4944 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] 1. सजं क्षप्त नाम और प्रारंभ- (1) इन जवजनयमों का संजक्षप्त नाम महू छावनी बोडड (बोरवेल की खुिाई और उपयोग) जवजनयम, 2024 ह।ै (2) य ेरािपत्र म ें उनके प्रकािन की तारीख स े प्रवृि होंगे। 2. पटरभाषाए.ं - (1) इन जवजनयमों म,ें िब तक दक संिभड स ेअन्यथा अपेजक्षत न हो,- (क) “अजधजनयम” से छावनी अजधजनयम, 2006 (2006 का 41) अजभप्रेत ह;ै (ख) “प्राजधकरण” से छावनी बोडड या जवजनयम 5 के अधीन छावनी बोडड द्वारा प्राजधकृत मुख्य अजधिासी अजधकारी अजभप्रेत ह;ै (ग) "पानी की उपलब्धता और उपयोग" का वही अथड होगा िो िल िजक्त मंत्रालय द्वारा प्रजत व्यजक्त िल उपलब्धता पर िारी अजधसूचना संख्या का.आ. 3289 (अ), तारीख 24 जसतंबर 2020 म ेंदिया गया ह;ै (घ) "बोरवेल" में ट्यूबवेल या खोिा हुआ कुआ ं या िनल कुआं या भूिल जनष्कषडण के जलए ऐसी अन्य संरचनाएं िाजमल ह।ैं (ड़) “छावनी बोड ड ” से महू छावनी बोडड अजभप्रेत ह;ै (च) "फ्लो मीिर" से भारतीय मानक संस्ट्थान (आईएसआई) या अतं राडष्ट्रीय मानकीकरण संगठन (आईएसओ) के मानकों के अनुसार फ्लो मीिर अजभप्रेत ह ै ; (छ) “ प्रपत्र ” से इन जवजनयमों से सलं ग्न प्रपत्र अजभप्रेत ह;ै (ि) "िल का उपयोग" स े िल िजक्त मंत्रालय द्वारा िारी अजधसूचना संख्या का.आ 3289 (अ), तारीख 24 जसतंबर 2020 के अधीन भारत म ें भूिल जनष्कषणड को जवजनयजमत और जनयंजत्रत करने के जलए िारी दििा-जनिेिों के उपाबंध - 6 म ें वर्णडत आवासीय इकाई, घर, बंगला, सोसायिी, रस्ट्ि, िैक्षजणक संस्ट्थान, उद्योग, होिल, व्यावसाजयक रेस्ट्तरां, चाय की िकु ान, कॉफी िॉप, स्ट्पा, कार स्ट्पा, ब्यूिी पालरड , नाई की िकु ान, जववाह स्ट्थल या हॉल इत्यादि द्वारा या अन्य दकसी उद्देश्य के जलए पानी के उपयोग से अजभप्रते है, (2) इन जवजनयमों में प्रयक्तु िब्ि और पि िो यहााँ पटरभाजषत नहीं हैं, का वही अथड होगा िैसा उस े अजधजनयम, और उसके जनयम और िल िजक्त मंत्रालय द्वारा अजधसूचना संख्या का.आ. 3289(अ), तारीख 24 जसतंबर, 2020 द्वारा िारी भारत म ें भूिल जनष्कषणड को जवजनयजमत और जनयंजत्रत करने के दििाजनिेिों में बताया गया ह।ैं 3. जवद्यमान बोरवले ों का सवक्षे ण – (1) छावनी बोड ड अपने अजधकार क्षेत्र म ें मौिूि बोरवेल का सवेक्षण करेगा और सवेक्षण में उस तारीख का उल्लेख होगा जिसमें उक्त बोरवेल का जनमाडण दकया गया था एव ं इसमें प्रजतदिन जनकलन े वाल ेऔसत पानी का सवेक्षण होगा। (2) छावनी क्षेत्र के भीतर भूिल जनष्कषडण के जलए आवेिन पर जवचार करने के जलए वतडमान िल आपूर्त ड स्रोत की उपलब्धता के साथ-साथ िनसंख्या के घनत्व पर भी जवचार दकया िाएगा। 4. उपलब्ध भिू ल का सवक्षे ण - छावनी बोड ड द्वारा िल िजक्त मत्रं ालय की एिेंजसयों या उस राज्य सरकार के दकसी अन्य संगठन की सहायता से छावनी बोडड म ें जस्ट्थत उपयोग के जलए उपलब्ध भूिल के स्ट्तर का पता लगान े के जलए अपन ेक्षेत्राजधकार वाल ेक्षेत्र का सवेक्षण करेगा। 5. प्राजधकारी की जनयजु क्त- छावनी बोडड, जनधाडटरत िजक्तयों का प्रयोग करके तथा कायों और कतडव्यों का जनवडहन करन े के जलए जनयुजक्त आििे म ें यथाजवजनर्िडष्ट रीजत के अनुसार मख्ु य अजधिासी अजधकारी की जनयुजक्त कर सकता ह।ै 6. प्राकृजतक िल पथ का सरं क्षण- (1) छावनी बोड डयह पता लगाने के जलए सवेक्षण करेगा दक क्या- (क) मानकों के अनुसार पेयिल प्रिषू ण से मक्तु ह ैऔर क्या िल पीन े योग्य ह ैया नहीं; (ख) कोई अपजिष्ट स्त्रोत ह,ै जिससे खतरनाक पानी का टरसाव हुआ ह ैऔर इस कारण बोरवेल का पानी प्रभाजवत हुआ ह;ै (2) िल की जवद्यमान आपूर्तड, गुणविा, उपयोग और भूिल की उपलब्धता को ध्यान म ें रखत े हुए, बोरवेल खोिन े के आवेिन पर छावनी बोडड द्वारा जवचार दकया िाएगा।