Short title and commencement.- (1) These regulations may be called the Railway Board Secretariat Stenographers' Service Principal Staff Officer Regulations, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Conditions of eligibility.- Eligibility condition for promotion to the post of Principal Staff Officer shall be at least five years‟ approved service in the grade of Senior Principal Private Secretary of Railway Board Secretariat Stenographers' Service on the 1st July of the select list year.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 3. Determination of vacancy.- Regular vacancies for a select list year shall be determined by Ministry of Railways (Railway Board) as per rules and, if selection is to be made for more than one select list year, vacancies shall accordingly be determined for each select list year. 4. Field of selection.- In accordance with the vacancies determined, a field of selection of eligible officials shall be fixed by the Central Government in the Ministry of Railways (Railway Board). 5. Constitution of Selection Committee.- (1) The composition of the Selection Committee to consider the cases of eligible officers for appointment to the post of Principal Staff Officer and to make suitable recommendations, shall comprise Chairman, Railway Board and Chief Executive Officer and two other Members of Railway Board as nominated by Chairman, Railway Board and Chief Executive Officer. (2) The Departmental Promotion Committee shall follow the guidelines or instructions as laid down by the Central Government from time to time. 6. Preparation of panels.- (1) The selection committee shall normally meet every year for selection against vacancies as determined in regulation 3. (2) The selection committee may recommend a panel of names of selected officers arranged in the order of their seniority in the lower grade: Provided that separate panels may be prepared for vacancies of different select list year and if selection for vacancies of any select list year is made on more than one occasion, on every such occasion a panel (part) will be prepared. (3) Vacancy for a select list year which may not be filled up, due to non-availability of suitable or eligible officers would be carried forward to the next select list year and the selection process for the first select list year shall be deemed to have been completed. 7. Appointments to the Principal Staff Officer grade.- (1) Appointments to the grade of Principal Staff Officer shall be made by the appointing authority in the order in which the names of the officers appear in the panel or panel (part) prepared by the Selection Committee. (2) Inclusion in the panel or panel (part) shall not confer any right to appointment to the grade, which will be made only upon availability of regular vacancy. 8. Removal of name from the select list.- The names of the persons of the following categories shall be removed by the Ministry of Railways (Railway Board) from the select list :- (a) Officers transferred to any other service or posts; (b) Officers, who die, retire from service or whose services are otherwise terminated. Constitution of Departmental Promotion Committee.- (1) There shall be a Departmental Promotion Committee consisting of the Chairman of the Union Public Service Commission or, where the Chairman is unable to attend, any other Member of the Commission representing it and other members as follows :- (i) The Chairman or a Member of the Union Public - Chairman; Service Commission (ii) Secretary, Railway Board - Member; (iii) One Executive Director or Joint Secretary, Railway - Member. Board (2) The Departmental Promotion Committee shall follow the guidelines or instructions as laid down by the Central Government from time to time. 6. Preparation of Panels.- (1) The Departmental Promotion Committee shall normally meet every year for selection against vacancies as determined in regulation 3 above. (2) The Departmental Promotion Committee will recommend a panel of names of selected officers assigned in the order of their seniority in the lower grade: Provided that separate panels will be prepared for vacancies of different select list year and if selection for vacancies of any select list year is made on more than one occasion, on every such occasion a panel (part) will be prepared. Short title and commencement:- (1) These regulations may be called the Railway Board Secretariat Stenographers' Service preparation of the panel or panels(part) for the Private Secretary Grade (Seniority Quota) Regulations, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Conditions of eligibility.- Any regular official of the Railway Board Secretariat Stenographers' Service, who on the 1st July of the select list year have rendered not less than five years‟ of approved service in the grade of Personal Assistant, shall be eligible. 3. Determination of vacancy.- Regular vacancies for a select list year shall be determined by the Ministry of Railways (Railway Board) as per rules and if the selection is to be made for more than one select list year, vacancies shall accordingly be determined for each select list year. 4. Fixation of zone of consideration.- In accordance with the vacancies determined, a zone of consideration of eligible officials would be fixed by the Central Government in the Ministry of Railways (Railway Board). 5. कंप्य टू र सािरता: जनजी सजचव ्ेणी म ें प्रोन्‍द नजत के जलए सीजमत जवभागीय प्रजतयोगी परीिा म ें सजम्मजलत होने वाले दकसी वैयजिक सहायक स े सरकार द्वारा समय-समय पर यथा जवजनर्ददष्ट कौिल परीिा सजियमों के साथ कम् प् यटू र पर अपन े आिुजलजप रटप् पणों के प्रजतलेखन की अपेिा होगी। 5. पात्रता के बारे म ें जवजनश्च य.- परीिा के जलए प्रवेि हते ु दकसी अभ् यथी की पात्रता के बारे म ें या उससे अन्‍द यथा आयोग का जवजनश् चय अंजतम होगा और ऐसा कोई अभ् यथी जजसको आयोग द्वारा प्रवेि प्रमाण पत्र जारी नहीं दकया गया ह,ै परीिा म ें सजम्मजलत नहीं होगा। 6. पररणाम.- (1) ऐस े अभ् यर्षथयों के नामों को जजन्‍द ह ें आयोग द्वारा, जवजनयमों के प्रारंभ होने के पश् चात् आयोजजत दकसी परीिा के पररणामों के आधार पर चयन के जलए उपयक्ु त माना गया ह,ै यो्‍ यता के ्रमम म ें और जवजनयम 7 के उपजवजनयम (2) के उपबंधों के अधीन रहते हुए ्‍ यवजस्ट्थत दकया जाएगा और अपेजित सख्ं या तक उस ्रमम म ें चयन के जलए उनकी जसफाररि की जाएगी। (2) आयोग, अनुसूजचत जाजत और अनुसूजचत जनजाजत के अभ् यर्षथयों की दिा म ें अहतड ा का स्ट् तर तब जिजथल कर सकेगा जब इस जनजमत् त केन्‍द रीय सरकार की जव्मान नीजत के अनुसार साधारण स्ट् तर के आधार पर अपेजित संख् या म ें इन समुदायों के अभ् यथी उपलब् ध नहीं होत े ह।ैं (3) प्रत् यके अभ् यथी को परीिा के पररणामों की संसूचना का प्ररूप और रीजत का जवजनश् चय आयोग द्वारा उसके जववेकानुसार दकया जाएगा और आयोग पररणामों के संबंध म ें अभ् यर्षथयों से पथृ क रूप स े कोई पत्राचार नहीं करेगा। 7. चयन और जनयजु िया.