(cid:18)(cid:18)(cid:18)(cid:18)(cid:2)(cid:2)(cid:2)(cid:2)तत तत ााााववववननननाााा 1.1 व(cid:19)$ (cid:18)सं(cid:19)क रण, व(cid:19)$ उ3ोग मू(cid:6) य Dृंखला का एक ब9त मह@ वपूण ( घटक ह।ै भारतीय व(cid:19) $ उ3ोग क8 (cid:18)ित(cid:19)प धा@( म कता, व(cid:19)$ (cid:18)सं(cid:19)क रण #े$ क8 शिG पर िनभ(र करती ह।ै 1.2 इसके अलावा, चूं(cid:4)क भारत म% (cid:18)सं(cid:19) करण #े$ म% अिधकतर लघु और मH यम उ3म शािमल ह I इसिलए समKपत (cid:18)दषू ण िनयं$ण उपकरण लगाना Lय िGगत (cid:18)सं(cid:19)क रण इकाइय(cid:23) के िलए आKथक प स ेL यवहाय (नहM ह।ै पNरणामत: सामा+य अपिश,ट शोधन सयं ं$ (सीईटीपी) और सामान य् जल आपूKत (cid:18)णाली इन इकाइय(cid:23) के िलए उपयुP त ह।I 1.3 एक8कृत (cid:18)सं(cid:19)क रण िवकास योजना (आईपीडीएस) मं$ालय Qारा 12वM पचं वष"य योजना अविध के दौरान शु क8 गई थी। इस योजना स े (cid:18)ाRत अनभु व और व(cid:19) $ (cid:18)सं(cid:19) करण #े$ के सामने आई चनु ौितय(cid:23) के आधार पर मं$ालय न े कुछ संशोधन(cid:23) के साथ उPत योजना को जारी रखन ेका िनण(य िलया ह।ै 2222.... उउउउ3333ेे44ेे44 यय यय आईपीडीएस का (cid:18)मुख उTेUय पया(वरण अनुकूल (cid:18)सं(cid:19) करण मानक(cid:23) और (cid:18)ौ3ोिगक8 का (cid:18)योग करके वैिU वक तौर पर (cid:18)ितयोगी बनन े के िलए भारतीय व(cid:19) $ उ3ोग को सिु वधा (cid:18)दान करना है। यह योजना अपेि#त पया(वरणीय मानक(cid:23) को पूरा 7091 GI/2017 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] करने के िलए व(cid:19)$ इकाइय(cid:23) को सिु वधा (cid:18)दान करेगी। आईपीडीएस मौजूदा (cid:18)सं(cid:19) करण कल(cid:19) टर(cid:23) एव ं नए (cid:18)सं(cid:19) करण पाक(cid:27), िवशेष प स े जल और अपिश,ट जल (cid:18)बंधन के #े$ म % नई सीईटीपी तथा (cid:18)सं(cid:19) करण #े$ म % (cid:19) वVछ (cid:18)ौ3ोिग(cid:4)कय(cid:23) के िलए अनसु ंधान और िवकास का सवं ध(न करने के िलए सहायता (cid:18)दान करेगी। 3333.... ययययोोोोजजजजननननाााा ककककाााा ककककाााायययय5555%%%% (cid:4)(cid:4)ेे(cid:4)(cid:4)ेे 3.1 आईपीडीएस का, व(cid:19)$ कल(cid:19)ट र(cid:23) क8 आवU यकताW को पूरा करत े 9ए चल रही पNरयोजनाW को परू ा करने और 3 से 4 पNरयोजनाW को (cid:19)व ीकृत करने का (cid:18)(cid:19)त ाव ह।ै इस योजना के अंतग(त पा$ पNरयोजनाW म %िनZ निलिखत शािमल ह(cid:23)गे: • समूह क :- जल शोधन एवं अपिश,ट शोधन सयं ं$ और (cid:18)ौ3ोिगक8 (समु[ी, तटवत" और जेडएलडी (cid:18)णाली सिहत)। • समूह ख :- नवीकरणीय और हNरत ऊजा( सिहत कैिRटव िव3ुत उ@ पादन संयं$ जैसी सामा+य अवसंरचना। • समूह ग :- परी#ण (cid:18)योगशालाएं और आर॰ एंड॰ डी॰ जसै ी सामा+ य सुिवधाएं। 3.2 भारत सरकार के अनुदान क8 अनमु ित जेडएलडी और समु[ी बिह^ाव के िलए 75 करोड़ bपए क8 सीमा तक और तटवत" और परंपरागत शोधन, जसै ा भी मामला हो, के िलए 10 करोड़ bपए क8 सीमा के अH यधीन पNरयोजना लागत के 50% क8 समc सीमा के भीतर कैिRटव िव3ुत उ@ पादन संय$ं सिहत केवल समूह ‘क’ एवं ‘ख’ के अंतग(त सघं टक(cid:23) के िलए (cid:18)दान क8 जाएगी। एसपीवी, भारत सरकार क8 अ+ य आर॰ एडं ॰ डी॰ योजनाW के साथ सम+ वय करके समूह ‘ग’ सघं टक के िलए सहायता (cid:18)ाRत कर सकती ह।ै भारत सरकार के अनुदान का उपयोग भिू म क8 खरीद के िलए नहM (cid:4)कया जाएगा। भिू म क8 खरीद/Lय व(cid:19)थ ा एसपीवी Qारा क8 जाएगी। भिू म क8 लागत कुल पNरयोजना लागत का भाग नहM होगी। 3.3 यह योजना मौजूदा व(cid:19)$ कल(cid:19) टर(cid:23) म % (cid:18)ौ3ोिगक8 उ+न यन और उि(cid:6)लिखत सिु वधाW क8 #मता वृ िd के िलए भी लाग ूहोगी। 4444.... &&&&6666ययययाााा7777वव वव ययययनननन ककककाााा ढ़ढ़ढ़ढ़ााााचचंंचचंं ाााा:::: 4.1 यह पNरयोजना पृथक िवशेष (cid:18)योजन तं$ (एसपीवी) का गठन करके (cid:4)Bयाि+वत क8 जाएगी जो कंपनी अिधिनयम के अंतग(त पंजीकृत गैर-लाभ वाली कंपनी होगी। एसपीवी का (cid:19) वािम@व (cid:18)सं(cid:19) करण कल(cid:19) टर के सद(cid:19) य(cid:23) (औ3ोिगक इकाइय(cid:23)) के पास होगा। भारत सरकार Qारा िनधा(Nरत (cid:4)दशािनदश? (cid:23) के भीतर इस योजना को (cid:4)Bयाि+वत करन े के िलए (cid:18)चालना@ मक (cid:19)व ाय@त ता एसपीवी के पास होगी। 4.2 भारत सरकार, एसपीवी को जारी क8 गई िनिधय(cid:23) क8 Lय वहाय(ता, िवतरण/उपयोग स े संबंिधत (cid:18)(cid:19) ताव(cid:23) के मू(cid:6)य ाकं न और पNरयोजना (cid:4)Bया+व यन क8 समय-समय पर मॉनीटgरग करने म % सरकार क8 सहायता के िलए पNरयोजना (cid:18)बंधन परामश(दाता (पीएमसी) के एक पनै ल क8 िनयिु G करेगी। पीएमसी इस योजना के (cid:18)भावी (cid:4)Bया+ वयन के िलए सरकार को अ+य आवUय कता आधाNरत एडवाइजरी सेवाए ं भी (cid:18)दान करेगी। भारत सरकार इस योजना को (cid:18)शासिनक सहायता (cid:18)दान करने के िलए सयं ुPत सिचव, व(cid:19) $ मं$ालय क8 अH य#ता म %पNरयोजना जांच सिमित (पीएससी) और सिचव, व(cid:19)$ क8 अHय #ता म% पNरयोजना अनमु ोदन सिमित (पीएसी) का गठन भी करेगी। 4.3 एसपीवी, पारदश" (cid:18)(cid:4)Bया के माHय म स े पNरयोजना का काय( करन े और िव(cid:19) तृत पNरयोजना Nरपोट( (डीपीआर) (cid:18)(cid:19)त ुत करने स े पहले पीएमए के साथ करार करन े के िलए पया(R त तकनीक8 द#ताW वाली पNरयोजना (cid:18)बंधन एज%सी (पीएमए) क8 तैनाती करेगा। 4.4 पNरयोजना (cid:18)(cid:19)त ाव को डीपीआर के प म % व(cid:19) $ मं$ालय को भेजा जाना चािहए िजसका पीएमसी Qारा मू(cid:6) याकं न (cid:4)कए जान ेके पUच ात उसे पीएससी के सम# मू(cid:6) याकं न हते ु (cid:18)(cid:19) तुत (cid:4)कया जाएगा। 