1992 (1992 का 15) की धारा 30 के तहत प्रदत्त िजियों का प्रयोग करत े हुए एतद्द्वारा भारतीय प्रजतभूजत और
जिजिमय बोडड (प्रजतभूजत बािार स े संबंजधत कपटपूण ड और अऋि ु व्यापाररक व्यिहारों का प्रजतषेध) जिजियम, 2003
का संिोधि करि े के जलए जिम्नजलजखत जिजियम बिाता ह,ै अर्ाडत:् -
1. इि जिजियमों को भारतीय प्रजतभूजत और जिजिमय बोडड (प्रजतभूजत बािार स े संबंजधत कपटपूण ड और अऋि ु
व्यापाररक व्यिहारों का प्रजतषेध) (संिोधि) जिजियम, 2020 कहा िा सकेगा ।
2. िे रािपत्र म ें उिके प्रकािि की तारीख को प्रिृत्त (लाग)ू होंगे ।
3. भारतीय प्रजतभूजत और जिजिमय बोडड (प्रजतभूजत बािार स े संबंजधत कपटपूण ड और अऋि ु व्यापाररक व्यिहारों
का प्रजतषेध) जिजियम, 2003 म,ें -

I. जिजियम 2 में, उप-जिजियम (1) म,ें खंड (घ) जिम्नजलजखत खंड स े प्रजतस्ट्र्ाजपत हो िाएगा, अर्ाडत्,-
“(घ) “अन्िेषक प्राजधकारी” (इन्िेजस्ट्टगेटटंग अर्ॉररटी) स े ऐसा कोई व्यजि अजभप्रेत ह,ै जिसे
अजधजियम की धारा 11ग (11सी) के तहत अन्िेषण (इन्िेजस्ट्टगेिि) करि े के जलए बोडड द्वारा
प्राजधकृत दकया गया हो;”
II. जिजियम 5 जिम्नजलजखत जिजियम से प्रजतस्ट्र्ाजपत हो िाएगा, अर्ाडत,् -
“अन्िषे ण (इन्िजे स्ट्टगिे ि) करि ेका आदेि देि ेकी बोडड की िजि
5. िहााँ बोडड, अध्यक्ष, सदस्ट्य या कायडपालक जिदेिक (जििका उल्लेख यहााँ आग े “जियुजि
प्राजधकारी” के रूप म ें दकया गया ह)ै के पास यह जिश्वास करिे का तकडसंगत आधार हो
दक –
(क) प्रजतभूजतयों (जसक्यूररटीज़) म ें लेिदिे (संव्यिहार / रांिेक्िि) इस तरह स े दकए
िा रह े ह ैं दक िे जििेिकों या प्रजतभूजत बािार (जसक्यूररटीज़ माकेट) के जलए
हाजिकारक ह ैंऔर उिस ेइि जिजियमों का उल्लंघि हुआ ह;ै
(ख) दकसी मध्यिती (इंटरमीजडयरी) ि े या प्रजतभूजत बािार (जसक्यूररटीज़ माकेट) स े
िुड े दकसी व्यजि ि े अजधजियम या जियमों या जिजियमों के दकसी प्रािधाि का
उल्लघं ि दकया ह,ै
तो िह, दकसी भी समय जलजखत आदेि द्वारा, आदेि म ें उजल्लजखत दकसी व्यजि
(जिसका उल्लेख यहााँ आग े “अन्िेषक प्राजधकारी” के रूप में दकया गया ह)ै को
ऐस े मध्यिती (इंटरमीजडयरी) या प्रजतभूजत बािार (जसक्यूररटीज़ माकेट) से िुडे
व्यजियों या दकसी अन्य व्यजि के कामकाि का अन्िेषण (इन्िेजस्ट्टगेिि) करि े
का और उस पर बोडड को ररपोट ड देिे का जिदेि दे सकेगा, उसी प्रकार िैसा
अजधजियम की धारा 11ग (11सी) म ेंउल्लेख दकया गया ह ै।”

(PROHIBITION OF FRAUDULENT AND UNFAIR TRADE PRACTICES RELATING TO
SECURITIES MARKET) (AMENDMENT) REGULATIONS, 2020
No. SEBI/LAD-NRO/GN/2020/08.—In exercise of the powers conferred under Section 30 of the
Securities and Exchange Board of India Act, 1992 (15 of 1992), the Board hereby makes the following
regulations to amend the Securities and Exchange Board of India (Prohibition of Fraudulent and Unfair Trade
Practices relating to Securities Market) Regulations, 2003, namely: –
1. These regulations may be called the Securities and Exchange Board of India (Prohibition of Fraudulent and
Unfair Trade Practices relating to Securities Market) (Amendment) Regulations, 2020.
2. They shall come into force on the date of their publication in the Official Gazette.
3. In the Securities and Exchange Board of India (Prohibition of Fraudulent and Unfair Trade Practices
relating to Securities Market) Regulations, 2003, –
I. In regulation 2, in sub-regulation (1), in clause (d), the words “officer of the Board not below
the rank of Division Chief,” shall be substituted by the word “person”.
II. In regulation 5, the words “officer not below the rank of Division Chief” shall be substituted
by the word “person”.