ं- (1) परीिा म ें सफलता तब तक चयन का अजधकार प्रदत् त नहीं करेगी जब तक संवग ड अजधकारी का ऐसी जांच करने के पश् चात,् जो वह आवश् यक समझ,े यह समाधान नहीं हो जाता दक अभ् यथी, सेवा म ें उसके आचरण को ध् यान म ेंरखते हुए चयन के जलए सभी प्रकार स े उपयुक् त ह।ै (2) उन जवजनयम (1) के अधीन रहत े हुए सीजमत जवभागीय प्रजतयोजगता परीिा के माध् यम स े भरी जाने वाली जनजी सजचव की ररजियों के जलए कोई जनयुजि सिम प्राजधकारी द्वारा उपजवजनयम (6) के अनुसार तैयार केन्‍द रीय सरकार द्वारा समय समय पर जारी अनुसूजचत जाजत और अनुसूजचत जनजाजत के अभ् यर्षथयों के जलए आरिण के आदिे के अनुसार यो्‍ यता के ्रमम म ें्‍ यवजस्ट्थत सफल अभ् यर्षथयों के पैनल के का दो्ी घोज्त दकया ह ै या दकया जाता ह,ै- (क) दकन्‍द हीं साधनों द्वारा अपनी अभ्य र्षथता के जलए समथनड अजभप्राप् त करना; या (ख) प्रजतरूपण करना; या (ग) दकसी ्‍ यजि द्वारा प्रजतरूपण उपाप् त करना; या (घ) गढा हुआ ऐसा दस्ट् तावे य या ऐसे दस्ट् तावे य प्रस्ट् तुत करना जजससे छेड़छाड़ की गई ह;ै या (ङ) ऐस े कथन करना जो सही नहीं ह ैया जमथ् या ह ैंया ताजत् वक जानकारी को जछपाना; या (च) परीिा के जलए अपनी अभ् यर्षथता के संबंध में दकसी अन्‍द य अजनयजमत या अनुजचत साधन का आ्य लेना; या (छ) परीिा कि म ेंअनुजचत साधनों का उपयोग करना; या (ज) परीिा कि म ेंकदाचार करना; या (झ) पूवडगामी खंडों म ें जवजनर्ददष् ट सभी या Definitions.- (1) In these regulations, unless the context otherwise requires,- (a) „Commission‟ means the Union Public Service Commission;[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 13 (b) “computer literacy” means a person who shall be able to transcribe his shorthand notes on a computer with the skill based norms as specified by the Government from time to time; (c) “crucial date” means the 1st day of July of the select list year for which the examination is held; (d) “examination” means a Limited Departmental Competitive Examination held by the Commission for making additions to the select list of Private Secretary grade; (e) “Scheduled Castes” and “Scheduled Tribes” shall have the same meanings as are assigned to them by clauses (24) and (25) respectively of article 366 of the Constitution; (f) “selection” means inclusion in the select list of Private Secretary grade. (2) All other words and expressions used in these regulations and not defined herein but defined in the Railway Board Secretariat Stenographers' Service Rules, 2021, shall have the meanings respectively assigned to them in the said rules. 3. Holding of the examination.- (1) The examination shall be conducted by the Union Public Service Commission in the manner notified from time to time by the Central Government in the Department of Personnel and Training. (2) The dates on which and the places at which the examination shall be held shall be fixed by the Commission. 4. Conditions of eligibility.- Any regular Personal Assistant of the Railway Board Secretariat Stenographers' Service who possess a bachelor‟s degree from a recognised University, on the crucial date and satisfies the following conditions, shall be eligible to appear at the examination:- (i) Length of Service: He should have rendered not less than three years' of approved and continuous service in the grade: Provided that if he had been appointed to the Personal Assistant Grade of the Railway Board Secretariat Stenographers' Service on the results of the competitive examination including a Limited Departmental Competitive Examination, such an examination should have been held not less than three years before the crucial date and he should have rendered not less than two years approved and continuous service in that grade. (ii) Personal Assistants who are on deputation to ex-cadre posts with the approval of the competent authority shall be eligible to be admitted to the examination, if otherwise eligible: Provided that the Personal Assistant who has been appointed to an ex-cadre post or to another service on 'transfer' and does not have a lien in Personal Assistant shall not be eligible to be admitted to the examination. (iii) Computer Literacy: Any Personal Assistant appearing in the Limited Departmental Competitive Examination for promotion to Private Secretary grade shall be required to transcribe his shorthand notes on computers with the skill test norms as specified by the Government from time to time. 5. Decision as to eligibility.- The decision of the Commission as to the eligibility or otherwise of a candidate for admission to the examination shall be final and no candidate to whom a certificate of admission has not been issued by the Commission shall be admitted to the examination. 6. Results.- (1) The names of the candidates who are considered by the Commission to be suitable for selection on the results of any examination held after the commencement of these regulations shall be arranged in the order of merit and subject to the provisions of sub-regulation (2) of regulation 7, and they shall be recommended for selection in that order upto the required number. (2) The Commission may relax standard of qualification in case of the candidates belonging to the Scheduled Castes and the Scheduled Tribes, in case required number of the candidates from these communities are not available on the basis of general standard as per extant policy of the Central Government in this regard. (3) The form and manner of communication of the results of the examination to the individual candidates shall be decided by the Commission in their discretion and the Commission shall not enter into any correspondence with individual candidates regarding the results.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 7. Selection and appointments.- (1) Success in the examination shall confer no right to selection unless the cadre authority is satisfied, after such enquiry as may be considered necessary, that the candidate, having regard to his conduct in service, is suitable in all respects for selection: (2) Subject to sub-regulation (1) above, any appointment to the vacancies of Private Secretary to be filled through Limited Departmental Competitive Examination shall be made by the competent authority on the basis of the panel of successful candidates to be prepared as per regulation (6) and arranged in order of merit in accordance with the order on reservations for the candidates belonging to the Scheduled Castes and the Scheduled Tribes issued by the Central Government, from time to time. (3) Limited Departmental Competitive Examination vacancies for a select list year which are not filled up due to non-availability of suitable candidates shall be carried forward to the next select list year and the selection process for the first select list year would be deemed to have been completed. 8. Penalty for misconduct.