समूह 'क' (िैज्ञाजिक और तकिीकी) पि, भती जियम, 2017, को उि बातों के जसिाए अजधक्ांत करते हुए जिन्ह ें ऐसे अजधक्मण के पूिव दकया गया ह ै या करिे का लोप दकया गया है, इलेक्ट्रॉजिकी और सूचिा प्रौद्योजगकी मंत्रालय म ें समूह 'क' (िैज्ञाजिक और तकिीकी) पिों पर भती की पद्धजत को जिजियजमत करिे के जलए जिम्नजलजखत जियम बिाते ह,ैं अर्ावत:् – 1. संजिप्त िाम और प्रारंभ. – (1) इि जियमों का संजिप्त िाम इलेक्ट्रॉजिकी और सूचिा प्रौद्योजगकी मंत्रालय, िैज्ञाजिक और तकिीकी, समूह 'क' पि, भती जियम, 2025 ह।ै (2) य ेरािपत्र में उिके प्रकािि की तारीख को प्रिृत्त होंगे। 2. पररभाषाए-ं इि जियमों म,ें िब तक दक संिभव स ेअन्यर्ा अपेजित ि हो, – (क) "जियंत्रण प्राजधकारी” स े इलेक्ट्रॉजिकी और सूचिा प्रौद्योजगकी मंत्रालय, भारत सरकार अजभप्रेत ह;ै (ख) "अिुसूची" स ेइि जियमों के सार् संलग्न अिुसूची अजभप्रेत है; 6246 GI/2025 (1)2 THE योििा अजभप्रेत ह।ै (घ) "िैज्ञाजिक पि" से, योििा में पररभाजषत दकया गया पि अजभप्रेत ह।ै 3. िेति मैररक्ट्स म ें िाम, पिों की संख्या, िगीकरण और स्ट्तर. – (1) पिों के िाम और संख्या, उिके िगीकरण और िेति (56100- 'बी' रािपजत्रत, अििुसजचिीय। (2025)* 177500 रुपय)े । * कायवभार पर जभन्नता के आधार पर। रिप्पण - प्रत्येक ग्रडे में ररजियों को पहले फीडर ग्रडे में िज्ञै ाजिकों से भरा िाएगा जिन्ह ें योििा के अधीि अगले उच्च ग्रेड म ें प्रोन्नजत के जलए अिुिंजसत दकया गया ह।ै यदि योििा के अंतगवत अगली ग्रडे म ें प्रोन्नजत पर जिचार करि े के जलए संस्ट्तुत िैज्ञाजिकों की सख्ं या प्रोन्नजत ग्रडे म ें उपलब्ध ररजियों की सख्ं या स े अजधक ह ै तो उस सीमा तक पिों की संख्या को ितव के अध्यधीि स्ट्ित: प्रोन्नजत ग्रडे म ें अपग्रडे कर दिया िाए परंत ु सभी ग्रडे ों की संयुि स्ट्िीकृत संख्या समाि रहगे ी। िौकरी छोड़कर िािे के कारण उत्पन्न होिे िाली ररजिया ं सामान्यत संबंजधत िैज्ञाजिक अर्िा तकिीकी श्रेणी के प्रिेि स्ट्तर के ग्रडे पर ही रहगे ी। तर्ाजप, कायावत्मक आिश्यकताओं के आधार पर और सिम प्राजधकारी के अिुमोिि से इिमें स े कुछ ररजियों को समग्र स्ट्िीकृत संख्या के भीतर व्यजिगत अभ्यर्र्वयों की उच्च अहतव ा और कौिल के सार् ररजि के स्ट्तर और अिरूु प के आधार पर प्रििे स्ट्तर स ेऊपर के पिों के जलए इि जियमों में जिजहत भती पद्धजत द्वारा भरा िा सकता ह ै 4. भती की पद्धजत. – उि पिों पर भती की पद्धजत, अहतव ा और उससे संबंजधत अन्य मामले जिम्नािुसार होंग:े – (1) िैज्ञाजिक 'बी' स े िैज्ञाजिक 'िी' के पि चयि पि होंगे। (2) भती के प्रयोिि स े पिों को संघ लोक सेिा आयोग के कायविेत्र स े छूि प्राप्त होगी। (3) िैज्ञाजिक 'बी', 'सी', 'डी', 'ई' और 'एफ' के प्रत्येक पि के जलए भती की पद्धजत समय-समय पर जियंत्रण प्राजधकारी द्वारा जिजिश्चय की िाएगी।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (4) िज्ञै ाजिक 'बी' के पिों की भती के जलए भती सीधी भती द्वारा की िाएगी िैसा दक पहली अिुसूची के खंड क और इि जियमों म ें उपाबद्ध िसू री अिुसूची के खंड (ख) के उपखंड (ii) म ें अजधकजर्त प्रदक्या के अधीि जिर्िवष्ट दकया गया ह।ै (5) िज्ञै ाजिकों 'सी', 'डी' और 'ई' के पिों की भती के जलए भती या तो योििा के अधीि प्रोन्नजत या उन्नयि या सीधी भती या प्रजतजियुजि (अल्पकाजलक अिुबंध सजहत)/ आमेलि पहली अिुसूची में जिर्िवष्ट के रूप म ें और इि जियमों के सार् उपाबद्ध िसू री अिुसूची के खंड (बी) के उपखंड (ii) में अजधकजर्त प्रदक्या के अिुसार की िाएगी। (6) िज्ञै ाजिक 'एफ' के पि की भती के जलए भती या तो योििा के अधीि प्रोन्नजत या उन्नयि या सीधी भती या प्रजतजियुजि (अल्पकाजलक अिुबंध सजहत)/ आमले ि पहली अिुसूची म ें जिजिर्िवष्ट के रूप म ें और इि जियमों के सार् उपाबद्ध िसू री अिुसूची के खंड (ख) के उपखंड (i) म ें अजधकजर्त प्रदक्या के अिुसार की िाएगी। (7) िैज्ञाजिक 'िी' के पि की भती पर भती योििा के अधीि प्रोन्नजत या उन्नयि के माध्यम स े की िाएगी। (8) िैज्ञाजिकों 'बी', 'सी', 'डी', 'ई', 'एफ' और 'िी' के मामले म,ें जियुजि प्राजधकारी प्रभारी मंत्री होंगे। िेति मैररक्ट्स (144200-218200 रुपये) या उससे ऊपर के स्ट्तर 14 म ें िेति िाले पि पर जियुजि या प्रोन्नजत के संिभव म ें मंजत्रमंडल की जियुजि सजमजत की मंिूरी आज्ञापक ह।