7359 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अब, अतः केन्द्रीय सरकार उक्त अजधजनयम की धारा 72 की उप-धारा (2) और (3) के साथ पठठत उप-धारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए जनिेि िेती ह ैदक पंिाब जवश्वजवद्यालय अजधजनयम, 1947 (पूवी पंिाब अजधजनयम 1947 का 7), जनम्नजलजखत सिं ोधनों के अध्यधीन उस तारीख से प्रभावी होगा, िो केन्द्रीय सरकार द्वारा जनयत की िाए अथागत ् :- सिं ोधन 1. पंिाब जवश्वजवद्यालय अजधजनयम, 1947 (पूवी पंिाब अजधजनयम 1947 का 7) म,ें (क) धारा 13 के स्ट्थान पर जनम्नजलजखत धारा प्रजतस्ट्थाजपत की िाएगी, नामत: :- 13. सामान्द्य सिस्ट्य- (1) सामान्द्य सिस्ट्यों की संख्या चौबीस से अजधक नहीं होगी और ऐसी सख्ं या में- (क) िो सिस्ट्य प्रजतजित जवश्वजवद्यालय के पूवग छात्र होंग ेजिन्द्ह ेंकुलाजधपजत द्वारा नाजमत दकया िाएगा; (ख) िो सिस्ट्य जवश्वजवद्यालय के जिक्षण जवभागों के प्रोफेसरों द्वारा अपन े में से ही चुन े िाएंगे, बिते दक कला जवभाग से एक सिस्ट्य और जवज्ञान जवभाग से एक सिस्ट्य चनु ा िाएगा; (ग) िो सिस्ट्य जवश्वजवद्यालय के जिक्षण जवभागों के सह प्रोफेसरों और सहायक प्रोफेसरों द्वारा अपने म ें से ही चुने िाएंग,े बिते दक कला जवभाग से एक सिस्ट्य और जवज्ञान जवभाग से एक सिस्ट्य चुना िाएगा; (घ) चार सिस्ट्य संबद्ध और सघं टक महाजवद्यालयों के प्राचायों द्वारा अपने म ेंसे ही चुन े िाएंग;े (ङ) छह सिस्ट्य संबद्ध और सघं टक महाजवद्यालयों के अध्यापकों द्वारा अपने म ेंसे ही चनु े िाएंग;े (च) िो सिस्ट्य पंिाब जवधान सभा द्वारा, उसके अध्यक्ष (स्ट्पीकर) द्वारा नाजमत दकए गए सिस्ट्यों म ेंस,े अपन ेम ें से ही चुने िाएगं े: बिते दक चयजनत सिस्ट्य दकसी जवश्वजवद्यालय का जडग्री धारक हो; (छ) िेष सिस्ट्य कुलाजधपजत द्वारा ऐसे व्यजक्तयों में स ेनाजमत दकए िाएंगे िो सावगिजनक िीवन म ेंप्रजतिा और सम्मान के धनी हों, या जिन्द्ह ेंजिक्षा, अनुसंधान और नवाचार के क्षेत्र म ेंजविेष ज्ञान या व्यावहाठरक अनुभव हो, या जिन्द्होंन े जिक्षा के क्षेत्र में उत्कृष्ट सेवाएँ प्रिान की हों। (2) दकसी भी सामान्द्य सिस्ट्य का चुनाव कुलाजधपजत के अनुमोिन के अध्यधीन होगा। (3) सामान्द्य सिस्ट्य, इसके बाि के प्रावधान को छोड़कर, चार वषग तक पि धारण करेगा। (4) एक सामान्द्य सिस्ट्य जिसने अपना पि त्याग दिया है, वह इस अजधजनयम के प्रावधानों के अध्यधीन, पुनः सामान्द्य सिस्ट्य के रूप म ेंनाजमत दकया िा सकता ह।ै (5) उप-धारा (1) म ें उजल्लजखत दकसी भी श्रेणी के सिस्ट्य के रूप में जनवागजचत कोई भी व्यजक्त अपेजक्षत योग्यता न रखने के पर अपना पि धारण नहीं कर सकेगा। (6) दकसी चुनाव म,ें यदि कोई जववाि उत्पन्न होता ह ैदक कोई व्यजक्त उप-धारा (1) के खडं (ख), (ग), (घ) और (ङ) के अथ ग म ें दकसी महाजवद्यालय का प्राचायग, प्रोफेसर, सह- प्रोफेसर और सहायक प्रोफेसर या प्रमुख ह ै या नहीं, तो प्रश्न का जनधागरण कुलपजत द्वारा दकया िाएगा;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (ख) धारा 14 का लोप दकया िाएगा; (ग) धारा 19 और 20 के स्ट्थान पर जनम्नजलजखत धाराएं प्रजतस्ट्थाजपत की िाएगं ी, नामतः :- “19. सकं ाय- सीनेट ऐसे जवषयों में संकायों का गठन कर सकेगी, जिन्द्ह ें वह इस अजधजनयम के प्रावधानों के अनुसार बनाए गए जवजनयमों के अंतगगत उजचत समझे। “20. ससजं डकेट- (1) जवश्वजवद्यालय का कायगकारी अजभिासन ससंजडकेट में जनजहत होगा जिसमें जनम्नजलजखत िाजमल होंगे – (क) कुलपजत को अध्यक्ष के रूप म,ें पिेन; (ख) सजचव, उच्चतर जिक्षा, भारत सरकार या उनके प्रजतजनजध, पिेन, (ग) जनिेिक, लोक अनुिेि महाजवद्यालय, पंिाब – पिने ; (घ) जनिेिक, लोक अनुिेि महाजवद्यालय, चडं ीगढ़ – पिेन; (ङ) सीनेट का एक सिस्ट्य, जिसे कुलाजधपजत द्वारा नाजमत दकया िाएगा; (च) कुलपजत द्वारा जनम्नजलजखत म ेंसे वठरिता के आधार पर रोटेिन द्वारा िस सिस्ट्यों को नाजमत दकया िाएगा:- (i) संकायों के डीन से िो; (ii) जवश्वजवद्यालय के प्रोफेसरों से िो; (iii) जवश्वजवद्यालय सह प्रोफेसरों से एक; (iv) जवश्वजवद्यालय सहायक प्रोफेसरों से एक; (v) महाजवद्यालयों के प्रधानाचायों से िो; (vi) कॉलेि के प्रोफेसरों से एक; (vii) प्रोफेसरों के अजतठरक्त अन्द्य जिक्षकों से एक। (2) ससंजडकेट अपन े दकसी कायगकारी कायग को कुलपजत को या ससंजडकेट के सिस्ट्यों में से जनयक्तु उप-सजमजत को या उसके द्वारा जनयुक्त दकसी सजमजत को, जिसमें ऐसे व्यजक्त भी िाजमल हो सकते ह ैंिो ससंजडकेट के सिस्ट्य नहीं ह,ैं या दकसी अन्द्य प्राजधकारी को, िैसा दक जवजनयमों द्वारा जनधागठरत दकया िाए, प्रत्यायोजित कर सकेगा।