From the Estate Officer, Hyderabad Lr.No.D1/MS-30/MP/793/2011, dt.20-12-2011. *** O R D E R :- In the reference 4th read above, Smt Y.Prabhavathy, w/o late Y.V.Nagaraju, Section Officer, A.P.Secretariat, Hyderabad and Previous occupant of 3RT Govt Qtr.No.MS-30 at Malakpet Colony, Hyderabad informed that her husband was allotted Govt Qtr.No.MS-30 at Malakpet Colony by the Govt and her family resided in the said quarter. Her husband expired on 11-6-2007 while in service. Subsequently her family vacated the said quarter in November, 2008. Thereafter her son Sri Y.Siddartha who was appointed as Jr. Assistant in the o/o Director for Govt Examinations, Nampally, Hyderabad was allotted 2RT Govt Qtr.No.MC-282 in the same colony and since then they are residing in the said quarter. She stated that after vacating the quarter No.MS-30 in November, 2008, he has approached the Estate Office for NOC to claim the terminal benefits of her late husband and she was asked to pay an amount of Rs.5,000/- which she paid and she was told that she will have to pay some more amount as arrears. She further stated that her husband expired in June, 2007 and she is yet to receive the terminal benefits of her late husband including family pension, DCRG etc, because of Non-submission of NOC for the above said quarter. Therefore he requested the Govt to waive off the arrears if any, in respect of the quarter No.MS-30, Malakpet Colony for which she has already paid Rs.5,000/- and issue NOC so as to enable her to claim the pension, DCRG and other terminal benefits of her late husband as she is suffering financially in clearing off the loans taken for the treatment of her late husband. 2. In the reference 5th read above, the Estate Officer, Hyderabad informed that Govt vide reference 2nd read above, have accorded permission to Smt Y.Prabhavathi, W/o Sri Y.Nagaraju, R/o Govt Quarter No.MS-30, Malakpet Colony on payment of Standard Rent/Rent an amount equivalent to HRA last drawn. Further the Government in the reference 3rd read above, issued orders to the applicant stating that the request for retention of the quarter by the occupant cannot be considered as per rules in force. Accordingly the Demand Notice Lr.No.D/MS- 30/MP/Rent/EO/Hyd/2008 dt.1-4-2008 has been issued to the spouse of Late Sri Y.Nagaraju to pay the Rent/Penal Rent w.e.f 12-6-2007 to 31-3-2008 after calculating the Rent & Penal Rent which assessed to Rs.61,735/- and on receipt of the Demand Notice Smt Y.Prabhavathi has remitted an amount of Rs.5000/- on 7-5-2008 through Demand Draft on 24-5-2008 and the same was remitted through Challan No.26712 dt.18-6-2008 as per the records available. 3. But the rest of the penal rent has neither calculated nor notice issued to the occupant till to-day. Further it is revealed from the representation of Smt Y.Prabhavathi that she has vacated the Govt Qtr.No.MS-30, Malakpet Colony on 30-11-2008 for which a revised Demand Notice w.e.f 12-6-2007 to 30-11-2008 is calculated to Rs.1,41,735/-. After deducting Rs.5,000/- the amount already received in his office, still an amount of Rs.1,36,735/- to be recovered from the applicant. Now the said quarter No.MS-30, Malakpet Colony was demolished under MRTS Project. Further Smt Y.Prabhavathi has stated that the Pension, DCRG and other terminal benefits are not yet settled and her family is suffering from financial problems in clearing the loans taken for her husband’s treatment and requested for waiver of penal rent. In the circumstances stated above, after careful examination of the matter, Government hereby consider the request of Smt Y.Prabhavathi, w/o late Y.Nagaraju, Section Officer, A.P.Secretariat, Hyderabad & Previous resident of Govt Qtr.No.MS-30, Malakpet Colony, Hyderabad and waive off the penal rent of Rs. 1,36,735/- levied for overstayal in the Govt Qtr.No.MS-30, Malakpet Colony by Smt Y.Prabhavathi, w/o late Y.Nagaraju, Section Officer, after the death of her husband from 14-10-2007 to November, 2008 without permission from the Govt on humanitarian grounds. 5. The Estate Officer, Hyderabad is requested to take necessary action in the matter. 6. This order issues with the concurrence of the Finance Department with ref. to the U.O.No.01570/37/Exp.GAD.I/12, Dated.8-2-2012.
