पर भत(cid:7278) की िविध के िविनयमन हते ु िन(cid:7388)िलिखत िनयम सहषर् बनाती ह,(cid:7289) -:
1. सिं क्ष(cid:7385) शीषकर् यह िनयम ‘‘िदल्ल ी उच् च न् यायालय िवभागीय क(cid:7289)टीन कमर्चारी (िनयुि(cid:7334) एव ं सेवा
शत(cid:7288)), िनयम 2017’’ कहलाय(cid:7286)ग े।
2. (cid:7079)ारंभ एव ं(cid:7079)योज्यता (i) ये िनयम शासकीय राजप(cid:7074) म(cid:7286) इनके (cid:7079)काशन की ितिथ से लागू ह(cid:7298)ग े|
(ii) ये िनयम िदल्ली उ(cid:7340) न्यायालय िवभागीय क(cid:7289)टीन सेवा के सभी कमर्चािरय(cid:7298) पर
लागू ह(cid:7298)गे ।
3. पिरभाषा इन िनयम(cid:7298) म(cid:7286),जब तक िक िवषय अथवा सन्दभर् म(cid:7286) कुछ भी (cid:7079)ितकूल न हो:
क. ‘‘मुख्य न्यायाधीश’’ स े तात्प यर् िदल् ली उच् च न् यायालय के मख्ु य न्यायाधीश से
ह;ै
ख. ‘‘उ(cid:7340) न्यायालय से तात्पयर् िदल्ली उ(cid:7340) न्यायालय ”से ह;ै
ग. से तात्पयर् इन िनयम(cid:7298) ”िनधार्िरत“(cid:7367)ारा िनधार्िरत से ह;ै
घ. ‘‘मान्यता (cid:7079)ा(cid:7385) बोडर्/ िव(cid:7393)िव(cid:7378)ालय से तात्पयर् भारत म (cid:7286)िविध (cid:7367)ारा ”िनगिमत
िकसी भी बोडर्/ िव(cid:7393)िव(cid:7378)ालय या िकसी अन्य बोडर्/ िव(cid:7393)िव(cid:7378)ालय/
संस्थान से ह ै िजसे इन िनयम(cid:7298) के (cid:7079)योजन हते ु मुख्य न्यायाधीश (cid:7367)ारा
मान्यता (cid:7079)ा(cid:7385) बोडर्/ िव(cid:7393)िव(cid:7378)ालय घोिषत िकया गया ह ै|

4. कमचर् ारी सख्ं या िदल्ली उ(cid:7340) न्यायालय िवभागीय क(cid:7289)टीन के कमचर् ािरय(cid:7298) की सख्ं या इन िनयम(cid:7298) की
अनुसूची-I म(cid:7286) दशार्ये गए पद(cid:7298) के अनुसार होगी, जो िक समय-समय पर मख्ु य
न्यायाधीश (cid:7367)ारा संशोिधत की जा सकती ह ै।
5. िनयिु (cid:7334) हते ुशत (cid:7288)एव ंयोग्यता िदल्ली उ(cid:7340) न्यायालय िवभागीय क(cid:7289)टीन म(cid:7286) िनयुि(cid:7334) हते ु वह (cid:7390)ि(cid:7334) योग्य ह ैजो िक:
(क) भारत का नागिरक हो;
(ख) नेपाल का व् यि(cid:7334) हो;
(ग) भूटान का व् यि(cid:7334) हो;
(घ) िचिकत् सीय रूप से स् वस् थ हो;
(ङ) अच् छे चिर(cid:7074) का हो;
(च) मान्यता (cid:7079)ा(cid:7385) बोडर्/िव(cid:7393)िव(cid:7378)ालय से िनधार्िरत शैक्षिणक योग्यता रखता
हो;
(छ) उन मामल(cid:7298) म(cid:7286) जहां कायर् का अनुभव अपेिक्षत न हो, उस वषर् की पहली
जनवरी को िजसम(cid:7286) भत(cid:7278) की (cid:7079)ि(cid:7059)या (cid:7079)ारंभ की जाती ह ै18 वषर् से कम एवं
27 वषर् से अिधक आयु का न हो, एवं
(ज) उन मामल(cid:7298) म(cid:7286) जहां एक (1) वषर् का अनुभव अपेिक्षत हो, ऊपरी आयु
सीमा 29 वषर् होगी एवं उन मामल(cid:7298) म(cid:7286) जहा ं दो (2) अथवा अिधक
वष(cid:7300) का अनुभव अपेिक्षत है ऊपरी आय ुसीमा 31 वषर् होगी |
नोट-1 : (cid:7079)बंधक (cid:7061)ेड-II एवं सहायक (cid:7079)बंधक-सह-स्टोरकीपर के पद के सम्बन्ध म (cid:7286)
सीधी भत(cid:7278) हते ु ऊपरी आयु सीमा म(cid:7286) 35 वष(cid:7300) की आयु तक छूट होगी |
नोट-2 : (ख) एवं (ग) म(cid:7286) आने वाला अभ्यथ(cid:7278) वह (cid:7390)ि(cid:7334) होगा िजसके पक्ष म(cid:7286) भारत