- Any candidate who is or has been declared by the Commission to be guilty of, - (a) obtaining support for his candidature by any means; or (b) impersonating; or (c) procuring impersonation by any person; or (d) submitting fabricated documents or documents which have been tampered with; or (e) making statements which are incorrect or false, or suppressing material information; or (f) resorting to any other irregular or improper means in connection with his candidature for the examination; or (g) using unfair means in the examination hall; or (h) misbehaving in the examination hall; or (i) attempting to commit or, as the case may be, abetting the commission of all or any of the acts specified in the foregoing clauses; may, in addition to rendering himself liable to criminal prosecution, be liable - (i) to be disqualified by the Commission from the examination for which he is a candidate; and/or (ii) to be debarred either permanently or for a specified period - (a) by the Commission, from any examination or selection held by them; (b) by the Central Government from any employment under them; and (iii) to disciplinary action under the appropriate rules. Short title and commencement.- (1) These regulations may be called the Railway Board Secretariat Stenographers‟ Service preparation of the panel or panels (part) for the Personal Assistant grade (Seniority Quota) Regulations, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Conditions of eligibility.- Any regular official of the Railway Board Secretariat Stenographers‟ Service who, on the 1st July of the select list year has rendered not less than ten years‟ of approved service in the grade of Stenographer Grade „D‟, shall be eligible: Provided that eligibility service shall continue to be five years‟ of approved service for officials holding Stenographer Grade „D‟ posts on regular basis before the date of commencement of the said Rules. 3. Determination of vacancy.- Regular vacancies for a select list year shall be determined by the Central Government in the Ministry of Railways (Railway Board) as per rules and if the selection is to be made for more than one select list year, vacancies shall accordingly be determined for each select list year. 4. Fixation of zone of consideration.- In accordance with the vacancies determined, a zone of consideration of eligible officials shall be fixed by the Central Government in the Ministry of Railways (Railway Board). 5. Constitution of Departmental Promotion Committee.- (1) The composition of the Departmental Promotion Committee to be constituted to assess the suitability of eligible officials for appointment to the post of Personal Assistant under seniority quota and to make suitable recommendations, shall be as follows:- (i) Director or Deputy Secretary (Administration) Chairman; (ii) Under Secretary (Administration) Member; (iii) Two other Under Secretaries or Deputy Directors Members. (2) The Departmental Promotion Committee shall follow the guidelines or instructions as laid down by the Central Government from time to time. 6. Preparation of Panels.- (1) The Departmental Promotion Committee shall normally meet on annual basis for consideration of eligible officials for promotion to the grade of Personal Assistant. (2) The cadre authority shall prepare panel or panel (part) of officials from the eligible officials found fit, by arranging the names of officials selected by the Departmental Promotion Committee in the order of their seniority in the lower grade, provided that separate panel or panel (part) shall be prepared for vacancies of different select list years. (3) Vacancy for a select list year which may not be filled up due to non-availability of suitable or eligible officials, shall be carried forward to the next select list year and the selection process for the first select list year shall be deemed to have been completed. 7. Appointment to the Personal Assistant grade.- (1) Appointment to the vacancies of seniority quota in the grade of Personal Assistant shall be made by the competent authority in the order in which the names of the officials appear in the panel or panel (part) prepared by the cadre authority. परीिा म ें सजम्मजलत होने वाले दकसी आिुजलजपक ्ेणी ‘घ’ के जलए कम् प् यूटर पर अपने आिुजलजप रटप् पणों का प्रजतलेखन करना अपेजित होगा। 5. पात्रता के बारे म ें जवजनश्च य.- परीिा के जलए प्रवेि हते ु दकसी अभ् यथी की पात्रता या अन्‍द यथा के बारे म ें कमडचारी चयन आयोग का जवजनश् चय अंजतम होगा और ऐसा कोई अभ् यथी जजसे कमडचारी चयन आयोग द्वारा प्रवेि प्रमाण पत्र जारी नहीं दकया गया ह,ै परीिा म ें प्रवेि नहीं ददया जाएगा। 6. पररणाम.- (1) ऐस े अभ् यर्षथयों के नामों को, जजन्‍द ह ें कमडचारी चयन आयोग द्वारा, इन जवजनयमों के प्रारंभ होन े के पश् चात् आयोजजत दकसी परीिा के पररणामों के आधार पर चयन के जलए उपयुक्त माना गया ह,ै यो्‍ यता के ्रमम म ें और जवजनयम 7 के उपजवजनयम (2) के उपबंधों के अधीन रहत े हुए ्‍ यवजस्ट्थत दकया जाएगा और जवजनजित की गई जनयुजियों की संख् या तक उस ्रमम म ें चयन के जलए उनकी जसफाररि की जाएगी। (2) कमडचारी चयन आयोग, यदद इस जव्य में केन्‍द रीय सरकार की जव्मान नीजत के अनुसार साधारण स्ट्त र के आधार पर अपेजित संख् या म ें इन समुदायों के अभ् यथी उपलब् ध नहीं होत े तो वह अनुसूजचत जाजत और अनुसूजचत जनजाजत से संबंजधत अभ् यर्षथयों की दिा म ेंअहतड ा के स्ट् तर को जिजथल कर सकेगा। (3) अभ् यर्षथयों को ्‍ यजिगत रूप स े परीिा के पररणामों की संसूचना का प्ररूप और रीजत का जवजनश् चय कमडचारी चयन आयोग द्वारा उसके जववेकानुसार दकया जाएगा और आयोग पररणामों के संबंध म ें अभ्य र्षथयों स े पृथक रूप स े कोई पत्राचार नहीं करेगा। 7. चयन और जनयजु िया ं (1) परीिा म ें सफलता, सेवा के वैयजिक सहायक के जलए चयन सचू ी में सजम्मजलत करन े हते ु, अजधकार तब तक प्रदत् त नहीं करेगी जब तक संवग ड प्राजधकारी का, ऐसी जांच करन े के पश् चात ् जो वह आवश् यक समझ,े यह समाधान नहीं हो जाता दक अभ् यथी, सेवा म ें उसके आचरण को ध् यान म ें रखत े हुए चयन के जलए सभी प्रकार स े उपयुक् त ह।ै (2) उपरोक्त उप जवजनयम (1) के अधीन रहत े हुए, सीजमत जवभागीय प्रजतयोजगता परीिा के माध् यम स े भरी जाने वाली वैयजिक सहायक की ररजियों के जलए कोई जनयुजि सिम प्राजधकारी द्वारा जवजनयम (6) के अनुसार तैयार की जान े वाली केन्‍द रीय सरकार द्वारा समय समय पर जारी इस जनजमत् त अनुसूजचत जाजत और अनुसूजचत जनजाजत के अभ् यर्षथयों के जलए आरिण के आदेि के अनुसार यो्‍ यता के ्रमम म ें व य् वजस्ट्थत सफल अभ् यर्षथयों के पैनल के आधार पर की जाएगी। (3) दकसी चयन सूची व् ड के सीजमत जवभागीय प्रजतयोजगता परीिा की ऐसी ररजिया,ं जो उपयुक् त अभ् यर्षथयों की अनुपलब्ध ता के कारण भरी नहीं गई ह,ैं अगल े चयन सचू ी व्ड के जलए अग्रनीत कर दी जाएंगी और प्रथम चयन सूची व्ड के जलए चयन प्रद्रमया को पूणड हुआ समझा जाएगा। 8. अवचार के जलए िाजस्ट्त.- कोई अभ् यथी जजस,े कमडचारी चयन आयोग द्वारा जनम्न जलजखत का दो्ी घोज्त दकया जाता ह ै और दकया गया ह,ै- (क) दकन्‍द हीं साधनों द्वारा अपनी अभ्य र्षथता के जलए समथनड अजभप्राप् त करना; या (ख) प्रजतरूपण करना; या (ग) दकसी ्‍ यजि द्वारा प्रजतरूपण उपाप् त Definitions.