(SALARIES, ALLOWANCES, PENSION, ETC.) (AMENDMENT) BILL, 2015

Further to amend the Members of the Legislative Assembly of the Government of National Capital Territory of
Delhi (Salaries, Allowances, Pension, etc.) Act, 1994.
No. 21(18)/MLA-Salary/2015/LAS-IV/Leg./7336.—Be it enacted by the Legislative Assembly of the
National Capital Territory of Delhi in the Sixty Sixth year of the Republic of India as follows:-
1. Short title and commencement. — (1) This Act may be called the Members of the Legislative
Assembly of the National Capita] Territory of Delhi (Salaries, Allowances, Pension, etc.) (Amendment) Act, 2015.
(2) It shall come into force on such date as the Lieutenant Governor may, by notification in the Official
Gazette, appoint.
2. Amendment of section 3. -- In the Members of the Legislative-Assembly of the National Capital
Territory of Delhi (Salaries, Allowances, Pension, etc.) Act, 1994, (hereinafter referred to as the principal Act), in
section 3, -
(a) In sub-section (I)-
(i) for the words "twelve thousand rupees", the words "fifty thousand rupees" shall be
substituted;
(ii) for the words "one thousand rupees" the words "two thousand rupees" shall be substituted;
and
(iii) the words "subject to maximum up to forty days" shall be omitted;
(b)(cid:9) Insertion of new sub-section (1) (a), " (a)The salary of members shall be rupees fifty
thousand initially and shall be raised by rupees five thousand every twelve months during each term
of the assembly:
Provided a member elected in a bye - election to the Legislative Assembly shall draw a
salary equal to the salary drawn by the members who were elected in the general elections to that
Assembly.-
(c) In sub-section (2), for the words "eighteen thousand rupees", the word, "fifty thousand rupees"
shall be substituted;
(d) In sub-section (3), for the words "six thousand rupees", the word "thirty thousand rupees" shall
be substituted;[PART IV

In sub-section (4), for the words "secretarial assistance" the words "communication allowance"
(e)
shall be substituted;
Insertion of sub-section (5), "(5) There shall be paid to each member rupees twenty five thousand
(f)
per month as MLA's Constituency Office rental and related utilities allowance;
provided that the allowance shall not be paid to members operating from office space allotted by
public agencies or from their own residences";
Insertion of sub-section (6) "(6) There shall be paid to each member a sum of rupees one lakh as

one time allowance for furnishing their MLA's Constituency Office for each term of office";
Insertion of sub-section (7), "(7) There shall be paid to each member a sum of rupees sixty
(h) thousand as one time allowance for buying MLA's Constituency Office equipment for each term
of office";
Insertion of sub-section (8), "(8) There shall be paid to each member a sum of rupees one lakh as
(i) one time allowance for purchase of laptop, personal computer, printer, mobile handset etc. for
each term of office";
In the principal Act,
Substitution of section 6.- —

In the principal Act, in section 8 for the words "four lakh rupees" the words

STATEMENT OF OBJECTS AND REASONS
For some time past, there has been persistent demand from the MLAs for the increase in their salaries and
perks/ facilities having regard to the increase in the price index. It has also been pointed out that salaries/perks/facilities
of Ministers/Speaker/Deputy Speaker/Leader of Opposition/Chief Whip are a bit inadequate which should be upgraded
and enhanced to a commensurate extent.

to undertak e a comprehensive study of the structurc of salaries and facilities for the Members
Experts on(cid:9) 70.08.2015 to recommended revision of salary allowances and other
of Delhi and

has made its recommendations for increasing the Salaries and allowances etc. of Members of Legislative Assembly of
National Capital Territory of Delhi.
For the purpose, the Members of Legislative Assembly of Delhi of National Capital Territory of Delhi
(Salaries, allowances, pension etc.) (Amendment) Bill, 2015, has been initiated to amend the Members of Legislative
Assembly of National Capital Territory of Delhi (Salaries, Allowances, Pension etc) Act, 1994. The Bill proposes to
increase the salaries, allowances & other facilities of the Members of the Legislative Assembly of Delhi, so as to
facilitate them to work effectively in their fields.
The Bill seeks to achieve the aforesaid objectives.(cid:9) (cid:9)

FINANCIAL MEMORANDUM
For the implementation of the proposals contained in The Members of Legislative Assembly of the National
Capital Territory of Delhi (Salaries, Allowances, Pension etc.) (Amendment) Bill, 2015, there will be an additional
annual recurring expenditure from the Consolidated Fund of the National Capital Territory of Delhi.
MEMORANDUM REGARDING DELEGATED LEGISLATION
The Members of Legislative Assembly of National Capital Territory of Delhi (Salaries, Allowances, Pension
etc.) (Amendment) Bill, 2015, does not seek to confer power of legislation on any subordinate functionaries.