ै (9) प्रत्येक पि के जलए या िैज्ञाजिक बी के पि पर सीधी भती के प्रत्येक मामल े म ें और िैज्ञाजिक सी, डी, ई और एफ के पिों पर सीधी भती या प्रजतजियुजि (अल्पकाजलक अिुबंध सजहत) के प्रत्येक मामले के जलए जििेष व्यिस्ट्र्ा या आिश्यक िैजिक अहतव ा और अिुभि का ित्रे जिजभन्न जिषयों के िैज्ञाजिकों की उपलब्धता और दकसी जििेष व्यिस्ट्र्ा म ें िैज्ञाजिक की आगे की अपिे ा को ध्याि म ें रखते हुए, जियंत्रण प्राजधकारी द्वारा तय दकया िाएगा और जििेष अिुिासि को इि जियमों म ेंसंलग्न अिुसूची चौर्ी के खडं (क) और खंड (ख) म ें उजल्लजखत जिषयों की सचू ी स े चुिा िाएगा। (10) पूि व सैजिकों की भती समय-समय पर केंद्रीय सरकार के आिेिों के अिुसार पुि: रोिगार के आधार पर की िा सकती ह।ै 5. प्रोन्नजत या उन्नयि (1) िैज्ञाजिक 'सी' स े िैज्ञाजिक 'िी' ग्रडे म ें िैज्ञाजिकों की प्रोन्नजत या उन्नयि योििा के अधीि जिजिर्िवष्ट के रूप म ेंहोगा। (2) िैज्ञाजिक 'िी’ तक िैज्ञाजिक 'सी' के ग्रडे म ें िैज्ञाजिकों की प्रोन्नजत या उन्नयि िीच े ििाईव गई न्यूितम काय व जिष्पािि अिजध और योििा म ें जिर्िवष्ट अन्य उपबंधों के अिपु ालि के अिुसार होगा। िेति मैररक्ट्स म ेंस्ट्तर पि कायव जिष्पािि से संबंजधत न्यूितम सेिा अिजध िेति मैररक्ट्स म ें स्ट्तर िैज्ञाजिक बी िून्य -10 (4) जिधावरण एक िष व म ें िो बार दकया िाएगा और उि िैज्ञाजिकों के मामल े जिन्होंिे यर्ाजस्ट्र्जत जिधारव ण की कि-ऑफ तारीखों अर्ावत 1 िििरी या 1 िलु ाई के अिुसार न्यूितम काय-व जिष्पािि अिजध परू ी कर ली ह ै या परू ी कर लेंग,े और अर्िवत दकया ह ै या िार्षवक 1 की संख्या अर्िवत करेंग े जिधावरण की कि ऑफ तारीखों स े पहले की अिजध के जलए न्यूितम काय-व जिष्पािि अिजध के िषों की संख्या के बराबर या उससे अजधक प्रििवि जिधावरण ररपोिव पर योििा के अधीि जिधावरण के जलए जिचार दकया िाएगा। (5) िो िैज्ञाजिक लेिल-I स्ट्क्ीनिंग अर्िा लेिल-2 स्ट्क्ीनिंग म ेंअहतव ा प्राप्त िहीं करते ह,ैं उिका जिधावरण केिल एक िष व के बाि दकया िाएगा िब उन्ह ें कम स े कम एक और िार्षवक जिष्पािि जिधावरण ररपोिव तर्ा िार्षवक काय व ररपोिव प्राप्त होगी और ऐस े पुिर्िवधारण के जलए पिु स्ट्तर-I और स्ट्तर-2 की िांच की िाएगी और यह उस चरण स े िरूु िहीं होगी िहां िैज्ञाजिक अहतव ा प्राप्त करिे म ेंअसफल रह।े (6) अगली ग्रडे म ें प्रोन्नजत अर्िा उन्नयि के जलए योििा के अंतगतव जिधावरण प्रदक्या केिल तीि बार आयोजित की िाएगी और तत्पश्चात् िैज्ञाजिकों को यर्ा लागू संिोजधत सजु िजश्चत कैररयर प्रगजत दििा-जििेिों के अतं गतव िाजमल दकया िाएगा िो केन्द्रीय सरकार के जसजिजलयि कमवचाररयों और िैज्ञाजिकों को प्रिाि दकया गया ह ै संिोजधत सुजिजश्चत कैररयर प्रोन्नयि योििा द्वारा योििा म ें दकए गए उपबंध के अिुसार अगली किा के जलए जिचार दकया िा सकता ह।ै (7) प्रबंधि या प्रिासजिक काय व करि े िाल े िैज्ञाजिकों या तकिीकी जििेषज्ञों की सेिा की अिजध को योििा के अधीि प्रोन्नजत या उन्नयि के जलए िहीं जगिा िाएगा। जििेष रूप स े प्रबंधि या प्रिासजिक काय व करिे िाले िैज्ञाजिकों या तकिीकी जििेषज्ञों को योििा के अधीि प्रोन्नजत या उन्नयि के जलए जिचार िहीं दकया िाएगा और उन्ह ें केिल संिोजधत सुजिजश्चत कैररयर प्रोन्नयि योििा के अधीि उन्नयि का लाभ दिया िाएगा। (8) योििा के अधीि अगल े उच्च ग्रेड म ें प्रोन्नजत या उन्नयि के जलए अिुिंजसत िैज्ञाजिकों की प्रोन्नजत या उन्नयि की तारीख िह तारीख होगी जिस दिि सिम प्राजधकारी िे प्रोन्नजत या उन्नयि को मंिूरी िी र्ी। संगठि के बाहर छुट्टी या प्रजतजियुजि पर आए अजधकाररयों को उिके मलू संिग व म ें पुि िाजमल होिे या लौििे की तारीख स े ही प्रोन्नजत या उन्नयि दिया िाएगा। (9) कोई पूिवव्यापी प्रोन्नजत या उन्नयि िहीं होगा। (10) अिुसंधाि और जिकास म ें फील्ड अिुभि या िैज्ञाजिक पररयोििाओं के कायावन्ियि म ें अिुभि, िैज्ञाजिक 'एफ' के जलए प्रोन्नजत या उन्नयि के जलए कम स े कम िो िष व और िैज्ञाजिक 'िी' के जलए प्रोन्नजत या उन्नयि के जलए पांच िष व का अिुभि आिश्यक होगा। (11) छुट्टी की अिजध, प्रजतजियजु ि या जििेि सेिा आदि पर जबताए गए समय का न्यूितम जििास अिजध की गणिा के जलए उपचार योििा म ेंजिजिर्िवष्ट दकया िाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (12) इि जियमों म ें उजल्लजखत कुछ भी योििा के उपबंधों द्वारा िाजसत िहीं होगा। 6. िार्षवक कायवजिष्पािि और मल्ू यांकि ररपोिव और िार्षवक काय व ररपोिव। िैज्ञाजिक िार्षवक काय व ररपोिव और िार्षवक कायवजिष्पािि मूल्यांकि ररपोिव को िार्षवक आधार पर आज्ञापक रूप स े योििा म ें प्रिाि दकए गए प्रारूप म ें भरा िाएगा। 