L.-33004/99 सी.जी.-डी.एल.-अ.-22092023-248882 xxxGIDHxxx CG-DL-E-22092023-248882 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 652] नई दिल्ली, बृहस्ट्प जतवार, जसतम्ब र 21, 2023/भाद्र 30, 1945 No. 652] NEW DELHI, THURSDAY, SEPTEMBER 21, 2023/BHADRA 30, 1945 राष्ट्रीय आयर्ु वज्ञि ान आयोग अजधसचू ना नई दिल्ली, 19 जसतम्ब र, 2023 जचदकत्सा जिक्षा के मानकों का अनरु क्षण जवजनयम, 2023 फा. स.ं एन-P016/1/2023-पीिीएमईबी-एनएमसी.—राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 और जविेष रूप से उक्त अजधजनयम की धारा 10, 24, 25 और 57 द्वारा प्रित्त समस्ट्त िजक्तयों का प्रयोग करते हुए, राष्ट्रीय आयुर्विज्ञान आयोग, जचदकत्सा जिक्षा में उच् च गणु वत्ता और उच्च मानकों को बनाए रखने के जलए, सामान्य और जविेष रूप से अपन े कायों का सुचारू अनुपालन सुजनजित करने के जलए जनम्नजलजखत जवजनयम बनाता ह।ै अध्याय I – प्रारंजभक 1. संजक्षप्त िीषकि - इन जवजनयमों को "जचदकत्सा जिक्षा मानकों का अनुरक्षण जवजनयम, 2023" कहा िाएग। संक्षेप म,ें इन जवजनयमों को एमएसएमईआर-2023 कहा िाएगा। 2. प्रारंभ - ये जवजनयम आजधकाररक रािपत्र म ेंउनके प्रकािन की तारीख से प्रवृत होंगे। 3. पररभाषाएँ - इन जवजनयमों म,ें िब तक दक संिभि म ें अन्यथा आवश्यक न हो, यहां पररभाजषत िब्िों का वही अथ ि होगा िो नीचे दिया गया ह ैऔर उनकी सिातीय अजभव्यजक्तयाँ और जवजवधताएं तिनुसार समझी िाएंगी – क. "अजधजनयम" स े राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 [2019 का अजधजनयम संख्या 30] अजभप्रते होगा। 6022 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] ख. "आयोग" स े राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 की धारा 3 के अधीन जवजधवत स्ट्थाजपत राष्ट्रीय आयुर्विज्ञान आयोग अजभप्रेत होगा। ग. "मल्ू याकं न" स े 'मूल्यांकन/जनरीक्षण' की अजभव्यजक्त या गजतजवजध अजभप्रेत होगी जिसम ें आभासी और/या भौजतक जनरीक्षण िाजमल होगा। घ. "एमएआरबी" से राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 की धारा 16 के अधीन गरित जचदकत्सा मूल्यांकन और रेट ंग बोड िअजभप्रेत होगा। ङ. "मजे डकल महाजवद्यालय या जचदकत्सा सस्ट्ं थान" - िब तक दक संिभि से अन्यथा अपेजक्षत न हो, इससे कोई ऐसा महाजवद्यालय या दकसी भी नाम से कोई ऐसी संस्ट्था ज्ञात अजभप्रेत होगी, जिसमें कोई व्यजक्त अध्ययन कर सकता ह ै या ऐसा कोई प्रजिक्षण पाठ्यक्रम पूरा कर सकता ह ै िो उसे दकसी मान्यता प्राप्त स्ट् नातक या स्ट् नातकोत्तर जचदकत्सा अहताि धारण करने के योग्य बनाएगा। च. "एमएसआर" से स्ट् नाकोत्तर जचदकत्सा जिक्षा बोडि या अन्तर स्ट्न ातक जचदकत्सा जिक्षा बोड ि द्वारा इस प्रकार या दििाजनिेिों के माध्यम से अजधसूजचत न्यूनतम मानक आवश्यकताएं अजभप्रेत होगा और जिसमें समय - समय पर िारी दकए गए व्याख्यात्मक र प्पणी, पररपत्र, परामिि आदि भी िाजमल होंगे। छ. "पीिीएमईबी" - राष्ट्रीय आयुर्विज्ञान आयोगअजधजनयम, 2019 की धारा 16 के अधीन गरित स्ट् नातकोत्तर जचदकत्सा जिक्षा बोडि को संिर्भति करता ह।ै ि. "यिू ीएमईबी" - राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 की धारा 16 के अधीन गरित स्ट् नातक जचदकत्सा जिक्षा बोडि को संिर्भति करता ह।ै झ. “ईएमआरबी”- राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 की धारा 16 के अधीन गरित नैजतकता और जचदकत्सा पंिीकरण बोड िको सिं र्भित करता ह।ै अध्याय II - वार्षकि प्रक ीकरण ररपो ि और उसका मल्ू याकं न 4. वार्षकि प्रक ीकरण का अजधिेि 1) अपनी स्ट्थापना के बाि, जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थान संबंजधत बोडि को एक वार्षिक प्रक ीकरण ररपो ि प्रस्ट्ततु करने के जलए बाध्य ह,ै िो यूिीएमईबी या पीिीएमईबी द्वारा अजधसूजचत एमएसआर और एनएमसी के जनयमों, िैसा भी मामला हो, के अधीन प्रिान की गई ितों को पूरा करता हो। 