सजमजत पद्धजत) जनयम, 2021 का प्रारूप, भारत के राजपत्र, ऄसाधारण म,ें संख्या जी एस अर 796 (इ), ददनांक
15 नवंबर 2021 के ऄधीन ईन सभी व्यजियों की जानकारी हते ु प्रकाजित दकया जजनके आससे प्रभाजवत होने की
संभावना ह ै ; और सूचना प्रदान की गइ थी दक ईि प्रारूप जनयमों पर केंद्र सरकार द्वारा आस ऄजधसूचना वाल े राजपत्र
की प्रजतयां सामान्दयजन को ईपलब्ध कराए जाने की तारीख स े तीस ददनों की ऄवजध की समाजि के पश् चात जवचार दकया
जाएगा;
और जबदक ईजल्लजखत राजपत्र ऄजधसूचना की प्रजतयां सामान्दयजन को 15 नवंबर, 2021 को ईपलब्ध करा दी
गइ थीं;
और जबदक, ईजल्लजखत प्रारूप जनयमों के संबंध म ेंजनता स ेकोइ अपजि और सुझाव प्राि नहीं हुए थे;
ऄत:, ऄब, केंद्र सरकार समुद्री नौचालन सहायता ऄजधजनयम, 2021 (2021 का 20) की धारा 46 की
ईप-धारा (2) द्वारा प्रदि िजियों का प्रयोग करत े हुए जनम्नजलजखत जनयम बनाती ह,ै नामत: -
1. लघ ु िीर् ग और प्रारंभता .– (1) आन जनयमों का नाम समुद्री नौचालन सहायता (केन्दद्रीय सलाहकार सजमजत पद्धजत)
जनयम, 2022 ह।ै

(2) य ेराजपत्र म ेंईनके प्रकािन की जतजथ से लाग ू होंगे ।
2. पररभार्ाएं .- (1) आन जनयमों में, जब तक दक जवर्य की ऄन्दयथा अवश्यकता न हो,
(क) “ऄजधजनयम” ऄथागत समुद्री नौचालन सहायता ऄजधजनयम, 2021 (2021 का 20);
(ख) “सजमजत” ऄथागत ऄजधजनयम की धारा -6 के ऄधीन नौचालन सहायता हते ु केन्दद्रीय सलाहकार सजमजत का
गठन;
(ग) “वार्षर्क ररपोर्ग” ऄजधजनयम की धारा -36 के ऄधीन संदर्षभत वार्षर्क ररपोर्ग;
(घ) “ऄध्यक्ष” ऄथागत सजमजत का ऄध्यक्ष;
(ङ) “सदस्ट्य” ऄथागत सजमजत के सदस्ट्य;
(च) “सदस्ट्य सजचव” ऄथागत सजमजत के सदस्ट्य सजचव;
(छ) “गरै िासकीय सदस्ट्य” ऄथागत सजमजत का ऐसा सदस्ट्य जो केन्दद्र सरकार द्वारा पोजर्त दकसी संस्ट्थान ऄथवा
संगठन ऄथवा जनकाय में जनयिु न हो;
(2) आन जनयमों म ें प्रयिु िब्द एव ं व्याख्या जो पररभाजर्त न की गइ हो और ऄजधजनयम में पररभाजर्त दकए गए हों,
का आस ऄजधजनयम में क्रमिः समान तात्पयग प्रदान दकया गया ह।ै
3. सजमजत का गठन .- सजमजत के जनम्न जलजखत सदस्ट् य होंग,े नामत: -
(i) सजचव, भारत सरकार, पत् तन, पोत पररवहन और जलमाग गमत्रं ालय, पदेन (ऄध् यक्ष);
(ii) ऄपर सजचव और जवत् तीय सलाहकार, भारत सरकार, पत् तन, पोत पररवहन और जलमागग मंत्रालय, पदने
(सदस्ट् य);
(iii) संयुक् त सजचव, भारत सरकार, पत् तन, पोत पररवहन और जलमाग ग मंत्रालय, महाजनदेिालय, नौचालन
सहायता से संबंजधत मामलों का जनपर्ान, पदेन (सदस्ट् य) ;
(iv) समुद्री सलाहकार, भारत सरकार, पदेन (सदस्ट् य) ;
(v) मुख्य जलसववेकक्षक, भारत सरकार, पदेन (सदस्ट् य) ;
(vi) महाजनदेिक, नौचालन सहायता, सदस्ट् य सजचव होंग,े पदेन (सदस्ट् य) ;
(vii) भारतीय तर् रक्षक का एक प्रजतजनजध (सदस्ट् य) ;
(viii) भारतीय पत् तन संघ का एक प्रजतजनजध (सदस्ट् य);
(ix) भारतीय समुद्री जवश् वजव्ालय का एक प्रजतजनजध (सदस्ट् य);
(x) संसद के दो सदस्ट्य, लोकसभा का एक सदस्ट् य और रा्यसभा का एक सदस्ट् य;
(xi) भारतीय राष्ट्रीय पोत स्ट्वामी संघ (गरै िासकीय सदस्ट्य) का एक नाजमत प्रजतजनजध;
(xii) भारतीय वाजण् य एवं ई्ोग महासंघ (गरै िासकीय सदस्ट्य) का एक नाजमत सदस्ट्य;
(xiii) भारतीय वाजण् य और ई्ोग मंडल (गैर िासकीय सदस्ट्य) का एक नाजमत सदस्ट्य;