7. पररिीिा (1) सीधी भती द्वारा िैज्ञाजिक 'ख' और 'ग' श्रेणी म ें जियुि िैज्ञाजिकों के जलए पररिीिा अिजध िो िष व और सीधी भती द्वारा िैज्ञाजिक 'डी', 'ई' और 'एफ' के ग्रडे म ेंजियुि िैज्ञाजिकों के जलए एक िष व होगी: परंत ु जियंत्रक प्राजधकारी इस संबंध म ें समय-समय पर केंद्रीय सरकार द्वारा िारी दकए गए अिुिेिों के अिुसार पररिीिा की अिजध बढा सकता ह:ै परंत ु पररिीिा अिजध के जिस्ट्तार के जलए दकसी जिजिश्चय जपछल े पररिीिाधीि अिजध की समाजप्त के बाि आठ सप्ताह के भीतर सामान्य रूप स े जलया िाएगा और उि अिजध के भीतर ऐसा करि े के कारणों के सार् संबंजधत अजधकारी को जलजखत रूप म ेंसूजचत दकया िाएगा। (2) पररिीिा की अिजध या उसके दकसी जिस्ट्तार के पूरा होिे पर, िैज्ञाजिक को यदि स्ट्र्ायी जियुजि के जलए उपयुि मािा िाता ह,ै तो उन्ह ें जियजमत आधार पर उिकी की गई जियुजि म ें रखा िाएगा और इसकी उपलब्ध मूल ररजियों के जिरूद्ध पुजष्ट की िाएगी। (3) पररिीिा अिजध अर्िा उसके दकसी जिस्ट्तार के िौराि, यदि केन्द्रीय सरकार का यह मत ह ै दक कोई िैज्ञाजिक स्ट्र्ायी जियुजि के जलए उपयिु िहीं ह,ै तो यर्ाजस्ट्र्जत केन्द्रीय सरकार िैज्ञाजिक को सेिा म ें उसकी जियुजि स े पूि व उसके द्वारा धाररत पि पर सेिामुि या प्रत्याितत कर सकती ह।ै (4) पररिीिा अिजध के िौराि, या उसके दकसी जिस्ट्तार के िौराि, सरकार द्वारा िैज्ञाजिकों को प्रजििण और जिििे ों के ऐसे पाठ्यक्मों स े गुिरिा और परीिाओं और परीिणों (नहिं ी म ें परीिा सजहत) को उत्तीणव करिे की आिश्यकता हो सकती ह,ै िैसा दक सरकार पररिीिा के संतोषििक समापि की ितव के रूप म ें उजचत समझे। (5) िहा ं तक पररिीिा स े संबंजधत अन्य मामलों का संबंध ह,ै सेिा के सिस्ट्यों को इस संबंध म ें समय-समय पर केन्द्रीय सरकार द्वारा िारी दकए गए अिुिेिों द्वारा िाजसत दकया िाएगा। 8. पष्टु ीकरण.- सीधी भती के माध्यम स े जियुि िैज्ञाजिक पिों की पुजष्ट जिभागीय संपुजष्ट सजमजत की संस्ट्तुजत पर जियंत्रण प्राजधकारी द्वारा की िाएगी, जिसकी संरचिा जिम्नािसु ार होगी:- (क) अध्यि - सजचि, इलेक्ट्रॉजिकी और सूचिा प्रौद्योजगकी मंत्रालय; (ख) सिस्ट्यों - इलेक्ट्रॉजिकी और सूचिा प्रौद्योजगकी मंत्रालय के िो िैज्ञाजिक 'िी', और (ग) प्रमुख (कार्मवक प्रभाग), इलेक्ट्रॉजिकी और सूचिा प्रौद्योजगकी मत्रं ालय। 9. जिहरव ता - कोई भी व्यजि, - (क) जिसिे ऐसे व्यजि के सार् जििाह दकया ह ैया अिुबंजधत ह ैजिसका िीििसार्ी िीजित ह;ै या6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) जिसिे, एक पजत या पत्नी के िीजित होते हुए भी, दकसी अन्य व्यजि के सार् जििाह दकया ह ैया अिुबंध दकया ह,ै उि पिों पर जियुजि के जलए पात्र िहीं होंगे: परंत ु यदि केन्द्रीय सरकार मान्य करती ह ैदक ऐसा जििाह ऐस े व्यजि और जििाह के िसू रे पिकार को लाग ू स्ट्िीय जिजध के अधीि अिुज्ञेय ह ैऔर ऐसा करिे के अन्य आधार ह,ैं तो दकसी व्यजि को इस जियम के प्रितवि स ेछूि िी िा सकेगी। 10. भारत और बाहर सेिा करि े के जलए अजधकाररयों की िेयता. (1) इि जियमों के अधीि जियिु अजधकारी भारत म ें और बाहर कहीं भी सेिा करिे के जलए उत्तरिायी होंगे। (2) इि जियमों के अधीि जियुि अजधकारी इस तरह के प्रजििण स े गुिरिे के जलए उत्तरिायी होंगे और भारत या जििेि म ें जििा के पाठ्यक्मों पर जिस्ट्ततृ होंग े िैसा दक सरकार समय-समय पर तय कर सकती ह ै और प्रजििण या पाठ्यक्म के जलए जिस्ट्तृत अजधकारी, जिसकी अिजध छह महीिे या उससे अजधक ह ै या भारत के बाहर या भारत म ें जििी फमों या कारखािों के सार् प्रजििण के जलए जिस्ट्तृत अजधकारी, प्रजििण की अिजध के जसिाए, प्रजििण की पूरी लागत म ें िापसी के जलए उत्तरिायी होगा, यदि, दकसी भी कारण स,े प्रजििण के िौराि, या इस तरह के प्रजििण के पूरा होि े के तीि िष व की अिजध के भीतर, िह अपिी सेिा को बंि करि े का जिकल्प चुिता ह।ै 11. प्रजििण. - सीधी भती के आधार पर इि जियमों के अधीि जियुि एक अजधकारी अजििाय व रूप स े इलेक्ट्रॉजिकी और सूचिा प्रौद्योजगकी मंत्रालय द्वारा जिर्िवष्ट अिजध के जलए प्रजििण कायवक्म से गुिरिा होगा और दकसी भी अजधकारी को इस तरह के प्रजििण कायवक्म को पूरा दकए जबिा उसकी पररिीिा अिजध के जलए मंिूरी िहीं िी िाएगी। 