4.5 डीपीआर के साथ राhय (cid:19)त रीय पया(वरण (cid:18)भाव आकलन (एसएलईआईए) सिहत संबंिधत एसपीसीबी/राh य एज%सी से पया(वरणीय (cid:19)व ीकृित सिहत राhय सरकार का ‘सैdािं तक’ अनमु ोदन भी (cid:18)(cid:19) ततु (cid:4)कया जाना चािहए। व(cid:19) $ उ3ोग स े अपिश,ट बिह^ाव के मानक (cid:4)दनाकं 10.10.2016 के पयाव( रण एव ं वन मं$ालय के आदशे और समय-समय पर पया(वरण एवं वन मं$ालय अथवा एसपीसीबी Qारा इस िवषय म% जारी (cid:4)कए गए (cid:4)कसी भी अनुवत" आदशे (cid:23) के अनु प ह(cid:23)गे। 4.6 भारत सरकार के अनुदान क8 पहली (cid:4)क(cid:19) त जारी होने के पU चात इस योजना के अंतग(त पNरयोजनाW के पूरा होन े क8 समय सीमा िनZन ानुसार होगी: i. cीन फ8(cid:6)ड पNरयोजना के िलए 3 वष( ii. oाउन फ8(cid:6)ड पNरयोजना के िलए 2 वष(¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 3 5555.... ििििवववव8888तत तत पपपपोोोोषषषषणणणण कककक(cid:15)(cid:15)(cid:15)(cid:15) पपपप9999िििितततत:::: 5.1 िवशेष (cid:18)योजन तं$ उ3ोग के सद(cid:19) य(cid:23) स े(cid:18)ाR त इ(cid:4)pटी, व(cid:19) $ म$ं ालय, राh य सरकार स े (cid:18)ाR त अनदु ान सहायता तथा बIक(cid:23) और िव@त ीय सं(cid:19)थ ाW स े (cid:18)ाRत ऋण के िमDण स े पNरयोजना को िव@त पोिषत करेगा। अनुदान Qारा इस योजना के अंतग(त भारत सरकार क8 सहायता शू+य तरल बिह^ाव (cid:18)णािलय(cid:23) वाली पNरयोजनाW के िलए 75 करोड़ bपए क8 सीमा और परंपरागत शोधन (cid:18)णािलय(cid:23) वाली पNरयोजनाW के िलए 10 करोड़ bपए क8 सीमा के साथ पNरयोजना लागत का 50% तक सीिमत होगी। समु[ी बिह^ाव पNरयोजनाW के िलए सहायता का िवUल ेषण अिधकतम 75 करोड़ bपए क8 सीमा के साथ मामला-दर-मामला आधार पर (cid:4)कया जाएगा। 5.2 पNरयोजना लागत क%[, राhय , लाभाथ", बIक ऋण Qारा Bमश: 50:25:15:10 के अनपु ात म %वहन क8 जाएगी। • पNरयोजना लागत के 15% का अंशदान एसपीवी Qारा इ(cid:4)pटी के माH यम स े(cid:4)कया जाएगा। • 10% िव@त पोषण क8 Lय व(cid:19)थ ा बIक ऋण के माH यम स ेक8 जाएगी। • भारत सरकार का अनुदान (कुल पNरयोजना लागत का 50%) 15:35:30:20 क8 4 (cid:4)क(cid:19) त(cid:23) म% जारी (cid:4)कया जाएगा। (cid:1) भारत सरकार के अनुदान (भारत सरकार के शेयर का 15%) क8 पहली (cid:4)क(cid:19) त जारी होने से पहले एसपीवी का 50% अंशदान (इ(cid:4)pटी + ऋण) को टीआरए के खाते म% लाया जाएगा। (cid:1) भारत सरकार के अनुदान (भारत सरकार के शेयर का 35%) क8 दसू री (cid:4)क(cid:19) त जारी होन े से पहल े राhय के 50% अंशदान और एसपीवी के शषे 50% शेयर को लाया जाएगा और उपयोग (+य ूनतम 70% तक) (cid:4)कया जाएगा। (cid:1) संयं$ के एक बार (cid:18)चालनशील हो जाने और राh य सरकार का शेष 50% शेयर (cid:18)ाRत कर लेन े और उपयोग कर लेन े के बाद भारत सरकार के 30% अनुदान क8 तीसरी (cid:4)क(cid:19) त जारी क8 जाएगी। (cid:1) संयं$ के तीन वष( तक (cid:18)चालनशील रहने पर 20% क8 चौथी और अंितम (cid:4)क(cid:19) त जारी क8 जाएगी। 5.3 योजना के िलए िव@त ीय सहायता िनZन िलिखत शत(cid:27) के अH यधीन होगी:- (क) क%[ीय सहायता भाग 3 म % उि(cid:6)लिखत मद(cid:23) के िलए पूंजी लागत(cid:23) को परू ा करन े के िलए ही (cid:18)दान क8 जाएगी। िनिधय(cid:23) का (cid:18)योग पNरयोजना के िलए भिू म क8 खरीद के िलए नहM (cid:4)कया जाएगा। (ख) आवत" अथवा (cid:18)चालन और रखरखाव क8 लागत(cid:23) को पूरा करने के िलए कोई सहायता (cid:18)दान नहM क8 जाएगी। (ग) समय और लागत आिधPय के िलए क%[ सरकार क8 कोई दने दारी नहM होगी। (घ) पूव((cid:18)भाव वाल ेिव@त पोषण के िलए कोई (cid:18)ावधान नहM ह।ै (ङ) भिू म कुल पNरयोजना लागत का भाग नहM होगी। (च) भारत सरकार के अनुदान क8 पहली (cid:4)क(cid:19)त जारी (cid:4)कए जाने स े पहले पया(वरणीय (cid:19) वीकृित और अ+ य (cid:19)व ीकृितया ं(cid:18)ाRत क8 जाएगं ी और मं$ालय को (cid:18)(cid:19) ततु करनी ह(cid:23)गी। 6666.... ििििननननििििधधधधययययाााा ंं ंंजजजजााााररररीीीी ककककररररननननाााा:::: 6.1 एसपीवी, (cid:4)कसी रा,r ीकृत बकI म% िनतातं पNरयोजना िविश, ट r(cid:19) ट एवं (cid:18)ितधारण खाता (टीआरए) का रखरखाव करेगा और मं$ालय, एसपीवी और बIक के बीच ि$प#ीय ए(cid:19)B ो करार पर ह(cid:19) ता#र (cid:4)कए जान ेके पU चात उसी खात े म % सरकार क8 िनिधया ं जारी क8 जाएंगी। अनुमोदन के पU चात सरकार िनZ निलिखत सूची के अनुसार 4 चरण(cid:23) म % अपनी सहायता के शेयर Nरलीज करेगी: (i) भारत सरकार (जीओआई) के कुल शेयर के 15% क8 पहली (cid:4)क(cid:19) त एसपीवी को िनZन िलिखत मानदडं (cid:23) को पूरा करने पर जारी क8 जाएगी: (क) एसपीवी क8 (cid:19)थ ापना4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] (ख) िनदशे क मंडल म% भारत सरकार के एक (cid:18)ितिनिध और पीएमसी के एक (cid:18)ितिनिध को शािमल (cid:4)कया जाना (ग) एसपीवी के कsज े म% भिू म का होना (घ) एसपीवी के सद(cid:19)य (cid:23) को आबंटन योt य #े$/#मता के अनपु ात म %उनको एसपीवी Qारा शेयर जारी करना। (ङ) शेयर हो(cid:6)ड र करार का िन,प ादन (च) (cid:4)कसी रा,r ीयकृत बIक म% टीआरए खाता क8 (cid:19) थापना। टीआरए म% एसपीवी Qारा मौके पर जमा (cid:4)कए गए अंशदान (अथा(त एसपीवी के शये र का 50%) को (cid:18)दKशत करते 9ए पNरयोजना िविश, ट टीआरए का िववरण (cid:18)(cid:19)त ुत करना। (छ) एसपीवी Qारा शेष 10% ऋण संघटक के िलए बकI (cid:23)/िव@त ीय सं(cid:19) थाW से (cid:18)ाRत (cid:19) वीकृत प$ (cid:18)(cid:19) तुत (cid:4)कया जाएगा। (ज) इ(cid:4)pटी अशं दान का sय ौरा (झ) पNरयोजना के िलए सशं ोिधत डीपीआर तयै ार करना और उस े पीएमसी Qारा िविधवत वधै कराकर व(cid:19)$ मं$ालय को (cid:18)(cid:19)त ुत करना। (ञ) पNरयोजना लागत क8 25% िनिधयां जारी करन ेके िलए राh य सरकार स े(cid:18)ितबdता प$। (ट) पीएमसी का (cid:18)माणप$ िजसम % यह उ(cid:6)ल ेख (cid:4)कया गया हो (cid:4)क एसपीवी ने पNरयोजना श ु करन े के िलए अपेि#त द(cid:19)त ावेज(cid:23) के साथ सभी आवU यक सािं विधक (cid:19) वीकृितया ं(cid:18)ाR त कर ली ह।