[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 3 7. भिू ल जनष्कषणड सरं चना की अनमु जत स े छूि - िल िजक्त मंत्रालय की ओर स े िारी अजधसूचना संख्या का. आ. 3289 (अ), तारीख 24 जसतंबर, 2020 द्वारा भारत म ें भूिल जनष्कषणड जवजनयजमत और जनयंजत्रत करने हते ु दििाजनिेिों के अनुसार छावनी बोड डद्वारा छूि प्रिान की िाएगी। 8. जवद्यमान बोरवले ों का पिं ीकरण- (1) प्राजधकारी, जवद्यमान बोरवेलों के अजनवायड पंिीकरण के जलए एक मास की अवजध के भीतर व्यापक प्रचार करके अजधसूचना प्रकाजित करेगा । (2) पंिीकरण के जलए जनवाजसयों को प्ररूप िारी दकया िाएगा और पंिीकरण या नवीकरण िल्ु क, यदि कोई हो, छावनी बोडड द्वारा तय दकया िाएगा। 9. नय े बोरवले ों का पिं ीकरण - (1) आवेिक (माजलक, घर का मुजखया, पट्टेिार, जवजधक उिराजधकारी, अजधकृत अजधभोगी) जवजनर्िडष्ट प्ररूप म ें नया बोरवेल खोिन े के जलए प्राजधकरण के पास आवेिन फाइल कर सकता ह ै और उक्त आवेिन की प्राजधकारी द्वारा मुख्यत: आवेिन की तारीख स े तीस दिनों की अवजध के भीतर िांच की िाएगी और जनणडय की सूचना आवेिक को िी िाएगी। (2) यदि तीस दिन की अवजध के भीतर जनणडय की सूचना नहीं िी िाती ह,ै तो इस े अनुमोदित नहीं माना िाएगा और प्रत्येक नए बोरवेल के जलए, आवेिक को छावनी बोड ड द्वारा यथा जवजनर्िडष्ट जनयजमत अंतराल पर लाइसेंस का नवीनीकरण कराना होगा। नए बोरवेल की अनुमजत के जलए फीस घरेल/ू अधड- वाजणज्यक इकाई अथाडत् टरहायिी इकाई/घर, चाय की िकु ान, कॉफी िॉप, स्ट्पा, ब्यूिी पालडर, नाई की िकु ान इत्यादि के जलए िस हिार रुपय े होगी और उद्योग, होिल, वाजणजज्यक रेस्ट्तरां, कार, स्ट्पा, ब्रिर स्ट्िॉल की िकु ानों, जववाह स्ट्थल/हॉल, पूरी तरह स े वाजणजज्यक उपयोग आदि या िल िजक्त मंत्रालय द्वारा 24 जसतंबर, 2020 की अजधसूचना संख्या का. आ 3289(अ) के तहत भारत म ें भूिल जनष्कषडण को जवजनयजमत और जनयंजत्रत करन े के जलए िारी दििा-जनिेिों के उपाबंध-6 म ें उजल्लजखत दकसी अन्य उद्दश्े य के जलए बीस हिार रुपय ेहोगी । (3) छावनी बोडड की स्ट्थानीय सीमाओं के भीतर सैन्य स्ट्थापनाओं को अजस्ट्तत्ववान बोरवेल के बारे म ें सूजचत करना आवश्यक ह।ै 10. भिू ल जनष्कषणड सरं चनाओं को खड़ा करन े के जलए पिं ीकरण या अनमु जत हते ु िस्ट्ताविे - (1) आवेिक भूिल जनष्कषणड के जलए सरं चना खड़ा करन े हते ु पंिीकरण या अनुमजत के जलए जनम्नजलजखत िस्ट्तावेि प्रस्ट्तुत करेगा, अथाडत: - (i) जनयमानुसार आवेिन एवं घोषणा संलग्न प्रपत्र के अनुसार; (ii) संबंजधत प्राजधकारी द्वारा िारी जवजनर्िडष्ट प्रयोिन हते ु प्रभाव आकलन टरपोिड अथाडत िल िजक्त मंत्रालय द्वारा अजधसूचना सं. का. आ. 3289 (अ), दिनांक 24 जसतंबर 2020 के उपाबंध - 4 में उजल्लजखत टरपोिड। (iii) भूिल जनष्कषणड के जलए आवेिक का आधार काड ड या पैन काड ड या िीएसिी नंबर (िैसा लाग ू हो) और दकसी पंिीकृत सोसायिी, रस्ट्ि, फमड, कंपनी के मामले में सामान्य जनकाय की बैठक में पाटरत प्रस्ट्ताव और संबंजधत सोसायिी के अजधकृत प्राजधकारी। (2) वषाड िल संचयन प्रदिया का पालन आवासन और िहरी कायड मंत्रालय द्वारा बनाए गए जवद्यमान मॉडल भवन उपजनयमों के अनुसार दकया िाएगा और इस आिय का प्रस्ट्ताव छावनी बोडड को प्रस्ट्तुत दकया िाएगा। 11. छावनी बोड ड द्वारा जनिेि -बोड ड दकसी भी समय कारणों को अजभलेखबद्ध कर भूिल जनष्कषडण को रोकने के जलए जनिेि िारी कर सकता ह।