(xiv) सेललग वैसल की ओर स े पजिमी तर् और पूवी तर् की एक-एक (गैर िासकीय सदस्ट्य) केन्दद्र सरकार के दो
नाजमत प्रजतजनजध;
(xv) मछुअरों की ओर से (गरै िासकीय सदस्ट्य) केन्दद्र सरकार का एक नाजमत ऄजधकारी;
(xvi) कंर्ेनर जिलपग लाआन द्वारा नाजमत (गैर िासकीय सदस्ट्य) एक प्रजतजनजध।
4. सजमजत का कायकग ाल .- एक ही समय पर सजमजत का गठन का 02 साल की ऄवजध हते ु दकया जाएगा, जजसे 06 माह
ऄथवा नइ सजमजत गरठत होन ेतक, जो भी पहल े हो, तक की ऄवजध हते ुबढाया जा सकता ह।ै[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3
5. सजमजत की ऄवजध .- आन जनयमों के ऄन्द य प्रावधानों के ऄंतगतग , पदेन सदस्ट् य के ऄजतररक्त प्रत् यके सदस्ट् य दो वर् ग की
ऄवजध हते ु पद धारण करेगा ;
बितवेक, सजमजत के सदस्ट् य के रूप में संसद सदस्ट् य दो साल की ऄवजध हते ु ऄथवा जजसका वह प्रजतजनजधत्व करता ह ै
ईसका सदस्ट् य बना रहता ह,ै जो भी कम हो, तक पद धारण कर सकता ह।ै
6. अकजस्ट्मक ररजिया ं .- सजमजत में हुइ अकजस्ट्मक ररजि को जसै ी भी मामला हो, केन्दद्र सरकार द्वारा नामांकन ऄथ वा
जनयुजि द्वारा भरा जाएगा और नामांकन ऄथवा जनयुजि के रूप में जनयुक्त दकया गया सदस्ट्य , ईतनी ही ऄवजध तक
पद धारक रहगे ा, जब तक दक, प्रश् नगत सदस्ट् य का स्ट् थान भरता नहीं ह।ै
7. सदस्ट्य का त्य ागपत्र.- (1) कोइ भी सदस्ट् य, पदेन सदस्ट् यों के ऄजतररक् त, ऄध् यक्ष को संबोजधत ऄपने पत्र के द्वारा ऄपनी
सदस्ट् यता स े त् याग पत्र दे सकता ह,ै बितवेक ऄध् यक्ष द्वारा ईसका त् याग पत्र स्ट् वीकृत करन े या त्य ाग पत्र देन े की जतजथ स े
तीस ददन परू े होन,े जो भी पहले हो, तक ईसे पद पर बना रहना होगा।
(2) ऄध् यक्ष द्वारा त् यागपत्र स्ट् वीकार दकए जान े की जतजथ स े ऄथवा त् याग पत्र ददए जाने की तीस ददनों की ऄवजध के
पश् चात, जो भी पहले हो, से सदस्ट् य को ररक्त माना जाएगा।
8. सदस्ट्य का हर्ाया जाना.- केन्द द सरकार दकसी भी समय दकसी भी सदस्ट् य को सदस्ट् यता से हर्ा सकती ह,ै ऄथागत:
(i) यदद वह ऄध् यक्ष की ऄनुमजत के बगैर सजमजत की दो बैठकों में लगातार रूप से ऄनुपजस्ट्थत रहा हो;
(ii) यदद वह ऄमुक् त ददवाजलया हो ;
(iii) यदद वह दकसी ऐसे ऄपराध में दोर्ी ठहराया जाता ह,ै जजसम,ें केन्द द्र सरकार के ऄनुसार नैजतक ऄधमता हो;
(iv) केन्द द्र सरकार के मतानुसार यदद, ईन्द होंने ईनके जहतों का प्रजतजनजधत्व करना बंद कर ददया हो, जजनकी ओर स े
ईन्द ह ें जनयुक्त दकया गया था ;
(v) यदद केन्द द्र सरकार की राय म,ें यह दकसी ऄन्द य कारण स,े जलजखत रूप में दज ग दकया जाना ह,ै यह वांछनीय
नहीं ह ैदक वह सदस्ट् य बना रह।े
9. सजमजत के प्रजतजनजधत्व का जनलबं न ऄथवा समापन.- केन्द द्र सरकार की यह राय ह ै दक यदद, जो वह अवश्यक समझे दक
सजमजत में प्रजतजनजधत्व करने वाले दकसी जनकाय या संघ न े ऄजधजनयम के ईद्देश्यों के प्रजतकूल कायग दकया ह ै या काय ग
कर रहा ह,ै तो अदेि द्वारा, ईस जनकाय या संघ के प्रजतजनजधत्व को ईस अदेि म ें जनर्ददष्ट ऄवजध के जलए जनलंजबत कर
सकते ह ैं या ईस े पूरी तरह स े समाि कर सकते हैं ; बित वेक आस जनयम के ऄधीन आस तरह के जनकाय ऄथवा सघं को
सुनवाइ का ईजचत ऄवसर ददए जबना कोइ अदेि पाररत नहीं दकया जाएगा ।