- (1) In these regulations, unless the context otherwise requires, - (a) “computer literacy” means a person who shall be able to transcribe his shorthand notes on a computer with the skill test norms as specified by the Government from time to time; (b) “crucial date” means the 1st day of July of the select list year for which the examination is held; (c) “examination” means a Limited Departmental Competitive Examination held by the Staff Selection Commission for making additions to the select list for Personal Assistant Grade of the Service; (d) “regularly appointed Stenographer Grade D” means a person appointed to the grade in accordance with the modes of the recruitment provided in the Railway Board Secretariat Stenographers‟ Service Rules, 2021.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (e) “Scheduled Castes” and “Scheduled Tribes” shall have the meanings assigned to them in clause (24) and clause (25), respectively of article 366 of the Constitution; (f) “selection” means inclusion in the select list for the Personal Assistant grade of the Service. (2) All other words and expressions used in these regulations and not defined herein but defined in the Railway Board Secretariat Stenographers‟ Service Rules, 2021, shall have the meanings respectively assigned to them in the said Rules. 3. Holding of the examination.- (1) The examination shall be conducted by the Staff Selection Commission in the manner notified from time to time by the Central Government in the Department of Personnel and Training. (2) The dates on which and the places at which the examination shall be held shall be fixed by the Staff Selection Commission. 4. Conditions of eligibility.- (1) Any regularly appointed Stenographer Grade „D‟ of the Service who satisfies the following conditions shall be eligible to appear at the examination:- (a) Length of service: He should have on the crucial date, rendered not less than six years‟ approved service as Stenographer Grade „D‟. Note.- Stenographers Grade „D‟ who are on deputation to ex-cadre posts with the approval of the competent authority, and those having a lien in Stenographer Grade „D‟ of the Service will be eligible to be admitted to the examination, if otherwise eligible: Provided that if the official had been appointed to Stenographer Grade „D‟ of the Railway Board Secretariat Stenographers‟ Service on the results of the Competitive Examination, including a Limited Departmental Competitive Examination, the results of such examination should have been announced not less than six years before the crucial date and the officer should have rendered not less than five years‟ approved and continuous service in that grade: Provided further that eligibility service shall continue to be three years‟ of approved service for officials holding Stenographer Grade „D‟ posts on regular basis before the date of commencement of the Rules. (b) Computer Literacy: Any Stenographer Grade „D‟ appearing in the Limited Departmental Competitive Examination for promotion to Personal Assistant shall be required to transcribe his shorthand notes on computers. 5. Decision as to eligibility of a candidate.- The decision of the Staff Selection Commission as to the eligibility or otherwise of a candidate for admission to the examination shall be final and no candidate to whom a certificate of admission has not been issued by the Staff Selection Commission shall be admitted to the examination. 6. Results.- (1) The names of the candidates who are considered by the Staff Selection Commission to be suitable for selection on the results of the examination shall be arranged in the order of merit and, subject to the provisions of sub-regulation (2) of regulation 7, they shall be recommended for selection in that order upto the number of appointments decided to be made. (2) The Staff Selection Commission may relax standard of qualification in case of the candidates belonging to the Scheduled Castes and the Scheduled Tribes, in case required number of the candidates from these communities are not available on the basis of general standard as per extant policy of Central Government in this regard. (3) The form and manner of communication of the results of the examination to the individual candidates shall be decided by the Staff Selection Commission in their discretion and the said Commission shall not enter into any correspondence with individual candidates regarding the results. 7. Selection and appointments.- (1) Success in the examination shall confer no right to selection for inclusion in the select list for the Personal Assistant of the Service unless the cadre authority is satisfied, after such enquiry as may be considered necessary, that the candidate, having regard to his conduct in service, is suitable in all respects for selection.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 21 (2) Subject to sub-regulation (1) above, appointment to the vacancies of Personal Assistant to be filled through Limited Departmental Competitive Examination shall be made by the competent authority on the basis of the panel of successful candidates to be prepared as per regulation (6) and arranged in order of merit, subject to the reservations for the candidates belonging to the Scheduled Castes and the Scheduled Tribes in accordance with the orders issued by the Central Government from time to time, in this behalf. (3) Limited Departmental Competitive Examination vacancies for a select list year which are not filled up due to non-availability of suitable candidates shall be carried forward to the next select list year and the selection process for the first select list year would be deemed to have been completed. 8. Penalty for misconduct.- Any candidate who is or has been declared by the Staff Selection Commission to be guilty of,- (a) obtaining support for his candidature by any means; or (b) impersonating; or (c) procuring impersonation by any person; or (d) submitting fabricated documents or documents which have been tampered with; or (e) making statements which are incorrect or false, or suppressing material information; or (f) resorting to any other irregular or improper means in connection with his candidature for the examination; or (g) using unfair means in the examination hall; or (h) misbehaving in the examination hall; or (i) attempting to commit, or as the case may be, abetting the commission of all or any of the acts specified in the foregoing clauses; may, in addition to rendering himself liable to criminal prosecution, be liable - (i) to be disqualified by the Staff Selection Commission from the examination for which he is a candidate; and/or (ii) to be debarred either permanently or for a specified period- (a) by the Staff Selection Commission from any examination or selection held by them; and/or (b) by the Central Government from any employment under them; and (iii) to disciplinary action under the appropriate rules. या (ख) उसे व्यजियों के ऐसे प्रवगगों स े संबंजधत होना चाजहए जो केंरीय सरकार म ें कार्षमक, लोक जिकायत और पेंिन मंत्रालय के कार्षमक और प्रजििण जवभाग द्वारा-समय समय पर इस जनजमत्त अजधसूजचत दकया जा सके। (ii) आय ु : वह 18 व् ड की आय ु प्राप्त कर चुका हो और उस व् ड जजसम ें परीिा आयोजजत की गई ह,ै के 1 अगस्ट्त को 27 व्ड की आयु प्राप्त नहीं करनी चाजहए: परंतु केंरीय सरकार द्वारा समय-समय पर जारी आदेिों के अनुसार अनुसूजचत जाजतयों, अनुसूजचत जनजाजतयों और व्यजियों के अन्‍दय जविे् प्रवगगों के अभ्यर्षथयों की दिा म ें ऊपरी आय ु सीमा म ें जिजथलता दी जा सकेगी।