Delhi, the 10th February, 2020
No. F. 7(87)/AD/LB/2016/CD.000389764/314-323.—In exercise of the powers conferred under sub-
section (1) of section 349A of the Delhi Municipal Corporation Act, 1957, and in continuation of the Action
Plan adopted vide Notification No.F.7(87)/AD/LB/2016/CD.000389764/3355-64 dated 24.4.2019, the
Government of National Capital Territory of Delhi adopts and makes following Action Plan to be applicable to
the areas under jurisdiction of concerned local bodies i.e. South Delhi Municipal Corporation, North Delhi
Municipal Corporation, East Delhi Municipal Corporation.
ACTION PLAN FOR MAKING BUILDINGS IN DELHI SEISMICALLY COMPLIANT
In the earlier Action Plan, notified on 24th April 2019, for making buildings in Delhi seismically
compliant, different aspects were taken into account with the following headings, however, the details under
different headings is not being repeated here for the sake brevity and can be considered as per the last action
plan:-

Keeping in view of the earlier Action Plan and discussions held in the meetings, the following
additions are done for re-action plan:-
1. Keeping in view the large number of properties to be evaluated, more number of Structural Engineers
can be empanelled. In this regard, public notice may be given asking the Structural Engineers of this field to get
themselves empanelled. The empanelment of Structural Engineers should also be done by other Agencies like
Central Public Works Department / Delhi Development Authority / Cantonment Board / New Delhi Municipal
Council, Urban Development Department, Government of National Capital Territory Delhi etc. for this purpose.
a) The empanelled Structural Engineers can be approached by the citizens and the residents for securing
certificates and for queries, w.r.t. the structural safety of the units and other related details. The list of the
empanelled Structural Engineers with their names, mobile numbers etc. will be published in the major
newspapers and will also be placed on the website of all MCDs and other related Departments so that they are
accessible to the general public and residents.
b) In addition to this, the list of the responsible officers in the Disaster Management Authority, who can
also be approached for their by the citizens for securing certificates and for queries, w.r.t. the structural safety
of their units and other related details, shall be placed on the website of related departments.
c) In addition to this, the name and contact numbers of the responsible officials at Zonal level from the
Building Department as well the Maintenance Department shall be placed on the website who can be
approached by the citizens for securing certificates and for queries, w.r.t. the structural safety of the units and
other related details.
d) Similarly, the names and the contact numbers of the responsible officers from the Central Public Works
Department, Cantonment Board, New Delhi Municipal Council, Delhi Development Authority and other related
Departments shall be placed on the website who can be approached by the citizens and the residents for securing
certificates and for queries, w.r.t. the structural safety of the units and other related details.
e) (i). Delhi falling in Seismic Zone-IV but there is a variation in the vulnerability in different areas.
Some areas are more vulnerable or dangerous. It can also be said that some Zones are in High Risk Zones and
others are in Moderate or Low Risk Zones. The National Institute of Disaster Management has done a lot of
work on this aspect and based on their study, the Action Plan for evaluation of the properties and subsequent
retrofication can be made. As per this study, the Zones / Areas which are of High Risk Zones should be
evaluated immediately and within a short time span and on the second and third phase, the other Zones can be
taken.
ii). There are many high rise buildings also having height more than 15 meters. The evaluation of the buildings
shall be done phasewise wherein the High Rise Buildings shall be evaluated and subsequently the retrofication
can be made in first phase and in a short span and subsequently thereafter the other buildings can be taken in
subsequent phases.
iii).The buildings can also be classified on the basis of the year of construction i.e. very old, old and new and
their evaluation can be done phase-wise respectively.
iv). That “As per Clause 2.1.3 of UBBL-16 (modified), the owner/applicant, at the time of submitting
application for building permit, has to submit in Performa-1 of Common Application Form (CAF), a certificate
of Structural Safety from a designated Structural Engineer that he has/shall follow Structural Safety
requirements in accordance to National Building Code 2016 Part-IV. The Structural Engineer is required to
certify that the structural design shall be based on National Building Code, including safety from natural
hazards, based on soil conditions will be taken into consideration and would be duly incorporated in structural
drawings of the buildings to be constructed.6 DELHI GAZETTE : EXTRAORDINARY PART IV]
The above provisions of the UBBL-2016 have been incorporated to ensure structural safety including safety
from natural hazards like seismic safety as per National Building Code in new/upcoming buildings”.
