(1) इन जनयमों का संजिप्त नाम भारतीय तार मागग के अजधकार (संिोधन) जनयम, 2023 ह।ै (2) य ेरािपत्र म ेंउनके प्रकािन की तारीख को प्रिृत्त होंगे। 2. भारतीय तार मागग के अजधकार जनयम, 2016 (जिसे इसम ें इसके पश्चात् उि जनयम कहा गया ह)ै के जनयम 9 के पश्चात् जनम्नजलजखत जनयम अंतःस्ट्थाजपत दकया िाएगा, अथागत:्- "9 क. अस्ट्थायी भजू म के ऊपर तार अिसरं चना की स्ट्थापना - (1) दकसी भी कारण स े मौिूदा भूजमगत तार अिसंरचना के िजतग्रस्ट्त होन े की जस्ट्थजत म ें लाइसेंसधारी, जिसकी मौिूदा भूजमगत तार अिसंरचना िजतग्रस्ट्त हो गई ह ै तो िह समुजचत प्राजधकारी को अिसंरचना के नुकसान की ठरपोर् ग करने की तारीख स े साि ददनों की अिजध के जलए तार सेिा 5102 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] को बहाल करने हते ु िजतग्रस्ट्त भूजमगत तार अिसंरचना के बदले भूजम के ऊपर अस्ट्थायी रूप स े तार अिसंरचना की स्ट्थापना करेगा। (2) इस जनयम के अधीन अस्ट्थायी रूप स े भूजम के ऊपर तार अिसंरचना की स्ट्थापना के जलए समुजचत प्राजधकारी द्वारा कोई फीस या प्रजतकर नहीं जलया िाएगा। 3. उि जनयमों के जनयम 10 के, उप-जनयम (5) म,ें- (क) िब्द और अंक “जनयम 10ख” के स्ट्थान पर िब्द और अंक “जनयम 10क और जनयम 10ख” रखे िाएंग;े (ख) खंड(ग) के पश्चात ् जनम्नजलजखत खंड अंतःस्ट्थाजपत दकए िाएंग,े अथागत्:- ‘(घ) "मागग फनीचर" स े जिद्युत, स्ट्रीर् लाइर्, रैदफक लाइर्, यातायात संकेत, बस स्ट्र्ॉप, राम स्ट्र्ॉप, र्ैक्सी स्ट्र्ैंड, सािगिजनक िौचालय, स्ट्मारक, सािगिजनक मूर्तगकला, यूठर्जलर्ी पोल या दकसी अन्य संरचना या दकसी समुजचत प्राजधकरण की संपजत्त पर स्ट्थाजपत ऐसी प्रकृजत के मिीन के जलए प्रयुक् त पोस्ट्र् अथिा खंभा अजभप्रेत ह।ै ’ 4. उि जनयमों के जनयम 10क म,ें- (क) उप-जनयम (1) के पश्चात,् जनम्नजलजखत उप-जनयम अतं ःस्ट्थाजपत दकए िाएंग,े अथागत:्- (1क) लाइसेंसधारक के पास कई स्ट्थलों के जलए एकल आिेदन प्रस्ट्तुत करन े का जिकल्प होगा और समुजचत प्राजधकारी ऐसे आिेदनों को स्ट्िीकार करने और स्ट् मॉल सेलों की स्ट्थापना हते ु तदनुसार कई स्ट्थलों के जलए एकल अनुमजत िारी करन े के जलए उजचत उपबधं करेगा।" (ख) उप-जनयम (5) के स्ट्थान पर, जनम्नजलजखत उप-जनयम रखा िाएगा, अथागत्:- “(5) उपयक्ु त केंद्रीय प्राजधकरण स्ट् मॉल सले ों की स्ट्थ ापना की अनुमजत दगें े और अनुसूची के भाग-I या भाग-III के अनुसार अपन े जनयंत्रण म ें जनजहत या उनके अधीन भिनों और संरचनाओं पर स्ट् मॉल सले ों की स्ट् थापना के जलए कोई प्रिासजनक फीस या प्रजतकर नहीं लगें े: परंत ु दक ये प्रभार िास्ट्तजिक आंकडे के अनुसार भिन स्ट्िाजमयों द्वारा प्रदान की गई जबिली (उद्योग र्ैठरफ के अनुसार), दफक्स्ट्चर आदद के जलए लगाए िाएंग े और लाइसेंसधारी स्ट् मॉल सले की तैनाती के दौरान हुए नुकसान को बहाल करेगा।” 5. उि जनयमों की अनुसूची के स्ट्थान पर, जनम्नजलजखत अनुसूची रखी िाएगी, अथागत:्- “अनसु चू ी [जनयम 5(3), 6(1ख), 6(2)(क), 6(3), 9(3), 9क(2), 10(2), 10(3)(क), 10क(2), 10क(4), 10क(5)] जनयम मद राजि (1) (2) (3) भाग-I िुल्क 5(3) भूजमगत तार अिसंरचना की स्ट्थापना के जलए एक हिार रुपये प्रजत दकलोमीर्र 9(3) भूजम के ऊपर तार अिसंरचना की स्ट्थापना के (i) मोबाइल र्ािर लगाने के जलए दस हिार रुपये जलए (ii) भूजम के ऊपर तार लाइन की स्ट्थापना के जलए एक हिार रुपये प्रजत दकलोमीर्र। (iii) खंभों की स्ट्थापना के जलए, स म् ॉल सेल और तार लाइन की स्ट्थापना के जलए, अचल संपजत्त पर जनजहत या उपयुक् त केंद्रीय प्राजधकरण के जनयंत्रण या प्रबंधन के जलए िून्य।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (iv) खंभों की स्ट्थापना के जलए, स म् ॉल सेल और तार लाइन की स्ट्थापना के जलए, अचल संपजत्त पर जनजहत या समुजचत केंद्रीय प्राजधकरण समुजचत के अलािा समुजचत प्राजधकरण के जनयंत्रण या प्रबंधन के जलए प्रजत पोल एक हिार रुपये। 