एवं भूतपूवर् सैिनक(cid:7298) की (cid:7088)ेणी म(cid:7286) आने वाले अभ्यिथर्य(cid:7298) के सम्बन्ध म(cid:7286) सीधी भत(cid:7278) हते ु
ऊपरी आयु सीमा म(cid:7286) समय-समय पर कािमर्क, लोक िशकायत और प(cid:7286)शन मं(cid:7074)ालय
(कािमकर् एवं (cid:7079)िशक्षण िवभाग), भारत सरकार (cid:7367)ारा िनधार्िरत छूट होगी |

5क. सीधी भत(cid:7278) िकसी भी पद पर सीधी भत(cid:7278) पयार्(cid:7385) (cid:7079)चार के प(cid:7391)ात होगी कम से कम दो
अख़बार(cid:7298) म(cid:7286) िवज्ञापन, िजनम(cid:7286) से एक स् थािनक भाषा म(cid:7286) हो, िजसका िदल् ली म(cid:7286)
व् यापक िवतरण हो तथा िरि(cid:7334)य(cid:7298) का अन् य (cid:7079)कार स े भी िवज्ञापन िकया जायगे ा
जैसे रोज़गार समाचार, आिद, िजसम(cid:7286) भत(cid:7278) हते ु अिधसूिचत पद(cid:7298) की कुल संख्या
और िविभ(cid:7382) आरिक्षत (cid:7088)ेिणय(cid:7298) हते ु आरिक्षत िरि(cid:7334)यां भी दशार्यी जाय(cid:7286)गी |
6. िनरहतर् ा कोई (cid:7390)ि(cid:7334)-
(क) िजसने अपने जीवनसाथी के जीिवत रहते, िकसी अन् य से िववाह या
िववाह हते ु अनुबंध कर िलया हो, अथवा
(ख) िजसने िकसी ऐसे (cid:7390)ि(cid:7334) से िववाह या िववाह हते ु अनुबंध िकया ह ै
िजसका पहल ेसे ही कोई जीिवत जीवनसाथी हो;
उपरो(cid:7334) पद(cid:7298) के िलए योग्य नह(cid:7277) होगा ।
बशत(cid:7288) िक, यिद मुख् य न् यायाधीश संतुष् ट ह(cid:7298) िक ऐसा करने का कोई िवशेष कारण
ह,ै ऐसे व् यि(cid:7334) को दस िनयम से छूट (cid:7079)दान सकते ह (cid:7289)।
7. िनयिु (cid:7334) की िविध स् थापन् न, अस् थायी या तदथ र् आधार पर िनयुि(cid:7334) के अलावा, इन िनयम(cid:7298) की
अनुसूची-II म(cid:7286) िविन(cid:7416)दर्(cid:7397) पद(cid:7298) पर िनयुि(cid:7334) हते ु अहतर् ाएं एवं िविध यथा िववरिणत
ही रहगे ी ।
8. िनयिु (cid:7334) की (cid:7079)कृित अनूसुची-II म (cid:7286)िविन(cid:7416)दर्ष् ट पद पर िनयुि(cid:7334) स् थायी या पिरवीक्षा पर या स् थानापन् न,
अस् थायी या तदथ र्आधार पर होगी । स् थायी िनयुि(cid:7334) के अलावा कोई भी िनयुि(cid:7334)
िबना कारण बताये िकसी भी समय समाप् त की जा सकती ह ै । परीवीक्षा की
अविध सामान् यत: एक वषर् की होगी, जो बढ़ाई भी जा सकती ह ै । परीवीक्षा