ै 12. फीस लगाना (1) -यदि पंिीकृत उपयोक्ता फ्लो मीिर नहीं लगाता ह ै और यदि फ्लो मीिर काम नहीं कर रहा ह ै तो, ऐस े उपयोक्ता का पंिीकरण जनलंजबत दकया िा सकता ह ै और उपयोक्ता द्वारा प्राजधकारी को एक हिार रूपए फीस के साथ आविे न िेकर जनलंबन को रद्द करवाया िा सकता ह ै । (2) जवद्यमान टरहायिी और ग्रुप हाउससंग सोसायिी बोरवेल स े भूिल जनष्कषणड प्रभार, सौ लीिर स े अजधक के जनष्कषणड के जलए पाचं हिार रूपए प्रजतवषड या समय-समय पर यथा जवजनर्िडष्ट अनसु ार।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (3) गरै -टरहायिी प्रयोिन के जलए बोरवेल स े भूिल जनष्कषणड प्रभार, पचास लीिर स े अजधक के जनष्कषडण के जलए बीस हिार रूपए प्रजतवष ड या समय-समय पर यथा जवजनर्िडष्ट अनुसार। 13. पानी के उपयोग पर प्रजतबधं - आवेिक या दकसी व्यजक्त द्वारा जनकाला गया भूिल प्राजधकारी की अनुमजत जबना दकसी भी रूप म ें बेचा नहीं िाएगा और यदि यह पाया गया दक आवेिक या कोई व्यजक्त जबना अनुमजत जनष्काजषत भूिल को बेच रहा है, तो िी गई अनुमजत को तत्काल जनलंजबत कर दिया िाएगा और बोरवेल तथा फ्लो मीिर को सील कर दिया िाएगा और पच्चीस हिार रुपए तक या समय-समय पर यथा जवजनर्िडष्ट अनुसार फीस लगाई िाएगी। 14. भिू ल की गणु विा का सरं क्षण- आवेिक और भूिल के उपयोगकता ड को सरकारी एिेंसी स े हर तीन साल म ें िल की गुणविा का परीक्षण कराना आवश्यक ह ै जिससे दक यह सुजनजित हो सके दक िल पीन े योग्य ह ै अथवा नहीं तथा इसकी टरपोिड प्राजधकारी को सौंपनी होगी और यदि िल िजू षत पाया िाता ह ैतो उस िल का उपयोग पीन े के जलए नहीं दकया िाएगा। 15. वषा ड िल सचं यन- प्रत्येक आवेिक को यह सुजनजित करना होगा दक वषा ड िल संचयन सरं चनाए ं बनाई गई ह ैं तथा वषाड िल संचयन का ध्यान रखा गया ह ै और छावनी बोडड यह सुजनजित करेगा दक वषा ड िल संचयन कायाडत्मक ह ैतथा छावनी बोडड द्वारा समय-समय पर इस आिय का सवेक्षण दकया िाएगा। 16. जनषधे ात्मक आिेि- यदि पता चलता ह ै दक पानी िजू षत ह ै और मानव उपभोग के जलए हाजनकारक ह,ै तो प्राजधकारी उपयोगकताडओं को नोटिस िारी करके जनषधे ात्मक आििे िारी कर सकता ह।ै 17. िल अकं ेक्षण -प्राजधकारी समय-समय पर िल अंकेक्षण करेगा और भूिल की उपलब्धता सुजनजित की िायेगी और भूिल म ें कमी की जस्ट्थजत म,ें प्राजधकारी द्वारा, जनधाडटरत जनणडय के अनुसार भूिल जनष्कषडण पर प्रजतबधं लगाया िाएगा। 18. अपील ( 1) -मुख्य अजधिासी अजधकारी के जनणडय के जवरुद्ध प्रत्येक अपील छावनी बोड ड के समक्ष की िाएगी और छावनी बोडड के जनणडय के जवरुद्ध प्रत्येक अपील प्रधान जनिेिक, रक्षा सम्पिा, कमान को की िाएगी (2) मुख्य अजधिासी अजधकारी अथवा छावनी बोडड के आिेि के संप्रेषण होन े के यथाजस्ट्थजत तीस दिन की अवजध के भीतर, उसके अनसु ार अपील की िा सकती ह।ै प्ररूप (जवजनयम 2(छ) िेख)ें जवद्यमान बोरवले / ट्यबू वले / खोिा गया कुआ ं / गहरा कुआ,ं आदि का पिं ीकरण या नया बोरवले / ट्यबू वले / खोिा गया कुआ ं / गहरा कुआ,ं आदि की खिु ाई के जलए अनमु जत श्री / श्रीमती …………………………………………………. को िारी दकया गया। बही संख्या …………………………………………………………………………... आवेिन प्ररूप िम संख्या …………………………………………………………… नए बोरवले / ट्यबू वले / खोिा गया कुआ ं / गहरा कुआं, इत्यादि के पिं ीकरण, सिं ोधन या पटरवतनड या खिु ाई हते ु आविे न प्ररूप 1. आविे क का जववरण:- क) माजलक आवेिक का नाम (बड़े अक्षरों म)ें (कृपया पहचान प्रमाण संलग्न करें): ख) पुत्र / पुत्री / पत्नी / पजत श्री/श्रीमती:[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 5 ग) सलंग (कृपया जचजन्हत करें): पुरुष / मजहला घ) राष्ट्रीयता: ङ) आवेिक का पता: 2. जवद्यमान कुए ंके पिं ीकरण का जववरण:- क) पंिीकरण संख्या: ख) पंिीकरण की तारीख: 3. जवद्यमान / प्रस्ट्ताजवत नए बोरवले / ट्यबू वले / खिु ा हुआ कुआ ं/ गहरा कुआं, आदि का स्ट्थल जववरण:- क) वाडड संख्या: ख) मोहल्ला / सड़क / मकान सख्ं या: ग) िीएलआर सवेक्षण संख्या / रािस्ट्व सवेक्षण संख्या: घ) उपरोक्त (ख) में अजभजलजखत व्यजक्त का नाम: ङ) उपरोक्त (घ) म ेंअजभजलजखत व्यजक्त के साथ आवेिक का संबंध: च) कृपया जनम्नजलजखत िस्ट्तावेज़ सलं ग्न करें: आधार काडड / जबिली का जबल / भू-स्ट्वाजमत्व / िीएलआर का उद्धरण / रािस्ट्व टरकॉड डके जलए पत ेके प्रमाण के रूप में कोई भी िस्ट्तावेि। 4. जवद्यमान / पिं ीकृत / प्रस्ट्ताजवत नए कुएं का जववरण:- क) कुएं के जनमाडण / खुिाई की तारीख (जवद्यमान जस्ट्थजत): ख) कुएं का प्रकार अथाडत खोिा हुआ कुआं / ट्यूबवेल / बोररंग: अन्य (कृपया जनर्िडष्ट करें): ग) कुएं की अनुमाजनत गहराई (मीिर): घ) ट्यूबवेल के मामल े में: i. होस पाइप की अनुमाजनत लंबाई (मीिर) और व्यास (जममी) (यदि कोई हो): ii. छलनी की अनुमाजनत लंबाई (मीिर) और व्यास (जममी): iii. होस पाइप और खाली पाइप की सामग्री (पीवीसी / लोहा / गल्ै वेनाइज्ड लोहा) iv. छलनी की सामग्री: (पीवीसी / लोहा / गल्ै वेनाइज्ड लोहा) ङ) खोिे गए कुए ंके मामले म:ें - No. 91(E).—WHEREAS, the draft regulations for the Mhow Cantonment Board for Digging and use of Bore Wells, 2023-24 was published, on the Cantonment Board’s Notice Board vide Notice No. CBMHOW /8152/W.S, dated the 28th December, 2023 for inviting objections and suggestions by 27th January, 2024. AND, WHEREAS, the said notice was published on the official website of the Cantonment Board on 28th December, 2023 and in the local newspapers on 29th December, 2023; AND, WHEREAS, objections and suggestions so received from the public by the Cantonment Board before the said date were considered by the Board and suitably disposed of, vide Cantonment Board Resolution No. 09 (8), the dated 07th March, 2024. NOW, THEREFORE, in exercise of the powers conferred by sub-section (4) of section 204 of the Cantonments Act, 2006 (41 of 2006), Mhow the Cantonment Board hereby makes the following regulations, namely: – 1. Short title and commencement. – (1) These regulations may be called the Mhow Cantonment Board (Digging and Use of Bore Wells) Regulations, 2024. (2) They shall come into force on the date of publication in the Official Gazette. 2. Definitions. – (1) In these regulations, unless the context otherwise requires,– (a) “Act” means the Cantonments Act, 2006 (41 of 2006); (b) “authority” means the Cantonment Board or the Chief Executive Officer authorised by the Cantonment Board under regulation 5; (c) “availability and use of water” shall have the same meaning assigned to it in the notification issued by the Ministry of Jal Shakti on Per Capita Availability of Water vide notification number S.O. 3289(E), dated the 24th September, 2020 issued by the Ministry of Jal Shakti; (d) “Bore well” includes tube well or dug well or tunnel well or such other structures for extraction of ground water. (e) “Cantonment Board” means the Mhow Cantonment