12. जिजर्ल करि े की िजि. - िहा ाँ केन्द्रीय सरकार की राय ह ै दक ऐसा करिा अपेजित या समीचीि ह ै िहा ाँ िह, आिेि द्वारा और अजभजलजखत दकए िािे िाले कारणों के जलए, इि जियमों के उपबंधों म ें स े दकसी िगव या श्रेणी के व्यजियों के संबंध म ेंछूि ि े सकेगी। 13. व्यािृजत. - इि जियमों की कोई बात इस संबंध म ें समय-समय पर केन्द्रीय सरकार द्वारा िारी आििे ों के अिुसार अिुसूजचत िाजतयों, अिुसूजचत िििाजतयों, अन्य जपछड़े िगों, भूतपूि व सैजिकों और अन्य जििेष श्रेजणयों के व्यजियों के जलए आरिण, आय-ु सीमा म ेंछूि और अन्य ररयायते प्रभाि िहीं डालगे ी। पहली अिुसूची [जियम 4(3) और जियम 4(5) िेख]ें अ .सीधी भती (1) सीधी भती के जलए अपेजित िैजिक और अन्य अहतव ाए ं (क)आिश्यक: "दकसी मान्यता प्राप्त जिश्वजिद्यालय या संस्ट्र्ाि से चौर्ी अिुसूची के खंड 'क' में जिजिर्िवष्ट भौजतक या रासायजिक या गजणतीय या कम्प्यूिेििल और सूचिा में स्नातकोत्तर जडग्री; Short title and commencement. – (1) These rules may be called the Ministry of Electronics and Information Technology, Scientific and Technical, Group ‘A’ Posts, Recruitment Rules, 2025. (2) They shall come into force on the date of their publication in the official Gazette. 2. Definitions. – In these rules, unless the context otherwise requires, – (a) "controlling authority" means the Government of India in the Ministry of Electronics and Information Technology; (b) "schedule" means a Schedule appended to these rules;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15 (c) "scheme" means the Revised Flexible Complementing Scheme as issued by the Department of Personnel and Training vide O.M. No. AB-14017/41/2013-PP(RR), dated the 13th March, 2024; and (d) "scientific post" means a post as defined in the Scheme. 3. Name, number of posts, classification and level in pay matrix. – (1) The name and number of posts, their classification and level in the pay matrix attached thereto shall be specified as under : – Sl. Note. – The vacancies in each grade shall be first filled from the Scientists in the feeder grade who are recommended for promotion to the next higher grade under the Scheme. If the number of Scientists recommended for consideration of promotion to the next grade under the Scheme are more than the number of vacancies available in the promotion grade, then to that extent the number of posts be automatically upgraded to the promotion grade subject to the condition that the combined sanctioned strength of all the grades shall remain the same. Vacancies arising due to attrition shall normally revert to the entry level grade of the respective Scientific or Technical category. However, based on functional needs and with the approval of competent authority, some of these vacancies may be filled by the method of recruitment prescribed in these rules, for the posts above entry level, based on the level of the vacancy and commensurate with the higher qualifications and skills of individual candidates within the overall sanctioned strength. 4. Method of recruitment. – The method of recruitment to the said posts, qualifications and other matters relating thereto shall be as under: – (1) The posts of Scientists ‘B’ to Scientist ‘G’ shall be selection posts. (2) The posts shall be exempted from the purview of the Union Public Service Commission for the purpose of recruitment. (3) Method of recruitment for each post of Scientist 'B', 'C', 'D', ‘E’ and 'F' shall be decided by the controlling authority from time to time. (4) Recruitment for the posts of Scientist 'B' shall be made by direct recruitment as specified under clause A of First Schedule and as per the procedure laid down at sub-clause (ii) of clause (B) of Second Schedule appended to these rules. (5) Recruitment for the posts of Scientists ‘C’, ‘D’, and ‘E’ shall be made either by promotion or upgradation under the Scheme or direct recruitment or deputation (including