against Sri V.Pothu Raju, Executive Officer (Retired), Group Temples,
B.Kondepadu (Village), Pentapadu (Mandal), West Godavari District - Certain

in pension for a period of 3 (three) years in exercise of the powers conferred

ORDER:-
In his letter 1st read above, the Commissioner, Endowments
Department has informed that Sri V.Pothu Raju, former Executive Officer and
now retired, Group Temples, B.Kondepadu (Village), Pentapadu (Mandal),
West Godavari District was placed under suspension on dt.17.03.1997
pending framing of the charges against him as he has committed certain
irregularities in the administration of temple. Subsequently as many as 08
charges were framed against him:-
1) That he has not submitted the income returns of the institution under
his charge for the year 1995-96 to enable the higher authorities for
levy of contribution and audit fees and thus he failed to discharge of
his legitimate duties.
2) That he has not submitted the budget estimates of the institutions
under his charge for the year 1996-97 though nine months lapsed in
the financial year and incurred expenditure unauthorisedly without
getting sanction of budget estimates from the competent authority
and this he violated the statutory provisions as laid down under
Section 57 of the Act 30/87.
3) That he attended the temples under his charge at B.Kondepadu one
day only in the 2nd week of October, 1996 in connection with ‘Devi
Navarathrulu’ Festival and left the village on the very next day and
did not attend to the temples again upto 28.12.1996 and left the day-
today administration of the temples to their fate which shows of his
negligence in discharging of his duties as Executive Officer.
4) That he failed to restore Electricity power supply to Sri Visveswara
Swamy Temple and Sri Kana Durga Ammavari Temple at
B.Kondepadu which was lost in the cyclone on 06.11.1996 till the date
of visiting of the temple by the Inspector, Endowments Department,
Tadepalligudem i.e. on 28.12.1996 and kept the temples in darkness
without any lighting.

5) That he failed to attend for the Inspection of paddy crops available in
the temples lands along with the Court Commissioner who was
appointed by the Principal District Magistrate Court, Tanuku in
connection with the remission petitions filed by the tenants of the
lands of the temples at B.Kondepadu.
6) That he has taken away the account books and records of the temples
at B.Kondepadu for the year 1995-96and 1996-97 along with him
instead of keeping them in the temples Office.
7) That he failed to reside at his Head Quarters i.e. at B.Kondepadu and
was attending to the temples once in two or three months and failed
to collect the makthas from the tenants promptly and also failed to
give paditaram provisions to the Archakas regularly and caused mush
inconvenience to the Archakas in offering Dhoopa, Deepa,
Naivedyams to the Deities.
8) That he failed to get the permission from the competent authority for
withdrawal of amounts from the Bank and incurred the income of the
temples to the expenditure directly without depositing them in the
Bank initially and thus he violated the provisions as laid down under
Section 29 of the Act 30/87.
2. The Assistant Commissioner, Endowments Department, Eluru who was
appointed as Enquiry Officer has submitted enquiry report dt.06.12.2010. As
per the enquiry report except charge No.3 & 4, the remaining 6 charges were
held proved. A copy of the Enquiry report was communicated to the Charged
Officer to submit his explanation on the proved charges vide his office Rc.
dt.06.01.2011. The Charged Officer has submitted his further explanation
dt.31.01.2011. Since the charged officer retired from service on 31.01.2008,
the Commissioner, Endowments Department referred the case to
Government to take disciplinary action under Rule 9 of Andhra Pradesh
Revised Pension Rules, 1980 against the Charged Officer.
3. In Government Memo 2nd read above, a show-cause notice was issued
under rule 9 of Andhra Pradesh Revised pension Rules, 1980 to Sri V.Pothu
Raju, Executive Officer (Retired), Group Temples, B.Kondepadu (Village),
Pentapadu (Mandal), West Godavari District to explain as to why a cut of
02% (two percent) in pension for a period of 03 years should not be imposed
on him for the charges held proved.
4. In reply, the charged Officer has submitted his further explanation in
his letter 3rd read above, Government have examined the same and found
that the explanation is not convincing with reference to facts of the case and
therefore, decided to impose a penalty of 02% (two percent) cut in pension
for a period of 03 (three) years against Sri V.Pothu Raju, Executive Officer
(Retired), Group Temples, B.Kondepadu (Village), Pentapadu (Mandal), West
Godavari District.
5. In the letter 6th read above, the Government have referred the matter
to Andhra Pradesh Public Service Commission for concurrence as required
under Rule 9 (2) of Andhra Pradesh Revised Pension Rules, 1980. In the
letter 7th read above, the Andhra Pradesh Public Service Commission has
given its concurrence to the proposal of the Government to impose the
punishment of 02% (two percent) cut in pension for a period of 03 (three)
years against Sri V.Pothu Raju, Executive Officer (Retired), Group Temples,
B.Kondepadu (Village), Pentapadu (Mandal), West Godavari District.

6. Accordingly, the Government in exercise of the powers conferred
under Rule 9 of Andhra Pradesh Revised Pension Rules, 1980 hereby impose
the punishment of 02% (two percent) cut in pension for a period of 03
(three) years against Sri V.Pothu Raju, Executive Officer (Retired), Group
Temples, B.Kondepadu (Village), Pentapadu (Mandal), West Godavari
District. A copy of the advice of Andhra Pradesh Public Service Commission
communicated in the reference 7th read above is herewith enclosed.
7. The Commissioner, Endowments Department, Hyderabad shall take
necessary action accordingly.