9. अनसु िू चत जाितय(cid:7298), अनुसिू चत कायर्कुशलता को बनाये रखने और उपलब्धता और मुख्य न्यायाधीश (cid:7367)ारा समय-
जनजाितय(cid:7298), अन्य िपछड़ा वग,र् भूतपूव र् समय पर पािरत आदशे (cid:7298) के अध्य धीन, भारत सरकार (cid:7367)ारा समय-समय पर जारी
सिै नक या िदव्य ाग(cid:7298) के िलए पद(cid:7298) का िनयम(cid:7298), आदशे (cid:7298) और अिधसूचना(cid:7312) के अनुसार आरक्षण िदया जायेगा ।
आरक्षण
10. केन्(cid:7076)ीय सरकारी कमचर् ारी सवे ा िनयम(cid:7298) िदल्ली उ(cid:7340) न्यायालय िवभागीय क(cid:7289)टीन कमर्चािरय(cid:7298) की सेवा शत(cid:7300) स े सम्बिन्धत
का उपयोजन ऐसे सभी मामल(cid:7298) के सम्बन्ध म(cid:7286) िजनके िलए इन िनयम(cid:7298) म(cid:7286) कोई (cid:7079)ावधान नह(cid:7277)
िकया गया ह ै या अपयार्(cid:7385) (cid:7079)ावधान ह,ै तत् समय (cid:7079)वृत् त तथा केन् (cid:7076)ीय सरकारी
कायार्लय(cid:7298) म(cid:7286) गरै -सांिविधक िवभागीय क(cid:7289)टीन(cid:7298) के कमर्चािरय(cid:7298) पर लागू िनयम एवं
आदशे िदल् ली अच् च न् यायालय क(cid:7289)टीन कमर्चािरय(cid:7298) की सेवा शत(cid:7300) को उक् त िनयम(cid:7298)
म(cid:7286) ऐसे संशोधन, पिरवतर्न या अपवाद, यिद कोई ह(cid:7298), जैसा िक मुख् य न् यायाधीश
समय-समय पर, िविन(cid:7416)दष्र् ट कर(cid:7286), के अध् यधीन िनयिमत कर(cid:7286)गे ।
11. िनयम(cid:7298) म (cid:7286)छूट दने ेकी शि(cid:7334) मुख्य न्यायाधीश आदेश (cid:7367)ारा िकसी िविश(cid:7397) मामल े म,(cid:7286) िकसी िनयम की
आवश् यकता(cid:7312) को, ऐसी सीमा तक एवं ऐसी शत(cid:7300) के अध्य धीन, जैसा वह
आवश्यक समझ(cid:7286), छोड़ सकते ह (cid:7289)अथवा उसम(cid:7286) छूट द ेसकते ह (cid:7289)।
अभ्यथ(cid:7278) के अन्यथा पूणर्तः योग् य/असाधारण रूप स े कुशल/अनुभवी होने की दशा
म(cid:7286), आयु एवं योग् यताएं माननीय मुख् य न् यायाधीश के िववेक पर छूट योग्य ह (cid:7289)।
अनुसूिचत जाितय(cid:7298)/अनुसूिचत जनजाितय(cid:7298) के अभ्यथ(cid:7278) की दशा म(cid:7286) मुख्य न्यायाधीश
के िववेक पर अनुभव संबंधी योग्यताएं भी छूट योग्य ह (cid:7289) यिद चयन के िकसी स्तर
पर सक्षम (cid:7079)ािधकारी की राय म(cid:7286) अपेिक्षत अनुभव वाले इन समदु ाय(cid:7298) के अभ्यिथयर् (cid:7298)
की पयार्(cid:7385) संख्या उनके िलए आरिक्षत िरि(cid:7334)य(cid:7298) को भरने के िलए उपलब्ध नह(cid:7277)
होगी ।

NOTIFICATION
Delhi, the 25th July, 2017
No. 431/Rules/DHC.—In exercise of the powers vested under Article 229 of the Constitution of India,
Hon’ble the Acting Chief Justice of this Court has been pleased to frame the following Rules regulating the
method of recruitment of Group ‘B’ and ‘C’ Non-Gazetted posts in the Departmental Canteen, High Court of
Delhi, namely,:—
1. Short Title These Rules may be called the “Delhi High Court Departmental Canteen
Employees’ (Appointment and Conditions of Service), Rules, 2017”.
2. Commencement and (i) These Rules shall come into force from the date of their publication in the
Application Official Gazette.
(ii) These Rules shall apply to all the employees of the Delhi High Departmental