short-term16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] contract)/absorption as specified in First Schedule and as per the procedure laid down at sub-clause (ii) of clause (B) of Second Schedule appended to these rules. (6) Recruitment for the post of Scientists ‘F’ shall be made either by promotion or upgradation under the Scheme or direct recruitment or deputation (including short-term contract)/absorption as specified in First Schedule and as per the procedure laid down at sub-clause (i) of clause (B) of Second Schedule appended to these rules. (7) Recruitment to the post of Scientist ‘G’ shall be made through promotion or upgradation under the Scheme. (8) In the case of Scientists ‘B’, ‘C’, ‘D’, ‘E’, ‘F’ and ‘G’, the appointing authority will be Minister-in- Charge. The approval of Appointment Committee of Cabinet is mandatory in case of appointment or promotion to the post carrying pay in level 14 in the pay matrix (Rs. 144200-218200) or above. (9) Particular discipline or field of essential educational qualifications and experience for each post or in each case of direct recruitment to the post of Scientist B and in each case of direct recruitment or deputation (including short-term contract) to the posts of Scientists C, D, E and F shall be decided by the controlling authority, keeping in view of the availability of Scientists of different disciplines and further requirement of Scientist in a particular discipline and the particular discipline shall be chosen from the list of disciplines mentioned in clause (A) and clause (B) of Schedule Fourth appended to these rules. (10) Ex-serviceman may be recruited on re-employment basis in accordance with the orders by the Central Government from time to time. 5. Promotion or upgradation. – (1) Promotion or upgradation of Scientists to the grade of Scientist 'C' to Scientist ‘G’ shall be as specified under the Scheme. (2) Promotion or upgradation of Scientists to the grade of Scientist ‘C’ to Scientist ‘G’ shall be as per the minimum residency period indicated below and compliance with other provisions specified in the Scheme. (4) The assessment shall be done twice in a year and cases of those Scientists who have completed or will complete the minimum residency period as on the cut-off dates of assessment viz., 1st January or 1st July, as the case may be, and have earned or will earn number of Annual Performance Appraisal Reports equal to or more than the number of years of minimum residency period for the period preceding the cut off dates of assessment, shall be considered for assessment under the Scheme. (5) Scientist who does not qualify either in Level-1 Screening or Level-2 Screening shall be re- assessed only after one year when they earn at least one more Annual Performance Appraisal Report and Annual Work Report and such re assessment would again entail Level-1 and Level-2 Screening and not commence from the stage where the Scientist failed to qualify. (6) The assessment process under the Scheme for promotion or upgradation to the next grade shall be conducted only thrice, and thereafter, the scientist shall be covered under the Modified Assured Career Progression guidelines as applicable to the Central Government civilian employees and the scientist who has been granted any grade under the Modified Assured Career Progression Scheme may be considered for next grade as provided for in the Scheme. (7) The period of service of Scientists or Technical experts doing management or administrative work shall not be counted for promotion or upgradation under the Scheme. The Scientists or Technical experts doing exclusively management or administrative work shall not be considered for promotion or upgradation under the Scheme