I (ठ) पीएमसी क8 िसफाNरश िजसम% यह पुिu क8 गई हो (cid:4)क एसपीवी, जारी (cid:4)कए जाने के िलए सभी शत(cid:27) को परू ा करता ह।ै (ड) पNरयोजना अनमु ोदन सिमित Qारा अनमु ो(cid:4)दत डीपीआर और पीईआरटी चाट( (cid:18)(cid:19) ततु करना। (ढ) एसपीवी के सािं विधक लेखा-परी#क(cid:23) Qारा िविध वत (cid:18)मािणत एसपीवी के मौके पर अंशदान का समानुपाितक उपयोग कर िलए जाने के पU चात भारत सरकार के अनुदान का उपयोग (cid:4)कया जाएगा। * राhय सरकार, भारत सरकार के अनुदान क8 पहली (cid:4)क(cid:19) त जारी (cid:4)कए जान े के पU चात तरु ंत अपन े शेयर का 50% जारी करेगी। (ii) भारत सरकार के कुल शेयर के 35% क8 दसू री (cid:4)क(cid:19)त एसपीवी को िनZ निलिखत मानदडं (cid:23) को पूरा करन े पर (cid:18)दान क8 जाएगी: (क) (cid:18)ाRत पहली (cid:4)क(cid:19)त के िलए एसपीवी के सािं विधक लेखा-परी#क(cid:23) Qारा िविधवत (cid:18)मािणत उपयोिगता (cid:18)माणप$। (ख) टीआरए खाते म% राhय सरकार के अशं दान का 50% शेयर जारी (cid:4)कया जाना और राh य सरकार के अंशदान का +य ूनतम 70% उपयोग (cid:4)कया जाना। (ग) एसपीवी के शेयर का शषे 50% टीआरए खाते म %डाला जाएगा और कुल एसपीवी के शेयर का 70% उपयोग (cid:4)कया जाएगा िजसे एसपीवी के सािं विधक लेखा-परी#क(cid:23) Qारा िविधवत (cid:18)मािणत (cid:4)कया जाएगा। (घ) पा$ पNरयोजना लागत के 50% के बराबर ठेका (cid:4)दया जाना। (ङ) पीएमसी क8 िसफाNरश िजसम% यह पुिu क8 गई हो (cid:4)क एसपीवी Nरलीज के िलए सभी शत(cid:27) को पूरा करता ह।ै * राhय सरकार, भारत सरकार के अनुदान क8 दसू री (cid:4)क(cid:19) त जारी (cid:4)कए जाने के तरु ंत पU चात ही अपने शेयर का शेष 50% जारी करेगी। (iii) भारत सरकार के कुल शेयर के 30% क8 तीसरी (cid:4)क(cid:19) त एसपीवी को िनZ निलिखत मानदंड(cid:23) को पूरा करन े पर (cid:18)दान क8 जाएगी: (क) दसू री (cid:4)क(cid:19)त के िलए एसपीवी के सािं विधक लखे ा-परी#क(cid:23) Qारा िविधवत (cid:18)मािणत उपयोिगता (cid:18)माणप$, एसपीवी शेयर और पूण (पNरयोजना लागत के िलए Lय य के िववरण क8 (cid:18)मािणत (cid:18)ित।¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 5 (ख) टीआरए खाते म% राhय सरकार के अशं दान का शषे शेयर जारी करना और एसपीवी के सािं विधक लेखा- परी#क(cid:23) Qारा िविधवत (cid:18)मािणत इसका 100% उपयोग। (ग) कम से कम 6 महीन ेके ओ एंड एम L यय के साथ कापस( िनिध का एक िववरण भी तैयार (cid:4)कया जाएगा और द(cid:19)त ावेज (cid:18)(cid:19)त ुत (cid:4)कए तथा िव@त ीय सवं ी#ा क8 जाएगी और अनमु ोदन के िलए पीएसी के मू(cid:6)य ाकं न और िसफाNरश हते ुपीएससी को (cid:18)(cid:19)त ाव (डीपीआर) अcेिषत करेगी। 6.3 इन दाव(cid:23) के समथन( म% संगत िनयम(cid:23) के अंतग(त यथापिे #त जीएफआर 12-ए (जीएफआर-2017) के (cid:18)प$ म % उपयोिगता (cid:18)माणप$, (cid:18)ािv पूव( िबल, (cid:19) योNरटी बांड आ(cid:4)द जैसे द(cid:19) तावेज लगाए जाएंग।े कम से कम 6 महीन े के (cid:18)चालन और (cid:18)बंधन (ओ एंड एम) Lय य के साथ एक काप(स िनिध तयै ार क8 जाएगी और पNरयोजना के पूरा होने के पU चात तथा (cid:18)चालनशील होन ेस ेपहले द(cid:19)त ावेज (cid:18)(cid:19)त ुत (cid:4)कए Integrated Processing Development Scheme (IPDS) for next three year w.e.f. 01.04.2017 to 31.03.2020 No.1/8/2016-SITP.—In order to facilitate the textile industry to meet the required environmental standards and to support new Common Effluent Treatment Plants (CETP)/ upgradation of CETPs in existing processing clusters as well as new processing parks specially in the Coastal Zones, the Government has approved the continuation of Integrated Processing Development Scheme (IPDS) with modifications in the existing scheme for a period of three years i.e. from 01.04.2017 to 31.03.2020. The revised Guidelines of IPDS i.e. financial and operational parameters and implementation mechanism for IPDS are laid down as under:— 1. INTRODUCTION 1.1 Textile processing constitutes a very important component of the textile industry value chain. The competitiveness of Indian Textile industry is contingent on the strength of the textile processing sector. 1.2 Further since the processing sector in India comprises predominantly of small and medium enterprises, it is not economically feasible for the individual Processing units to install dedicated pollution control equipment. Consequently, Common Effluent Treatment Plant (CETP) and Common Water Supply Systems are appropriate for these units. 1.3 Integrated Processing Development Scheme (IPDS) was launched by the Ministry in the 12th Five year plan period. Based on the experience under the scheme as well as the challenges faced by the textile processing sector, the Ministry has decided to continue the said scheme with some modifications. 2. OBJECTIVE: The primary objective of the IPDS is to facilitate the Indian textile industry to become globally competitive using environmentally friendly processing standards and technology. The scheme would facilitate the textile units to meet the required environmental standards. The IPDS would support new CETPs in existing processing clusters as well as new processing parks specifically in the area of water and waste water management as also to promote research and development for cleaner technologies in the processing sector. 