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 23 (iii) िजै िक अहतड ाए ं : वह दकसी केंरीय अजधजनयम या प्रातं ीय अजधजनयम या राज्य अजधजनयम के द्वारा या उसके अधीन स्ट्थाजपत जनगजमत दकसी बोड ड या जविजव्ालय की 10+2 परीिा अवश्य उत्तीण ड हो, या अन्‍दयथा केंरीय सरकार द्वारा इसके समतुल्य मान्‍दयता प्राप्त कोई अन्‍दय अहतड ा रखता जो; और (iv) कंप्यटू र सािरता – आिुजलजपक ्ेणी ‘घ’ परीिा म ें सजम्मजलत अभ्यर्षथयों को कंप्यूटर पर अपने आिुजलजपक रटप्पण के प्रजतलेखन की अपेिा होगी। (v) फीस – ऐसी ररयायतों की छूटों के अध्यधीन जो समय-समय पर भारत सरकार म ें कार्षमक, लोक जिकायत और पेंिन मंत्रालय के कार्षमक और प्रजििण जवभाग द्वारा इस जनजमत्त अजधसूजचत की जा सकें, अभ्यथी कमडचारी चयन आयोग द्वारा जवजनर्ददष्ट ऐसी फीस का संदाय करेगा। 5. पात्रता के बारे म ें जवजनिय - परीिा म ें प्रवेि के जलए दकसी अभ्यथी की पात्रता या अन्‍दयथा के बारे म ें कमडचारी चयन आयोग का जवजनिय अंजतम होगा और कोई ऐसा अभ्यथी जजसका प्रवेि प्रमाणपत्र कमडचारी चयन आयोग द्वारा नहीं जारी दकया गया ह,ै परीिा म ें सजम्मजलत नहीं होगा। 6. पररणाम - (1) ऐस े अभ्यथी के नाम जजन पर कमडचारी चयन आयोग द्वारा परीिा के पररणामों पर जनयुजि के जलए उपयुि होने के जलए जवचार दकया जाता ह,ै उन्‍दह ें यो्‍यता के ्रमम म ेंव्यवजस्ट्थत दकया जाएगा और जवजनयम 7 के उपजवजनयम (5) के खंड (क) और (ख) के उपबंधों के अध्यधीन तथा उनकी जनयुजियों के जलए उस ्रमम म ें जवजनजित की गई जनयुजियों की संख्या तक जसफाररि की जाएगी। (2) व्यजष्ट अभ्यर्षथयों को परीिा के पररणामों की संसूचना का प्रारूप और रीजत को कमडचारी चयन आयोग द्वारा उनके जववेकानुसार जवजनजित दकया जाएगा जो पररणामों के संबंध म ें व्यजष्ट अभ्यर्षथयों स े कोई पत्र व्यवहार नहीं करेगा। 7. जनयजु िया ं - (1) परीिा म ें सफलता, सेवा के आिुजलजपक समूह ‘घ’ म ें जनयुजि के जलए कोई अजधकार प्रदत्त नहीं करेगी जब तक दक केंरीय सरकार का रेल मंत्रालय (रेलवे बोडड) ऐसी जााँच के पिात ् जजसे वह आवश्यक समझे समाधान नहीं हो जाता ह ै दक अभ्यथी सेवा म ें अपनी जनयुजि के जलए अपन े चररत्र और पूवडवृत्त को ध्यान म ें रखते हुए सभी प्रकार स े उपयुि ह।ै (2) कोई अभ्यथी सेवा के ्ेणी ‘घ’ म ें तब तक जनयुि नहीं दकया जाएगा जब तक दक वह ऐसी जचदकत्सीय जााँच जजसे केंरीय सरकार का रेल मंत्रालय (रेलवे बोड)ड जवजहत कर सके, के पिात ् दकसी मानजसक या िारीररक त्रुरट स े मुि पाया गया हो जजससे सेवा के कत्तडव्यों के जनवडहन म ें व्यवधान उत्पि होने की संभावना हो। (3) वह व्यजि, - (क) जजसने ऐसे व्यजि से जजसका पजत या पत्नी जीजवत ह,ैं जववाह दकया ह;ै या (ख) जजसने अपन े पजत या पत्नी के जीजवत रहत ेहुए दकसी व्यजि स े जववाह दकया ह,ै उि पद पर जनयुजि का पात्र नहीं होगा ; परंत ु यदद केंर सरकार को रेल मंत्रालय (रेलवे बोडड) का यह समाधान हो जाता ह ैदक ऐसा जववाह ऐस े व्यजि और जववाह के अन्‍दय पिकार को लाग ू स्ट्वीय जवजध के अधीन अनुज्ञये ह,ै तो वह दकसी व्यजि को इस जनयम के प्रवतडन स े छूट द े सकेगी। (4) उपजवजनयम (5) में यथा उपबंजधत के जसवाय, केंरीय सरकार म ें कार्षमक लोक जिकायत और पेंिन मंत्रालय के कार्षमक और प्रजििण जवभाग द्वारा समय-समय पर जारी आदेिों के अनुसार अनुसूजचत जाजतयों, अनुसूजचत जनजाजतयों, अन्‍दय जपछड़ा वगड, आर्षथक रूप से कम योर वगगों स े संबंजधत अभ्यर्षथयों और भूतपूव ड सैजनकों के अभ्यर्षथयों के जलए आरिणों के अध्यधीन, जनयुजि के जलए कमडचारी चयन चयन आयोग द्वारा जसफाररि की गए अभ्यर्षथयों की यो्‍यता के ्रमम म ें दकसी परीिा के पररणामों पर सेवा के ्ेणी ‘घ’ पर जनयुजियों को उपलब्ध ररजियों की सीमा तक दकया जाएगा। (5) (क) दकसी अनुसूजचत जाजत, अनुसूजचत जनजाजत, अन्‍दय जपछड़ा वगड अथवा आर्षथक रूप स े कम योर वगड के अभ्यर्षथयों के संबंध में उस सीमा तक जजस तक अनुसूजचत जाजतयों, अनुसूजचत जनजाजतयों, अन्‍दय जपछड़ा वगगों या आर्षथक रूप से कम योर वगगों दक जलए आरजित ररजियों की संख्या को साधारण मानक के आधार पर नहीं भरा जा24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] सकता ह,ै परीिा म ें यो्‍यता के ्रमम म ें उनके रैंको पर ध्यान ददए जबना सेवा म ें चयन के जलए इन अभ्यर्षथयों की उपयुिता के अधीन रहत े हुए कमडचारी चयन आयोग द्वारा आरजित कोटा म ें कमी को पूरा करन े के जलए जिजथल दकए गए मानक के आधार पर जसफाररि की जाएगी। (ख) भूतपूव ड सैजनक जजन पर परीिा के पररणामों पर जनयुजि के जलए कमडचारी चयन आयोग द्वारा जवचार दकया जाता ह,ै परीिा पर यो्‍यता के ्रमम म ें उनके रैंक को ध्यान ददए जबना उनके जलए आरजित ररजियों पर वे जनयुजि के पात्र होंग:े परंत ु दकसी अनुसूजचत जाजत, अनुसूजचत जनजाजत, अन्‍दय जपछड़ा वगगों के भूतपूव ड सैजनकों के संबंध म ें उस सीमा तक जजस तक अनुसूजचत जाजतयों, अनुसूजचत जनजाजतयों, अन्‍दय जपछड़ा वग ड के जलए आरजित ररजियों को साधारण मानक के आधार पर नहीं भरा जा सकता ह,ै परीिा म ें यो्‍यता के ्रमम म ें उनके रैंको पर ध्यान ददए जबना सेवा म ें चयन के जलए इन भूतपूव डसैजनकों की उपयुिता के अधीन रहते हुए कमडचारी चयन आयोग द्वारा आरजित कोटा म ेंकमी को पूरा करन े के जलए जिजथल की गए मानक के आधार पर जसफाररि की जा सकेगी: परंत ु यह दक दकसी एक भती व्ड म ें अनुसूजचत जाजतयों, अनुसजू चत जनजाजतयों, अन्‍दय जपछड़ा वग,ड आर्षथक रूप से कम योर वगड और भूतपूव ड सैजनकों के जलए आरजित ररजियों की कुल संख्या उस व्ड म ें भारी जाने वाली ररजियों के 50 प्रजतित स ेअजधक नहीं होगी। 8. अवचार के जलए िाजस्ट्त - कोई अभ्यथी जजसे आयोग द्वारा जनम्नजलजखत का दो्ी घोज्त दकया जाता ह ै या दकया गया ह-ै (क) दकन्‍दहीं साधनों द्वारा अपनी अभ्यर्षथता के जलए समथडन अजभप्राप्त करना ; या (ख) प्रजतरूपण करना ; या (ग) दकसी व्यजि द्वारा प्रजतरूपण उपाप्त करना; (घ) गढा हुआ ऐसा दस्ट्तावे य या ऐसे दस्ट्तावे य प्रस्ट्तुत करना जजससे छेड़छाड़ की गई ह;ै या (ड) ऐसे कथन करना जो सही नहीं ह ैंया जमथ्या हैं या ताजत्वक जानकारी को जछपाना; या (च) परीिा के जलए अपनी अभ्यर्षथता के संबंध में दकसी अन्‍दय अजनयजमत या अनुजचत साधन का आ्य लेना ; या (छ) परीिा भवन में अनुजचत साधनों का उपयोग करना ; या (ज) परीिा भवन में कदाचार करना ; या (झ) पूवाडगामी खंडों म ें जवजनर्ददष्ट सभी या उनम ें से दकन्‍दहीं कृत्यों को करन े का प्रयास करना या करन े के जलए दष्ु प्रेररत करना, वह आपराजधक अजभयोजन का दायी होने के अजतररि - (i) कमडचारी चयन आयोग द्वारा उस परीिा से जनरर्षहत होने का दायी होगा/होगी जजसका/जजसकी वह अभ्यथी ह;ै और/या (ii) स्ट्थायी रूप स े या दकसी जवजनर्ददष्ट अवजध के जलए - (क) कमडचारी चयन आयोग द्वारा, उसके द्वारा आयोजजत दकसी परीिा या चयन से वर्षजत होने का दायी होगा/होगी ; Short Title and Commencement.- (1) These regulations may be called the Railway Board Secretariat Stenographers‟ Service Grade „D‟ (Competitive Examination) Regulations, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.