“ (घ) धारा 31 की उप-धारा (2) म,ें खंड (ख) के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा, नामतः :- (ख) धारा 19 के अतं गतग सीनेट द्वारा संकायों के गठन का तरीका; (खक) धारा 20 की उप-धारा 2 के अतं गगत ससंजडकेट द्वारा कुलपजत, उप-सजमजत, सजमजत या दकसी अन्द्य प्राजधकारी को सौंपे िाने वाल ेकायगकारी कायग;” (ङ) धारा 37 का लोप दकया िाएगा; (च) अनुसूची के स्ट्थान पर जनम्नजलजखत अनुसूची प्रजतस्ट्थाजपत की िाएगी, नामतः :-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] “अनसु चू ी [धारा 12 िेख]ें पिेन सिस्ट्यों की सूची:- 1. मुख्यमंत्री, पंिाब; 2. मुख्य न्द्यायाधीि, पंिाब एव ंहठरयाणा उच्च न्द्यायालय; 3. जिक्षा मंत्री, पंिाब; 4. संघ राज्य क्षेत्र चडं ीगढ़ के प्रिासक के सलाहकार; 5. सजचव, उच्चतर जिक्षा, पंिाब; 6. जिक्षा सजचव, चंडीगढ़ प्रिासन; 7. संसि सिस्ट्य, चंडीगढ़।” 2. इस अजधसूचना में जनजहत कोई भी बात, रािपत्र में इस अजधसूचना के प्रकािन की तारीख से ठीक पहल े पि धारण करन े वाले सामान्द्य सिस्ट्यों, संकायों और कायगकारी अजभिासन की पिावजध को प्रभाजवत करन े वाली नहीं मानी िाएगी। [फा. स. ं 2-6/2021-यू.II] रीना सोनोवाल कौजल, संयुक् त सजचव MINISTRY OF EDUCATION (Department of Higher Education) NOTIFICATION New Delhi, the 4th November, 2025 S.O. 5023(E).— WHEREAS under sub-section (1) of section 72 of the Punjab Reorganisation Act, 1966 (31 of 1966), read with sub-section (3) thereof, the Punjab University constituted under the Punjab University Act, 1947(East Punjab Act 7 of 1947), shall on and from the 1st day of November, 1966, continue to function and operate in those areas in respect of which it was functioning and operating immediately before that day, subject to such directions as may, from time to time, be issued by the Central Government, until other provision is made by law in respect of the said University; WHEREAS under sub-section (2) of section 72 of the said Act, any such direction may include a direction that any law by which the said University is governed shall, in its application to that University, have effect, subject to such exceptions and modification as may be specified in the direction; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1), read with sub-sections (2) and (3), of section 72 of the said Act, the Central Government hereby directs that the Punjab University Act, 1947 (East Punjab Act 7 of 1947), shall have effect from the date, as appointed by the Central Government, subject to the following modifications, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 MODIFICATIONS 1. In the Punjab University Act, 1947 (East Punjab Act 7 of 1947), (a) for section 13, the following section shall be substituted, namely:- 13. Ordinary Fellows.- (1) The number of Ordinary Fellows shall not exceed twenty four and of such number- (a) two shall be eminent University Alumni to be nominated by the Chancellor; (b) two shall be elected by Professors on the staff of the Teaching Departments of the University from amongst themselves provided that one member each from the Arts and Science Departments shall be elected; (c) two shall be elected by Associate Professors and Assistant Professors on the staff of the Teaching Departments of the University from amongst themselves provided that one member each from the Arts and Science Departments shall be elected; (d) four shall be elected by Principals of Affiliated and Constituent Colleges from amongst themselves; (e) six shall be elected by Teachers of Affiliated and Constituent Colleges from amongst themselves; (f) two shall be elected by Punjab Legislative Assembly nominated by the Speaker of Punjab Legislative Assembly from amongst themselves: Provided that the member