2) ऊपर बताई गई दकसी भी बात पर प्रजतकूल प्रभाव डाल े जबना, संबंजधत बोडि, संबंजधत जचदकत्सा संस्ट्थान या संबंजधत एिेंजसयों से िो उस जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थानों पर जनयंत्रण रखता ह,ै से वार्षिक प्रक ीकरण ररपो ि के संबंध म ेंऐसी अजतररक्त िानकारी मागं सकता ह,ै जिसे अपन ेआंकलन के जलए आवश्यक समझे। 3) जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थान या ऐसे जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थान पर जनयंत्रण रखने वाली संबंजधत एिेंसी या एिेंजसयों का यह कतिव्य होगा दक वे जनधािररत रीजत में संबंजधत बोड ि को िानकारी (अजतररक्त िानकारी सजहत) प्रस्ट्तुत करें। 5. ररपो ि का मल्ू याकं न 1) अजधजनयम के समग्र उद्देश्यों को ध्यान में रखते हुए, संबंजधत बोडि (पीिीएमईबी या यूिीएमईबी) यह सत्याजपत करने के जलए वार्षिक प्रक ीकरण ररपो ि का मूल्यांकन कर सकता ह ै दक जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थान एमएसआर या एनएमसी जवजनयमों िैसा भी मामला हो, के माध्यम से जनर्िष्टि अपेजक्षत जनधािररत आवश्यक ितों को पूरा करते ह,ैं जिसमें िाजमल होंग े– i. भौजतक अवसंरचना का सत्यापन; ii. वास्ट्तजवक जिक्षण और अनुसंधान के जलए आवश्यक संख्या म ें योग्य संकाय की उपलब्धता और जनयजमत और जनरंतर आधार पर आवश्यक छात्र जिक्षण गजतजवजधयाँ िरूु दकया िाना; iii. जवजभन्न जवजिष्टताओं के रोजगयों की संख्या, छात्रों के सवाांगीण प्रजिक्षण को पूरा करन े के जलए रोजगयों की जवजवधता, जवजभन्न प्रदक्रयाओं की संख्या, िल्य जचदकत्सा, प्रयोगिाला िांच, रेजडयोलॉजिकल िांच और अन्य प्रासंजगक िांच के संिभि म ेंपयाप्ति नैिाजनक सामग्री की उपलब्धता;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 iv. अपनाई गई जिक्षण पद्धजत का मूल्यांकन; v. मूल्यांकन की जवजध और रीजत, छात्रों की ग्रेडडंग; vi. छात्रों से फीडबैक की समीक्षा; vii. जचदकत्सा जिक्षा के मानकों से संबंजधत अन्य पैरामी र जिन्ह ें संबंजधत बोडि या एनएमसी द्वारा समय-समय पर िाजमल दकया िा सकता ह।ै 2) उपरोक्त (1) या इन जवजनयमों में कहीं भी प्रजतकूल प्रभाव डाले जबना, संबंजधत बोड,ि अपने जववेकानुसार, उपरोक्त संिर्भित वार्षिक प्रक ीकरण ररपो ि पर जवचार करत े समय जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थान से कोई अजतररक्त िानकारी या स्ट्पष्टीकरण या अजतररक्त िस्ट्तावेि आदि मांग सकता ह।ै 3) जचदकत्सा महाजवद्यालय उपरोक्त उपखण्ड (2) के अधीन मांगी गई ऐसी िानकारी या स्ट्पष्टीकरण या अजतररक्त िस्ट्तावेि इत्यादि को संबंजधत बोड ि या उस संबंध म ें आवेिक के जवजिष्ट अनुरोध पर संबंजधत बोड ि द्वारा समय प्रिान दकया गया ह,ै से पत्राचार प्राप्त होन े की तारीख से िल्ि से िल्ि लेदकन 30 दिनों के अंिर प्रस्ट्तुत करेगा। बित,े जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थान संबंजधत बोड ि द्वारा अपजे क्षत िानकारी या स्ट्पष्टीकरण या अजतररक्त िस्ट्तावेि आदि प्रस्ट्तुत करत े समय जनधािररत प्रारूप या प्रो-फॉमाि का पालन करेगा। 4) यदि आवेिक संबंजधत बोड ि द्वारा प्रिान दकए गए दकसी भी अजतररक्त समय सजहत जनधािररत समय के भीतर ऐसी िानकारी िमा करन े या स्ट्पष्ट करन े या अजतररक्त िस्ट्तावेि आदि प्रिान करन े म ें जवफल रहता है, तो इस े जवजनयमों का गैर- अनुपालन माना िाएगा और िाजस्ट्त लगाई िाएगी। 6. सयं क्तु या स्ट्वतत्रं मल्ू याकं न 1) इन जवजनयमों में अन्यथा उल्लेजखत दकसी भी बात के बाविूि, कोई भी बोड ि (संगत बोडि को छोडकर) व्यजक्तगत या सामूजहक रूप से, जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थान के वार्षिक प्रक ीकरण ररपो ि म ें दिए गए कथनों की स ीकता और/या सच् चाई और/या सत्यता का मूल्यांकन कर सकता ह।