वाल े वृक्षो का िस गनु ा) प्रस्ट्ताजवत वृक्ष अजधकारी/ प्रिाजतयााँ नीम, अमलतास, पीपल, जपलिन, उप-वन संरक्षक (क) 1,57,89,000 /- गूलर, बरगि,िेसी कीकर, अिुथन एव ं अन्य िेिी (केंद्रीय) प्रिाजतयााँ का उपभोगी संस्ट्र्ा द्वारा यूजनवर्सथटी 2770 ऑफ़ कैंपस िािबाि िौलतपुर, बवाना, दिल्ली में 24120 वगथमीटर क्षेत्र म ें दकया िाएगा। उपभोगी संस्ट्र्ा द्वारा पररयोिना स्ट्र्ल से 252 वृक्षों का प्रत्यारोपण यूजनवर्सथटी ऑफ़ कैंपस िािबाि िौलतपुर, (ि) बवाना, दिल्ली में 4080 वगथमीटर क्षेत्र पर अपन े स्ट्वयं की लागत पर दकया िाएगा । जनयम एव ंित ें 1. दिल्ली जवश्वजवद्यालय,िो दक उपभोगी संस्ट्र्ा के रूप में संिर्भथत िै, को सात वर्षों की अवजध के जलए पौधों के सम्पूणथ जवकास एवं रिरिाव िते ु उपरोिानुसार 1,57,89,000 /-रुपय े (एक करोड़ सत्तावन लाि नवासी ििार मात्र @ रु. 57000/- प्रजत वक्षृ )(वापसी योग्य राजि- 1,37,29,505/- रुपय े (एक करोड़ सैंतीस लाि उनतीस ििार पांच सौ पांच मात्र) और प्रिासजनक िुल्क और आकजस्ट्मकता- रुपय े 20,59,495/- रुपये (बीस लाि उनसठ ििार चार सौ पंचानबे मात्र) की राजि अजिम रूप स े िमा करवानी िोगी और यदि उपभोगी संस्ट्र्ा द्वारा 2, 3 और 4 म ें उजल्लजित जनयमों और ितों का पालन निीं दकया िाता िै, तो इस राजि को िब्त कर जलया िाएगा और इस राजि को वन जवभाग द्वारा वृक्षारोपण के जलए उपयोग दकया िाएगा । 2. उपभोगी सस्ट्ं र्ा द्वारा वक्षृ ों का प्रत्यारोपण / कटाई िरूु करन ेस ेपिल ेपरू ी की िान ेवाली आवश्यक ित:ें - a. दिल्ली वृक्ष सरं क्षण अजधजनयम, 1994 की धारा 12 के अनुपालन म ें उपभोगी सस्ट्ं र्ा द्वारा संबंजधत वृक्ष अजधकारी/उप-वन संरक्षक को जवस्ट्तृत वृक्षारोपण कायथक्रम प्रस्ट्ततु दकया िाएगा। b. उपभोगी संस्ट्र्ा द्वारा साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योिना प्रस्ट्तुत दकया िाएगा। c. उपभोगी संस्ट्र्ा केद्वारा यि सजु नजित दकया िायेगा दक वृक्षो की कटाई / प्रत्यारोपण से पूवथ कोई लंजबत मुकिमा या स्ट्र्गन आिेि दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 d. उपभोगी संस्ट्र्ा द्वारा वृक्षो को कटाई/ प्रत्यारोपण का कायथ सभी वैधाजनक मंिूररयों को लेने के बाि िी िुरू दकया िाएगा। e. उपभोगी संस्ट्र्ा के द्वारा वनमिं ूरी म ें और अन्य मंिूरी म ें उजल्लजित सभी ितों, यदि कोई िो, का जनष्ठापूवथक पालन दकया िाएगा । 3. वक्षृ ों के प्रत्यारोपण / कटाई के िौरान परू ी की िान ेवाली आवश्यक ित:ें - a. क्र.स.ं 2 म ें ितों के अनुपालन िोने के तुरंत बाि उपभोगी संस्ट्र्ा द्वारा वृक्षो का प्रत्यारोपण िुरू दकया िाएगा और इसे छ:मिीन े के अंतराल में पूणथ दकया िाएगा । प्रत्यारोपण प्रदक्रया के पूणथ िोने का बाि एक सम्पूण थ ररपोटथ सम्बंजधत वृक्ष अजधकारी / उप- वन सरं क्षक को प्रस्ट्तुत की िायेगी । प्रत्यारोपण स्ट्र्ल मे प्रत्यारोजपत वृक्षो की िरू ी 4 मीटर (बबंि ुसे बबंि)ु से कम निीं िोनी चाजिए । b. उपभोगी संस्ट्र्ा द्वारा िरे रटेि बरगि वृक्ष संख्या 1 (कंप्यूटर सेंटर पर जस्ट्र्त) जिसकी पररजध 550 सेमी ि,ै को पररयोिना स्ट्र्ल के पास प्रत्यारोपण दकया िाएगा और इस जवजिष्ट वृक्ष के अजस्ट्तत्व को सुजनजित करन े जलए अजतररि िेिभाल की िाएगी । c. उपभोगी संस्ट्र्ा के द्वारा वृक्ष प्रत्यारोपण नीजत, 2020 में उजल्लजित सभी ितों का पालन दकया िाएगा । d. उपभोगी संस्ट्र्ा प्रजतरोजपत वक्षृ ों का न्यनू तम तीन वर्षों तक उसी प्रत्यारोपण एिेंसी के माध्यम से अनरु क्षण करेगी जिन के द्वारा प्रत्यारोपण दकया गया र्ा । e. उपभोगी संस्ट्र्ा द्वारा 15 वृक्षो को काटने स े पूव थ प्रत्यारोपण दकया िाएगा । 