Lr.No.5378/Vig.VI (2)/07-17, dated: 17.02.2012. 12.From the Secy., APPSC, Hyderabad, Lr.No.364/RT-I/1/12, dated: 17.02.2012. * * * * * ORDER: It has been brought to the notice of the Government by the Collector, Nizamabad District that the disciplinary proceedings were initiated against Sri Noor Mohammad, formerly Deputy Tahsildar (Enft), Varni and now retired from service and Sri K. Looka, formerly Agriculture Extension Officer, Birkur, Nizamabad on the allegation of misappropriation of 153.006 Metric Tons of paddy stock worth of Rs.11,47,545/-. The Collector, Nizamabd District has forwarded the common enquiry report to the Government for taking further necessary action in terms of Rule-9 of Andhra Pradesh Revised Pension Rules, 1980 as Sri Noor Mohammed, Deputy Tahsildar retired from service, vide reference 4th read above. 2. Government have examined the enquiry report and observed that the charge of misappropriation of paddy of 153.006 MTs worth of Rs.11,47,545/- was proved during the enquiry and both the Accused Officers viz., Sri Noor Mohammed, formerly Deputy Tahsildar (Enf), Varni & i/c Paddy Purchase Centre, Birkur and now retired from service and the co-accused viz., Sri K.Looka, formerly Agriculture Extension Officer, Birkur are equally responsible for the misappropriation. Therefore, Government have taken a provisional decision to impose the punishment of withholding of entire pension and gratuity permanently against Sri Noor Mohammed, formerly Deputy Tahsildar (Enf), Varni & i/c Paddy Purchase Centre, Birkur and now retired from service besides recovering an amount of Rs.5,73,772.50 Ps., being the half of the misappropriated amount, from him under Revenue Recovery Act.3. In the reference 5th read above while communicating the copy of enquiry report, a show-cause notice was issued to the individual seeking his explanation thereon within a period of (15) days from the date of receipt of the order as required under Rule 20 of Andhra Pradesh Civil Services (CC&A) Rules, 1991. In respect of another Accused Officer i.e. Sri Looka, while furnishing a copy of the enquiry report together with relevant material to Agriculture & Co-operation Department, being the administrative department under which the Accused Officer is working, that department was requested to take necessary further action against the Accused Officer vide reference 6th read above. 4. Though the show-cause notice was served on Sri Noor Mohammed, Deputy Tahsildar (Retired) on 06.01.2012, neither he submitted his explanation to the show-cause notice within the stipulated time nor sought time for submission of explanation. Hence, Government have examined the matter and construed that the Accused Officer has no explanation to offer and decided to confirm the above provisional decision taken to impose the punishment of withholding of entire pension and gratuity permanently besides recovery of an amount of Rs.5,73,772.50 Ps., being half of the misappropriated amount, under Revenue Recovery Act. 5. After careful examination of the matter and in consultation with the Andhra Pradesh Public Service Commission, Government hereby impose the punishment of withholding of entire pension and gratuity permanently against Sri Noor Mohammed, formerly Deputy Tahsildar (Enft.), Varni, Nizamabad District and now retired from service besides recovery of an amount of Rs.5,73,772.50 Ps., being half of the misappropriated amount, from him under Revenue Recovery Act. A copy of the letter of Andhra Pradesh Public Service Commission conveying its concurrence is herewith furnished as required Under Rule 23 of Andhra Pradesh Civil Service (CCA) Rules, 1981. 5. The Special Chief Secretary and Chief Commissioner of Land Administration, A.P., Hyderabad / Collector, Nizamabad District shall take necessary further action in the matter accordingly.