3. SCOPE OF SCHEME: 3.1 IPDS proposes to complete the on-going projects and sanction 3-4 new projects addressing the needs of the Textile Clusters. Eligible projects under the scheme would cover the following:- • Group A - Water treatment & effluent treatment plant and technology (including marine, Riverine and ZLD system). • Group B - Common infrastructure such as captive power generation plants including renewable and green energy. • Group C - Common facilities such as Testing Laboratories and R&D centres. 3.2 Government of India grant will be permitted for the components under groups A & B only including captive power generation plant within the overall ceiling of 50% of the project cost not exceeding Rs.75 crore for ZLD and Marine discharge and Rs. 10 crore for riverine and conventional treatment as the case may be. SPV may avail assistance for Group C component by dovetailing with other R&D schemes of Government of India. Government of India grant shall not be used for procurement of land. The land will be purchased/arranged by the SPV. The cost of land will not be part of the total project cost. 3.3 The scheme would also be applicable for technology upgradation and capacity enhancement of the above mentioned facilities in existing Textile Clusters.¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 11 4. IMPLEMENTATION STRUCTURE: 4.1 The Project would be implemented through formation of a separate Special Purpose Vehicles (SPVs) which will be a Non-profit Company registered under the Companies Act. The SPV shall be owned by the members (Industrial Units) of the processing cluster. The SPV shall have operational autonomy to implement the scheme, within the guidelines as stipulated by Government of India 4.2 Government of India would appoint a panel of Project Management Consultant (PMC) toassist the Government in evaluation of the proposals regarding viability, disbursement/utilization of the funds released to the SPV and periodical monitoring of the Project implementation. The PMC also shall provide other need based advisory services to the Government for effective implementation of the scheme. Government of India would also constitute a Project Scrutiny Committee (PSC) headed by the Joint Secretary-Ministry of Textiles and Project Approval Committee (PAC) headed by the Secretary (Textiles), in order to provide administrative support to the scheme. 4.3 The SPV shall engage through a transparent process a Project Management Agency (PMA) having adequate technical competencies to handle the project and enter into an agreement with the PMA before presentation of the Detailed Project Report (DPR). 4.4 The project proposal in the form of a DPR should be sent to the Ministry of Textiles which shall be submitted to the PSC for appraisal after it is evaluated by the PMC. 4.5 The DPR should be accompanied by “in principle” approval of the State Government along-with the environment clearance from the SPCB/ state agency concerned including State Level Environmental Impact Assessment (SLEIA). The standards of discharge of effluent from the textile industry shall confirm to the Ministry of Environment & Forest order dated 10.10.2016 or any subsequent orders issued within subject by MoEF or SPCB from time to time. 4.6 Timelines for completion of projects under the scheme after the release of 1st installment of GoI grant would be: i. Three years for a Greenfield project. ii. Two years for a Brownfield project. 5. FUNDING PATTERN: 5.1 The Special Purpose Vehicle shall fund the project through a mix of equity from members of industry, grant support from Ministry of Textile, State Government, and the loan from Banks and Financial Institutions. The Government of India support under the scheme by the way of grant would be limited to 50% of the project cost, with a ceiling of Rs.75 crores for projects with Zero Liquid Discharge Systems and Rs.10 crores for projects with conventional treatment systems. Support for marine discharge projects would be analyzed on a case to case basis with a maximum ceiling of Rs.75 crores. 5.2 The project cost shall be borne by the Center, State, Beneficiary, Bank loan in the ratio of 50:25:15:10 respectively. • 15 percent of project cost shall be contributed through equity by the SPV. • 10 percent funding to be arranged through Bank Loans • The GOI grant (50% of the total Project cost) shall be released in four installments of 15:35:30:20 (cid:1) 50% of the SPV contribution (equity + loan) shall be brought in the TRA account before release of 1st installment of GOI grant (15% of GoI share). (cid:1) 50% of state contribution and remaining 50% share of SPV share shall be brought and utilised (at least upto70%) before release of 2nd installment of GOI grant (35% of GoI share). (cid:1) 3rd installment of 30% of the GOI grant once the plant is operational and after availing and utilizing the balance 50% share of State Government. (cid:1) 4th and last installment of 20% once the plant has been run for 3 years.