No. 95/ RCT-VKI/2006-S9, dt.24.11.2011. ## ## Whereas in the reference first read above, the Director General, Anti- Corruption Bureau has informed that Sri N.Seetharamaiah, M.R.O., Vastavai Mandal, Krishna District and Sri Rauyapathi Pitchaiah, Attender were trapped by the Anti-Corruption Bureau Officials on 29.04.2006, when they demanded and accepted a bribe amount of Rs.500/- from the complainant Sri S.Srinivasa Rao of Pentelavarigudem village for doing official favour of issuing Income and Caste Certificates to the complainant for the purpose of obtaining loan under Rajiv Yuvasakthi Pathakam by him. The D.G, A.C.B., has recommended for prosecution of the A.Os., in a Court of Law. Accordingly, Government have issued orders for prosecution of the A.O. in the reference 2nd read above. And whereas, in the reference 3rd read above, the D.G., A.C.B., Hyderabad has forwarded a copy of the judgment dated:19.10.2011 of the (P.T.O):: 2 :: Hon’ble Court of the Special Judge for SPE & ACB Cases, Vijayawada delivered on 19.10.2011 in C.C.No.55/2007, wherein the Hon’ble Special Judge for SPE & ACB Cases, Vijayawada found A.O.1 Sri N.Seetharamaiah, M.R.O., Vastavai Mandal, Krishna District guilty for the offences under Section 7,13(2) read-with 13(1)(d) of Prevention of Corruption Act,1988 and sentenced him to undergo Rigorous Imprisonment for six month and to pay fine of Rs.2,000/- and in default of payment of fine amount to undergo Simple Imprisonment for one month each for the offence punishable under Section 7 of Prevention of Corruption Act. Sri N.Seetharamaiah, M.R.O., Vastavai Mandal, Krishna District is further sentenced to under go Rigorous Imprisonment for one year and also pay a fine of Rs.3000/- and in default to suffer Simple Imprisonment for 3 months for the offence punishable under Section 13(1)(d) read with 13(2) of the Prevention of Corruption Act, 1988. Both the sentences shall run concurrently. And whereas, it is considered that the conduct of the said Sri N.Seetharamaiah, M.R.O., Vastavai Mandal, Krishna District, which has led to his conviction, is such as to render his further retention in the public service undesirable. And whereas, the Government of Andhra Pradesh have examined the matter in the light of the above judgment and in terms of G.O.Ms.No.2, General Administration (Service-C) Dept., Dt.04-01-1999 read-with G.O.Ms.No.240, General Administration Department, Dated: 14-08-2003 and decided to impose a major penalty of dismissal from the Government service on Sri N.Seetharamaiah, M.R.O., Vatsavai Mandal, Krishna District as he is found guilty for the offences under Section 7,13(2) read-with 13(1)(d) of Prevention of Corruption Act,1988; and convicted and imposed sentence. (Contd…..P-3):: 3 :: Now, therefore in exercise of the powers conferred under Rule-9(x) read with sub-rule (i) of Rule 25 of the Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991 and in terms of G.O.Ms.No.2 General Administration (Services) Department, dated.04.04.1999, read with G.O.Ms.No.240, General Administration Dept., dated.14.08.2003, the Government of Andhra Pradesh hereby dismiss Sri N.Seetharamaiah, M.R.O., Vastavai Mandal, Krishna District from Government service with immediate effect. The following Notification shall be published in the extraordinary issue of Andhra Pradesh Gazette. NOTIFICATION In exercise of the powers conferred under Rule-9(x) read-with sub-rule (i) of Rule 25 of the Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991 and G.O.Ms.No.2 General Administration (Services) Department, dt.04.04.1999, readwith G.O.Ms.No.240, General Administration Dept., dt.14.08.2003 the Government of Andhra Pradesh hereby dismiss Sri N.Seetharamaiah, M.R.O., Vastavai Mandal, Krishna District. The Chief Commissioner of Land Administration, Andhra Pradesh Hyderabad shall take necessary further action in the matter accordingly.