Board; (f) “flow meter” means the flow meter as per the standards of the Indian Standards Institute (ISI) or International Organisation for Standardisation (ISO); (g) “form” means the form annexed to these regulations; (h) “use of water” means usage of water by residential unit, house, bungalow, society, trust, education institution, industry, hotel, commercial restaurant, tea stall, coffee shop, spa, car spa, beauty parlour, barber shop, marriage grounds or halls etc., or for any other purpose mentioned in Annexure - VI to the guidelines to regulate and control ground water extraction in India issued vide notification number S.O. 3289(E), dated the 24th September, 2020 by the Ministry of Jal Shakti. (2) The words and expressions used in these regulations and not defined shall have the same meaning as respectively assigned to them in the Act, rules made there under, and in the guidelines to regulate and control ground water extraction in India issued vide notification number S.O. 3289(E), dated the 24th September, 2020 by the Ministry of Jal Shakti. 3. Survey of existing bore wells. – (1) The Cantonment Board shall conduct a survey of existing bore wells within its jurisdiction and the survey shall include the date from which the said bore wells are in existence and average extraction of water every day. (2) The density of the population shall be considered along with the availability of the present water supply source for considering the application for extraction of ground water within the Cantonment Area.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] 4. Survey of ground water available. –The Cantonment Board shall conduct survey of the area within its jurisdiction to ascertain the level of ground water available for use with the help of agencies of the Ministry of Jal Shakti or any other organisation of the State Government in which the Cantonment Board is situated. 5. Appointment of authority. – The Cantonment Board may appoint Chief Executive Officer to exercise the powers and discharge the functions and duties as an authority in such manner as may be specified in the appointment order. 6. Preservation of natural water course. – (1) The Cantonment Board shall conduct survey to ascertain whether – (a) The drinking water is free from contamination as per the standards and whether the water is potable or not; (b) Any source of effluent and hazardous water has percolated and water of the bore well is affected; (2) Taking into consideration the existing supply of water, quality, use and availability of ground water, the application for digging bore well shall be considered by the Cantonment Board. 7. Exemption from permission for ground water extraction structure. – Exemption shall be granted by the Cantonment Board as per the guidelines to regulate and control ground water extraction in India issued vide notification number S.O. 3289(E), dated the 24th September, 2020 by the Ministry of Jal Shakti. 