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] 5.3 The financial assistance for the scheme shall also be subject to the following conditions: (a) The Central assistance will be provided only to meet capital costs towards the items mentioned in section 3. The funds shall not be used to procure the land for the Project. (b) No assistance will be provided for meeting recurring or operation and Maintenance costs. (c) The Central Government shall not have any liability towards time and cost over runs. (d) There is no provision for retrospective funding. (e) Land will not be part of the total project cost. (f) Environmental clearance and other clearances shall be obtained and submitted to the Ministry before release of first instalment of GoI grant. 6. RELEASE OF FUNDS: 6.1 The SPV shall maintain an exclusive project specific Trust & Retention Account (TRA) with any Nationalized Bank and the Funds from the Government will be released in that account after signing a Tri- partite escrow agreement between the Ministry, SPV and the Bank. After approval, the Government will release its share of assistance in 4 Phases as per the following schedule: (i) First Installmentof 15% of the total Government of India (GOI) share will be released to the SPV subject to fulfillment of following criteria: (a) Establishment of SPV. (b) Inclusion of one representative of Government of India and one representative of the PMC on the Board of Directors. (c) Land to be in Possession of SPV (d) Issuance of shares by SPV to members in proportion of area/ capacity allocable to them (e) Execution of share-holders agreement (f) Establishment of TRA account in a nationalized bank. Submission of statement of Project specific TRA reflecting the upfront contribution, (i.e. 50% of the share of the SPV) deposited by the SPV in the TRA. (g) Sanction letter from banks/ financial institutions for the balance 10% loan component shall be submitted by the SPV. (h) Details of equity contribution. (i) Preparation of a revised DPR for the project and submission of the same to the Ministry of Textiles duly validated by the PMC. (j) Commitment letter from the State Government for release of 25% funds of the project cost. (k) Letter from PMC certifying that SPV has obtained all the necessary statutory clearances for commencement of the project, alongwith requisite documents. (l) Recommendation of PMC confirming that SPV fulfills all the conditions for release. (m) DPR approved by Project Approval Committee and submission of PERT chart. (n) GoI grant will be utilized after utilization of SPVs proportionate upfront contribution duly certified by Statutory Auditors of the SPV. * State Government will release 50% of its share immediately after release of 1st installment GoI grant. (ii) Second instalment representing 35% of the total GOI sharewill be paid to the SPV subject to fulfillment of following criteria:- (a) Utilization Certificate duly certified by the Statutory Auditors of the SPV for the First installment received.¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 13 (b) Release of 50 percent share of State Govt. contribution into the TRA Account & utilization of atleast 70% of the state government contribution. (c) Remaining 50% share of SPV share shall be credited into TRA account and 70% of total SPV share utilization. Duly certified by Statutory Auditors of the SPV. (d) Award of contracts equivalent to 50% of the eligible project cost. (e) Recommendation of PMC confirming that SPV fulfills all the conditions for release. * State Government will release the remaining 50% of its share immediately after release of 2nd installment of GoI grant. (iii) Third instalment representing 30% of the total GOI share will be paid to the SPV subject to fulfillment of following criteria:- (a) Utilization Certificate duly certified by the Statutory Auditors of the SPV for the Second installment, SPV share and certified copy of expenditure statement for the complete project cost. (b) Release of remaining share of State Govt. contribution into the TRA Account and its 100% utilization duly certified by the Statutory Auditors of the SPV. (c) A statement of corpus fund with at least 6 months O&M expenditure will also be created and documents will be submitted. (d) Recommendation of State Pollution Control Board (SPCB) that the project is fully operational and conforms to the norms. (e) Recommendation of PMC confirming that SPV fulfills all the conditions for release. (iv) Fourth Installment representing 20% of the total GOI share will be released 3 years after the operationalization of the project and after the utilization of the 3rd installment. SPCB shall inspect the project after completion and give its report confirming that the project has been operational for a period of 3 years. 