15 वृक्षो की अनमु जत 252 वृक्षो के सफल प्रत्यारोपण और सम्बंजधत वृक्ष अजधकारी / उप- वन संरक्षक को अनुपालन प्रमाण पत्र प्रस्ट्तुत करन े के बाि िी िायेगी । f. उपभोगी संस्ट्र्ा द्वारा प्रत्यारोपण / काटे िाने वाले वृक्षों की प्रगजत ररपोटथ संबंजधत वृक्ष अजधकारी / उप- वन संरक्षक को वृक्षों के पूण थ जववरण के सार् प्रस्ट्ततु की िाएगी । g. यदि दकसी वृक्ष में पजक्षयों का घोंसला पाया िाता ि ै तो उसे तब तक निीं काटा/ प्रत्यारोपण दकया िाएगा िब तक दक पक्षी उसे स्ट्वतः छोड़ न ि ें। h. उपभोगी संस्ट्र्ा द्वारा 267 वृक्षो के अलावा दकसी भी वृक्ष की कटाई / प्रत्यारोपण दिल्ली वृक्ष सरं क्षण अजधजनयम, 1994 के अन्तगतथ एक अपराध िोगा । i. उपभोगी संस्ट्र्ा द्वारा वृक्षो को िटाए िाने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को सरकार के िाते म ेरािस्ट्व के रूप में िमा की िाएगी । j. उपभोगी संस्ट्र्ा द्वारा वृक्षों के ऊपरी िािाओं को काटे िान े के उपरान्त प्राप्त लकजड़यों को मुफ्त में जनकटतम सावथिजनक िविािों में प्रयोग िते ु सौपी िाएगी और इसकी सूचना सम्बंजधत वृक्ष अजधकारी / उप- वन संरक्षक को भी िी िाएगी । k. उपभोगी संस्ट्र्ा द्वारा वृक्षो को िटाए िाने के स्ट्र्ल से लकजड़यों को को ले िाने से पूव थ सम्बंजधत वृक्ष अजधकारी / उप- वन संरक्षक स ेढुलाई अनुमजत प्राप्त करनी िोगी । l. उपभोगी संस्ट्र्ा द्वारा वृक्षो की प्रत्यारोपण / कटाई और उसमें पैिा िोन े वाली वन उपि को सावथिजनक श्मिान म े90 दिनों के अंिर परू ा दकया िाएगा । m. उपभोगी संस्ट्र्ा के द्वारा यि सजु नजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तथत निीं दकया िाएगा । n. उपभोगी संस्ट्र्ा के द्वारा वन मिं ूरी में और अन्य मंिूरी म ें उजल्लजित सभी ितों, यदि कोई िो, का जनष्ठापूवथक पालन दकया िाएगा । o. उपभोगी संस्ट्र्ा के द्वारा अनुमोदित वृक्ष संरक्षण योिना के अतं गथत प्रस्ट्तुत सभी गजतजवजधयों का जनष्ठापूवथक पालन दकया िाएगा ।4 DELHI GAZETTE : EXTRAORDINARY PART IV] p. उपभोगी संस्ट्र्ा के द्वारा यि सुजनजित दकया िाएगा दक वृक्ष प्रत्यारोपण नीजत 2020 की धारा 4 (6-बी) के अंतगतथ सभी प्रावधानों का जनष्ठापूवथक पालन दकया गया ि ै और इसका सम्बंजधत वृक्ष अजधकारी / उप- वन संरक्षक को प्रस्ट्तुत दकया िाएगा । q. उपभोगी संस्ट्र्ा के द्वारा यि सजु नजित दकया िाएगा दक सभी प्रजतरोजपत वृक्षों के जलए िो 15 फीट ऊंचाई और कम से कम 6 इंच व्यास वाले स्ट्विेिी वृक्ष प्रिाजतयों म ें िीजवत निीं रि पाते ि,ैं तो उन्ि ें1:5 के अनुपात में लगाया िाएगा । आवश्यक अजतररि भूजम उपभोगी संस्ट्र्ा द्वारा प्रिान की िाएगी और वृक्षारोपण स्ट्वय ं की लागत पर दकया िाएगा । 4. वक्षृ अजधकारी / उप-वन सरं क्षक द्वारा सफलतापवू कथ वक्षृ ारोपण और सरु क्षा िमा राजि िारी करन े पर जवचार करन ेके जलए आवश्यक ित:ें- a. उपरोि ताजलका 1 (क) और (ि) के अनुसार, िेिी प्रिाजतयों के 2670 पौधो का 100% प्रजतपूरक वृक्षारोपण और उनका सात वर्षो तक रिरिाव उपभोगी संस्ट्र्ा द्वारा दकया िायेगा । इस वृक्षारोपण के सफलता पूवथक स्ट्र्ापना के बाि उपभोगी संस्ट्र्ा द्वारा जनगरानी की िाएगी । b. 267 वृक्षो के प्रत्यारोपण / काटे िाने के बिल े म े 1:10 के अनुपात म े स्ट्वििे ी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 2670 पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोने के तीन मिीन े के अंिर जनधाथररत की गई भूजम पर अजतररि उपायों के सार् वक्षृ ारोपण स्ट्र्ल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और अजिम सात (7) वर्षों के जलए रिरिाव तर्ा उसके बािउनका रिरिाव उपभोगी संस्ट्र्ा द्वाराअपनी स्ट्वयं की लागत पर दकया िाएगा । c. वृक्षो के िटाए िाने के बिल े म े 1:10 के अनुपात म े स्ट्वििे ी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाल े 100 पौधो का प्रजतपूरक वृक्षारोपण इंिीजनयररंग भवन के पास दिल्ली जवश्वजवद्यालय पररसरपर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोने के तीन मिीन े के अंिर जनधाथररत की गई भूजम पर अजतररि उपायों के सार् वृक्षारोपण स्ट्र्ल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और अजिम सात (7) वर्षों के जलए रिरिाव तर्ा उसके बािउनका रिरिाव उपभोगी संस्ट्र्ा द्वारा अपनी स्ट्वय ं की लागत पर दकया िाएगा । d. यदि उपभोगी संस्ट्र्ा सफलतापूवथक प्रजतपूरक वृक्षारोपण करने में जवफल रिती ि।