proceedings initiated against Sri B.Durga Prasad, former Sub-Registrar (now
retired) O/o. Sub Registrar, Gajapathinagaram, Vizianagaram District
indulged in corrupt practices and found with unexplained money of
Rs.9,050/- – Disciplinary action under Rule 9 of A.P.R.P. Rules, 1980 -
Imposing the penalty of 100% cut in pension on permanent basis under rule
9 of A.P.R.P. Rules, 1980 – Orders – Issued.

ORDER:
Where as the Director General, Anti Corruption Bureau in his report 1st
read above has stated that on reliable information that the staff of Sub
Registrar Office, Gajapathinagaram of Vizianagaram District were indulging in
corrupt practices by collecting mamools from the parties coming for getting
their properties registered and for issuing of E.C. etc., a Surprise check was
conducted on the office of Sub Registrar, Gajapathinagaram, Vizianagaram
District on 19.11.2007 and requested the Government to initiate
departmental action against Sri B.Durga Prasad, Sub Registrar and Smt
D.Venkatamma, Attender, O/o. Sub Registrar, Gajapathinagaram,
Vizianagaram District under Rule 20 of Andhra Pradesh Civil Service (CCA)
Rules,1991.
2. Where as after examination of the report of Director General, Anti
Corruption Bureau, Government have decided to initiate departmental action
against Sri B.Durga Prasad, Sub Registrar and Smt D.Venkatamma,
Attender, O/o. Sub Registrar, Gajapathinagaram, Vizianagaram District under
Rule 20 of Andhra Pradesh Civil Service (CCA) Rules, 1991 and accordingly
requested the Commissioner and Inspector General, Registration & Stamps
Department, A.P., Hyderabad.
3. Where as the Commissioner and Inspector General, Registration &
Stamps Department, A.P., Hyderabad has reported that Sri B.Durga Prasada
Rao, Sub Registrar has already been retired from service 30.09.2008 and assuch he has requested the Government to take further action under Andhra
Pradesh Revised Pension Rules.
4. Whereas Government after examination of the proposal of the
Commissioner and Inspector General, Registration & Stamps Department,
A.P., Hyderabad and decided to initiate departmental action against both the
Charged Officers by the Government in a common proceedings under Rule 20
& 24 of Andhra Pradesh Civil Services (CCA) Rules, 1991 read with Andhra
Pradesh Revised Pension Rules, 1980 against Sri B.Durga Prasad, Sub
Registrar (Retired).
5. Where as the following charges were framed against Sri B.Durga
Prasad, Sub Registrar (Retired) vide reference 5th read above:-
CHARGES:
1) that he is responsible for unaccounted amount of Rs.9,050/- which
was collected as illegal gratification from the public;
2) that he is responsible for appointment of private persons;
3) that he could not account for shortage of Government cash of Rs.910/-
as per the records and
4) that he found in possession of excess cash to a tune of Rs.127/-.
6. In the reference 6th read above, the Charged Officer submitted his
Written Statement of Defence. After examination of the written Statement of
defence of the Charged Officer, a regular inquiry was ordered in the matter
vide reference 7th read above.
7. In the reference 8th read above, the Regular Enquiry Officer after due
inquiry into the charges framed against the Charged Officer, has submitted
his findings holding that out of 4 charges, the charges 1 to 3 are proved.
8. Government after careful examination of the matter, have accepted
the findings of the Regular Enquiry Officer and a provisional decision was
taken to impose a punishment of 100% cut in pension permanently against
Sri B.Durga Prasad, Sub Registrar (Retired) under Rule 9 of Andhra Pradesh
Revised Pension Rules, 1980 for the charges held proved in the enquiry.
Accordingly a show cause notice was issued to him as to why 100% cut in
pension permanently should not be imposed on him for the above said lapses
within (15) days from the date of receipt, no reply is received within the
stipulated time of 15 days, it will be construed that he has no explanation to
offer and further action will be taken based on the material available without
any notice vide reference 9th read above.
9. In reply to the show cause notice, the Charged Officer has submitted
his explanation in the reference 10th read above.
10. After examining the explanation of the Charged Officer, Government
have observed that the contents raised by the Charged Officer in his
explanation are one and same which he was adduced before Regular Enquiry
Officer and that he has not adduced any new grounds in his explanation to
the Show Cause Notice. As the findings of the Regular Enquiry Officer has
been accepted and the proved charges are of Serious Nature of indulging in
Corrupt practices on discharge of duty in public office, the Government has
decided to withhold 100% Pension against Sri B.Durga Prasad, Sub Registrar
(Retired) in consultation with Andhra Pradesh Public Service Commission.
11. Government therefore order to withhold 100% eligible pension of Sri
B.Durga Prasada Rao, Sub Registrar (Retired) on permanent basis.12. The Commissioner & Inspector General of Registration and Stamps,
A.P., Hyderabad shall take further necessary action accordingly in the
matter.