10. सजमजत का जवस्ट्त ार.- केन्द द्र सरकार की यह राय ह ै दक यदद, दकसी जनकाय या संघ का सजमजत में प्रजतजनजधत्व नहीं ह ै या
सजमजत में ऄपयागि प्रजतजनजधत्व ह,ै तो मामला जैसा भी हो वह ऐसे जनकाय या संघ को प्रजतजनजधत्व दे सकती ह ै या
सजमजत में ऄजतररि सदस्ट्य के नामांकन के जलए कह सकती ह।ै
11. सजमजत के सदस्ट्य सजचव.- (1) महाजनदेिक, नौचालन सहायता, सजमजत के सदस्ट् य सजचव के रूप म ेंकायग करेंगे।
(2) सदस्ट् य सजचव के कतगव् य :-
(क) ऄध् यक्ष महोदय के जनदवेकि पर सजमजत ऄथवा जनयम 23 के ऄधीन जवजनर्ददष् र् एक ईप सजमजत की बैठक
अयोजजत करना;
(ख) कायगवृत् त और सदस्ट् य रजजस्ट् र्र का रख-रखाव करना;
(ग) ऄध् यक्ष महोदय को ईनके कायों म ें सहायता करना;
(घ) समय समय पर सजमजत द्वारा ईन्द ह ेंसौंपे जाने वाले दाजयत् वों का जनष्प ादन करना ।
12. सदस्ट्य रजजस्ट्र् र :- सदस्ट् य सजचव ऐसे एक रजजस्ट् र्र का रख-रखाव करेंग े जजसमें सजमजत के सभी सदस्ट् यों के नाम और
पतों से संबंजधत जववरण दज गहोगा।
13. सजमजत की बठै कें.- (1) सामान्द यत: सजमजत की बैठक 12 माह के ऄंतराल म ें होती ह ै और अवश् यकता ऄनुसार कम

(2) सजमजत की ऄसाधारण बठै क बुलाइ जाएगी, यदद सजमजत के कम से कम पांच सदस्ट् य, बैठक बुलाने के ईदश्े् य
और कारणों के प्रस्ट्त ाव को जलजखत रूप में ऄध् यक्ष महोदय के समक्ष प्रस्ट् ततु करते ह।ै
(3) सजमजत की प्रत् यके बैठक ऄध् यक्ष महोदय द्वारा जवजनजित जतजथ, तय समय और ऐसे स्ट्थ ान पर अयोजजत की
जाएगी।
(4) ऄध् यक्ष द्वारा सजमजत की प्रत् येक बैठक की ऄध् यक्षता की जाएगी और ईनकी ऄनपु जस्ट्थजत म ें ईपजस्ट्थत सदस्ट् य
बैठक की ऄध् यक्षता हते ु स्ट् वयं म ें से दकसी एक सदस्ट् य का चयन कर सकते ह ैं और ईि के ऐसे सदस्ट्य को ऄजधसूजचत
कर सकते ह।ैं
14. बठै क की सचू ना और कायसग चू ी.- (1) सजमजत के सदस्ट् यों को सजमजत की बैठक, स्ट् थान और समय संबंधी सूचना बैठक

(2) ईप जनयम (1) के ऄधीन सूचना सदस्ट् यों को डाक ऄथवा दकसी भी इलेक्र ाजनक माध् यम स े ईपलब् ध करायी जा
सकती ह।ै
15. कायसग चू ी.- सजमजत की बैठक की सूचना सजहत प्रस्ट् ताजवत बैठक की कायगसूची भी सजमजत के प्रत् येक सदस्ट् य को
ईपलब् ध करायी जानी ऄपेजक्षत ह,ै ऄध्यक्ष की ऄनुमजत के जबना बैठक में ऐसा कोइ भी मद िाजमल नहीं दकया जाएगा
जो कायगसूची में सजम्मजलत न दकया गया हो।
16. बठै क हते ुकायसग ाधक सख्ं य ा.- (1) सजमजत की बैठक हते ु कायगसाधक संख्य ा पांच होगी।
(2) यदद दकसी भी समय बैठक की कायगसाधक संख् या नहीं होती ह ै तो सजमजत की बैठक ऄगली तारीख हते ु स्ट्थ जगत कर
दी जाएगी, नयी जतजथ मलू बठै क की तारीख स े चौदह ददनों के पहल े की होगी और स्ट्थजगत बैठक म ें कायग दकया
जा सकता ह,ै भले ही ईस बैठक में कायगसाधक संख्य ा हो या न हो।
(3) जजस जवर्य से बैठक स्ट्थ जगत हुइ थी, ईसी जवर्य से चचाग प्रारंभ की जाएगी। ऄपणू ग जवर्य के ऄजतररक्त ऄन्द य
दकसी भी जवर्य पर चचाग नहीं की जाएगी।
17. बठै क की प्रदक्रया .- (1) आच् छुक सदस्ट् य सजमजत की बैठक की जनधागररत जतजथ स े पंद्रह ददन पूव ग जलजखत रूप स े सदस्ट् य
सजचव को सूचीबद्ध कायगसूची के संबंध में चचाग म ेंिाजमल होने की आच् छा की जानकारी से ऄवगत कराएंगे।
(2) सजमजत की बैठक की ऄध् यक्षता करन ेवाला सदस्ट् य बैठक के संचालन को जनयंजत्रत करेगा।