- (1) In these regulations, unless the context otherwise requires,- (a) “available vacancies” means the vacancies of Stenographer Grade „D‟ of the Service which are decided to be filled on the results of an examination; (b) “Commission” means the Staff Selection Commission; (c) “computer literacy” means a person shall be able to transcribe his shorthand notes on a computer with the skill test norms as specified by the Government from time to time; (d) “examination” means a competitive examination held by the Staff Selection Commission for direct recruitment to Stenographer Grade „D‟ of the Service in accordance with these regulations; (e) “ex-serviceman” means a person who has served in any rank (whether as a combatant or not) in the Armed Forces of the Union for a continuous period of not less than six months and who has been released otherwise than by way of dismissal or discharge on account of misconduct or inefficiency, or has been transferred to the reserve pending such release, or has to serve for not more than six months for completing the period of service requisite for becoming entitled to be released or transferred to the reserve as aforesaid. EXPLANATION.- For the purpose of this clause, “Armed Forces of the Union” means the Naval, Military or Air Force of the Union and includes the Armed Forces of the former Indian States; (f) “Scheduled Castes” and “Scheduled Tribes” shall have the meanings assigned to them by clauses (24) and (25), respectively of article 366 of the Constitution. (2) All other words and expressions used in these regulations and not defined herein shall have the meanings respectively assigned to them in the Railway Board Secretariat Stenographers‟ Service Rules, 2021. 3. Conditions of eligibility.- In order to be eligible to compete at the examination, a candidate must satisfy the following conditions, namely:- (i) Nationality: (a) he must be a citizen of India; or26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (b) he must belong to such categories of persons as may from time to time, be notified in this behalf by the Central Government in the Department of Personnel and Training in the Ministry of Personnel, Public Grievances and Pensions; (ii) Age : He must have attained the age of 18 years and must not have attained the age of 27 years on the 1st day of August of the year in which the examination is held : Provided that the upper age limit may be relaxed in the case of the candidates belonging to the Scheduled Castes, the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time; (iii) Educational qualifications : He must have passed the 10+2 Examination of a Board or University established or incorporated by or under Central Act or a Provincial Act or a State Act or otherwise possess any qualification recognized by the Central Government as equivalent thereto; (iv) Computer literacy : Candidates appearing in the Stenographer Grade „D‟ Examination shall require to transcribe their shorthand notes on computers; (v) Fees : Subject to such exemptions or concessions or both, as may be notified in this behalf by the Government of India in the Department of Personnel and Training, Ministry of Personnel, Public Grievances and Pensions from time to time, the candidate shall pay such fees as specified by the Staff Selection Commission. 5. Decision as to eligibility.- The decision of the Staff Selection Commission as to the eligibility or otherwise of a candidate for admission to the examination shall be final and no candidate to whom a certificate of admission has not been issued by the Staff Selection Commission shall be admitted to the examination. 6. Results.- (1) The names of the candidates who are considered by the Staff Selection Commission to be suitable for appointment on the results of examination shall be arranged in the order of merit and subject to the provision of clauses (a) and (b) of sub-regulation (5) of regulation 7, and they shall be recommended for appointment in that order upto the number of appointments decided to be made. (2) The form and manner of communication of the results of the examination to individual candidates shall be decided by the Staff Selection Commission in its discretion and the Staff Selection Commission shall not enter into any correspondence with the individual candidates regarding the results. 7. Appointments.- (1) Success at the examination shall confer no right to appointment to the Stenographer Grade „D‟ of the Service unless the Central Government in the Ministry of Railways (Railway Board) is satisfied after such enquiry as may be considered necessary, that the candidate, having regard to his character and antecedents, is suitable in all respects, for appointment to the Service. (2) No candidate shall be appointed to Grade „D‟ of the Service unless he is, after such medical examination as the Central Government in the Ministry of Railways (Railway Board) may prescribe, found to be free from any mental or physical defect which is likely to interfere with the discharge of the duties of the Service. (3) No person, - (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the Service: Provided that the Central Government in the Ministry of Railways (Railway Board) may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing exempt any person from the operation of these regulations.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 27 (4) Save as provided in sub-regulation (5), appointments to Grade „D‟ of the Service on the results of any examination shall be made to the extent of the available vacancies, in the order of merit of the candidates recommended by the Staff Selection Commission for appointment, subject to the reservations for the candidates belonging to the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Economically Weaker Section and for the ex-Servicemen in accordance with the orders issued from time to time by the Central Government in the Department of Personnel and Training in the Ministry of Personnel, Public Grievances and Pensions in this behalf. (5) (a) Candidates belonging to any of the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes or the Economically Weaker Section may, to the extent the number of vacancies reserved for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes and the Economically Weaker Section cannot be filled on the basis of general standard, be recommended by the Staff Selection Commission by a relaxed standard to make up the deficiency in the reserved quota, subject to the fitness of these candidates for selection to the Service, irrespective of their ranks in the order of merit at the examination. (b) Ex-servicemen who are considered by the Staff Selection Commission to be suitable for appointment on the results of the examination shall be eligible to be