Executive Summary & Key Takeaways

**Executive Summary** The Ministry of Ports, Shipping and Waterways notified the Merchant Shipping (Marine Incident and Emergency Response) Rules, 2026, which came into effect on May 12, 2026. These rules establish a regulatory framework for a Nodal Authority to coordinate and supervise responses to maritime casualties to minimize damage to life, property, and the environment. Key provisions include mandatory five-year record-keeping for ports and offshore facilities and defined mechanisms for cost recovery from ship owners. **Key Points / Main Content** **Scope and Definitions** * **Marine Casualty:** Defined as events directly connected to ship operations resulting in death, serious injury, loss of a person, ship abandonment, material damage, stranding, or severe environmental damage. * **Reporting Hub:** The Directorate General of Shipping Communication Centre is designated as the single point for casualty and emergency reporting. * **Nodal Authority:** An authority appointed under the Merchant Shipping Act, 2025, to coordinate inter-agency cooperation and supervise incident responses. **Duties and Powers of the Nodal Authority** * **Supervision:** Responsible for ensuring minimum damage to vessels, persons, property, cargo, and the marine environment during an incident. * **Directive Issuance:** Empowered to issue safety directives to any person, ship owner, master, crew, port authority, salvor, or insurer. * **Emergency Measures:** Authorized to mandate salvage, firefighting, pollution control, and the removal of hazardous substances from coastlines. * **Operational Control:** In cases of delay by primary response parties, the Nodal Authority can initiate immediate response actions, enter land/premises, and assume control of relevant ships or property. **Cost Recovery and Compliance** * **Reimbursement:** Any entity or person complying with Nodal Authority directives is entitled to recover reasonably incurred costs from the ship owner. * **Government Recovery:** Costs incurred by Central or State Governments during emergency responses are recoverable from ship owners at specified rates. * **Enforcement:** The Nodal Authority oversees compliance; penalties for contravention of directives are enforced by the Principal Officer under the Merchant Shipping Act, 2025. **Record Keeping and Audit** * **Documentation:** All ports and offshore facilities must maintain incident logs, inspection records, and training documentation in physical or electronic form for at least five years. * **Verification:** The Nodal Authority is authorized to conduct annual audits or surprise inspections to verify preparedness and compliance. **Impact Analysis** **Ship Owners, Managers, and Operators** **Impact** They are legally and financially liable for the costs of emergency response measures and any damage mitigation actions directed by the Nodal Authority. **Action Required** Must strictly comply with all safety directives issued during an incident and reimburse costs incurred by the government or other entities acting under the Nodal Authority’s direction. **Ports and Offshore Facilities** **Impact** These entities are now subject to mandatory documentation standards and oversight. **Action Required** Maintain comprehensive incident and training logs for a minimum of five years and facilitate annual or surprise audits by the Nodal Authority. **Nodal Authority** **Impact** Granted centralized power to manage maritime emergencies and mobilize inter-agency resources (e.g., Indian Navy, Coast Guard). **Action Required** Coordinate with national and international agencies, oversee compliance with directives, and conduct regular audits of maritime facilities. **Primary Response Parties** **Impact** They are subject to oversight regarding their readiness and response times. **Action Required** Mobilize resources promptly; failure to do so allows the Nodal Authority to take direct control of the response operations.