6.2 The SPVs would submit the initial proposal which shall be technically and financially vettedby a third party committee consisting of a representative from TRA and a faculty member from the department concerned of IIT and forward the proposal (DPR) to the PSC for appraising and recommending to the PAC for approval. 6.3 The claims shall be supported by documents such as Utilisation Certificate in the format of GFR 12- A (GFR-2017),Pre-Receipt Bill, Surety Bond etc., as required under the relevant rules. A corpus fund with atleast 6 months Operation and Management (O&M) expenditure will also be created and documents submitted after the completion of project and before operationalization. 6.4 Separate accounts shall be kept by SPV for the funds released by GOI, which shall be subject to audit by the Comptroller & Auditor General of India. 6.5 In the event of an SPV withdrawing from executing a project, then the SPV should immediately return the Government assistance together with the interest accrued thereon, if any. Payment of penal interest by the SPV @10% or as decided by the Project Approval Committee (PAC) on case to case basis. 6.6 User charges would be fixed for various facilities and services by SPV. There shall be full recovery of Operational & Maintenance (O&M) cost through user charges. 6.7 The PAC can cancel the project in case of inordinate delay in execution. On cancellation the SPV will return the GoI grant along with interest accrued thereon and penal interest as decided by PAC. 7. PURCHASE OF LAND: Land for processing Parks shall be purchased / arranged by the SPV. The GOI grant shall not be used for procurement of land. The land will not be part of the total project cost. 8. PROJECT FORMULATION: The project proposal shall be formulated with the help of the PMC after conducting a diagnostic study of the requirements of common facility and infrastructure in the specific location and based on demand and potential.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] 9. TECHNOLOGY SELECTION: Regulatory norms to be met by the processing Parks would vary according to the location as well as norms that are specified by the respective State Pollution Control Boards. Consequently, it is recognized that the requirements for Water Supply and Waste Water Treatment would vary from one location to the other in order to meet local guidelines. Proposals under IPDS shall be governed by the norms laid down in the MoEF notification dated 10.10.2016 regarding standards for discharge of effluents from Textile Industry. For project formulation the following must be kept in mind by the SPV / PMC. a) Proposed technology should be based on Best Available Technology (BAT) and should have a proven track record b) The proposed technology along with financial vetting should be vetted by a third party preferably by IIT or TRA. c) The project cost which would be eligible for subsidy should be reasonable for conventional, marine discharge, riverine discharge and ZLD effluent treatment systems All proposals should include a mechanism for managing the waste sludge / salt generated from the system. 10. OPERATION AND MAINTENANCE ARRANGEMENTS: A. Each SPV should appoint an independent Operation and Maintenance agency who will be responsible for operation and maintenance of the water treatment as well as wastewater treatment facility. The PMA can continue as the O&M agency for the facility once the Project implementation and commissioning is completed.A Memorandum of Agreement (MOA) shall be executed between the O&M Agency, SPV and the SPCB with the following terms: (a) CETP shall be managed professionally by the SPV and the O&M operator. (b) Environmental audit shall be linked with financial audit (at the commissioning stage) at the cost of the SPV. (c) The O&M Agency shall be responsible for compliance of inlet quality and flow from the contributing industries and shall provide status of non-complying units to SPCB for action on a monthly basis. (d) The O&M Agency shall monitor specified quality outlet parameters and flow rate on daily basis and submit the monitoring data to the SPCB on regular basis. Parameters to be specified by SPCB shall be monitored by the O&M Agency online at outlet of CETP and real time online IT based linkage shall be provided to the SPCB. The SPCB shall ensure that continuous 24 hour data is displayed on its website. (e) A three tier monitoring mechanism viz. at industry level, monitoring by SPCB and third party monitoring shall be undertaken. (f) A corpus fund with minimum 6 month O&M expenditure shall be maintained at all times by the SPV. B. A legal agreement between the SPV and its member units clearly delineating their relationship and mutual obligations should be executed. The cost recovery formula developed for the CETP project should be ratified by all members. 