8. Registration of existing bore wells. – (1) The authority shall publish a notice by giving wide publicity for compulsory registration of the existing bore wells, within a period of one month. (2) The form shall be issued to the residents for registration and the registration. The registration fee for existing bore well dug without permission shall be rupees five thousand and renewal charges will be rupees two thousand after every five years form the 1st day of April. The authority may issue direction to stop extraction of ground water any time without assigning any reason therefor. 9. Registration of new bore wells – (1) The applicant (owner, head of residence, lessee, legal heir, authorised occupant) may submit the application with the authority for digging new bore well in the specified form and the said application shall be scrutinised by the authority preferably within a period of thirty days from the date of application and the decision shall be communicated to the applicant. (2) In case, the decision is not communicated within a period of thirty days, it shall not be treated as a deemed approval and for every new bore well, applicant shall be required to renew the licence at regular intervals as may be specified by the Cantonment Board. The Charges for new bore well permission shall be rupees ten thousand for domestic/semi-Commercial unit i.e., Residential unit/house, Tea stall, Coffee Shop, Spa, Beauty parlour, Barber shop etc. and rupees twenty thousand for Industry, Hotel, Commercial Restaurant, Car, Spa, Brusher stall shops, marriage grounds/halls, fully commercial use etc. or for any other purpose mentioned in Annexure - VI to the guidelines to regulate and control ground water extraction in India issued vide notification number S.O. 3289(E), dated the 24th September, 2020 by the Ministry of Jal Shakti. (3) Military establishments within the local limits of the Cantonment Board shall be required to inform about the existence of bore well. 10. Documents for registration or permission to erect the structure for extracting ground water. – (1) The applicant shall submit the following documents for registration or permission to erect the structure for extracting ground water, namely:– (i) The application and declarations as per the forms I and II; (ii) Impact Assessment Report for a specified purpose issued by the concerned authority i.e., report mentioned in Annexure - IV to the notification number S.O. 3289(E), dated the 24th September, 2020 by the Ministry of Jal Shakti shall be followed. (iii) Aadhaar Card or Pan Card or GST No. (as applicable) of the applicant and in the case of any registered society, trust, firm, company the resolution passed in General Body Meeting for extracting the water from the ground and authorisation to the concerned office bearer of the society.[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 9 (2) Rain water harvesting process shall be followed as per the existing model Building Bye-laws made by the Ministry of Housing and Urban Affairs and a proposal to this effect shall be submitted to the Cantonment Board. 