9 क (2) भूजम के ऊपर तार अिसंरचना की अस्ट्थायी िून्य। स्ट्थापना 10 क (2) माग गफनीचर का उपयोग करते हुए स् मॉल सेल िून्य। और तार लाइन की स्ट्थापना के जलए 10 क (5) समुजचत केंद्रीय प्राजधकरण के जनजहत या अधीन िून्य। भिनों अथिा संरचनाओं पर स् मॉल सेलों की तैनाती के जलए भाग-II बहाली के जलए प्रभार 6(2)(क) लाइसेंसधारक द्वारा िजत को बहाल करने की यदद केंद्रीय लोक जनमागण जिभाग द्वारा उस िेत्र के जलए कोई दाजयत् िों का जनिगहन करने का िचन नहीं दर जनधागठरत नहीं की गई हो तो अचल संपजत्त को उस िेत्र के देने पर भूजमगत तार अिसंरचना की स्ट्थापना। जलए केंद्रीय लोक जनमागण जिभाग द्वारा जनधागठरत दर के अनुसार या उस िेत्र के जलए राज्य सािगिजनक कायग जिभाग द्वारा जनधागठरत दर के अनुसार अचल संपत् जत को पुनस्ट्थागजपत करने के जलए अपेजित राजि। 6(3) लाइसेंसधारी द्वारा िजतपूर्तग को बहाल करने अचल संपजत्त को उस ित्रे के जलए केंद्रीय लोक जनमागण जिभाग की दाजयत् ि जनिगहन का िचन ददया है िहााँ द्वारा जनधागठरत दर के अनुसार या उस िेत्र के जलए राज्य भूजमगत तार अिसंरचना की स्ट्थापना के सािगिजनक कायग जिभाग द्वारा जनधागठरत दर के अनुसार मामले में जनष्पादन हते ु सुरिा के रूप में बैंक पुनस्ट्थागजपत करने के जलए आिश्यक राजि का 20 प्रजतित यदद गारंर्ी। केंद्रीय लोक जनमागण जिभाग द्वारा उस िेत्र के जलए कोई दर जनधागठरत नहीं की गई हो। 10 (3)(क) भूजम के ऊपर तार अिसंरचना की स्ट्थापना अचल संपजत्त को उस िेत्र के जलए केंद्रीय लोक जनमागण जिभाग द्वारा जनधागठरत दर के अनुसार या उस िेत्र के जलए राज्य सािगिजनक कायग जिभाग द्वारा जनधागठरत दर के अनुसार पुनस्ट्थागजपत करने के जलए आिश्यक राजि, यदद केंद्रीय लोक जनमागण जिभाग द्वारा उस िेत्र के जलए कोई दर जनधागठरत नहीं की गई हो, इसके अलािा लाइसेंसधारक स्ट् मॉल सेल और तार लाइनों की स्ट्थापना के जलए खंभों को स्ट्थाजपत करने के मामले में हुई िजत की भरपाई करेगा। भाग-III प्रजतकर 6(1ख) भूजमगत तार अिसंरचना की स्ट्थापना िून्य। 9 क(2) अस्ट्थायी भूजम के ऊपर तार अिसंरचना की िून्य। स्ट्थापना 10(2) भूजम के ऊपर अिसंरचना की स्ट्थापना यदद ऐसी संपजत्त का उपयोग दकसी अन्य प्रयोिन के जलए नहीं दकया िा सकता ह ै तो उपयुक् त प्राजधकरण के सामान्य आदिे द्वारा दर जनर्दष्टग कर सकता है। तथाजप स म् ॉल सेल और तार लाइनों की स्ट्थापना हते ु खंभों की स्ट्थापना के जलए प्रजतकर िून्य होगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 10 क (4) स्ट् मॉल सेल और तार लाइन की स्ट्थापना के (i) स् मॉल सेल की स्ट्थापना के जलए: माग ग फनीचर के जलए माग गफनीचर का उपयोग अनुसार िहरी िेत्र के जलए प्रजत िर् ग तीन सौ रुपये और ग्रामीण िेत्रों के जलए प्रजत िर् गएक सौ पचास रुपये। (ii) तार लाइन की स्ट्थापना के जलए: प्रजत माग ग फनीचर के अनुसार एक सौ रुपये प्रजत िर्ग। 10 क (5) समुजचत केंद्रीय प्राजधकाठरयों में जनजहत या िून्य”। उनके जनयंत्रण में भिन अथिा संरचनाओं पर स्ट् मॉल सेलों की तैनाती के जलए [फा. स.ं 2-6/2023-नीजत] सुनील कुमार िमा,ग संयक्ु त सजचि ठर्प्पण: मलू जनयम भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) म ें अजधसचू ना सा.का.जन. 1070 (अ.) तारीख 15 निंबर, 2016 के द्वारा प्रकाजित दकए गए थ े और तत्पश्चात सा.का.जन. 407 (अ.) तारीख 21 अप्रैल, 2017, सा.का.जन. 749 (अ.) तारीख 21 अक्र्ूबर, 2021 और सा.का.