Further to amend the Ministers of the Government of National Capital Territory of Delhi (Salaries and Allowances)
111100NON Act, 1994.
No. 21 (19)/Min.-Salary/2015/LAS-IV/Leg./7351.—Be it enacted by the Legislative Assembly of the
National Capital Territory of Delhi in the Sixty Sixth year of the Republic of India as follows:-
1. Short title and commencement. — (I) This Act may be called the Ministers of the National Capital
Territory of Delhi (Salaries and Allowances) (Amendment) Act, 2015.
(2)(cid:9) It shall come into force on such date as the Lieutenant Governor may, by notification in the l/1111ACII
Gazette, appoint.
2. Amendment of section 3. — In the Ministers of the National Capital Territory of Delhi (Salaries and
Allowances.) Act, 1994, (hereinafter referred to as the Principal Act), in section 3, -
(a) In sub-section (I), for the words "twenty thousand rupees", the word "eighty thousand rupees" shall be
substituted;
(b) Insertion of new sub-section (1) (a), "(a) The salary of Ministers shall be rupees eighty thousand initially and
shall be raised by rupees eight thousand every twelve months for their term as Ministers:
Provided a Minister who is appointed to the position at a later date shall draw a salary equal to the salary
drawn by the Ministers who were appointed at the time of constitution of new Government immediately after
the general elections to that Assembly."
In sub-section (2), for the words "one thousand rupees", the words, "two thousand rupees" shall be substituted;

In sub-section (3), for the words "eighteen thousand rupees", the words "fitly thousand rupees" shall be

substituted;
(e) In sub-section (4), for the words "fifty thousand rupees" the words "three latch rupees" shall be substituted and
the words "within India" shall be omitted.
(f) Insertion of sub-section (5), "(5) There shall be paid to each Minister rupees twenty five thousand per month as
"MLA's Constituency Office rental and related utilities allowance;
provided that the allowance shall not be paid to Ministers operating from office space provided by public
agencies or from their own residences";
(g) Insertion of sub-section (6), "(6) There shall be paid to each Minister a sum of rupees one lakh as one time
allowance for furnishing their MLA's Constituency Office for each term of office as a member of the
Legislative Assembly";
(h) Insertion of sub-section (7), "(7) There shall be paid to each Minister a sum of rupees sixty thousand as one
time allowance for buying equipment for his MLA's Constituency Office for each term of office as a Member
of the Legislative Assembly";
Insertion of sub-section (8), "(8) There shall be paid to each Minister a sum of rupees one lakh as one time

allowance for purchase of laptop, personal computer, printer, mobile handset etc. for each term of office as a
member of the Legislative Assembly";
Insertion of soh-section (9), "(9) There shall be paid to each Minister a sum of rupees ten thousand per month

(k) Insertion of sub-section (10), "(10) A Minister shall be reimbursed upto a sum of thirty thousand rupees each
per month towards salary for his personal secretarial staff in his MLA's Constituency Office, subject to a
maximum of four staff personnel, on production of receipt of payment through cheque or electronic clearance
from the staff so employed."
(I) Insertion of sub-section (11), "(11) Notwithstanding the provisions of sub-section (9) of section 3, telephone
facilities shall be provided at the office and the residence of Ministers as may be required subject to a ceiling
of thirty thousand rupees per month."
Amendment of section 4. — In the principal Act, in section 4 for the words "four thousand rupees", the words

Amendment of sub-section (4) of section 6. — In the principal Act in sub-section (4) of section 6, for the

words "one thousand rupees" the words "thirty thousand rupees" shall be substituted.
Substitution of section 9. — In the principal Act, section 9 shall be substituted with the following, "9.

Conveyance advance. — (1) A Minister shall be entitled to a conveyance advance up to twelve lakh rupees for the
purchase of conveyance which shall be repayable within his term as a member of the Legislative Assembly.
(2) The rate of interest for the advance referred to in sub-section (1) and the mode of recovery and interest thereon shall
be such as may he prescribed by the Government, with the Prior approval of the President."
STATEMENT ON OBJECTS AND REASONS
For some time past, there has been persistent demand from the MLAs for the increase in their salaries and
perks/ facilities having regard to the increase in the price index. It has also been pointed out that salaries/perks/facilities
of Ministers/Speaker/Deputy Speaker/Leader of Opposition/Chief Whip are a bit inadequate which should be upgraded
A and enhanced to a commensurate extent.
Considering, the exigency of demand, the Speaker of Delhi Legislative Assembly appointed a Committee of
Experts on 20.08.2015 to undertake a comprehensive study of the structure of salaries and allowances of Members of
Legislative Assembly of Delhi and to recommended revision of salary allowances and other facilities for the Members
of Legislative Assembly of National Capital Territory of Delhi. The Expert Committee after deliberating on the issues
has made its recommendations for increasing the Salaries and allowances etc. of Members of Legislative Assembly of
National Capital Territory of Delhi.
For the purpose, the Ministers of the Government of National Capital Territory of Delhi (Salaries &
Allowances) (Amendment) Bill, 2015, has been initiated to amend the Ministers of the Government of National Capital
Territory of Delhi (Salaries & Allowances) Act, 1994. The Bill proposes to increase the salaries, allowances • other

FINANCIAL MEMORANDUM
For the implementation of the proposals contained in the Ministers of the Government of National Capital
Territory of Delhi (Salaries and Allowances) (Amendment) Bill, 2015, there will be an additional annual recurring
expenditure from the Consolidated Fund of the National Capital Territory of Delhi.
MEMORANDUM REGARDING DELEGATED LEGISLATION
The Ministers of the Government of National Capital Territory of Delhi (Salaries and Allowances)
(Amendment) Bill, 2015 does not seek to confer power of legislation on any subordinate functionaries.