11. ADMINISTRATIVE EXPENSES:Project administration charges will include administrative/ concurrent monitoring and other miscellaneous expenses. The SPV shall enter into an agreement with the PMA. The Fee for the PMA services and the Administrative expenses would be restricted to 5% of the eligible cost of the Project. 12. ROLE OF AGENCIES: I. STATE GOVERNMENT: The role of the State Government is vital in the sanction and implementation of the project in following areas: (i) ‘In Principle’ approval of the DPR from the State Govt.¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 15 (ii) The project proposal/Detailed Project Report (DPR) must have the recommendation of the State Pollution Control Board and also the consent to establish and Consent to operate the CETP. (iii) Environmental clearance should have been obtained before the project is approved by the Ministry of Textiles, GoI. (iv) State Government must provide grants for a minimum value of 25% of the Project cost. (v) Providing all pre-requisite clearances, wherever needed, for setting upthe plant including assistance for Power, Water and other utilities to the project site. (vi) Assist the SPV in identification and procurement of suitable land. (vii) State Government agencies like Infrastructure/Industry Development Corporations may also participate in the projects by way of subscribing to the equity of SPV. (viii) Providing flexible and conducive labour environment and consider special facilities like exemption of stamp duty etc. for the units located in the ITP. (ix) Dovetailing of other related schemes for overall effectiveness and efficiency of the project. (x) The State Government shall appoint a nodal agency for overseeing the project. (xi) Representative of State Govt. is one of the members of the PSC for selecting viable projects as recommended by the concerned state. State Govt. shall prioritize the proposals received through various SPVs and send it to this Ministry along-with its approval. (xii) Outlet norms for the industry shall be prescribed by SPCB in consent as a necessary condition. SPCBs shall also ensure that the outlet parameters for the individual industry and inlet parameters for CETP are in synergy. II. SPECIAL PURPOSE VEHICLE (SPV):SPV will be the focal point for implementation of the Scheme and play the following role: (i) The SPV will conceptualize, formulate, achieve financial closure, implement andmanage the infrastructure. (ii) The SPV will procure land, cost of which will not be built into the project cost. (iii) SPV will also facilitate securing bank finance required for setting up units in ITP. (iv) SPV will be responsible for maintaining the utilities and infrastructure created for processing park by collecting service and user charges. (v) The SPV has to be so structured as to be self-sustaining with a positive revenue stream. (vi) SPV will appoint contractors/PMA/O&M Agency in a fair and transparent manner. Inorder to ensure timely completion of the project, SPV will obtain appropriate performance guarantee from PMA/contractors. (vii) The SPV will be responsible for obtaining and maintaining statutory licenses and permits required for the various facilities. (viii) The SPV will maintain a comprehensive website and regularly upload pictures of the progress in implementation of the scheme. The website shall be regularly monitored & functional prior to release of each trench of government grant. III. PROJECT MANAGEMENT AGENCY(PMA) (Appointed by the SPV) A PMA will discharge the following functions: (i) Identify the locations for setting up the processing park based on a scientific assessment of the demand and potential of the area. (ii) Facilitate formation of SPV at each project level with the participation of local industry. (iii) Prepare Project Plan including the setting of standards for infrastructure.