appointed to the vacancies reserved for them irrespective of their ranks in the order of merit at the examination: Provided that ex-servicemen belonging to any of the Scheduled Castes, the Scheduled Tribes or Other Backward Classes may, to the extent the number of vacancies reserved for the Scheduled Castes, the Scheduled Tribes or the Other Backward Classes cannot be filled on the basis of the general standard, be recommended by the Staff Selection Commission by a relaxed standard to make up the deficiency in the quota reserved for them out of the quota of vacancies reserved for ex-servicemen, subject to the fitness of these candidates for selection to the Service irrespective of their ranks in the order of merit at the examination: Provided further that in any one recruitment year, the total number of the vacancies reserved for, the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes and ex- servicemen taken together shall not exceed 50% of the vacancies to be filled in that year. 8. Penalty for misconduct.- Any candidate who is or has been declared by the Staff Selection Commission to be guilty of, - (a) obtaining support for his candidature by any person; or (b) impersonating; or (c) procuring impersonation by any person; or (d) submitting fabricated documents or documents which have been tampered with; or (e) making statements which are incorrect or false, or suppressing material information; or (f) resorting to any other irregular or improper means in connection with his candidature for the examination; or (g) using unfair means in the examination hall; or (h) misbehaving in the examination hall; or (i) attempting to commit or, as the case may be, abetting the commission of all or any of the acts specified in the foregoing clauses, may, in addition to rendering himself liable to criminal prosecution, be liable- (i) to be disqualified by the Staff Selection Commission from the examination for which he is a candidate; and/or (ii) to be debarred either permanently or for a specified period- (a) by the Staff Selection Commission from any examination or selection held by them; and/or (b) by the Central Government from any employment under them; and28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) if he is already in service under the Central Government, to disciplinary action under the appropriate rules. संख् या ऐसी वास्ट् तजवक ररजियों तक सीजमत हो जाएगी और उस दिा में जजन्‍द हें चयन सूची में सजम्मजलत नहीं दकया गया है, पश् चातव्ी व्गों के जलए नए जसरे से जवचार दकया जाएगा। (3) यदद चयन सूची व् ड के जलए दकसी ्ेणी हते ु केवल भाग पैनल उपलब् ध होत े ह ैं तो अनंजतम चयन सूची को उपरोक्त उपजवजनयम (2) के अनुसार ज्य ेष्ठ ता के जसद्ांतों का अनुसरण करके उपलब् ध भाग पैनल को जमलाकर तैयार की जाएगी।[भाग II—खण् ड सहायक ्ेजणयों के जलए यथाजस्ट्थजत चयन सूची या अनंजतम चयन सूची, प्रोन्‍द नजत पनै ल और सीजमत जवभागीय परीिा पैनल म ें सजम्मजलत अजधकाररयों के नाम अंतवदेशजित करके भती व् ड के अंत म ें इस ्रमम म ें तैयार की जाएगी जजसमें वे जनजी सजचव के जलए 2:1 और वैयजिक सहायक ्ेणी के जलए 1:1 अनुपात में उस चयन सूची व्ड के जलए सुसंगत पनै ल में आ जाएं। परंत ु ऊपर वर्षणत प्रत् येक प्रवगड स े ्‍ यजियों का च्रमानु्रमम केवल दकसी जनर्ददष् ट प्रवग ड के उपलब् ध ्‍ यजियों की सीमा तक ही जलया जाएगा और तत्प श् चात् अन्‍दय प्रवगड के ्‍ यजियों को सामूजहक रूप स े सजम्मजलत दकया जाएगा। परंतु प्रत् येक पैनल स े चयन सूची में सजम्मजलत ड के जलए अंजतम रूप ददया गया ह,ै का पुनर्षवलोकन दकया जाएगा और सभी अजधकाररयों के नाम जो ्ेणी म ें अब सेवा में नहीं ह ैं और जजनका उस ्णे ी म ें दकसी पद पर धारणाजधकार नहीं ह,ै को हटा ददया जाएगा। (ख) उन अजधकाररयों के नाम जजन्‍दह ोंने जपछल े भती व् ड के दौरान जनयजमत आधार पर पदग्रहण दकया है, ज्य ष्े ठ ता सूची म ें उस ्रमम में जोड़ा जाएगा जजसमें जवजनयम 7 के उप जवजनयम (2) के अधीन तैयार रूप से चयन पनै ल अजं तम रूप दने ा.- (1) ज य् ेष् ठता सूची का प्रारूप जजसे जवजनयम 4, 5 और 6 के अनुसार तैयार दकया गया ह,ै आिेप, यदद कोई हो, आमंजत्रत करन े के जलए रेलवे बोडड की वेबसाइट में डाला जाएगा। (2) प्रारूप ज्य ष्े ठ ता सूची के प्रकािन के 30 ददन के भीतर प्राप् त आिेप सिम प्राजधकारी द्वारा जवजनजित दकए जाएंगे और पुनरीिण, यदद कोई हों, करन े के पश् चात ् 30 ददन के भीतर अंजतम ज्य ेष्ठ ता सूची तैयार की जाएगी। (3) अंजतम ज्य ष्े ठ ता सूची का उपांतरण उन मामलों के जसवाय जहां सिम न्‍द यायालय या अजधकरण के दकसी आदेि को द्रमयाजन्‍दवत करना अपेजित ह ै या उस दिा में जब जनजी सजचव या वैयजिक सहायक ्ेजणयों के जलए सीजमत जवभागीय प्रजतयोजगता परीिा हते ु संघ लोक सेवा आयोग या कमडचारी चयन आयोग स े अनुपूरक चयन सूची प्राप् त होती ह,ै नहीं दकया जाएगा और ऐसा उपांतरण उपरोक्त ब् यौरेवार, अंजतम ज्य ष्े ठ ता सूची/प्रारूप को तैयार Central Government in the Ministry of Railways hereby makes the following regulations, namely:- 1. Short title and commencement:- (1) These regulations may be called the Railway Board Secretariat Stenographers' Service (Preparation of Seniority List) Regulations, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.- (1) In these regulations, unless the context otherwise requires,- (a) „seniority list‟ in relation to any grade means the seniority list of officers working in that grade as on the 1st July of any year and revised in accordance with these regulations; (b) „competitive examination‟ in relation to Stenographer Grade „D‟ of the service, means the competitive examination other than Departmental Competitive Examination, held by the Staff Selection Commission for direct recruitment to the grade; (c) „rules‟ means Railway Board Secretariat Stenographers' Service Rules, 2021. (2) Words and expressions used in these regulations and not defined but defined in the Railway Board Secretariat Stenographers' Service Rules, 2021 shall have the meanings respectively assigned to them in the rules. 3. Seniority list.- A seniority list shall be prepared as on the 1st July every year for each grade of the Service to determine the inter-se seniority of all officers/officials serving in that grade as per procedure specified in regulations 4, 5 and 6 and the seniority list may be updated every year as on the 1st July of that year. 4. Preparation of seniority list for Principal Staff Officer, Senior Principal Private Secretary and Principal Private Secretary grade.- (1) Preparation of panel.- The promotion panel for each grade for a select list year shall be as prepared by the selection committee, and if more than one part panel is prepared for completion of the selection process of a select list year, all such part panels will be merged, by including the names of officers in the order in which they appear in the seniority list for the lower grade, to prepare the panel for that select list year. 2) Select list.