(3) बैठक म ेंईपजस्ट्थत सदस्ट् यों में मतभेद होन े की दिा में सजमजत बहुमत का समथगन करेगी।
(4) प्रत् यके सदस्ट् य का एक मत होगा, और यदद दकसी जवर्य पर मत समान हो जात े ह ैतो ऄध्य क्ष ऄथवा ऄध् यक्षता
करने वाल ेसदस्ट् य का मत जनणायग क होगा ।
18. इलक्ै र ोजनक माध्य म स े सजमजत की बठै क और कारगवाइ सचं ाजलत करन े की िजि.- सजमजत के सदस्ट् य सजचव जवजडयों
कान्द रेलसग ऄथवा ऄन्द य इलैक्र ोजनक माध् यम से सजमजत की बैठक और सजमजत की कारगवाइ अयोजजत कर सकत े ह।ैं
19. बठै क का कायवग त्ृ त .- (1) सजमजत के सदस्ट् य सजचव द्वारा बैठक के कायगवृत् त का जनमागण दकया जाएगा और प्रश् नगत
कायगवृत् त सजमजत के प्रत् येक सदस्ट् य में पररचाजलत दकया जाएगा और दकसी भी संिोधन के साथ कायगवृि को सजमजत
की ऄगली बैठक म ेंपजु ष्ट के जलए रखा जाएगा।
(2) कायगवृत् त की पुजष्ट और ऄध् यक्ष ऄथवा जजन्द होंन े ऄध् यक्षता की ह,ै के हस्ट्त ाक्षर के पश् चात कायगवृत् त बही म ें दज ग दकया
जाएगा । प्रत्येक बैठक म ेंईपजस्ट्थत सदस्ट्यों के नाम कायगवृि पुजस्ट्तका में दज गदकए जाएंगे।
(3) सजमजत की दकसी भी बैठक में ईपजस्ट्थत होने वाले सदस्ट्य आस प्रयोजन के जलए ईपलब्ध कराइ जाने वाली पस्ट्ु तक
ऄथवा रजजस्ट्र्र म ेंऄपन े नाम पर हस्ट्ताक्षर करेगा।
20. सजमजत द्वारा की गइ जसफाररि.ें - सजमजत द्वारा जलए गए जनणगयों पर दकसी प्रकार की कारगवाइ की ऄवश् यकता होन े
की दिा म ें जनणगय को जसफाररि का जलजखत रूप प्रदान करत े हुए ररकाड ग दकया जाए और ईसे पत् तन, पोत पररवहन
और जलमागग मंत्रालय को ऄग्रेजर्त दकया जाए।
21. बठै कों म ें भाग लने े वाल े गरै सदस्ट्य .- सजमजत के ऄध् यक्ष रा्य समुद्री बोडों के प्रजतजनजधयों ऄथवा दकसी सजमजत
ऄथवा रा्य समुद्री बोडों के कायों का जवतरण करन े वाल े व्यजियों के जनकाय, ऄथवा दकसी भी व्यजि को,[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5
भारतीय ऄथवा ऄन्द यथा, जजसके पास जवर्य वस्ट्तु जविेर्ज्ञता ह,ै सजमजत की दकसी भी बैठक म ें भाग लेन े के जलए
ईपजस्ट्थत होने के जलए अमंजत्रत कर सकता है; बित वेक ऐसे सदस्ट्य ों को मताजधकार नहीं होगा।
22. ईप सजमजत की जनयजु ि.- सजमजत मामलों के संदभग में सलाह की प्रदानगी हते ु दकसी जवजिष्ट जवर्य ऄथवा जवर्यों
पर ररपोर्ग करन ेके ईद्देश्य से सजमजत एक ऄथवा ऄनेक ईप सजमजतयां, स्ट् थायी ऄथवा ऄन्द य गरठत कर सकती ह।ै
23. गरै सरकारी सदस्ट्य ों के ऄलावा ऄन्दय सदस्ट्य ों को भत्त ों की प्रदानगी.- गैर सरकारी सदस्ट् यों के ऄलावा यात्रा करन े
वाले वाले ऄन्द य सदस्ट् यों को आन जनयमों के ऄधीन ईन्द ह ें ईनके दाजयत् व के जनवहनग हते ु यात्रा भत् ता, दैजनक भत् ता और
ऄन्द य भत् तों की प्रदानगी ईनकी मान्द यता के ऄनुसार की जाएगी, जो ईनके मूल जवभाग को जनयंजत्रत करने वाल े
जनयमों के ऄनुसार दकया जाएगा, जजससे ईनका संबंध ह।ै
24. गरै सरकारी सदस्ट्य ों को भत्त ों की प्रदानगी.- सांसद के ऄजतररक्त गरै सरकारी सदस्ट् य को आन जनयमों के ऄधीन ईन्दह ें
ईनके दाजयत् व के जनवहनग हते ु यात्रा भत् ता, दैजनक भत् ता और ऄन्द य भत् तों की प्रदानगी ईनकी मान्द यता के ऄनुसार की
जाएगी जैसा दक महाजनदेिक, समुद्री नौचालन सहायता द्वारा जनधागररत दकया गया ह।ै