ै उपभोगी संस्ट्र्ाद्वारा अजतररि साइट सुधार िचों को िमा दकया िाएगा िो दक सम्बंजधत वृक्ष अजधकारी / उप- वन संरक्षक द्वारा गणना के अनुसार वृक्षारोपण के जलए उपयुि बनाने के जलए आवश्यक िो सकती िै । e. िो भूजम प्रजतपूरक वृक्षारोपण / वृक्ष प्रत्यारोपण के जलए आवंरटत ि,ै उसका उपयोग दकसी अन्य कायो के जलए सक्षम प्राजधकारी की स्ट्वीकृजत के जबना निीं दकया िाएगा। f. उपभोगी संस्ट्र्ा द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षत्रे दिल्ली सरकार को जनधाथररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वर्षथ के अंत में सम्बंजधत वृक्ष अजधकारी / उप- वन संरक्षक को प्रस्ट्तुत की िाएगी । प्रारूप की प्रजत https://dpta.eforest.delhi.gov.in पर उपलब्ध ि।ै g. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतपरू क वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई अजतक्रमण न िो । h. उपभोगी संस्ट्र्ा द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्र्ल में मृिा नमी संरक्षण कायथ की गजतजवजधयों को दकया िाएगा। i. उपभोगी संस्ट्र्ा के द्वारा यि सजु नजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तथत निीं दकया िाएगा। 5. यदि उपरोि में से कोई भी ित थ उपभोगी संस्ट्र्ा द्वारा परू ी निीं की िाती िै, तो संबंजधत वृक्ष अजधकारी / उप- वन संरक्षक द्वारा दिल्ली वृक्ष सरं क्षण अजधजनयम, 1994 की धारा 12 के अनुसार कारथवाई की िाएगी ।[PART IV DELHI GAZETTE : EXTRAORDINARY 5 6. 267 वृक्षो को उपराज्यपाल के आिेि स ेतर्ा उनके नाम पर, ए. के. बसंि, प्रधान सजचव (पयाथवरण एवं वन) DEPARTMENT OF FORESTS AND WILDLIFE NOTIFICATION Delhi, the 1st February, 2024 F. No. 54/CFD/TC/Felling/OnlineId-15283/2023-24/7808-15.—In exercise of the powers conferred by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Lt. Governor of National Capital Territory of Delhi, hereby, in public interest exempts an area of 4.8834 ha for construction of inter-Disciplinary Academic and Research Building of Eminence, Academic Building for faculty of Technology, Library Building and Computer Centre at North Campus, Delhi University, New Delhi from the provision of sub-section (3) of section 9 of the said Act. Total 321 252 15 2670 The said exemption is subject to fulfillment of the following conditions:- Sl. Location of Compensatory plantation. Number of Total Amount including To be No. saplings to other Administrative Deposited be planted expenses and with Forest contingency charges (in Division. Rs.). (1) (2) (3) (4) (5) (a) Compensatory Plantation of 2670 number of tree saplings (10x267=2670, i.e., ten times the number of trees permitted for Tree Officer / transplantation of trees) consisting of Deputy species of Neem, Amaltas, Peepal, 2770 1,57,89,000 /- Conservator of Pilkhan, Gular, Bargad, Desi Kikar and Forests Arjun along with other native species (Central) shall be carried out by User Agency at University of CAMPUS Shahbad Daulatpur, Bawana, Delhi in 24120 sqm. area. (b) Transplantation of 252 numbers of trees which are standing on site shall be done by User