Note : This provision in the UBBL-2016 as well as MPD-2021 ensures that the new buildings which are being
constructed after getting the building plans sanctioned shall be following the above mentioned norms with
respect to the structural stability of the buildings and as such these buildings are less vulnerable as compared to
the buildings which are being constructed or have been constructed without getting the building plans
sanctioned.
v). That evaluation of all such types of buildings shall be comprehensively started immediately after the
approval of the Action Plan, phase-wise. The clear timeline for the assessment of these buildings can also be
fixed by considering the facts like quantum of work, ground realities, number of technical persons available and
field situations.
f) That the onus should lie on the owner / occupier of the existing building(s) to get their building(s)
evaluated within stipulated time frame, from empanelled structural engineer and subsequently carry out the up-
gradation / strengthening / retro-fitting, if required as per the evaluation of the said building.
g) That practical problem in evaluation would arise due to the multiple owners (floor-wise / area-wise) in
different buildings and for this the necessary provisions in the Building Bye Laws / DMC Act can be done for
enforcing the required provisions.
h) That in unauthorised colonies, the buildings have been constructed without getting the building plans
sanctioned in an unplanned manner, without any Technical involvement or help and without following any
Structural Designs. There should be a comprehensive and uniform policy for enforcing the Law in unauthorised
colonies also.
i) That for implementation of the Action Plan and awareness amongst the general public for safety and
protection, wide publicity be given by the Government and different agencies by way of various means viz
website, print media, radio and social media etc.
j) That for facilitating such a huge reform and data, easy online software is to be developed by the
Information Technology Department of Government / different agencies so that a common man / individual can
have the comprehensive and complete information, guidelines and measures required to be taken by them step
by step, precautions, contact numbers and information about the concerned technical persons as well as officials
etc.
k) That there is a provision in the Building Bye Laws (UBBL-2016) Clause 9.2 which states that
regarding Seismic Strengthening / Retrofitting, it is necessary that evaluation of the existing structure in regard
to structural vulnerability in the specified wind / seismic hazard zone shall be carried out by a Structural
Engineer. If as per the evaluation of the Structural Engineer, the seismic resistance is assessed to be less than the
specified minimum seismic resistance as per norms, action will be initiated to carry out the upgrading of the
seismic resistance of the building as per applicable standard guidelines. If the owners/occupiers do not get their
properties evaluated as per the requirement and do not make the necessary compliances if required as per the
recommendation of Structural Engineers, the suitable action should be taken against owners of such properties
as per law. The Delhi Jal Board, the concerned electricity department and sub-registrar of Government of
National Capital Territory of Delhi can also be linked for taking necessary action against such properties.
l) That as per Section 348 / 349 of the DMC Act-1957, if any building is in ruinous conditions, or likely
to fall or in any way dangerous to any person occupying etc. in such cases, the Commissioner by order in
writing, require the owner / occupier of such building to demolish, secure or repair such building or do one more
or such things within a specified period and if any person fails to do so, the building can be vacated or
demolished by the Department.
m) That if as per the evaluation of the Structural Engineer, the seismic resistance is assessed to be less than
the specified minimum seismic resistance as per norms and strengthening has been suggested by the Structural
Engineer as per requirement of the National Building Code-2005 under Seismic Zone-IV, in such cases, there
may not be an EMINENT danger to the building, however, the building will be unsafe in the event of an
earthquake of the intensity specified in Seismic Zone-IV. So, for such events, there should be an amendment
and suitable provisions be made in the DMC Act / MPD-2021 / UBBL-2016 or in some other way, to enforce
the Law.
n) That there should be some uniformity in fee structure to be charged by the empanelled structural
engineers so that no harassment is done to the general public.PART IV] DELHI GAZETTE : EXTRAORDINARY 7
o) That the time limit shall be fixed for each category of the building with regard to the evolution as well
as further retrofittings / strengthening of the building as per recommendation of the Structural Engineer.
p) That in case of non-compliance of the provisions, a criminal liability should be fixed to the owner /
occupier.
q) That for verification and other purposes, Urban Local Bodies and other Departments have to bear
heavy cost so in order to achieve that some uniform charges can be levied at the time of sanction of building
plan or along with property tax, similar to the analogy as the CESS charges are being taken.
This issues with the approval of Hon’ble Minister (Urban Development), Government of the National
Capital Territory of Delhi.