जन. 635 (अ.) तारीख 17 अगस्ट्त, 2022 द्वारा संिोजधत दकए गए थे। MINISTRY OF COMMUNICATIONS (Department of Telecommunications) NOTIFICATION New Delhi, the 7th August, 2023 G.S.R. 594(E). —In exercise of the powers conferred by sub-section (1) and clause (e) of sub-section (2) of section 7 read with sections 10, 12 and 15 of the Indian Telegraph Act, 1885(13 of 1885), the Central Government hereby makes the following rules further to amend the Indian Telegraph Right of Way Rules, 2016, namely: - 1. (1) These rules may be called the Indian Telegraph Right of Way (Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Indian Telegraph Right of Way Rules, 2016 (hereinafter referred to as the said rules), after rule 9, the following rule shall be inserted, namely: - “9A. Establishment of temporary overground telegraph infrastructure. – (1) In case of damage of any existing underground telegraph infrastructure for any reason, the licensee, whose existing underground telegraph infrastructure is damaged, may temporarily establish the overground telegraph infrastructure, in lieu of the damaged underground telegraph infrastructure, to restore the telegraph service for the period of sixty days from the date of reporting of damage of the infrastructure to the appropriate authority. (2) No fee or compensation shall be charged by the appropriate authority for the establishment of temporary overground telegraph infrastructure under this rule”. 3. In rule 10 of the said rules, in sub-rule (5),– (a) for the word and figure “rule 10B”, the words and figures, “rule 10A and rule 10B”, shall be substituted; (b) after clause (c), the following clause shall be inserted, namely: - ‘(d) “street furniture” means post or pole used for electricity, street light, traffic light, traffic sign, bus stop, tram stop, taxi stand, public lavatory, memorial, public sculpture, utility pole or any other structure or contrivance of such nature established over the property of an appropriate authority.’.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 4. In rule 10A of the said rules,– (a) after sub-rule (1), the following sub-rule shall be inserted, namely: – “(1A) The licensee shall have the option of submitting single application for multiple sites and appropriate authority shall make due provisions for accepting such applications and issuing single permission for multiple sites accordingly for establishment of small cells.”. (b) for sub-rule (5), the following sub-rule shall be substituted, namely: - “(5) The appropriate central authorities shall permit deployment of small cells and shall charge no administrative fees or compensation for deployment of small cells on buildings and structures vested in or under their control as per Part-I or Part-III of the Schedule: Provided that the charges shall be levied for power (as per Industry tariffs), fixtures etc. provided by building owners as per actuals and licensee shall restore the damage done during deployment of small cells”. 5. For the Schedule of the said rules, the following schedule shall be substituted, namely:– “THE SCHEDULE [See rules 5 (3), 6 (1B), 6 (2) (a), 6 (3), 9 (3), 9 A (2), 10 (2), 10 (3) (a), 10A (2), 10A (4), 10 A (5)] Rule Item Amount (1) (2) (3) Part-I Fee 5(3) For establishment of underground One thousand rupees per kilometer. telegraph infrastructure 9(3) For establishment of overground (i) Ten thousand rupees for establishment of mobile telegraph infrastructure towers (ii) One thousand rupees per kilometre for establishment of overground telegraph line. (iii) Nil for establishment of poles, for installation of small cells and telegraph line, on the immovable property vested in, or under control or management of appropriate central authority (iv) One thousand rupees per pole for establishment of poles, for installation of small cells and telegraph line, on the immovable property vested in, or under control or management of appropriate authority, other than appropriate central authority. 