3. Definition In these Rules, unless there is anything repugnant in the subject or context:
a. “Chief Justice” means the Chief Justice of High Court of Delhi;
b. “High Court” means the High Court of Delhi;
c. “Prescribed” means prescribed by these Rules;
d. “Recognized Board/University” means any Board/University
incorporated by law in India or any other Board/University/ Institution
which is declared by the Chief Justice to be a recognized
Board/University for the purpose of these Rules.
4. Staff Strength The staff strength of Delhi High Court Departmental Canteen shall consist of the
posts as shown in Schedule–I to these Rules, which may be amended by the Chief
Justice from time to time.
5. Conditions of and A person shall be eligible for appointment in Delhi High Court Departmental
Eligibility for Canteen, who is:
Appointment
(a) citizen of India;
(b) a subject of Nepal;
(c) a subject of Bhutan;
(d) medically fit;
(e) of good character;
(f) possessing the prescribed educational qualifications from a recognized
Board/University;
(g) not below 18 years of age and over 27 years of age on the first day of
January of year in which the process of recruitment is initiated, in cases
where no work experience is required; and
(h) in cases which require one (1) year’s experience, upper age limit will be
29 years and in cases which require two (2) or more years’ experience,
upper age limit will be 31 years.
Note-1 : The upper age limit for direct recruitment in respect of the post of
Manager Grade-II and Assistant Manager-cum-Store Keeper shall be relaxable
upto the age of 35 years.
Note-2 : A candidate belonging to (b) and (c) shall be a person in whose favour a
certificate of eligibility has been issued by the Govt. of India.
Provided that the upper age limit for direct recruitment in respect of candidates
belonging to Scheduled Caste, Scheduled Tribe, Other Backward Classes, Persons
with Disabilities and Ex-servicemen shall be relaxable as prescribed from time to
time by the Government of India, Ministry of Personnel, Public Grievances and
Pensions (Department of Personnel & Training).
5A. Direct Recruitment Direct recruitment to any post shall be after giving adequate publicity, i.e.,
advertisement in at least two newspapers, one of which must be in vernacular
language, having wide circulation in Delhi and the vacancies may be advertised by
other modes also, i.e., Employment News, etc. indicating the total number of
vacancies notified for recruitment and the number of vacancies reserved for
different reserved categories.”
6. Disqualification No person –
(a) who having a spouse living, has entered into or contracted marriage with
any person, or
(b) who has entered into or contracted marriage with a person having a
spouse living;
shall be eligible for appointment to the said posts.
Provided that the Chief Justice may, if satisfied that there are special grounds for
doing so, exempt any such person from the operation of this rule.7 DELHI GAZETTE : EXTRAORDINARY PART IV]
7. Mode of Except for appointment on officiating, temporary or ad hoc basis, the mode of and

shall be as stated therein.
8. Nature of Appointment to post specified in Schedule–II may be substantive or on probation
Appointment or on officiating, temporary or ad hoc basis. Any appointment other than
substantive appointment may be terminated at any time without assigning reasons.
Probation shall ordinarily be of one year’s duration, which can be extended.
Expiry of the period of probation shall not result in automatic confirmation.
9. Reservation of posts Consistent with maintenance of efficiency and subject to availability and orders
for Scheduled passed by the Chief Justice from time to time, reservation shall be given in
Castes, Scheduled accordance with the Rules, orders and notifications issued from time to time by
Tribes, Other the Government of India.

10. Application of In respect of all such matters regarding the conditions of service of Delhi High
Central Government Court Departmental Canteen Employees, for which no provision or insufficient
Servants Service provision has been made in these Rules, the rules and orders for the time being in
Rules force and applicable to Employees in Non-Statutory Departmental Canteens in
Central Government Offices shall regulate the conditions of service of Delhi High
Court Canteen Employees, subject to such modifications, variations or exception,
if any, in the said rules, as the Chief Justice may, from time to time, specify.
11. Power to relax rules The Chief Justice may, by order, dispense with or relax the requirements of any
rule to such extent and subject to such conditions as he/she may consider
necessary in any particular case.
Age and qualification(s) are relaxable at the discretion of the Chief Justice in the
case of candidate otherwise well qualified/exceptionally skilled/ experienced.
The qualification(s) regarding experience is/are also relaxable at the discretion of
the Chief Justice in case of candidate belonging to Scheduled Castes/Scheduled
Tribes if, at any stage of selection, the competent authority is of the opinion that
sufficient number of candidates belonging to these communities possessing the
requisite experience are not likely to be available to fill up the vacancies reserved
for them.

Note-2: Services of Safaiwala will henceforth be outsourced. Merged cadre of Canteen Attendant, however, shall
also include existing incumbent in the grade of Safaiwala (Regular) till he retires on attaining the age of
superannuation or leaves the services of this Court or his services are terminated by the competent
authority on any ground whatsoever.