and they shall only be given benefit of upgradation under the Modified Assured Career Progression Scheme. (8) The date of promotion or upgradation of Scientists recommended for promotion or upgradation to the next higher grade under the Scheme shall be the date on which the competent authority approved the promotion or upgradation. The officers on leave or deputation outside the organisation shall be given promotion or upgradation only with effect from the date they rejoin or return to the parent cadre. (9) There shall be no retrospective promotion or upgradation. (10) The field experience, in research and development or experience in implementation of scientific projects, of atleast two years for promotion or upgradation to Scientist 'F' and five years for promotion or upgradation to Scientist 'G' shall be essential. (11) Treatment of period of leave, period spent on deputation or Foreign Service etc., towards counting of minimum residency period shall be as specified in the Scheme. (12) Anything not mentioned in these rules shall be governed by provisions of the Scheme. 6. Annual Performance and Appraisal Reports and Annual Work Reports. – The Scientists shall fill up the Annual Work Report and Annual Performance Appraisal Report, in the format provided for in the Scheme, mandatorily on an annual basis. 7. Probation. – (1) The period of probation for Scientists appointed to the grade of Scientist 'B', and Scientist ‘C’ by direct recruitment shall be two years and one year for Scientists appointed to the grade of Scientist 'D', 'E' and 'F' by direct recruitment: Provided that the controlling authority may extend the period of probation in accordance with the instructions issued by the Central Government from time to time in this regard: Provided further that any decision for extension of a probation period shall be taken ordinarily within eight weeks after the expiry of the previous probationary period and communicated in writing to the concerned officer together with the reasons for so doing within the said period. (2) On completion of the period of probation or any extension thereof, Scientists shall, if considered fit for permanent appointment, be retained in their appointments on regular basis and be confirmed against the available substantive vacancies. (3) During the period of probation or any extension thereof, as the case may be, the Central Government is of the opinion that a Scientist is not fit for permanent appointment, the Central Government may18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] discharge or revert the Scientist to the post held by him prior to his appointment in the service, as the case may be. (4) During the period of probation, or any extension thereof, Scientists may be required by Government to undergo such courses of training and instructions and to pass examinations and tests (including examination in Hindi) as Government may deem fit, as a condition to satisfactory completion of the probation. (5) As regards other matters relating to probation, the members of the service shall be governed by the instructions issued by the Central Government in this regard from time to time. 8. Confirmation. – Confirmation of scientific posts appointed through direct recruitment shall be done by the controlling authority on the recommendations of Departmental Confirmation Committee, the composition of which shall be as follows : – (a) Chairman - Secretary, Ministry of Electronics and Information Technology; (b) Members - Two Scientists ‘G’ from the Ministry of Electronics and Information Technology, and (c) Head (Personnel Division), the Ministry of Electronics and Information Technology. 