25. सासं दों को भत्त ों भत्त ों की प्रदानगी.- (1) संसद सदस्ट्यों के वते न, भिे और पेंिन ऄजधजनयम, 1954 (1954 के 30)
की धारा 4 के ऄधीन संसद सदस्ट् य स्ट् वीकायग यात्रा भिा, दैजनक भिा और ऄन्दय भिे प्राि करन े का हकदार होगा।
(2) जब संसद ऄथवा एक संसदीय सजमजत, जजस पर सदस्ट्य सेवा कर रहा है, सत्र में ह,ै सदस्ट्य सजमजत के साथ ऄपन े
कायग के संबंध में कोइ दैजनक भिा प्राि करने का हकदार नहीं होगा, जब तक दक वह प्रमाजणत नहीं करता दक सजमजत
से जुडे ऄपने काम के कारण ईसे संसद या संसदीय सजमजत के सत्र में भाग लने े स े रोका गया था और आसजलए संसद स े
कोइ दैजनक भिा नहीं जलया, जजसके बाद वह उपर बताए ऄनसु ार दैजनक भिा प्राि करन े का हकदार होगा।
(3) जब कोइ संसद सदस्ट् य को दकसी केंद्र सरकार ऄथवा रा्य सरकार ऄथवा एक स्ट्वायि औ्ोजगक या वाजणज्यक
ईपक्रम ऄथवा जनगम, ऄथवा वैधाजनक जनकाय ऄथवा एक स्ट्थानीय प्राजधकरण के खचग पर जन:िल्ु क अवास और
भोजन की ऄनुमजत दी जाती ह,ै जजसम ें सरकारी धन का जनविे दकया गया ह ै ऄथवा जजसमें सरकार का कोइ ऄन्दय
जहत हो, दैजनक भिे का भगु तान संसद सदस्ट् य (यात्रा और दैजनक भत् ता) जनयम 1957 के ऄंतगगत जवजनयजमत होगा ।
26. गरै सदस्ट्य ों हते ु भत्त ा.- महाजनदेिक, नौचालन सहायता द्वारा जनयम 23 और जनयम 24 के ऄधीन दकए गए
जनधागणानुसार, आन जनयमों के ऄधीन गैर सदस्ट् य द्वारा ऄपने दाजयत् वों के जनष्प ादन हते ु ऄथवा प्रश् नगत संदर्षभत बैठक
में भाग लने े के जलए की गइ यात्रा हते ु मान्द यता के ऄनुसार यात्रा भत् ता, दैजनक भत् ता और ऄन्दय भत् तों की प्रदानगी की
जानी ह।ै

NOTIFICATION
New Delhi, the 25th April, 2022
G.S.R. 330(E).—Whereas the Central Government had, in exercise of its powers under sub-section
(1) of section 46 of the Marine Aids to Navigation Act, 2021 (20 of 2021), published the draft Marine Aids
to Navigation (Central Advisory Committee Procedural) Rules, 2021, in the Gazette of India,
Extraordinary, vide number G.S.R 796 (E), dated 15th November 2021 for information of all persons likely
to be affected thereby; and notice was given that the said draft rules would be taken into consideration by
the Central Government after the expiry of a period of thirty days from the date on which copies of the
Gazette containing this notification are made available to the public;
And whereas, the copies of the said Gazette notification were made available to the public on 15th
November, 2021;
And whereas, no objections and suggestions were received from the public in respect of the said

Now, therefore, in exercise of the powers conferred by sub-section (2) of section 46 of the Marine
Aids to Navigation Act, 2021 (20 of 2021), the Central Government hereby makes the following rules,
namely:-
1. Short title and commencement.—(1) These rules may be called the Marine Aids to Navigation (Central
Advisory Committee Procedural) Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.—(1) In these rules, unless the content otherwise requires,