ै 2) िब उप-धारा (1) के अधीन उजल्लजखत ऐसा मूल्यांकन दकया िाता है, तो संबंजधत मेजडकल कॉलेि या मेजडकल संस्ट्थान का यह कतिव्य होगा दक वह मूल्यांकन के िौरान संबजं धत बोडि या बोडों को, िैसा भी मामला हो, सभी आवश्यक सहायता प्रिान करे, जिसमें िस्ट्तावेिों का खुलासा करना, अजतररक्त साक्ष्य प्रिान करना, िैसा भी मामला हो, मौजखक बयान प्रिान करना आदि िाजमल होगा। 3) ऊपर बताई गई दकसी भी बात पर प्रजतकूल प्रभाव डाल े जबना, इस प्रावधान के अधीन मूल्यांकन करने वाल े संबंजधत बोड ि या बोडों, अजनवायि रूप से मल्ू यांकन के ऐस े आचरण और उसके पररणाम को िल्ि से िल्ि, अन्य बोडों और एनएमसी के साथ साझा करेंग,े लेदकन यह अवधी सात दिनों स ेअजधक नहीं होनी चाजहए। 4) इस जवजनयम के अधीन ऐसे जनरीक्षण के बाि, यदि संबंजधत बोड ि या बोड ि दकसी सुधारात्मक उपाय या कारिवाई आदि पर जवचार करते ह,ैं तो ऐसे उपाय या कारिवाई की सूचना संबंजधत बोडि (यूिीएमईबी या पीिीएमईबी) के माध्यम स े जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थान को िी िाएगी। बिते यह जनगरानी करना संबंजधत बोडि की प्रिासजनक जिम्मेिारी होगी दक सूजचत दकए गए ऐसे उपाय या कारिवाई का जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थान द्वारा जवजधवत अनुपालन दकया िाए। 7. अनपु ालन का पररणाम 1) यदि जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थान यूिीएमईबी या पीिीएमईबी के जलए जनधािररत आवश्यकताओं को सफलतापूवकि पूरा करत े हुए पाया िाता है, तो संबंजधत बोडि अगला/आगामी िैक्षजणक वषि के जलए पाठ्यक्रम/पाठ्यक्रमों को िारी रखने और छात्रों के प्रवेि के जलए एक नवीनीकरण प्रमाणपत्र प्रिान करेगा। 2) यदि कोई खामी पायी िाती ह ै तो उसके जलये उपरोक्त जनणिय के साथ या उसके जबना भी िाजस्ट्त अजधरोजपत की िाएगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] अध्याय III – िाजस्ट्त 8. िाजस्ट्त 1) िहां संबंजधत बोडि के पास यह जवश्वास करन े का कारण ह ै दक एक जचदकत्सा संस्ट्थान दकसी वैधाजनक प्रावधान, उसके अधीन बनाए गए जनयमों का पालन करने में जवफल रहा ह ै या अपने संबंजधत बोडों द्वारा जनधािररत अपक्षे ाओं के न्यूनतम मानकों का अनपु ालन नहीं दकया है, या ऐसे तरीके से आचरण दकया ह ै िो जचदकत्सा जिक्षा और अभ्यास के लक्ष्यों के अनरूु प नहीं ह,ै बोडि या तो जचदकत्सा महाजवद्यालय कॉलेि या जचदकत्सा संस्ट्थान पर िाजस्ट्त अजधरोजपत करेगा और/या ऐसे कृत्य की आगे िांच करेगा और िहां भी आवश्यक हो उसमे सुधार करने का अवसर प्रिान करेगा। 2) उपरोक्त धारा 8.1 में बताई गई दकसी भी बात पर प्रजतकूल प्रभाव डाल े जबना, िाजस्ट्त लगाने में जनम्नजलजखत म ें से एक/अजधक/सभी िाजमल हो सकते ह ैं– क. जचदकत्सा संस्ट्थान द्वारा, सुधार/अनुपालन करन,े िैसा भी मामला हो का जनिेि के साथ चेतावनी िारी करना; ख. जचदकत्सा संस्ट्थान द्वारा प्रजत उल्लघं न या चूक के कायि के जलए मौदद्रक िुमािना िो एक करो र पयपये से अजधक नहीं होना चाजहए; ग. गलत घोषणा/िस्ट्तावेि/अजभलेख (मरीिों के ररकॉड ि सजहत) प्रस्ट्तुत करन े वाल े संकाय/जवभागाध्यक्ष (एचओडी)/डीन/जनिेिक/डॉक् र के जलए मौदद्रक िुमािना िो पांच लाख पयपय े से अजधक नहीं होना चाजहए। इसके अलावा, उन पर प्रचजलत राष्ट्रीय आयुर्विज्ञान आयोग पंिीकृत जचदकत्सक (पेिेवर आचरण) जवजनयम, के अधीन किाचार के जलए भी आरोप अजधरोजपत दकया िा सकता ह ैया िंजडत दकया िा सकता ह।