9. Disqualification. – No person, – (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts: Provided that the Central Government, may if satisfied that such a marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 10. Liability of officers to serve in India and outside. – (1) Officers appointed under these rules shall be liable to serve anywhere in India and outside. (2) Officers appointed under these rules shall be liable to undergo such training and be detailed on courses of instruction in India or abroad as the Government may decide from time to time and an officer detailed for training or course, the duration of which is six months or more or an officer detailed for training outside India or with private firms or factories in India, irrespective of the duration of the training, shall be liable to refund in full the cost of training, if, for any reason, during the training, or within a period of three years after the completion of such training, he chooses to discontinue his service. 11. Training. – An officer appointed under these rules on direct recruitment basis shall compulsorily undergo training programme for a period specified by the Ministry of Electronics and Information Technology and no officer shall be cleared for his probation period without completing such training programme. 12. Power to relax. – Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 13. Saving. – Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 19 FIRST SCHEDULE [See rule 4(3) and rule 4(5)] A. Direct recruitment (1) Educational and other qualifications required for direct recruits (a) Essential: Master's degree in Physical or Chemical or Mathematical or Computational and Information as specified in clause A of Fourth Schedule from a recognised University or Institute; or Bachelor's degree in Engineering or Technology (minimum four year degree course) as specified in clause (B) of Fourth Schedule from a recognised University or Institute; (b) Desirable: Doctorate degree from a recognised University or institute in any of the disciplines specified in clause (A) of Fourth Schedule. (ii) Five years’ experience of evolving, managing and directing major Programmes under any branch of sciences. (iii) Published research work of high standard. Note. – The period spent on obtaining minimum essential qualification shall not count towards experience. Period spent on obtaining doctorate degree (in the field of educational qualification) from a recognised University or Institute, as evidenced by certification by such University or Institute, subject to completion of the doctorate degree and subject a maximum of two years shall count towards experience. The period spent on pursuing doctorate degree shall not count towards experience for any purpose, if the doctorate has not been awarded. However, in cases of full-time employment (regular or contractual) or more than two years during the same period spent on obtaining doctorate degree (degree awarded), experience shall be counted only for the employment period and not for the doctorate degree. (3) Age limit. – The upper age limit for direct recruitment in each category of post shall be as under : – Sl. Name of the post. Age-limit. No. (1) (2) (3) (i) Scientist ‘B’ not exceeding 30 years20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ii) Scientist ‘C’ not exceeding 35 years (iii) Scientist ‘D’ not exceeding 40 years (iv) Scientist ‘E’ not exceeding 45 years (v) Scientist ‘F’ not exceeding 50 years: Provided that - (i) there shall be age relaxation in respect of the Scientists already working on regular basis in the Ministry of Electronics and Information Technology as per the extant rules in vogue from time to time in the Central Government; (ii) the upper age-limit in respect of the