(a) “Act’ means the Marine Aids to Navigation Act, 2021 (20 of 2021);
(b) “Committee” means the Central Advisory Committee for aids to navigation constituted under
section 6 of the Act;
(c) “Annual Report” means the annual report referred to in section 36 of the Act;
(d) “Chairperson” means the Chairperson of the Committee;
(e) “member” means a member of the Committee;
(f) “Member-secretary” means the Member-secretary of the Committee.
(g) “Non-official member” means such a member of the Committee who is not employed in any
institution or organisation or body funded by the Central Government;
(2) Words and expressions used but not defined in these rules, and defined in the Act, shall have the
same meaning respectively assigned to them in the Act.
3. Constitution of the Committee.—The Committee shall consist of the following members, namely:-
(i) The Secretary to the Government of India, Ministry of Ports, Shipping and Waterways, ex-officio
(Chairperson);
(ii) The Additional Secretary and Financial Adviser to the Government of India, Ministry of Ports,
Shipping and Waterways, ex-officio (member);
(iii) The Joint Secretary to the Government of India, Ministry of Ports, Shipping and Waterways
dealing the matters pertaining to Directorate General of Aids to Navigation, ex-officio (member);
(iv) The Nautical Adviser to the Government of India, ex-officio (member);
(v) The Chief Hydrographer to the Government of India, ex-officio (member);
(vi) The Director General of Aids to Navigation shall be the Member-secretary;
(vii) One representative of Indian Coast Guard (member);
(viii) One representative of Indian Ports Association (member);
(ix) One representative of Indian Maritime University (member);
(x) Two Members of Parliament, one of each from the Lok Sabha and the Rajya Sabha;
(xi) One representative nominated by the Indian National Ship Owners’ Association (non-official
member);
(xii) One representative nominated by the Federation of Indian Chambers of Commerce and Industries
(non-official member);
(xiii) One representative nominated by the Associated Chambers of Commerce and Industry of India
(non-official member);
(xiv) Two nominees of the Central Government representing sailing vessels’ interests, one each from
the West and East Coast of India (non-official member);
(xv) One nominee of the Central Government representing interests of fishermen (non-official
member);
(xvi) One representative nominated by the Container Shipping Lines Association (non-official

4. Tenure of the Committee.—The Committee shall be constituted for a period of two years at a time
extendable up to a further period of six months or till the new committee is reconstituted, whichever is
earlier.