Further to amend the Leader of Opposition In the Legislative Assembly of the National Capital Territory of Delhi
(Salaries And Allowances) Act, 2001.
No. 21(21)/LoOp.Salary/2015/LAS-IV/Leg./7341.--Be it enacted by the Legislative Assembly of the
National Capital Territory of Delhi in the Sixty Sixth year of the Republic of India as follows:-
1. Short title and commencement. - (1) This Act may be called the Leader of Opposition In the Legislative
Assembly of the National Capital Territory of Delhi (Salaries And Allowances) (Amendment) Act, 2015.
(2)(cid:9) It shall come into force on such date as the Lieutenant Governor may, by notification in the Official
Gazette. appoint.
2. Amendment of section 3. - In the Leader of Opposition in the Legislative Assembly of the National Capital
Territory of Delhi (Salaries and Allowances) Act, 2001, (hereinafter referred to as the principal Act), in
section 3. -
(a) for sub section ( I) the following shall be substituted, namely:-
"The Leader of Opposition shall be entitled to receive a salary, all allowances and entitlements at
the same rate as are admissible to a Minister under the Ministers of the Government of the
National Capital Territory of Delhi (Salaries and Allowances) Act, 1994".
(b) sub-section 2 shall be deleted .
(c) sub-section 3 shall he deleted .
3. Deletion of section 4.- Section 4 of the principal Act shall be deleted.

STATEMENT OF OBJECTS & REASONS
For some time past, there has been persistent demand from the MLAs for the increase in their salaries and
perks/ facilities having regard to the increase in the price index. It has also been pointed out that salaries/perks/facilities
of Ministers/Speaker/Deputy Speaker/Leader of Opposition/Chief Whip are a bit inadequate which should be upgraded
and enhanced to a commensurate extent.
Considering the exigency of demand, the Speaker of Delhi Legislative Assembly appointed a Committee of
Experts on 20.08.2015 to undertake a comprehensive study of the structure of salaries and allowances of Members of
Legislative Assembly of Delhi and to recommended revision of salary allowances and other facilities for the Members
of Legislative Assembly of National Capital Territory of Delhi. The Expert Committee after deliberating on the issues
has made its recommendations for increasing the salaries and allowances etc. of Members of Legislative Assembly of
National Capital Territory of Delhi.
For the purpose, the Leader of Opposition in the Legislative Assembly of Delhi of National Capital Territory
of Delhi (Salaries & Allowances) (Amendment) Bill, 2015, has been initiated to amend the Leader of Opposition in the
Legislative Assembly of National Capital Territory of Delhi (Salaries & Allowances) Act, 2001. The Bill proposes to
increase the salaries, allowances & other facilities of the Leader of Opposition in the Legislative Assembly of Delhi, so
as to facilitate them to work effectively.
The Bill seeks to achieve the aforesaid objectives.
FINANCIAL MEMORANDUM
For the impiemenrarion of the proposals contained in the Leader of Opposition in the Legislative Assembly of
the National Capital Territory of Delhi (Salaries and Allowances) (Amendment) Bill, 2015, there will be an additional
annual recurring expenditure from the Consolidated Fund of the National Capital Territory of Delhi.
MEMORANDUM REGARDING DELEGATED LEGISLATION
The Leader of Opposition in the Legislative Assembly of the National Capital Territory of Delhi (Salaries and
Allowances) (Amendment) Bill, 2015 does not seek to confer power of legislation on any subordinate functionaries.

Territory of Delhi Act, 2003(cid:9) -
No. 21 (22)/C.Whip.Salary/2015/LAS-IV/Leg./7346.—Be it enacted by the Legislative Assembly of the
National Capital Territory of Delhi in the Sixty Sixth year of the Republic of India as follows:-(cid:9) •
1. Short title and commencement. – (I) This Act may be called the Salary and Allowances of the
Chief Whip in the Legislative Assembly of the National Capital Territory of Delhi (Amendment) Act, 2015.
(2)(cid:9) It shall come into force on such date as the Lieutenant Governor may, by notification in the Official
Gazette, appoint.
2. Amendment of section 3. – In the Salary and Allowances of the Chief Whip in the Legislative Assembly
of the National Capital Territory of Delhi Act, 2003, (hereinafter referred to as the principal Act), in
section 3, -
(d) for sub section (I) the following shall be substituted, namely:-
"The Chief Whip shall be entitled to receive a salary, all allowances and entitlements at the same

(e) sub-section 2 shall be deleted .