9 A (2) For Establishment of temporary over Nil. ground Telegraph Infrastructure. 10A (2) For installation of small cells and Nil. telegraph line using the street furniture 10 A (5) For the deployment of small cells on Nil. building or structures vested in or under the control of appropriate central authorities. Part-II Charges for restoration 6(2)(a) Establishment of underground telegraph Sum required to restore immovable property as per the infrastructure where undertaking is not rate prescribed by central public works department for given by the licensee to discharge the that area or as per the rate prescribed by state public responsibility to restore the damages works department for that area, if no rate has been prescribed by central public works department for that area. 6(3) Bank guarantee as security for 20 percent of the sum required to restore immovable performance in case of establishment of property as per the rate prescribed by central public underground telegraph infrastructure works department for that area or as per the rate where undertaking is given by the prescribed by state public works department for that area,6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] licensee to discharge the responsibility if no rate has been prescribed by central public works to restore the damages department for that area. 10(3)(a) Establishment of overground telegraph Sum required to restore immovable property as per the infrastructure rate prescribed by central public works department for that area or as per the rate prescribed by state public works department for that area, if no rate has been prescribed by central public works department for that area, further, licensee shall restore the damage incurred in case of establishment of poles for installation of Small Cells and telegraph line. Part-III Compensation 6(1B) Establishment of underground telegraph Nil. infrastructure 9 A(2) For Establishment of temporary over Nil. ground Telegraph Infrastructure. 10(2) Establishment of Over Ground Rates as the appropriate authority may, by general order, Infrastructure specify, if such property cannot be used for any other purpose. However, for establishment of poles for installation of small cells and telegraph line, compensation shall be Nil. 10A (4) Usage of street furniture for installation of (i) For installation of small cells: Three hundred rupees small cells and telegraph line per annum for urban area and one hundred and fifty rupees per annum for rural areas per street furniture. (ii) For installation of telegraph line: One hundred rupees per annum per street furniture. 10 A (5) For the deployment of small cells on Nil”. building or structures vested in or under the control of appropriate central authorities.