5. Term of Office.—Subject to other provisions of these rules, every member other than an ex-officio
member shall hold office for a period of two years;
Provided that a Member of Parliament as member of the Committee shall hold office for a period of two
years or for so long as he continues to be a member of that House, which he represents, whichever
occurs earlier.
6. Casual vacancies.—A casual vacancy in the office of member shall be filled by nomination or
appointment made by the Central Government, as the case may be and a member so nominated or
appointed to fill the vacancy shall hold office for so long only as the member whose place he fills would
have continued to hold office, if vacancy had not occurred.
7. Resignation of office of the member. —(1) A member, other than the ex-officio Members, may resign
his membership by a letter addressed to the Chairperson; provided that he shall continue in office until
his resignation is accepted by the Chairperson or expiry of thirty days from the date of resignation,
whichever is earlier.
(2) The office of the member shall fall vacant from the date on which the resignation of such member
is accepted by the Chairperson or expiry of thirty days from the date of resignation, whichever is
earlier.
8. Removal of Member. —The Central Government may remove any member from the office for the
following reasons, namely:
(i) if, he absents himself for two consecutive meetings of the Committee without the permission of
the Chairperson;
(ii) if, he is an undischarged insolvent;
(iii) if, he is convicted of any offence which, in the opinion of the Central Government, involves moral
turpitude;
(iv) if, in the opinion of the Central Government, he has ceased to represent the interests on whose
behalf he was appointed;
(v) if, in the opinion of the Central Government, it is for any other reason, to be recorded in writing,
not desirable that he should continue to be a member.
9. Suspension or termination of representation of the Committee. —If the Central Government is of
the opinion that anybody or association, which is represented on the Committee, has acted or is acting
in a manner prejudicial to the objectives of the Act, it may, by order, suspend the representation of that
body or association for such period as may be specified in that order or may terminate the same
altogether:
Provided that no order shall be passed under this rule without giving any such body or association a
reasonable opportunity of being heard.
10. Expansion of the Committee. —If the Central Government is of the opinion that anybody or
association which is not represented on the Committee or is inadequately represented on the Committee,
it may give representation to such body or association or ask for nomination of additional member in
the Committee, as the case may be.
11. Member-secretary of the Committee. - (1) The Director General of Aids to Navigation, shall also
function as Member-secretary to the Committee.
(2) The Member-secretary shall be responsible for.-
(a) convening, under the direction of the Chairperson, meetings of the Committee or of a sub-
committee of the Committee referred to in rule 23;
(b) maintaining the minutes book and the register of the members;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(c) assisting the Chairperson in discharging his functions;
(d) undertaking such other duties as may be assigned to him by the Committee from time to time.
12. Register of Members. —The Member-secretary of the Committee shall maintain a register containing
the names and addresses of all the members.
13. Meetings of the Committee. — (1) The Committee shall meet ordinarily once in twelve months and if
necessary, meet at shorter intervals.
(2) An extraordinary meeting of the Committee shall be convened, if not less than five members send a
written requisition to the Chairperson stating the object and reasons for which the meeting is
proposed.
(3) Every meeting of the Committee shall be held on such date and at such time and such place as the
Chairperson may decide.
(4) Every meeting of the Committee shall be presided over by the Chairperson and in his absence, the
members present shall elect one from amongst themselves to preside over the meeting and notify
such member of the same.
14. Notice of meeting and agenda. - (1) Notice of the place, date and time of each meeting of the
Committee shall be sent to the members at least thirty (30) days before the date of meeting:
Provided that a shorter notice may be given in cases where, in the opinion of the Chairperson, on
exigencies.
(2) A notice under sub-rule (1) shall be served to the members by post or any electronic mode.