- The select list for any year will be prepared at the end of that recruitment year by including names of officers included in the panel in the order in which they appear in the panel subject to the condition that if more names are included in the panel than the actual vacancies that actually occurred for that year the total number of officers in the select list will be limited to such actual vacancies and in that event, officers who are not included in the select list will be considered afresh for selection for subsequent years. (3) If only part panels are available for a grade, for a select list year, a provisional select list will be prepared by merging the available part panels following the principle of seniority as in sub- regulation (2) above. (4) The seniority list for the grade as finalized for the previous year shall be reviewed and names of all officers who are no longer serving in the grade and who have no lien on any post in that grade will be removed. (5) Names of the officers who have joined the grade on a regular basis during the previous recruitment year will be added to the common seniority list in the order in which their names appear in the select list for that grade, provided that the names of officers included in select list of an earlier year will be senior to the officers whose names are included in select list for a later year and further provided that names of officers whose names are included in a provisional select list will be included in the seniority list on a provisional basis. Preparation of seniority list for Private Secretary and Personal Assistant grades.- (1) Preparation of panel.- (a) The seniority quota panels for Private Secretary and Personal Assistant grades for a select list year shall be prepared, as per Railway Board Secretariat Stenographers' Service Preparation of the panel or panels(part) for the Private Secretary Grade(Seniority Quota) Regulations, 2021, and Railway Board Secretariat Stenographers' Service Preparation of the panel or panels(part) for the Personal Assistant Grade (Seniority Quota) Regulations, 2021 respectively and if more than one part panel is prepared for completion of the selection process of a select list year, all such part panels will be merged, by including the names of officers in the order in which they appear in the seniority list in the respective feeder grade, to prepare the panel for that select list year. (b) The Limited Departmental Competitive Examination panel for Private Secretary grade and Personal Assistant grade for a select list year shall be prepared as per sub- regulation (2) of regulation 7 of Railway Board Secretariat Stenographers' Service Private Secretary (Limited Departmental Competitive Examination Quota) Regulations, 2021 and sub-regulation (2) of regulation 7 of Railway Board Secretariat Stenographers' Service Personal Assistant Grade (Limited Departmental Competitive Examination Quota) Regulations, 2021 respectively. (2) Select lists.- Select list or provisional select list, as the case may be, shall be prepared for Private Secretary and Personal Assistant grades at the end of the recruitment year by interpolating the names of officers included in the seniority quota panel and Limited Departmental Competitive Examination panel, in the order in which they appear in the relevant panel, for that select list year, in the ratio of 2:1 for Private Secretary and 1:1 for Personal Assistant grade: Provided that the rotation of persons from each of the category stated above shall be taken only to the extent of the available persons from any of the stated category and persons from the other category shall, thereafter, be included enbloc: Provided that number of officers to be included in the select list from each of the panels will be restricted to the actual vacancies for that mode of recruitment for that select list year: Provided further that if selection process has not been completed for both the seniority quota and Limited Departmental Competitive Examination modes a provisional select list will be prepared. (3) The seniority list for the grade as finalized for the previous year shall be reviewed and names of all officers who are no longer serving in the grade and who have no lien on any post in that grade will be removed. (4) Names of officers who have joined the grade on a regular basis during the previous recruitment year will be added to the seniority list in the order in which their names appear in the select list for that grade: Provided that the officers included in the select list of an earlier year will be senior to the officers whose names are included in select list for a later year: Provided further that the names of the officers whose names are included in a provisional select list will be included in the seniority list on a provisional basis. (5) Names of officers which are included in the seniority list on a provisional basis will be included on a final basis after select list for that year is finalised and following the principle of seniority as detailed above. 6. Preparation of seniority list for Stenographer Grade ‘D’.- (a) The seniority list for the grade as finalized for the previous year shall be reviewed and names of all officers who are no longer serving in the grade and who have no lien on any post in that grade will be removed.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 33 (b) Names of officers who have joined the grade on a regular basis during the previous recruitment year will be added to the seniority list in the order in which their names appear in the selection panel as prepared under sub-regulation 2 of regulation 7: Provided that the officers whose names are included in the selection panel for an earlier recruitment year will be senior to the officers whose names are included in selection panel for a later year. 7. Finalisation of seniority list.- (1) The draft seniority list as prepared in accordance with regulation 4, 5 and 6 will be posted on the website of Railway Board for inviting objections, if any. (2) All objections received within 30 days of the publication of draft seniority list will be decided by the competent authority, and the final seniority list will be prepared after making revisions, if any, within 30 days thereafter. (3) Final seniority list shall not be modified except in case where it is required to implement an order of a competent court or a tribunal or in case when a supplementary selection list is received from the Union Public Service Commission or Staff Selection Commission for Limited Departmental Competitive Examination selection for Private Secretary or Personal Assistant grades and such modification shall be made following the general principles laid down for preparation of draft/final seniority list as detailed above provided that it does not come in conflict with the relevant order of the court or tribunal.