elected is a holder of a Degree of any University; (g) the remainder shall be nominated by the Chancellor from amongst the persons of eminence and standing in public life or have special knowledge or practical experience in education, research and innovation or have rendered eminent services for the cause of education. (2) The election of any Ordinary Fellow shall be subject to the approval of the Chancellor. (3) The Ordinary Fellow shall, save as hereinafter provided, hold office for four years. (4) An Ordinary Fellow who has vacated his office may, subject to the provisions of this Act be again nominated as an Ordinary Fellow. (5) No person elected in his capacity as a member of any of the categories enumerated in sub-section (1) shall continue to hold his office after he has ceased to possess the requisite qualification. (6) In an election, if any dispute arises whether any person is or is not a Principal, Professor, Associate Professors and Assistant Professors, or Head of a college within the meaning of clauses (b), (c), (d) and (e) of sub-section (1), the question shall be determined by the Vice- Chancellor; (b) section 14 shall be omitted; (c) for sections 19 and 20, the following sections shall be substituted, namely:- “19. Faculties.- The Senate may constitute Faculties in such subjects as it thinks fit under regulations made in accordance with the provisions of this Act. “20. Syndicate.- (1) The Executive Government of the University shall be vested in the Syndicate which shall consist of - (a) the Vice-Chancellor as Chairperson, ex officio; (b) Secretary, Higher Education Government of India or his representative, ex officio; (c) the director of Public Instructions Colleges, Punjab- ex officio; (d) the director of Public Instructions Colleges, Chandigarh, ex officio; (e) one member of Senate to be nominated by Chancellor; (f) ten members shall be nominated by the Vice-Chancellor on seniority basis by rotation from the following:- (i) two from the Deans of Faculties; (ii) two from University Professors; (iii) one from University Associate Professors; (iv) one from University Assistant Professors;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (v) two from Principals of colleges; (vi) one from Professors of colleges; (vii) one from teachers other than Professors. (2) The Syndicate may delegate any of its executive functions to the Vice Chancellor or to the Sub-committee appointed from amongst the members of the Syndicate or to a Committee appointed by it which may include persons who are not members of the Syndicate or to any other authority as may be prescribed by regulations.”; (d) in section 31, in sub-section (2), for clause (b), the following shall be substituted, namely:- (b) the manner of constituting the faculties by the Senate under section 19; (ba) the executive functions to be delegated by the syndicate to the Vice Chancellor, the Sub-Committee, Committee or any other authority under sub-section 2 of section 20;”; (e) section 37 shall be omitted; (f) for the Schedule, the following Schedule shall be substituted, namely:- “THE SCHEDULE [See section 12] List of Ex officio Fellows:- 1. Chief Minister, Punjab; 2. Chief Justice, High Court of Punjab and Haryana; 3. Education Minister, Punjab; 4. Advisor to the Administrator, Union territory of Chandigarh; 5. Secretary, Higher Education, Punjab; 6. Education Secretary, Chandigarh Administration; 7. Member Parliament, Chandigarh.” 2. That nothing contained in this notification shall be deemed to effect the term of the office of the Ordinary Fellows, Faculties and Executive Government, holding office as such immediately before the date of publication of this notification in the official Gazette.
