ORDER:-
In his letter 1st read above, Commissioner, Endowments Department
has informed that as many as 56 charges were framed against Sri K.Rama
Rao, former Executive Officer and now retired, Group Temples, Eluru, West
Godavari District as he committed certain irregularities in the administration
of temples. The Executive Officer, Sri Mavullamma Ammavari Temple,
Bheemavaram was appointed as Enquiry Officer has submitted enquiry report
Rc. dt.20.04.2004. As per the enquiry report, out of 56 charges, 30 charges
were held proved, 4 charges partly proved and 21 charges were not held
proved. A copy of the Enquiry report was communicated to the Charged
Officer by the Commissioner of Endowments to submit his explanation on the
proved charges vide his office Rc. dt.06.08.2004. The Charged Officer has
not submitted his further explanation. Since the Charged Officer retired from
service on 30.06.2003, the Commissioner, Endowments Department,
Hyderabad has referred the case to Government for taking disciplinary action
under Rule 9 of Andhra Pradesh Revised Pension Rules, 1980 against the
Charged Officer.
2. In the reference 5th read above, the Commissioner, Endowments
Department has further informed that the Assistant Commissioner,
Endowments Department, Eluru has submitted report stating that out of 56
charges, 3 charges i.e., Charge.Nos.27,42 & 43 are involved with financial
loss caused by the Charged Officer which comes to Rs.15,586/- and the
same should be recovered from the personal funds of Sri K.Rama Rao,
Executive Officer, (Retired) and requested the Government to take necessary
further action in the matter.

3. In Government Memo 6th read above, a show-cause notice was issued
under Rule 9 of Andhra Pradesh Revised pension Rules, 1980 to Sri K.Rama
Rao, Executive Officer (Retired), Group Temples, Eluru, West Godavari
District to explain as to why a cut of 5% (five percent) in pension for a period
of 03 (three) years besides recovery of Rs.15,586=00.Ps should not be
imposed on him for the charges held proved.
4. In reply, the Charged Officer has submitted his further explanation in
his letter 7th read above, Government have examined the same and found
that the explanation is not convincing with reference to facts of the case and
therefore, decided to impose a penalty of 5% (five percent) cut in pension for
a period of 03 (three) years besides recovery of Rs.15,586=00 Ps against
Sri K.Rama Rao, Executive Officer (Retired), Group Temples, Eluru, West
Godavari District.
5. In the letter 10th read above, the Government have referred the
matter to Andhra Pradesh Public Service Commission for concurrence as
required under Rule 9 (2) of Andhra Pradesh Revised Pension Rules, 1980.
In the letter 11th read above, the Andhra Pradesh Public Service Commission
has given its concurrence to the proposal of the Government to impose the
punishment of 5% (five percent) cut in pension for a period of 03 (three)
years besides recovery of Rs.15,586=00.Ps against Sri K.Rama Rao,
Executive Officer (Retired), Group Temples, Eluru, West Godavari District.
6. Accordingly, the Government in exercise of the powers conferred
under Rule 9 of Andhra Pradesh Revised Pension Rules, 1980 hereby impose
the punishment of 5% (five percent) cut in pension for a period of 03 (three)
years besides recovery of Rs.15,586=00.Ps (Rupees fifteen thousand five
hundred and eighty six only) against Sri K.Rama Rao, Executive Officer
(Retired), Group Temples, Eluru, West Godavari District. A copy of the
advice of Andhra Pradesh Public Service Commission communicated in the
reference 11th read above is herewith enclosed.
7. The Commissioner, Endowments Department, Hyderabad shall take
necessary action accordingly.