Schedule Castes, the Schedule Tribes, the Ex-servicemen, the Other Backward Classes, Orthopedically Handicapped and other special categories of persons shall be relaxable in accordance with the orders issued by the Central Government from time to time in this regard; (iii) the Central Government may relax the upper age-limit for all categories of posts in case of highly experienced candidates in specialised scientific areas; (iv) the crucial date for determining the age-limit shall be the closing date for receipt of applications from candidates in non-remote areas of India (and not the closing date prescribed for those in Assam, Meghalaya, Arunachal Pradesh, Mizoram, Manipur, Nagaland, Tripura, Sikkim, Union Territory of Ladakh, Lahaul and Spiti District and Pangi Sub-Division of Chamba District of Himachal Pradesh, Andaman and Nicobar Islands or Lakshadweep). B. Deputation (including short-term contract) / absorption. – In case of recruitment by deputation (including short-term contract)/absorption, grades from which the deputation (including short-term contract)/absorption to be made, shall be the Scientists or Technologists of the Central Government, State Governments, Union territories or autonomous body or statutory organisations, recongnised Universities or recognised research institutions, – (a) (i) holding analogous post on a regular basis in the parent cadre or department; or (ii) having the experience required in the post on regular basis as stated against the specific post : – Sl. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion. Note 3. – The maximum age-limit for appointment by deputation (including short-term contract) shall be not exceeding fifty-six years as on the closing date of receipt of applications. SECOND SCHEDULE Screening and Selection Process (For Direct Recruits and Deputation (including short-term contract)/absorption A. Screening Committee. – The Screening Committee for direct recruitment or deputation or absorption (including short-term contract) shall consist of a Chairman and two Members who shall be nominated by the Secretary, Ministry of Electronics and Information Technology. Secretary, Ministry of Electronics and Information Technology shall be the competent authority to accept the recommendations of the Screening Committee and only the screened-in candidates shall be eligible for the next level of recruitment. Note 2. – Absence of any member from the proceedings of the Assessment Board shall not invalidate the recommendations of the said Board. Note 3. – The quorum for any meeting of the Assessment Board shall be three including the Chairperson. 2.2. Composition for Departmental Peer Review Committee (for considering the promotion or upgradation under the Scheme to the post of Scientist ‘F’): 1. An officer of Level 15 in the pay matrix from the Ministry of Chairperson; Electronics and Information Technology and its organisations. 2. Two officers of Level 14 in the pay matrix from the Scientific Members; Ministries or Departments other than the Ministry of Electronics and Information Technology. 3. Two eminent Scientists from the Scientific Organisation of Members; Department under the Government of India, specialising in the field of scientific activities. 4. Joint Secretary, Department of Personnel and Training. Member. Note 1.–The chairperson at Sl. No. 1 above shall be nominated by the Secretary, Ministry of Electronics and Information Technology. Note 2.– The members at Sl. No. 3 above shall be one level above the post to which promotion or upgradation is to be done. 2.3 Composition for Departmental Peer Review Committee (for considering the promotion or upgradation under the Scheme to the post of Scientist ‘G’) : – 1.