11. Directions by Cantonment Board. – The Cantonment Board may issue directions to stop extraction of ground water at any time by recording reasons therefor 12. Levy of fee. – (1) If any registered user does not install the flow meter or in case flow meter is not working, the registration of such user may be suspended and the suspension may be revoked with an application by the user to the authority with a fee of rupees one thousand. (2) Ground water extraction charges for residential or group housing society from bore well: rupees five thousand per annum for extraction above one hundred liter or as may be specified from time to time. (3) Ground water extraction charges for commercial or industrial purpose, from bore well: rupees twenty thousand per annum for extraction above fifty liter or as may be specified from time to time. 13. Restriction on use of water. – Ground water so extracted shall not be sold in any form by the applicant or any person without permission of the authority and if it is noticed that the applicant or any person is selling the extracted ground water without permission, the registration granted shall be suspended forthwith and bore well and the flow meter shall be sealed and the user shall be liable to pay fee up to rupees twenty five thousand or as may be specified from time to time. 14. Protection of quality of ground water. – The applicant and user of the ground water shall be required to test the quality of the water in every three years from the Government Agency in order to ascertain as to whether the water is potable and submit the report to the authority and in case, water is found contaminated, the water shall not be used for drinking purpose. 15. Rain water harvesting. – Every applicant has to ensure that rain water harvesting structures are erected and rain water harvesting is observed and the Cantonment Board shall ensure that rain water harvesting is functional and survey for verification of the same shall be conducted by the Cantonment Board from time to time. 16. Prohibitory orders. –The authority may issue prohibitory orders, in case it is found that the water is contaminated and injurious to human consumption by issuing notice to the user. 17. Water audit. – Water audit shall be carried out by the authority from time to time and availability of the ground water shall be ascertained and in case of reduction in the ground water, restriction on the extraction of ground water shall be imposed as decided by the authority. 18. Appeal. – (1) Every appeal against the decision of Chief Executive Officer shall be preferred before the Cantonment Board and the appeal against the decision of the Cantonment Board shall be preferred before the Principal Director, Defence Estates, the Command. (2) Every appeal shall be made within a period of thirty days from the date of communication of order of the Chief Executive Officer or the Cantonment Board, as the case may be.