ै घ. प्रत्यायन प्रदक्रया को रोका िाना; ङ. उस िैक्षजणक वषि या इतने वषों के जलए मौिूिा पाठ्यक्रम में सी ों की वृजद्ध सजहत दकसी भी नए पाठ्यक्रम के जलए आवेिन की प्रदक्रया को रोकने के जलए एमएआरबी को जसफाररि करना। च. जचदकत्सा संस्ट्थान द्वारा अगले या बाि के िैक्षजणक वषों म ेंप्रविे पान े वाले छात्रों की संख्या कम करना; छ. अगले या आगामी िैक्षजणक वषों में एक या अजधक पाठ्यक्रमों में प्रवेि को रोकना। ि. अनुमजत वापस लेन े के जलए एनएमसी को जसफाररि दकया िाना; झ. पांच िैक्षजणक वषों तक की अवजध के जलए प्रत्यायन रोकना और वापस लेना। ञ. व्यजक्तयों या एिेंसी के माध्यम से यूिीएमईबी, पीिीएमईबी या एनएमसी पर िबाव डालने का कोई भी प्रयास जचदकत्सा संस्ट्थान द्वारा सभी आवेिनों/अनुरोधों के प्रदक्रयाधीन को तत्काल रोक िगे ा। च. व्यजक्तयों या एिेंसी के माध्यम से यूिीएमईबी, पीिीएमईबी या एनएमसी पर िबाव डालने का कोई भी प्रयास जचदकत्सा संस्ट्थान द्वारा सभी आवेिनों/अनुरोधों पर जवचार करन े की प्रदक्रया को तत्काल रोक िगे ा। ि. बिते दक जचदकत्सा संस्ट्थान को कजमयों को सुधारन े के जलए उजचत अवसर दिया िा सकता ह ै और यदि वह अपेजक्षत मानिंडों को पूरा करन े में जवफल रहता ह ैतो आग ेकोई कारिवाई की िाएगी। बित े दक, यूिीएमईबी, पीिीएमईबी या एनएमसी उस समय लागू आपराजधक कानून के अनसु ार गलत िानकारी िेने, या झूिे िस्ट्तावेि तैयार करने के जलए आपराजधक कायिवाही भी िुरू कर सकता ह।ै बित ेदक, यूिीएमईबी, पीिीएमईबी या एनएमसी उस समय लागू आपराजधक कानून के अनसु ार गलत िानकारी िेने, या झूिे िस्ट्तावेि तैयार करने के जलए आपराजधक कायिवाही भी िुरू कर सकता ह।ै अध्याय IV – अपील 9. एनएमसी स ेअपील एक जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थान या ऐसा कोई भी पीज रत व्यजक्त दकसी भी आिेि के जखलाफ जनर्िष्टि उजचत िुल्क के साथ आयोग के समक्ष अपील िायर कर सकता ह।ै[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 बिते, ऐसी अपील, िैसा भी मामला हो, ऐसे आििे पाररत होने या समय व्यतीत होने के साि दिनों के भीतर िायर की िाती ह।ै 10. केंद्र सरकार स ेअपील िहां कोई आवेिक/जचदकत्सा महाजवद्यालय या जचदकत्सा संस्ट्थान आयोग के जनणिय से असंतुष्ट ह ै या िहां आयोग ऐसी अपील की प्राजप्त की तारीख से पैंतालीस दिनों के भीतर अपना जनणिय िेन े में जवफल रहता है, तो ऐसे आिेि की तारीख या समय व्यतीत होने की तारीख से तीस दिनों के भीतर, िैसा भी मामला हो, केंद्र सरकार के समक्ष िसू री अपील िायर की िा सकती ह।ै इस संबंध में केंद्र सरकार का जनणिय अंजतम होगा। डॉ.जवपुल अग्रवाल, सजचव [जवज्ञापन-III/4/असा./434/2023-24] र प्पणी: ये जवजनयम अग्रं ेिी और डहिं ी िोनों भाषाओं में प्रकाजित दकया िा रह े हैं, इन जवजनयमों की व्याख्या के बारे में कोई भी संिेह होने पर अग्रं ेिी संस्ट्करण ही मान्य होगा। NATIONAL MEDICAL COMMISSION NOTIFICATION New Delhi, the 19th September, 2023 MAINTENANCE OF STANDARDS OF MEDICAL EDUCATION REGULATIONS, 2023 F. No. N-P016/1/2023-PGMEB-NMC.—exercise of overall powers conferred by the National Medical Commission Act, 2019 and particularly by sections 10, 24, 25 and 57 of the said Act, National Medical Commission makes the following Regulations to ensure smooth compliance with its functions in general and particularly to maintain a high quality and high standards in medical education. CHAPTER I – PRELIMINARY 1. Short Title – These Regulations may be called the “Maintenance of Standards of Medical Education Regulations, 2023”. In short, these regulations will be called MSMER-2023. 2. Commencement - These Regulations shall come into force from the date of their publication in the official gazette. 3. Definitions – In these Regulations, unless the context otherwise requires the terms defined herein shall bear the meaning assigned to them below and their cognate expressions and variations shall be construed accordingly – a. “Act” shall mean National Medical Commission Act, 2019 [Act No. 30 of 2019]. b. “Commission” shall mean the National Medical Commission duly established under Section 3 of the National Medical Commission Act, 2019. c. “Evaluation” shall mean the expression or activity of ‘Evaluation/inspection’ which shall include virtual and/or physical inspection. d. “MARB” shall mean the Medical Assessment and Rating Board constituted under Section 16 of the National Medical Commission Act, 2019. e. “Medical College or Medical Institution” - unless the context otherwise requires, shall mean any college or by whatever name called, in which a person may undergo a course of study or training which will qualify him for the award of any recognized graduate or post-graduate medical qualification. f. “MSR” shall mean the Minimum Standards Requirements as notified by the Post Graduate Medical Education Board or Under Graduate Medical Education Board as such or by way of guidelines and which shall also include, explanatory notes, circulars, advisories, etc., issued from time to time. g. “PGMEB” - refers to Post Graduate Medical Education Board constituted under Section 16 of the National Medical Commission Act, 2019. h. “UGMEB”- refers to Undergraduate Medical Education Board constituted under Section 16 of the National Medical Commission Act, 2019. i. “EMRB”- refers to Ethics and Medical Registration Board constituted under Section 16 of the National Medical Commission Act, 2019.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] CHAPTER II – ANNUAL DISCLOSURE REPORT AND ITS EVALUATION 4. Mandate of Annual Disclosure 1) After its establishment, the medical college or medical institution is obligated to furnish an Annual Disclosure Report to the corresponding Board, satisfying such conditions provided under the notified MSRs by UGMEB or PGMEB and regulations of NMC, as the case may be. 2) Without prejudice to anything stated above, the concerned Board may seek such additional information with regard to the Annual Disclosure Report, as and when deemed necessary for their assessment and otherwise from the concerned medical institution or concerned agencies having or exercising control over that medical college or medical institution. 3) It shall be the duty of the medical college or medical institution or the concerned agency or agencies exercising control over such medical college or medical institution to furnish the information (including additional information) to the concerned Board in the prescribed mode. 5. Evaluation of Report 1) Keeping in mind the overall objectives of the Act, the respective Board (PGMEB or UGMEB) may undertake the evaluation of the Annual Disclosure Report for verifying whether the medical college or medical institution fulfils the required conditions prescribed by way of MSRs or NMC Regulations as the case may be, which shall include – i. verification of physical infrastructure; ii. availability of required number of qualified faculty for actual teaching and research and to undertake necessary student learning activities on a regular and continued basis; iii. availability of adequate clinical material in terms of number of patients of different specialties, variety of patients to fulfil all round training of students, number of variety of procedures, surgeries, laboratory investigations, radiological investigations and other relevant investigations; iv. assessment of the teaching methodology adopted; v. the methods and modes of assessment, grading of the students; vi. review of feedback from students; vii. other parameters related to standards of medical education that may be added from time to time by the respective boards or NMC. 2) Without prejudice to (1) above or elsewhere in these Regulations, at its sole discretion, the respective Board may seek any additional information or clarification or additional documents etc., from the medical college or medical institution while considering the Annual Disclosure Report referred above. 