Agency with their own funds at University of CAMPUS Shahbad Daulatpur, Bawana, Delhi over an area of 4080 sqm. TERMS & CONDITIONS 1. University of Delhi herein referred to as User Agency, shall make an advance deposit of an amount of Rs 1,57,89,000 /- (One Crore Fifty Seven Lakh Eighty Nine Thousand Only, i.e., /- @ Rs. 57000/- per tree)6 DELHI GAZETTE : EXTRAORDINARY PART IV] (Refundable amount- Rs. 1,37,29,505/- Rupees (One Crore Thirty Seven Lakh Twenty Nine Thousand Five Hundred Five Only) and Administrative charges and contingencies- Rs. 20,59,495/-Rupees (Twenty Lakh Fifty Nine Thousand Four Hundred Ninety Five Only)) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven (7) years and the same shall be forfeited and utilized for plantation by the Forest Department if terms and conditions mentioned at 2, 3 & 4 are not followed by User Agency. 2. The conditions required to be fulfilled before starting transplantation/felling of trees by User Agency:- a. Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer / Deputy Conservator of Forests in compliance with Section-12 of Delhi Preservation of Trees Act, 1994. b. User Agency shall submit a detailed plan for site preparation and plantation. c. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling/ transplantation of trees. d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall necessarily be obtained by the User Agency. e. It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other clearances, if any obtained, shall be followed scrupulously. 3. The conditions required to be fulfilled during the transplantation/felling of trees:- a. Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied and should be completed not later than six (06) months of such date, after which a completion report has to be submitted to the concerned Tree Officer / Deputy Conservator of Forests. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site. b. The heritage banyan (Bargad) tree number 1 (at Computer Center) having girth of 550 cm shall be transplanted at nearby project site and extra care shall be given by the User Agency to ensure survival of this specific tree. c. All the conditions mentioned in Tree Transplantation Policy, 2020 shall be followed scrupulously by User Agency. d. User Agency shall maintain the transplanted trees for minimum three years by engaging the same transplantation agency which has carried out the transplantation. e. The transplantation shall be carried out prior to felling of 15 number of trees permitted herein. The 15 trees shall be removed / felled after successful transplantation of 252 trees and submission of compliance certificate to concerned Tree Officer / Deputy Conservator of Forests f. The progress report of transplantation / felling shall be submitted to concerned Tree Officer / Deputy Conservator of Forests along with complete details of trees by the User Agency. g. If any tree is found to have nest of birds it should not be felled / transplanted till the same is abandoned by the birds. h. Transplantation / felling of any tree apart from 267 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act (DPTA), 1994. i. