L.-33004/99 सी.जी.-डी.एल.-अ.-24082026-275713 CG-DxLx-xEG-I2D4H0x8x2x0 26-275713 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4466] नई किल्ली, सोमवार, अगस्ट्त 24, 2026/भाद्र 2, 1948 No. 4466] NEW DELHI, MONDAY, AUGUST 24, 2026/BHADRA 2, 1948 कृजि एव ं ककसान कल्याण मत्रं ालय (कृजि एव ं ककसान कल्याण जवभाग) अजधसचू ना नई किल्ली, 21 अगस्ट् त, 2026 का.आ. 4649(अ).— यह कक केंद्र सरकार द्वारा कृजि एव ं ककसान कल्याण मंत्रालय, कृजि एवं ककसान कल्याण जवभाग के अंतगगत भारत में पंिीकृत कार्बोसल्फान कीटनािी के जनरंतर अथवा अन्यथा उपयोग की िांच करने हते ु 14 िनवरी 2026 को एक जविेिज्ञ सजमजत का गठन ककया, जिसन े जवस्ट्ततृ िांच के पश्चात 12 िनू 2026 को केंद्र सरकार को अपनी ररपोटग प्रस्ट्ततु की; और यह कक, केंद्र सरकार ने कीटनािी अजधजनयम, 1968 (1968 का 46) की धारा 5 के तहत गरठत पंिीकरण सजमजत के साथ परामिग ककया ह।ै और यह, पंिीकरण सजमजत न े अनुिंजसत अध्ययनों, आंकडों और सुरक्षा संर्बंधी मद्दु ों को प्रस्ट्तुत करने की जस्ट्थजत स े संर्बंजधत अपनी जसफाररि प्रस्ट्ततु की ह;ै और यह कक, पंिीकरण सजमजत ने अपनी जसफाररि म ें यह नोट ककया ह ै कक कार्बोसल्फान एक आंतररक रूप स े अत्यजधक खतरनाक कार्बागमेट कीटनािी ह ैिो तीव्रता स ेकार्बोफ्यूरान म ेंमेटार्बोलाइज़ हो िाता ह,ै िो एक अत्यजधक जविलै ा मेटार्बोलाइट ह ैिो गंभीर कोजलनेस्ट्टेरेि अवरोध और तीव्र प्रणालीगत जविाक्तता के जलए उत्तरिायी ह;ै पजक्षयों, परागणकों, 6488 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] िलीय िीवों और अन्य गैर-लजक्षत प्रिाजतयों के जलए कार्बोसल्फान की अत्यजधक जविाक्तता ह,ै साथ ही कई िेिों म ें इसके उपयोग को प्रजतर्बंजधत या जनजिद्ध करने वाली अंतरराष्ट्रीय जवजनयामक कारगवाइयां की गई ह;ैं यह भी िेखा गया कक यद्यजप एरोजपन और अन्य सहायक उपाय रोगसूचक प्रर्बंधन के जलए उपलब्ध हैं, कार्बोसल्फान के जविाक्त प्रभावों को उलटने के जलए कोई जवजिष्ट एटं ीडॉट मौिूि नहीं ह;ै कार्बोसल्फान का जनरंतर उपयोग सावगिजनक स्ट्वास्ट््य और पयागवरण के जलए र्बडे खतरे उत्पन्न कर सकता ह;ै और, यह कक पंिीकरण सजमजत न े भारत म ें कार्बोसल्फान पर पणू ग प्रजतर्बंध लगान े अथागत कीटनािी अजधजनयम, 1968 के अतं गतग कार्बोसल्फान के जनमागण, आयात, पररवहन, जवतरण, जर्बक्री और उपयोग पर तत्काल प्रजतर्बंध लगाने की जसफाररि की ह;ै और, यह कक केंद्र सरकार, पंिीकरण सजमजत की ररपोटग पर जवजधवत जवचार करन े के उपरांत इस र्बात स े संतष्टु ह ै कक कार्बोसल्फान कीटनािी उपयोग स ेमनुष्यों और िानवरों को खतरा होन े की संभावना है, जिससे तत्काल कारगवाई करना उजचत या आवश्यक हो िाता ह;ै अतः, कीटनािी अजधजनयम, 1968 की धारा 27 की उपधारा 2 सपरठत धारा 28 अंतगगत प्रित्त िजक्तयों का प्रयोग करते हुए केंद्र सरकार द्वारा प्रस्ट्ताजवत प्रारूप आिेि को उन सभी व्यजक्तयों की सूचना हते ु प्रकाजित ककया िाता ह ैिो इससे प्रभाजवत हो सकत े ह ैंऔर यह सूजचत ककया िाता ह ैकक उक्त प्रारूप आििे पर इस आिेि वाल े भारत के रािपत्र की प्रजतयां िनता को उपलब्ध कराए िान ेकी जतजथ से तीस किनों की अवजध की समाजि के र्बाि जवचार ककया िाएगा; उक्त प्रारूप आििे के संर्बंध में ककसी भी व्यजक्त से तीस किनों की पूवोक्त अवजध की समाजि से पहले प्राि ककसी भी आपजत्त या सुझाव पर केंद्र सरकार द्वारा जवचार ककया िाएगा। उक्त प्रारूप आिेि के संर्बंध म ें कोई भी आपजत्त या सुझाव संयुक्त सजचव (वनस्ट्पजत संरक्षण), कृजि एवं ककसान कल्याण मंत्रालय, कृजि एवं ककसान कल्याण जवभाग, कृजि भवन, नई किल्ली-110 001 को भिे ा िा सकता ह।ै प्रारूप आिेि 1. सजं क्षि नाम एव ंप्रारंभ - (1) इस आिेि को कार्बोसल्फान प्रजतर्बंध आिेि, 2026 कहा िा सकेगा; (2) यह रािपत्र में इसके अंजतम प्रकािन की जतजथ स ेलागू होगा। 2. कार्बोसल्फान कीटनािक पर प्रजतर्बधं : (1) इस आिेि के प्रकािन की जतजथ से कोई भी व्यजक्त कार्बोसल्फान का आयात, जनमाणग , जर्बक्री, पररवहन, जवतरण और उपयोग नहीं करेगा। (2) पंिीकरण सजमजत कार्बोसल्फान के जलए िारी ककए गए पिं ीकरण प्रमाणपत्र वापस ले लगे ी। (3) यकि पंिीकरण प्रमाणपत्र रखने वाला कोई व्यजक्त खंड (2) में जनर्िगष्ट पंिीकरण सजमजत को प्रमाणपत्र तीन महीने की अवजध के भीतर लौटाने म ेंजवफल रहता ह,ै तो उक्त अजधजनयम में जनजहत प्रावधानों के तहत कारगवाई की िाएगी। (4) उक्त अजधजनयम की धारा 9 के तहत कार्बोसल्फान के जलए िारी ककए गए पंिीकरण प्रमाणपत्र इस आिेि की जतजथ स े रद्द मान े िाएंगे। (5) प्रत्येक राज्य सरकार उक्त अजधजनयम और उसके अतं गतग र्बनाए गए जनयमों के प्रावधानों के तहत ऐसे सभी किम उठाएगी, जिन्ह ेंवह राज्य म ेंइस आिेि के जनष्पािन के जलए आवश्यक समझे। [फा. स. ं 12078/01/2023-पीपी-I] मुक् तानंि अग्रवाल, संयुक्त सजचव[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 21st August, 2026 S.O. 4649(E).