Tel. 080-22034625 Fax. 080-22353932 No. CI 60 SPI 2020(E) Date 04.09.2020 NOTIFICATION The draft of the following rules further to amend the Karnataka Industries (Facilitation) Rules, 2003 which the Government of Karnataka proposes to make in exercise of the powers conferred by section 21 and read with section 11A of the Karnataka Industries (Facilitation) Act, 2002 (Karnataka Act 45 of 2003) is hereby published for the information of all the persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after fifteen days from the date of its publication in the official Gazette. Any objection or suggestion, which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above will be considered by the State Government. Objections and suggestions may be addressed to the Principal Secretary to Government, Commerce and Industries Department, Karnataka Government Secretariat, Vikasa Soudha, Bangalore-560001. DRAFT RULES 1. Title and commencement.- (1) These rules may be called the Karnataka Industries (Facilitation)(Amendment) Rules, 2020 (2) They shall come into force from the date of their final publication in the official Gazette. (1)2 2. Amendment of rule 2.- In rule 2 of the Karnataka Industries (Facilitation) Rules, 2003 (hereinafter referred as the said rules),- (i) after clause (a) the following shall be inserted, namely:- “(a1)“Acknowledgment certificate” means the acknowledgement certificate issued under clause (h) of sub-section (1) of section 13; (a2) “Applicant” means Medium, Small and Micro Enterprises, Large or Mega manufacturing Enterprises or manufacturing industries, whether a new or expansion Unit; (a3) “Authorized Officer” means the person authorized by Nodal Agency at State level or District level for carrying out the functions assigned in these rules;” (ii) after clause (b) the following shall be inserted, namely:- “(b1) “Commencement of commercial operation” means the date on which the manufacturing Enterprise or Industry issues the first bill of sale or invoice or tax invoice, of the goods manufactured relating to self-certification in Form II; (b2) “District Level Nodal Agency” means the Nodal Agency at District level as appointed under section 12 of the Act; (b3) “Expansion Unit” means new manufacturing facilities set up by an existing enterprise within the existing facility or in a new site or in an adjacent vacant site for manufacturing a product which is already being manufactured with or without up-gradation of technology or the existing process;” (iii) after clause (c) the following shall be inserted, namely:- “(c1) "New Unit" means a manufacturing industry or Enterprise which has obtained approval of the State High Level Clearance Committee or State Level Single Window Clearance Committee or District level Single Window Clearance Committee on or after the commencement of the date of the Karnataka Industries (Facilitation) (Amendment) Ordinance, 2020 and includes an enterprise set up or proposed to be set up by an existing enterprise for manufacturing products at a location which is separately identifiable;” 3. Insertion of new rule 8A and 8B.- After rule 8 of the said rules, the following shall be inserted, namely:- “8A. Self certification.- (1) The self certification shall be submitted in Form V by the following, namely:- (i) the proprietor, in case of proprietary enterprise; (ii) the authorized partner in case of partnership including L.L.Ps enterprise; (iii) the Director or the Managing Director in case of private limited or public limited companies; and3 (iv) the Chief Executive Officer or Director or Trustees in case of co-operative societies or other forms of enterprises. (2) In case the enterprise has commercial operations on more than one set of premises, a separate Self Certification shall be submitted for each such set of premises. 8B. Procedure for grant of acknowledgement certificate.- (1) Every manufacturing enterprise or manufacturing industry seeking acknowledgement certificate shall first obtain approval for the project from the State High Level Clearance Committee or State Level Single Window Clearance Committee or District Single Window Clearance Committee and then furnish a duly filled Combined Application Form for obtaining acknowledgment certificate (CAF) in Form IV, along with relevant fees towards services and self certification in Form V, electronically on the online portal of the State level Nodal Agency. (2) On the receipt of self certification in Form V, the acknowledgement certificate shall be granted in electronic format by the State Level Nodal Agency for the projects approved by the State High Level Clearance Committee or State Level Single Window Clearance Committee and by the District Level Nodal Agency for the projects approved by District level Single Window Clearance Committee in Form VI, stating the date of receipt of self certification and the period of validity of acknowledgement certificate.” 4. Amendment of rule 9.- In rule 9 of the said rules, the following shall be inserted at the end, namely:- “During the period of validity of the acknowledgement certificate, in instances where inspections are warranted, the inspection shall be carried out by such officers of the respective departments in consultation with the nodal agency and approval of the head of the department concerned.” 5. Insertion of new rule 9A and 9B.- After rule 9 of the said rules the following shall be inserted, namely:- “9A. Operationalising the manufacturing enterprise or industry.– (1) The manufacturing enterprise or industry shall make relevant applications for operationalising the unit under applicable Acts, rules etc. within six months before the expiry of the acknowledgement certificate. The acknowledgement certificate issued under sub-section (3) of section 13 shall be the prerequisite document for getting approvals.4 (2) If the applicant fails to operationalise the unit within three years from the date of issue of acknowledgement certificate, the applicant has to obtain necessary clearances for setting up or establishment of industry, from the respective departments as per regular procedure. 9B. Functions of the State Level or District Level Nodal Agency.- (1) The State Level or the District Level Nodal Agency shall act as the coordinating and implementing agency for carrying out the purposes of the Act. (2) The State Level or District Level Nodal Agency shall appoint one or more authorised officer in the State Level or District Level Nodal Agency for the purpose of issuance of acknowledgement certificate under the Act. (3) The State Level Nodal Agency shall receive and address the grievances and queries of applicant related to the Act and these rules. (4) The State Level Nodal Agency shall maintain the electronic portal for carrying out the purposes of the Act and keep record of self certification and the acknowledgement certificate. (5) State Level or District Level Nodal Agency shall, on issuance of acknowledgement certificate, forward the self certification and the acknowledgement certificate of applicant to the respective competent authorities or departments. (6) State Level Nodal Agency shall monitor and maintain the record of the applications or proposals and acknowledgement certificate issued by both State Level or District Level Nodal Agency. (7)State Level Nodal Agency shall be responsible for co-ordination between the competent authority or departments and the applicant. In case of dispute between the applicant and competent authority or departments, State Level Nodal Agency shall resolve the dispute and may seek directions at State High Level Clearance Committee, as and when required.” 6.