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency. j. The lops & tops of the trees shall be sent / supplied to the nearest crematorium free of cost and the same should be reported to concerned Tree Officer / Deputy Conservator of Forests by User Agency. k. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the concerned Tree Officer / Deputy Conservator of Forests by User Agency. l. Transplantation / felling of trees and transportation of forest produce arising there from to the public crematorium shall be completed within 90 days. m. The User Agency shall ensure that the plan of this proposal shall not be changed. n. It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other clearances, if any obtained, shall be followed scrupulously. o. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously.[PART IV DELHI GAZETTE : EXTRAORDINARY 7 p. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy, 2020 have been followed and details of the same should be submitted to the Tree Officer / Deputy Conservator of Forests concerned. q. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with 15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be provided by User Agency & plantation has to be done at own cost. 4. The conditions required to be fulfilled for considering successful plantation & release of Security Deposit by the Tree Officer / Deputy Conservator of Forests :- a. 100% Compensatory Plantation of 2670 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment as mentioned on table above. b. 2670 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of transplantation / felling 267 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out there after by User Agency with their own funds. c. Additionally 100 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in the Delhi University campus near proposed Faculty of Engineering building on account of all trees being removed from the site. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out there after by User Agency with their own funds. d. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer / Deputy Conservator of Forests concerned (as deposits). e. The land over which compensatory plantation / Tree transplantation raised shall not be utilized for other purpose without the approval of the Competent Authority. f. User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife, Government of NCT of Delhi and a copy of the same shall be submitted to the concerned Tree Officer / Deputy Conservator of Forests at the end of every financial year. A copy of format is available in https://dpta.eforest.delhi.gov.in. g. Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory plantation/ transplantation. h. The User Agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation site. i. The User Agency shall ensure that the plan of this proposal shall not be changed. 5. If any of the above condition is not fulfilled by the User Agency, concerned Tree Officer/ / Deputy Conservator of Forests shall initiate action as per Section 12 of Delhi Preservation of Trees Act, 1994. 6. Permission for transplantation / felling of 267 numbers of tress is being granted to the User Agency at their own risk and without prejudice the claim(s) of any other person(s) who may be having any right(s) over the land or the trees.