3) The Medical College shall furnish such information or clarification or additional documents, etc., sought under sub-section (2) above at the earliest but not later than 30 days from the date of receipt of communication from the respective Board or such additional time to be provided by the respective Board on specific request from the applicant in that regard. Provided, the medical college or medical institution shall adhere to the prescribed format or pro-forma, while furnishing of information or clarification or additional documents etc., as required by the concerned Board. 4) If the applicant fails to submit such information or clarify or provide additional documents etc., as mandated by the respective Board within such prescribed time including any additional time provided by the respective Board, shall be deemed as non-compliance with the Regulations and shall attract penalty. 6. Joint or Independent Evaluation 1) Notwithstanding anything stated elsewhere in these Regulations, any of the Board (other than corresponding Board) individually or collectively, may cause to evaluate the accuracy and/or truth and/or veracity of the averments made out in the Annual Disclosure Report from the medical college or medical institution. 2) When such evaluation as enumerated under sub-section (1) is undertaken, it shall be the duty of the concerned medical college or medical institution to provide all necessary support to the concerned Board or Boards as the case may be, in their course of evaluation, which shall also include disclosure of documents, providing additional evidence as the case may be, providing oral statements etc.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 3) Without prejudice to anything stated above, the concerned Board or Boards conducting evaluation under this provision, shall mandatorily share such conduct of an evaluation and its outcome to other Boards and NMC at the earliest but not exceeding seven days. 4) After such inspection under this Regulation, if the concerned Board or Boards contemplate any remedial measure or action etc., such measure or action shall be intimated to the medical college or medical institution, through the concerned Board (UGMEB or PGMEB). Provided it shall be the administrative responsibility of the concerned Board to oversee that such measure or action intimated are duly complied with by the medical college or medical institution. 