1. (1) इस आिेि का संजिप्त नाम अन्तर-राज्य पररषि ्(संिोधन) आििे , 2026 ह।ै

2. अंतर-राज्य पररषि ्आिेि, 1990 के, खडं 2 में परन्तुक के स्ट्र्ान पर जनम्नजलजखत परन्तुक रखा िाएगा, अर्ावत ् :- “परंत ु -

(i) िहां कहीं दकसी राज्य के संबंध में भारत के संजर्धान के अनच्ु छेि 356 के अधीन राष्ट्रपजत द्वारा िारी की गई कोई उद्घोषणा लागू ह,ै र्हा ं उस राज्य के राज्यपाल को पररषि ् की बैठकों में भाग लेने के जलए आमंजत्रत दकया िाएगा; या

(ii) िहां राष्ट्रीय रािधानी राज्यित्रे के संबंध म,ें भारत के संजर्धान के अनुच्छेि 239 कख के अधीन राष्ट्रपजत द्वारा िारी आििे लागू ह,ै र्हां राष्ट्रीय रािधानी राज्यिेत्र के उप-राज्यपाल को पररषि ् की बैठकों में भाग लेन े के जलए आमंजत्रत दकया िाएगा; या

(iii) िहां संघ राज्यिेत्र पुडुचरे ी के संबंध में, संघ राज्यिेत्र िासन अजधजनयम, 1963 (1963 का 20) की धारा 51 के अधीन राष्ट्रपजत द्वारा िारी दकया गया आििे लागू ह,ै र्हां संघ राज्यिेत्र पुडुचेरी के उप-राज्यपाल को पररषि ्की बैठकों में भाग लने े के जलए आमंजत्रत दकया िाएगा; या

(iv) िहां िम्मू-कश्मीर संघ राज्यित्रे के संबंध म,ें िम्मू-कश्मीर पनु गठवन अजधजनयम, 2019 (2019 का

34) की धारा 73 के अधीन राष्ट्रपजत द्वारा िारी की गई उद्घोषणा लागू ह,ै र्हां िम्मू-कश्मीर सघं राज्यिेत्र के उप-राज्यपाल को पररषि की बैठक में भाग लेन े के जलए आमंजत्रत दकया िाएगा।” -ह- नई दिल्ली, द्रौपिी मुमुव, तारीख ___ जसतंबर, 2026 राष्ट्रपजत ———— [फा. स.ं IV/11017/3/90-सीएसआर-भाग-(1)] अरजर्न्ि खरे, संयक्ु त सजचर् रिप्पण – अंतर-राज्य पररषि ् आिेि, 1990 संख्या सा.का.जन. 512(अ) तारीख 28 मई, 1990 द्वारा भारत के रािपत्र, असाधारण, भाग II, खण्ड 3, उपखण्ड (i) में प्रकाजित दकया गया र्ा और तत्पश्चात सख्ं या का.आ. 575(अ) तारीख 19 िलु ाई, 1990 एर् ंसंख्या का.आ. 902(अ) तारीख 24 दिसंबर, 1996 द्वारा संिोधन दकया गया र्ा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 MINISTRY OF HOME AFFAIRS

NOTIFICATION New Delhi, the 9th September, 2026 S.O. 5143(E).— The following order by the President is published for general information.

ORDER In exercise of the powers conferred by article 263 of the Constitution, the President hereby makes the following

order further to amend the Inter-State Council Order, 1990, namely:-

1. (1) This order may be called the Inter-State Council (Amendment) Order, 2026.

(2) It shall come into force at once.

2. In the Inter-State Council Order, 1990, in clause 2 for the proviso, the following proviso shall be substituted,

namely:- “Provided that–

(i) where a proclamation issued by the President under article 356 of the Constitution of India in relation to any State is in force, the Governor of that State shall be invited to attend the meetings of the Council; or

(ii) where an order issued by the President under article 239AB of the Constitution of India in relation to the National Capital Territory is in force, the Lieutenant Governor of the National Capital Territory shall be invited to attend the meetings of the Council; or

(iii) where an order issued by the President under section 51 of the Government of Union Territories Act, 1963 (20 of 1963) in relation to the Union territory of Puducherry is in force, the Lieutenant Governor of the Union territory of Puducherry shall be invited to attend the meetings of the Council; or

(iv) where an order issued by the President under section 73 of the Jammu and Kashmir Reorganisation Act, 2019 (34 of 2019) in relation to the Union territory of Jammu and Kashmir is in force, the Lieutenant Governor of the Union territory of Jammu and Kashmir shall be invited to attend the meetings of the Council”.

NOTE : The Inter-State Council Order, 1990 was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) vide number G.S.R. 512(E), dated the 28th May, 1990 and subsequently amended vide number S.O. 575(E), dated the 19th July, 1990 and S.O. 902(E), dated the 24th December 1996.
