Hindi Branch) Recruitment Rules, 2013, in so far it relates to the post of Joint Secretary and Legislative Counsel, except as respects things done or omitted to be done before such supsession, the President hereby makes the following rules regulating the method of recruitment to the post of Joint Secretary and Legislative Counsel in the Official Languages Wing, Legislative Department, Ministry of Law and Justice, namely:- 1. Short title and commencement.- (1) These rules may be called the Ministry of Law and Justice, Legislative Department, Official Languages Wing, Joint Secretary and Legislative Counsel (Group ‘A’ Post), Recruitment Rules, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of post, classification and level in pay matrix.– The number of post, its classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules. 3. Method of recruitment, age limit, qualifications, etc.- The method of recruitment to the said posts, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule. 4. Disqualification.- No person,- (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons. 6. Or (B) (i) Bachelors Degree in Law (LLB) from a recognised University / Institution; and (ii) possessing the following: (I) a member of State Judicial Service for a period of fifteen years; or (II) a Central or State or UT Government Servant / an executive / officer in a Public Sector Undertaking / Statutory Body / Autonomous Body who has had experience in legal affairs for fifteen years; or (III) a qualified legal practitioner who has practised as such for fifteen years; or (IV) a teacher of Law for fifteen years in a recognized institution; or (V) fifteen years experience of translation into Hindi of statutes, statutory rules and orders in Central Government or the State Government or Union territory; and (VI) Fifteen years experience of drafting of statutes in the Central Government or the State Government or Union territory; and (iii) passed Secondary School Examination or any8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] higher examination from a recognised Board or University or institution through Hindi medium or had offered Hindi as a subject in Secondary School Examination or any higher examination from a recognized Board or University or any institution or foreign university approved by the Central Government. Note 1: The expression Qualified Legal Practitioner used in the essential qualifications means a person who is an advocate or a pleader and has practised as such for thirteen years in case of holder of Masters Degree in Law (LLM) or 15 years in case of holder of Bachelors Degree in Law (LLB). Note 2: The term experience in legal affairs means holding of a substantive legal post under the Government or Public Sector Undertaking or Statutory Body or Autonomous Body for which LLB degree is a prerequisite or essential qualification for recruitment. Desirable: (i) Five years experience of legislative drafting in Hindi in Central Government or State Government or Union territory. (ii) Bachelors degree from a recognised university with Hindi as a subject or medium at degree level. Note 1: The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization/department of the Central Government shall ordinarily not exceed three years. Note 2: The Maximum age limit for appointment by deputation shall be Not exceeding 56 years as on the last date of receipt of applications. Note 3: Where juniors who have completed their qualifying/eligibility service are being considered for promotion, their senior would also be considered provided they are not short of the requisite qualifying / eligibility service by more than half of such qualifying /eligibility service or 2 years, whichever is less and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying/eligibility service. Note 4: The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation.