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] (iv) Structure the projects and submit the same for evaluation and vetting (Technical and financial) by third party preferably by IIT and TRA and appraisal by Project Scrutiny Committee (PSC). (v) Prepare Detailed Project Report (DPR) and getting the same vetted by the Independent Technical Agency and obtain the Environmental clearance from the State Government. The PMA will also ensure that the DPR is thereafter appraised and approved by the PSC and PAC respectively. (vi) Preliminary Design, Engineering and Project Management. (vii) Assist the SPV in selection of agencies for preparation of bid documents and procurement procedure to appoint various contractors. The Tender transparency Act norms are to be followed in selection of the contractors/vendors. (viii) Assist the SPV in achieving financial closure. (ix) Monitor the implementation and submit periodical progress reports to PMC, SPCB and the MoT. (x) Liaise with the State Governments to resolve State-related problems& facilitate clearances. (xi) Ensure timely completion of project(s) as fixed by the PAC. (xii) The PMA will not be permitted to work as a contractor in the implementation of the project. However, the PMA can act as the O&M agency after execution of the project by the contractors. IV. PROJECT MANAGEMENT CONSULTANT (PMC) (Appointed by MOT)- The role of PMC shall be as follows: (i) Evaluation of the proposals and forward the same to PSC for appraisal and recommendation to PAC for final approval. (ii) Scrutiny of claims, including disbursements and utilization of funds, submitted by the SPVs. (iii) Assisting MoT in periodical monitoring of the Project implementation and submit periodical reports to MoT with regard to the progress of the implementation works. (iv) Provide other need based advisory services to the Government in effective implementation of the scheme. (v) The MOT shall enter into an agreement with the PMC and the Fee for PMC services shall be paid by MoT directly to the PMC and this will not form part of the Project cost of the SPVs. V. PROJECT SCRUTINY COMMITTEE (PSC): The project proposals as submitted by SPVs shall be considered and appraised by the Project Scrutiny Committee (PSC) headed by the Joint Secretary, Ministry of Textiles. The other members of the Project Scrutiny Committee shall be as follows: (1) Adviser(Industry), NITI Aayog or his nominee (2) Joint Secretary(PF-II), Department of Expenditure or his nominee (3) Joint Secretary (Infrastructure), Department of Commerce or hisnominee (4) Joint Secretary (IIUS), Department of Industrial Policy & Promotion or his nominee (5) Joint Secretary, Ministry of Environment & Forests or his nominee. (6) Representative from IIT Delhi. (7) Representative from TRAs. (8) Representative from concerned State Govt. (9) Representative from State Pollution Control Board. (10) Representatives from Central Pollution Control Board. (11) Textile Commissioner, Mumbai or his nominee. (12) Economic Advisor, Ministry of Textile. (13) Director/Deputy Secretary, IFW, Ministry of Textiles. (14) Director (Infra-II), Ministry of Textiles (Member Secretary).¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 17 • Project Scrutiny Committee will appraise the entire proposal submitted by SPV/PMA in terms of the project components, viability, feasibility and time lines of each project. The Committee shall look into the utility of the projects in terms of modernization & integration of supply and management chain, and make the final recommendations to Project Approval Committee (PAC). VI. PROJECT APPROVAL COMMITTEE (PAC): There shall be a Project Approval Committee to consider and approve the recommendations of Project Scrutiny Committee headed by Secretary (Textiles), Additional Secretary & Financial Adviser, Ministry of Textiles and Joint Secretary, Ministry of Textiles in charge of IPDS. The PAC will also be vested with discretionary and interpretational powers. VII. Operation and Management (O&M) AGENCY: (i) The O&M agency would be responsible for evaluation of performance guarantee runsfor the water and effluent treatment plants to be demonstrated by the respective EPC contractors as per their contracts with the SPC and takeover of the facilities thereafter. (ii) The O&M agency will be responsible right from the commissioning of the facilities toensure smooth takeover of the facility. The agency will ensure rectification of defects if any by the EPC Contractor before taking over of the facilities. (iii) The O&M agency will be responsible for O&M for a minimum period of 10 years and shall maintain the assets in a professional manner to ensure optimum performance throughout the O&M period. The agency will be responsible for refurbishments andtechnology up-gradation, if required, during the O&M tenure. (iv) The O&M agency shall be responsible for compliance of inlet quality and flow fromthe contributing industries and shall provide status of non-complying units to SPCB for action on monthly basis. (v) The O&M agency shall monitor specified quality outlet parameters and flow rate on daily basis and submit the monitoring data to the SPCB on regular basis. Parameters to be specified by SPCB shall be monitored by the agency online at outlet of CETP and IT based linkage shall be provided by to the SPCB. The SPCB shall ensure that continuous 24 hour data is displayed on its website. (vi) SPV may change the O&M agency, if need be.