15. Agenda. —A list of the business proposed to be transacted at the meeting shall be sent to every member
along with the meeting notice, and no business which is not on the list, shall be transacted at the
meeting except with the permission of the Chairperson.
16. Quorum for the meeting. - (1) the quorum for a meeting of the Committee shall be not less than five
members of the Committee.
(2) If any time there is no quorum, the meeting of the Committee shall be adjourned to a later date,
such date being not later than fourteen days from date of original meeting and business may be
transacted at the adjourned meeting whether or not there is quorum.
(3) No business shall be transacted at any adjournment meeting other than the business left unfinished
at the meeting from which the adjournment took place.
17. Procedure of the meeting. —(1) A member desiring discussion on listed agenda shall give written
notice to the Member-secretary at least fifteen days before the date fixed for the meeting of the
Committee.
(2) The member presiding the Committee meeting shall regulate the conduct of the meeting.
(3) In the case of difference of opinion amongst the members present, the opinion of the majority shall
prevail.
(4) Each member shall have one vote, and if there shall be an equality of votes on any question to be
decided by the Committee, the Chairperson or the member presiding shall have a casting vote.
18. Power to conduct meetings and the business of the Committee, electronically. —The Member-
secretary may conduct the meetings and business of the Committee through video-conferencing or other
electronic mode.
19. Minutes of the meeting. —(1) The minutes of the proceedings at each meeting of the Committee shall
be drawn up by the Member-secretary and circulated to all the members and the minutes along with any
amendments suggested shall be placed for confirmation at the next meeting of the Committee.
(2) After the minutes are confirmed and signed by the Chairperson or the member, who presided at the
meeting, they shall be recorded in a minute’s book. The names of the members present at each
meeting shall be recorded in the minute’s book.
(3) A member present at any meeting of the Committee shall sign his name in a book or register to be

20. Recommendations made by the Committee. —Decisions arrived at during the Committee meeting
requiring any further action shall be recorded in writing in the form of recommendations to be
forwarded to the Ministry of Ports, Shipping and Waterways.
21. Non-member attending meetings. —The Chairperson may invite representatives of State Maritime
Boards or any committee or body of persons discharging the function of state Maritime Boards, or any
person who has/have subject matter expertise, from India or otherwise, to be present at any meeting of
the Committee to participate in the discussions at the meeting; provided that such persons shall not be
entitled to vote.
22. Appointment of sub-committee. —The Committee may appoint one or more sub-committee, standing
or otherwise, for the purposes of advising it with regard to any of the matters and report on any specific
subject or subjects referred by the Committee.
23. Allowances to members other than non-official members. —A member other than a non-official
member shall be paid travelling allowance, daily allowance and other allowances, as may be applicable
to him, for discharging his duties under these rules, in accordance with the rules governing the parent
department to which the member belongs.
24. Allowances to non-official members. - A non-official member other than the Member of Parliament
shall be paid travelling allowance, daily allowance and other allowances as may be applicable to him,
for discharging his duties under these rules or undertaking journeys in furtherance of the same, as
determined by the Director General of Aids to Navigation.
25. Allowances to the Member of Parliament. - (1) The Member of Parliament shall be entitled to draw
travelling allowance, daily allowance and other allowances, at the rate admissible to the Members of
Parliament under section 4 of the Salaries, Allowances and Pensions of Members of Parliament Act,
1954 (30 of 1954).
(2) When the Parliament or a Parliamentary Committee on which the Member is serving is in session,
the Member shall not be entitled to draw any daily allowance in connection with his assignment
with the Committee, unless he certifies that he was prevented from attending the session of the
Parliament or the Parliamentary Committee owing to his work connected with the Committee and
therefore did not draw any daily allowance from the Parliament, subsequent to which he shall be
entitled to draw daily allowance as indicated above.
(3) When a Member of Parliament is allowed free boarding and lodging at the expenses of the Central
Government or the State Government or an autonomous industrial or commercial undertaking or
corporation, or statutory body or a local authority, in which Government funds have been invested
or in which Government have any other interest, the payment of daily allowance will be regulated
under Members of Parliament (Travelling and Daily Allowances) Rules, 1957.
26. Allowance to non-Members. - A non-Member invited for attending the meeting shall be paid
travelling allowance, daily allowance and other allowances as may be applicable to him, for discharging
his duties under these rules or undertaking journeys in furtherance of the same attending meetings
referred to in rule 23 and 24, as determined by the Director General of Aids to Navigation.