7. Consequence of Compliance 1) If the medical college or medical institution is found to be successfully meeting requirements as prescribed for the UGMEB or PGMEB as the case may be, the concerned Board shall provide a renewal certificate for continuation of the course/s and admission of students thereof for the next/ coming Academic Year. 2) Any deficiency noted will attract penalties with or without the decision above. CHAPTER III – PENALTIES 8. Penalties 1) Where the respective Board has reason to believe that a medical institution has failed to comply with any statutory provision, regulations framed thereunder or has not complied with the Minimum Standards of Requirements as prescribed by their respective Boards, or has conducted themselves in any manner which is not in accordance with the goals of medical education and practice, the Board shall either penalize the medical college or medical institution and /or conduct further enquiry into such act and wherever needed provide an opportunity to rectify the same. 2) Without prejudice to anything stated at Section 8.1 above, the imposition of the penalty may include one/more/ all of the following – a. Issuance of warning with direction to rectify/comply, as the case may be, by the medical institution; b. Monetary penalty not exceeding INR one crore per violation or act of omission by the medical institution; c. Monetary penalty not exceeding Rupees five lakh for the faculty/Head of the Department (HoD)/ Dean/Director/doctor submitting false declaration/documents/records (including patients’ records). Further, they can also be charged or penalized for misconduct under the Registered Medical Practitioner (Professional Conduct) Regulations in vogue. d. Withholding the accreditation process; e. recommending to MARB for withholding processing of application(s) for any new course including increase of seats in the existing course for that academic year or for such number of years. f. Reducing the number of students in the next or subsequent academic years to be admitted by the medical institution; g. Stoppage of admission to one or more of the courses in the next or subsequent academic years. h. Recommending to NMC for withdrawal of permission; i. Withholding and withdrawal of accreditation for a period up to five academic years. j. Any attempt to pressurize UGMEB, PGMEB or NMC through individuals or agency will lead to immediate halt of the processing of all applications/requests by the medical institution. Provided that the medical institution, may be granted a reasonable opportunity to rectify the deficiencies and any further action shall be taken if it fails to meet the requisite norms. Provided further that, the UGMEB, PGMEB or the NMC may also initiate criminal proceedings for furnishing false information, or fabrication of false documents as per the criminal law in force at that time.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] CHAPTER IV –APPEALS 9. Appeal to NMC A medical college or medical institution or any such aggrieved person may file an appeal before the Commission with an appropriate fee as specified against any order. Provided, such an appeal is filed within sixty days of passing of such an order or lapse of time, as the case may be. 10 Appeal to the Central Government Where an applicant/ medical college or medical institution is aggrieved by the decision of the Commission or where the Commission fails to give its decision within forty-five days from the date of receipt of such an appeal, a second appeal may be filed before the Central Government within thirty days from the date of such order or lapse of time, as the case may be.