— Whereas the Central Government in the Ministry of Agriculture and Farmers Welfare, Department of Agriculture and Farmers Welfare constituted an Expert Committee on 14 January 2026 to examine the continued use of or otherwise of Carbosulfan insecticide registered in India which, after detailed examination submitted its report to the Central Government on the 12 June 2026; And whereas, the Central Government, has undertaken consultation with the Registration Committee constituted under section 5 of the Insecticides Act, 1968 (46 of 1968). And whereas, the Registration Committee has submitted its recommendation with regard to status of submission of recommended studies, data and safety concerns; And, whereas, the Registration Committee has noted in its recommendation that Carbosulfan is an intrinsically highly hazardous carbamate insecticide which is rapidly metabolised to carbofuran, a highly toxic metabolite responsible for severe cholinesterase inhibition and acute systemic toxicity; significant toxicity of Carbosulfan to birds, pollinators, aquatic organisms and other non-target species, together with international regulatory actions restricting or prohibiting its use in several countries; also noticed that although atropine and other supportive measures are available for symptomatic management, no specific antidote exists to reverse the toxic effects of Carbosulfan; continued use of Carbosulfan is likely to pose significant hazards to public health and the environments; And, whereas, the Registration Committee has recommended complete prohibition of Carbosulfan in India, i.e. an immediate ban on the manufacture, import, transport, distribution, sale, and use of Carbosulfan under the Insecticides Act, 1968; And, whereas, the Central Government, after duly considering the report of the Registration Committee is satisfied that the use of Carbosulfan insecticide is likely to involve risk to human being and animals as to render it expedient or necessary to take immediate action; Now therefore, the Draft Order, which the Central Government proposes to make, in exercise of the powers conferred by sub-section 2 of Section 27 read with section 28 of the Insecticides Act, 1968 is hereby published for information of all persons likely to be affected thereby and notice is hereby given that the said draft order shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of the Gazette of India containing this Order are made available to the public; Any objection or suggestion which may be received from any person in respect of the said draft Order before the expiry of the aforesaid period of thirty days will be considered by the Central Government. Any objection or suggestion in respect to the said draft Order may be forwarded to the Joint Secretary (Plant Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture and Farmers Welfare, Krishi Bhawan, New Delhi-110 001.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] DRAFT ORDER 1. Short title and commencement - (1) This Order may be called the Banning of Carbosulfan Order, 2026; (2) It shall come into force on the date of its final publication in the Official Gazette. 2. Prohibition of Carbosulfan Insecticide: (1) No person shall import, manufacture, sale, transport, distribute and use Carbosulfan from the date of publication of this Order. (2) The Registration Committee shall call back the certificates of registration granted for the Carbosulfan. (3) If any person who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in clause (2), within a period of three months, action shall be taken under the provisions contained in the said Act. (4) The certificates of registration for the Carbosulfan granted under section 9 of the said Act shall be deemed to be cancelled from the date of this order. (5) Every State Government shall take all such steps under the provisions of the said Act and the rules framed thereunder, as it considers necessary for the execution of this order in the state. [F.
